APPLICANT: PACIFIC RIM CONSTRUCTION FILE NO. SP-019-84 LOCATION: 3401 N.E. 4th Street on the premises of the Greenwood Cemetery. SUMMARY OF REQUEST: Approval of a special permit for fill and grade to allow the excavation of material and refill of import material totaling 200,000 cubic yards, over a four-year period. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval subject to conditions Hearing Examiner Decision: Approval subject to conditions BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on July 3, 1984. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 3, 1984, at 9:40 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1- Yellow file containing application and pertinent information regarding posting for this application. Exhibit #2 - Original Site Plan for proposed fill and grade. Exhibit #3 - Letter from Pacific Rim to Roger Blaylock, Zoning Administrator, dated 7/12/84. Exhibit #4 - Revised Site Plan. Exhibit #5 - Supplemental Staff Report dated July 3 and July 24, 1984. The Hearing was opened and Roger Blaylock, Zoning Administrator for the City of Renton requested a continuance of this matter. He stated the applicant had not provided his department with additional information and consequently the staff review has not been completed at this point. There is a discrepancy in the original application and the drawings. The drawings show approximately 600,000 cubic yards to be removed and the application shows 200,000 cubic yards. The City has requested a revised plan and to date the applicant has not provided same. The Examiner inquired if contact had been made with the applicant or their representative. Mr. Blaylock stated there was no one in attendance at the hearing, but he had both called and written the applicant, and they were aware of the request for continuance. The Examiner set a date of July 13, 1984, 5:00 P.M. as the deadline for new plans to be presented to staff by the applicant. If they are not submitted by that time the item will be dismissed. The hearing on this application was continued to July 24, 1984. PACIFIC RIM CONSTRUC File SP-019-84 August 1, 1984 Page 2 CONTINUED HEARING - July 24, 1984 The Hearing Examiner opened the meeting at 9:05 A.M. and called on the Zoning Administrator, Roger Blaylock to review the previous request and present the revised proposal. Mr. Blaylock advised that the removal of the fill is to be completed over a 2 year period of time; the Environmental Review Committee considered only the 1st phase of this plan to include only 200,000 cubic yards of fill, not the 700,000 cubic yards projected for the completed operation. The intent is to excavate 60-66 feet to obtain the necessary 200,000 c.yd's of material and then the site would be refilled with other debris that is in compliance with the city code. The ERC conditions for this phase were reviewed. Traffic concerns were discussed because of the truck traffic involved. It was pointed out that there are city shop sites in the area as well as the district ';ourt to the south which would generate traffic as well as pedestrians. It was felt access to N.E. 2nd should be excluded. The suggested hours of operation were 9:00 AM to 3:00 PM and 1:00 PM to 11:00 PM. These hours would help eliminate the heavy truck traffic during the peak hours from the Renton Highland area and Highway 405. The evening hours were suggested because the area of excaval.ion is separated from most residential areas and recognition was given to the critical construction slated for completion on I-405. The Zoning Administrator stated the plans as presented are incomplete, but added it was acknowledged that the engineer for the project had been on a 3 week vacation which happened to coincide with the 3 week extension that was requested. It was Mr. Blaylock's feeling that the plan details could be put together and become contained in the annual license, with specific conditions. It was also mentioned that no landscape plans for this project have been submitted. The subject of traffic trips was briefly discussed with the Examiner and it was determined this project would generate approximately 8,000 trips which does not present any significant impact when compared with the 25,000 trips from regular vehicular traffic in the area. At this point in the hearing the Examiner called for testimony from the applicant or their representative. Responding was: Mr. John Smith P. O. Box 2670 Renton, Wa. 98056 Mr. Smith made reference to the recommendation of hours of operations and stated that the Segale pit has hours from 7:00 AM to 3:30 PM which are longer morning hours than their own, plus the fact Segale does not have a traffic light going into or coming out of their pit which creates an impact on peak hour traffic. He stated he feels because there is a traffic light at the entrance Ito their pit, there would be less of an impact on traffic than at any other pit in the area. Mr. Smith said they prefer the morning hours to be longer, and the project had been designed For a 4 year period as opposed to the recommended 2 year period. He asked that the City split the time and grant them 3 years because of special projects coming up for the State that they will be bidding on - such as the "S" curves on I-405. He said as far as the rest of the staff repert, he concurred with their recommendations. The Hearing Examiner called for further testimony and responding was: Dan Holms 3401 N. E. 4th Renton, Wa. 98056 Mr. Holms asked the Zoning Administrator to clarify what he meant by stating the fill material had to be "suitable matter". Roger responded that the material could not be organic type materials that would decompose and create a gas, as well as voids, causing the project to settle. It was agreed that this would be disasterous to their project. Mr. Holms, owner of the Greenwood Cemetery, and Mr. Blaylock referred to the site map and clarified where Phase 1, 2, and 3 would be in relation to his property. After this was completed, there was no further comment. Again the Examiner called for further testimony either for, or against the proposal. The Zoning Administrator spoke briefly regarding the traffic concerns. He stated when comparing the trips made by the applicant, as opposed to the trips made by the public down the N. E. 3rd and 4th Street corridors, plus the fact this is a temporary not an on-going activity, it is felt there will be no intrusion. Mr. Blaylock went on to say this site will have a controlled access and the hours have been increased to include evening hours because of the connection to the state highway system. It was pointed out that other operations in the same area do not have evening hours and there may be some administrative complaints because of it. He closed recommending the six conditions contained in the supplemental staff report. There being no one else wishing to speak on this proposal, the hearing was closed at 9:30 A.M. PACIFIC RIM CONSTRUC . .JN File SP-019-84 August 1, 1984 Page 3 FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1.The applicant, Pacific Rim Construction, filed a request for approval of a special permit to excavate, fill and grade approximately 2.5 acres of property. 2.T le application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (FRC), responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5.There was no opposition to the subject proposal from any member of the public. 6.The subject site is located in the southwest corner of what is The Greenwood Memorial Cemetery. The site is located at 3401 N.E. 4th Street. 7.The subject site is relatively level and consists of gravelly material which can be utilized for fill purposes. 8.The applicant proposes extracting the gravel for use in the I-405 reconstruction project and refilling the site with hauled in material from other sites to regrade thu subject site. This activity is proposed to occur over a four year period. 9.The amount of material which would be removed then replaced would be approximately 200,000 cubic yards. Approximately 8000 trips will be required to haul the material from the site, and a similar number to restore the grade of the site. 10. The traffic levels on N.E. 4th Street/N.E. 3rd Street are approximately 25,000 cars per day. Staff has recommended limiting the hours of hauling so they do not coincide with peak hour commuter rush in the Renton Highlands. The original recommendation was to limit hauling between the hours of 9:00 am and 3:00 pm and between 7:00 pm and 11:00 pm. The applicant opposed the limitation. 11. Th;: applicant proposes three phases covering 3 different areas of the site. This review has been limited to only the first phase. 12. Thy: subject site is located within the ground water recharge area of Mt. Olivet Cemetery. Removal and replacement of the gravelly material would alter the recharge capability of the subject site. Staff has recommended the inclusion of perforated drain tile so that permeability can be maintained. CONCLUSIONS 1.The proposed excavation, in effect a quarrying operation, appears to serve the public use and interest. The material to be extracted will be utilized for the I-405 project. The haul route will be relatively short to reach I-405. 2.The filling of the subject site also appears to serve the public use and interest. Rather than leaving the site in its excavated state the applicant will regrade the site with a variety of fill material which must meet city standards. 3. While the haul route is short (from the cemetery at Monroe and N.E. 4th to the bottom of the hill at I-405), the route is the major peak hour route out of the Highlands to the City and I-405. Therefore, limitations upon hauling would appear reasonable to minimize the interference with peak hour traffic. The hours of hauling, therefore, shall be limited to between the hours of 9:00 am and 3:00 pm and between the hours of 7:00 pm and 11:00 pm, Monday through Friday. PACIFIC RIM CONST RUC N File SP-019-84 August 1, 1984 Page 4 In order to accommodate the applicant's needs the split hours would appear to reasonably allow the applicant to move the gravel to the site while meeting the City's concerns regarding rush hour traffic on the steep, winding hill between the site and I-405. 4.The further limitation upon the duration of the special permit also appears reasonable. Over the next four years changes to roads, peak hour demands, and land use near the site could change dramatically. The 2 years recommended by staff would permit the city to reevaluate the operation. If the project appears to have no additional consequences it could be renewed at that time and the applicant can maintain the continuity by applying for the new permit prior to the expiration of this approval. 5. Hauling of material generally results in the deposition of some unwanted debris upon the city roads. In order to assure reasonable cleanup of such debris the applicant should post a renewable cash bond upon which the City can draw to clean streets if the applicant fails to remedy the situation. If the cash fund should become exhausted a new bond must be posted to maintain this special permit. The ariount to be posted shall be $500.00. 6. The subject site is in a sensitive ground water area. Under the circumstances the applicant should provide a method of recharging the aquifer as indicated by the Department of Public Works. This should include perforated pipes and drain tiles. DECISION The special permit to excavate, refill and grade the subject site is approved subject to the following conditions. 1. The permit shall expire at the end of two years from the date of this decision but may be renewed by application prior to its expiration, and subject to the standard review procedures. 2. The posting of a $500.00 revolving cash bond upon which the city may draw to remove from city streets debris generated by the applicant which the applicant fails to clean. 3. The hauling shall be restricted to between the hours of 9:00 am to 3:00 pm and between -7:00 pm and 11:00 pm and may be conducted only between Mondays and Fridays. The 11:00 pm termination hour may be limited but not extended at the request of any city department for good cause. 4. The applicant shall be required to install an aquifer recharge system subject to the approval of the Department of Public Works when the site is refilled. 5. Any reuse of the subject shall be subject to site plan review. 6. Fill material brought to the site shall meet the standards provided by the City of Renton. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The App';arance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State En ironmental Policy Act of 1971, as amended, RCW 43-21C, a final declaration of non-significance was issued by the Environmental Review Committee on June 13, 1984. Conditions were attached to the project and are discussed below under Staff Analysis. K. AGENCIES/DEPARTMENTS CONTACTED: 1. DEPARTMENT ANALYSIS: 1. The applicant, Pacific Rim Construction, is requesting a special permit to excavate and refill approximately 200,000 cubic yards of material. 2.The Environmental Review Committee issued a Declaration of Non-significance on June 18, 1984, subject to the following conditions: a. All excavations shall be at least 30 feet from the property lines. This 30-foot setback shall be landscaped. b. Access from the site shall be limited to Monroe Avenue N.E. No access is allowed to N.E. 2nd Street. c. The access road entering onto Monroe Avenue N.E. shall be paved for a distance of 100 feet or a truck tire cleaning facility shall be available and operational at all times of operation. d. The fill material is not solid waste as defined by City Code, but limited to materials defined by Section 4-2316. 3. City departments have responded basically commenting on the vagueness of the engineering drawings and the operation of the proposed excavation and fill operation. The written proposal does not comply with the engineering drawings.. 4.The Building and Zoning Department has requested the modification of the plans to correspond to the request. These plans have not been provided by the applicant. M. Box 2670 Renton, WA 98056 Reference: Special Permit to Fill and Grade/SP-019-84 Dear Mr. Smith: The Environmental Review Committee has considered the information submitted by your firm on June 12th in response to our inquiry of June 7th and found that the proposal is non-significant under a series of mitigating conditions. These conditions specifically include that a 30-foot setback from the edge of all property lines shall be maintained. In addition, access is to be limited to Monroe Avenue N.E. based upon the fact that the adjacent uses are high-intensity, urban uses which would conflict with the operational activities of excavating the gravel from the subject site. The requirement to have a 100-foot paved roadway section is also included as a condition in the environmental decision for the same reason because of the high urban use activity surrounding the subject cite. Attached are listed the seven basic criteria established for fills. Please note item 4, which slates that earth materials shall have no more than minor amounts of organic substances and shall have no rocks or similar irreducible material with a maximum dimension greater than 8 inches. Construction or demolition debris, which includes lumber and other organic materials, is not normally placed into a standard fill but, under City Code, placed into a solid waste fill according to requirements of Section 4-2317. That type of operation is completely different from those normally allowed by the City of Renton. In addition, sanitary landfills come under the prerogative and approval of both King Ccunty and the State of Washington Department of Ecology. You should also be aware that the Building and Zoning Department considers asphalt to be an organic materia:, primarily because its principal component is oil or coal tars. Mr. John H. Where in you requested additional information before an enviromental declaration could be issued. Item # 1. The discrepancy between the 200,000 cu. yd. on the permit application and the 690,000 cu. yd. on the engineering plans is that the immediate plans are to only excavate the S.W. portion of the Greenwood property, which we estimate is about 200,000 cu. yd. I realize there is so much more material there than that and our long term plans are to excavate the remaining amount only if our initial excavation proves to ecomomically feasible. Item #2. The types of material to be placed back in the hole would consist of construction debris. Ex:. .Concrete, bricks, glacial till, clay, misc. demolition debris. No organic material will be placed in the excavated hole. The excavation, filling and grading operation is expected to last approx. four years. Item #3. A set backcof 30' from edge of curb would be an acceptable compromise as the Segale property just West of Monroe has a set back of approx. 5' from edge of curb. Also, you stated that access is to be limited to Monroe Avenue. Please note that it may be necessary to use N E 3rd as an entrance or an exit, we felt that this restriction seems a little unusual in that N E 3rd is the entrance and exit for all of the City of Renton construction and maintance vehicles and also all of King Counties construction and maintance vehicles. The vehicles we are ref- fering to here are not just pick-ups and cars but large trucks and trailers, dump trucks, cranes, road graders, etc. so we feel that the Monroe Avenue restriction seem a little unjustified. A 100' paved roadway requirement also seemed unusual as we will be providing a street maintance bond to the city, to insure proper road contitions at all times. Sincerely, Jo n L.
