SUMMARY OF REQUEST: j The applicant seeks site plan approval to allow the
construction of a woodworking shop and accessory office
building having 4,872 square feet.

Hearing Examiner Decision: Approval.
BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT:received by the Examiner on April 24, 1984.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with the
application, and field checking the property and
surrounding area, the Examiner conducted a public hearing
on the subject as follows:
The hearing was opened on May 1, 1984, at 11:09 a.m. in the Council Chambers of the Renton
Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The Zoning Administrator presented the staff report, submitting:
Exhibit #1 Yellow file containing the application,
staff report, and other pertinent
documents pertaining to posting and
publication.
Exhibit #2 Site plan map showing the buildin and
landscaping.
j Exhibit #3 Elevation of the proposed structure.
Mr. Blaylock noted this site plan application is the result of a condition of approval of the
rezone of the property to L-1 granted in 1983 requiring site plan review at the time of
development. The site wa's pointed out on both the Zoning and Comprehensive Plan maps. The
applicants aide aware that lincreased water will have to be brought into the property because of
a substandard system along S.W. 13th.
The Examiner inquired, specifically, regarding the comment submitted by the Engineering
Division, asking how the downstream drainage system will be built. He was advised by Mr.
Blaylock that they will have to connect to drainage systems on Raymond and proceed to the
north. The question was

eferred to Mr. Lucker, the applicant's architect, for further
clarification.
Proposed landscaping plans were described by the Zoning Administrator in detail. It was noted
that the front setback will he very heavily landscaped to accent the front of the structure, and
the building itself will appear to be an advertising approach to the creativity of Beckmann
Homes. He described the; building's proposed unique design, utilizing underground parking, its
floor plan, nd general architectural treatment. It was noted there will be limited asphalt
paving: Thig is the first new"development on the block; therefore, there will be no problems
blending in with adjacent properties.
Mr. Blayloc concluded by advising that approval is recommended. While the staff report
indicates approval "subject to the condition that off-site improvement plans be approved prior
to the issuance of the building permit, he advised this is normal procedure and, therefore,
should be stuck from the ietmmendation.
The Examiner called for comment from the applicant or representative. Responding was:

Mr. Lucker noted that, ;when he was first involved with the project, he reviewed restrictive
covenants associated with the rezone which specify 6-foot sideyards on both sides of the
property and a 20-foot landscape setback in the front. The design and location of the building
was evolved from thee restrictions. To address Engineering's concerns regarding storm
drainage, he advised that they could reach the system on Raymond Street or connect to Spencer
Street to the east. The Fire Department's concerns with respect to fire flow have been
discussed with their representatives, and it appears that they will have to upgrade the water
main on S.W. 13th and install a hydrant. The water system, however, is considered adequate for
fire flow. He also noted that the sanitary system is available. In response to questioning by Mr.
Lucker, the Examiner indicated that it is his assumption that, should a condition be imposed
requiring them to meet adequate storm drainage control, the technical details can be resolved
at the time of development.
The Examiner called for 'itestimony in support of the application. There was none.
He then invited comment in opposition. There was none.
The Zoning Administrator was invited to make further comments. Mr. Blaylock commented as
a point of information, it may be possible for the applicant to seek a latecomer's agreement on
extensions of water. mains into those areas. That should be directed to the City Council. Mr.
Lucker acknowledged the information.
As there was no further testimony, the hearing was closed at 11:24 a.m.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the following:
FINDINGS:
1. The applicant, Beckmann Homes, Inc., filed a request for approval of a site plan for a
woodworking shop and accessory office building.
2. The application file containing the application, the State Environmental Policy, Act
documentation, the Building and Zoning Department Report, and other pertinent
documents was entered into the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA, a Memorandum of
Concurrence has been issued for the subject proposal by the Environmental Review
Committee (ERC), responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the impact
of this development.
5. There was no opposition to the subject proposal from any member of the public.
6. The subject site is located at 708 S.W. 13th Street just north of I-405.
7. The site is relatively level and the three legal lots which comprise the subject site total
approximately .206 acres. A single family home and a trailer home are presently located
on the subject site. '
8. The subject site was annexed into the city by Ordinance 1928 adopted in December of
1961. The site was automatically zoned G-6000 upon annexation, a classification which
was modified.to R 11 by a zoning district consolidation in 1982. The site was reclassified
to L-1 (Light Industry) by Ordinance 3759 in December, 1983.
9. The map element of the Comprehensive Plan designates the area in which'the subject site
is located as suitable for the development of manufacturing park type uses but does not
mandate such development without consideration of other policies of the plan.
10. The uses in the general vicinity surrounding the subject site consist of a variety of
activities including, newly developing commercial/industrial uses, vacant property, and
transitional residential development.
11. The applicant proposes constructing an approximately 4,872 sq ft building which contains
parking located beneath the structure. The required parking for such a building is six
parking stalls and the applicant will provide them as required.
12. The rezone required a landscaped front yard of 20 feet and six foot landscaped side yards.
The applicant has provided a landscape plan with the required amenities to provide
fidelity to the Comprehensive Plan.

CONCLUSIONS
1. The proposed site plan appears to serve the public use and interest. The constructio of a
new building on the site will increase the property value and thereby increase the ass ssed
valuation of the site providing additional tax revenue to the city.
2. The addition of the wood shop and office will not substantially increase the demand on the
existing utility infrastructure and the applicant will be improving certain of the utillities
as required by the
3. The plan appears to provide sufficient landscaping which will buffer the site and provide
relief fIom wall to walla warehouses in the area and comport with the goals and policies of
the Comprehensive Plan.
DECISION
The site plan is approved.

Pursuant to Title IV, Sections 3015 of the City's Code, request for reconsideration must be filed
in writing on or before May 28, 1984. Any aggrieved person feeling that the decision of the
Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the
discovery of new evidence which could not be reasonably available at the prior hearin6 may
make a written request fora review by the Examiner within fourteen (14) days from the date of
the Examiner's decision. This request shall set forth the specific errors relied upon by such
appellant, and the Examiner may, after review of the record, take further action as he deems
proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that such
appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other
specified requirements. Copies of this ordinance are available for inspection or purchase in the
Finance Department, first floor of City Hall.
The Appearance of Fair4ss Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use decisions. This means that parties to a land use
decision may not communicate in private with any decision-maker concerning the proposal.
Decision-makers in the land use process include both the Hearing Examiner and members of the
City Council.
All communications concerning the the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to openly
rebut ,the evidence. Any violation of this doctrine would result in the invalidation of the
request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as;Appeals to the City Council.

FINDINGS, COI NCLUSIONS & DECISION:
Having reviewed the record 1in this matter, the Examiner now makes and enters the following:
FINDINGS:
1. The applicant, Beckmann Homes, Inc., filed a request for approval of a site plan =or a
woodworking shop and accessory office building.
2. The ap rl lication file jcontaining the application, the State Environmental Policy Act
documentI tation, the Building and Zoning Department Report, and other pertinent
documents was entered into the record as Exhibit #1.
3. Pursuantto the City of Renton's Environmental Ordinance and SEPA, a Memorandum of
Concurrence has been issued for the subject proposal by the Environmental Review
Committee (ERC), responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the impact
of this development.
5. There vJas no opposition to the subject proposal from any member of the public.
6. The subject site is located at 708 S.W. 13th Street just north of I-405.
7. The site is relatively level and the three legal lots which comprise the subject site total
approximately .206 acres. A single family home and a trailer home are presently located
on the subject site.
8. The subject site was: annexed into the city by Ordinance 1928 adopted in December of
1961. The 'site was automatically zoned G-6000 upon annexation, a classification Yvhich
was modified to R-1 by a zoning district consolidation in 1982. The site was reclassified
to L-1 (Light Industry) by Ordinance 3759 in December, 1983.
9. The map element of the Comprehensive Plan designates the area in which the subject site
is located as suitable for the development of manufacturing park type uses but does not
mandate such development without consideration of other policies of the plan.
10. The uses in the gents al vicinity surrounding the subject site consist of a variety of
activities including newly developing commercial/industrial uses, vacant propert , and
transitional residential development.
11. The applicant proposes constructing an approximately 4,872 sq ft building which contains
parking located beneath the structure. The required parking for such a building is six
parking' stalls and the applicant will provide them as required.

12. The re one required a landscaped front yard of 20 feet and six foot landscaped side Yards.
The applicant has provided a landscape plan with the required amenities to provide
fidelity to the Comprehensive Plan.

CONCLUSIONS
1. The proposed site plan appears to serve the public use and interest. The construction of a
new building on the site will increase the property value and thereby increase the assessed
valuation of the site providing additional tax revenue to the city.
2. The addition of the wood shop and office will not substantially increase the demand on the
existing utility infrastructure and the applicant will be improving certain of the utilities '
as required by the ERC.
3. The plan appears to provide sufficient landscaping which will buffer the site and provide
relief from wall to wall warehouses in the area and comport with the goals and policies of
the Comp rehensive Plan.

All communications concerning the the proposal must be made in public. This permits all
interested parties to know! the contents of the communication and would allow them to openly
rebut the evidence. Any. violation of this doctrine would result in the invalidation of the
request by thde Court.i

The subject site was annexed into the City by Ordinance #1928 of December 12,
1961, at which time. it was zoned G-6000. This classification was changed to the
R-1 designation with the adoption of the new zoning map by Ordinance #3634 of
June 13, 1982. The'L1-1, Light Industrial zoning designation was implemented by
Ordinance 3759 of December 14, 1983.
D. PHYSICAL BACKGROUND:
1., Topography: The site is relatively level.
2. Soils: Urban Land (Ur). This soil has been modified by disturbance of the
natural layers with additions of fill material several feet thick to
accommodate large industrial and housing installations. The erosion hazard is
slight to moderate. No capability or woodland classification.

The subject site is surrounded by developing commercial/industrial uses to the
north, commercial uses to the east, vacant land to the south, and industrial uses to
the west.
F. PUBLIC SERVICES:
1. Utilities:
a. Water: A 12-inch water line runs near the subject site along Raymond
Avenue S.W. and a 6-inch water line runs along S.W. 13th Street
adjacent to the subject site. The Engineering Division of the Public
Works Department has determined that the water system along S.W.
13th is sub-standard.
b. .Sewer: An 8-inch sanitary sewer line extends along the alley adjacent
to the subject property.
c. Storm Water Drainage: The Engineering Division of the Public Works
Department has determined that the existing storm water from the site

moderate impact on the traffic problems along S.W. Grady Way.

Pursuart to the City of Renton's Environmental Ordinance and the State
Environmental Policy, Act of 1971, as amended, RCW 43-21C, a memorandum of
concurrence was issued by the Environmental Review Committee on April 18, 1984.

L. DEPARTMENT ANALYSIS:
1. The applicant, Beckmann Homes, Inc., is requesting a site plan approval to
allow the construction of a light industrial woodworking shop and accesssory
offices having a total square footage 4,872 square feet. This site plan review
is part of the rezone decision, file R-060-83, to allow a light industrial use
upon the approximately 8600 square foot site.
In addition to, the site plan approval, restrictive covenants were filed
establishing a landscaped front yard of 20 feet and 6-foot landscaped side
yards.
2. Tlie proposal complies with the Comprehensive Plan , designation of
Manufacturing Park as delineating under the approved rezone to light
industry with restrictive covenants.
3. The proposed des'gn covers most of the site with building instead of parking
because it places the parking beneath the office area and the storage areas so
that all of the parking is functionally contained within the building. The
parking and parking aisles meet the dimensional requirements of the Parking
and Loading Ordinance and also the number of parking spaces based upon
requirements. 'A total of 6 parking spaces are required and a total of 6
parking spaces are provided.
4. The Environmental Review Committee has issued a Memorandum of
Concurrence concerning the proposed site approval. Under the rezone
review, the Environmental Review Committee required that since the
right-of-way width on S.W. 13th Street between Seneca Avenue S.W. and
Raymond Avenue S.W. adjacent to the site was substandard, it has to be
improved so that the paving is at least 20 feet wide for emergency vehicles.
At this point the applicant has not submitted specific off-site improvement
plans meeting this requirement.
5. The Police Department, Building and Zoning Department, and Parks
Department have recommended approval of the site plan. The three divisions
of the Public; Works Department and the Fire Department have taken
exception to .the project because detailed off-site improvement plans have
not been submitted. The site will call for an upgrade in not only streets,
curbs, gutters, and sidewalks but also street lighting and water mains to
provide minimum fire flows. These are technical plans that can be reviewed
ait the building permit stage and be conditioned as a. requirement of the
approval of the,site plan.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the .above analysis, it is recommended that the Hearing Examiner
approve the site plan as requested, file SA-046-84, subject to the condition that
off-site improvement plans be approved prior to the issuance of the building
permit.

Acting as the Responsible Official, the ERC has determined that the requested
modifications to the initial;proposal reviewed under ECF-052-83 on September 21, 1983,
are within the scope of that original proposal and the environmental determination of
non-significance is still valid.
This decision was reached following a presentation by Jerry Lind of the Building and
Zoning Department. Oral comments were accepted from: James Matthew, David
Clemens, Robert Bergstrom', Richard Houghton, Jerry Lind, James Hanson, Ronald Nelson,
Gary Norris, James Bourasa; and Roger Blaylock.
