SUMMARY OF REQUEST: ! Site Plan approval to allow a two-story, 21,500 sq. ft.
office and warehouse building. The building will
consist of 18,500 sq. ft. of warehouse space and 3,000
sq. ft. of office space.

DEPARTMENT REPORT:received by the Examiner on August 9, 1984.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing was opened on August 14, 1984, at 9:00 A.M. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. •
The following exhibits were entered into the record:

The Hearing Examiner called the hearing to order and called upon the Zoning
Administrator, Roger Blaylock to present the staff report. Mr. Blaylock stated the
subject property was originally platted as part of the Earlington Industrial Park No. 2, but
became a separate parcel on July 1, 1968. There will be no impact to schools; fire
protection will be provided by the City of Renton; and water, sewer and storm drainage
are available to the site. It was stated that development of the facility will generate
approximately 130 trips pe I day. The applicant will be required to participate in a traffic
signal at S.W. Grady Way and Powell Avenue as well as a signal at S.W. 7th.Street and
Hardie 'Ave. S.W. The total amount due for the signals will be required when the building
permit ,is isued. _Mr. Blaylock noted that in July of 1967 the City Council, on the
recommenda ion of the Planning Commission, approved a variance to allow a 17-1/2 ft.
variance in 6-le cul-de-sac instead of 60 ft., but, in 1971 the city attorney rendered a
decision regarding the stab s,of variances approved prior to April 5, 1971 which said in part
that variances prior to April; 5, 1971 were only good for 2 years, or until April 5, 1973. In
essence, this decision made the variance invalid because the site was not developed. The
Hearing Examiner questioned if the decision from the attorney was in writing. Mr.
Blaylock said there is no written decision because there is a pending appeal on another
variance. It was noted that the applicant, Don Thomas does not plan to utilize the revised
variance language. Mr. Blaylock stated the proposal complies with the Parking and
Loading Ordinances and it is! possible in the future there will be modifications to interior
office space, which may affect the Latecomers Agreement. The Fire Department was
concerned about the access around the perimeter of the building as well as access to the
storage yard. The building will have to go through a fire flow analysis.

Mr. Blaylock stated the building department's modified site plan will ensure trucks can do
all backing orj private property, with no maneuvering on the streets. It was felt trucks up
to 40 ft. would have no problem maneuvering on-site but larger trucks would have trouble
because there is approximately 60 ft. in front of the truck doors and it takes
approximately 90 ft. to t rn. The Hearing Examiner stated the Parking and Loading
Ordinance requires all maneuvering to take place on private property and stated_if the
City Ordinance requires all maneuvering to take place on- site, then the site plan should
take that requirement into account or smaller trucks should visit the site. Mr. Blaylock
stated we should require special set backs or specialized loading areas, and the problem
that may arise, from a planning point of view, is when we allow.more offices in certain
areas we will have traffic from offices competing with warehouse traffic. He said staff
would recommend this project with conditions regarding secondary access and striped fire
lanes through the storage area on the east side of the property and long the north,end of
the property ine.

Mr. Sconzo stated he agreed;with the recommendations of staff. He said the building on
the property is approx. 50 ft. back from the planting strip giving them a 60 ft. setback,
along with extensive landscaping, which can be reduced to allow them to enter on the site
and still make the proper space available for on-site maneuvering for the larger trucks.
They will hie both 40 ft. and 60 ft. trucks coming to the site. He said the cab of the
larger trucks turning on-site will come to the edge of the property. Mr. Sconzo stated if
they can hav a reduction in the landscaping required, there should be no problem.

Mr. Thomas tated in support of the parking maneuvering area, their operation is not a
manufacturing operation but a distribution operation and receives approximately 3 or 4
over-the-road trailers a day; so whatever maneuvering area is required they could
designate they end door for the large trucks and the other doors for the smaller trucks. He
said they woyld prefer not to;have to move the building back if possible.
The Hearing Examiner called; for testimony in opposition of the request. There was no one
else wishing to speak. Mr. Blaylock commented on Section 4-2205 of the Parking and
Loading Ordinance with reference to loading space and the fact that no portion of a
vehicle taking part in loading or unloading should project into a public street or alley. He
said the concern he has is that_maneuvering is not addressed very clearly in the ordinance
where it should be; whether the public right-of-way should be used or not. He had no
further comments.
With no other persons wishing to testify or comment, the hearing was closed at 9:28 A.M.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the ,
following:
FINDINGS:
1. The applicant, Don Thomas, filed a request for approval of a site plan for a
two-story combined office and warehouse building.
2. The application file containing the application, the State Environmental Policy Act
SEPM documentation, the Building and Zoning Department Report, and other
pertinent documents was entered into the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C,
1971, as amended), a Declaration of Non- Significance has been issued for the
subject proposal by 'the Environmental Review Committee (ERC), responsible
official.

4. Plans for the proposal.have been reviewed.by all city departments affected by the
impact of this development.
5. The subject site is located on the east side of the 800 block of the Seneca Ave S.W.
cul-de-sac. The site is located in the approximate, middle of the original
Earlin ton Industrial Park.
6. The subject site was annexed into the city in April of 1959 by Ordinance 1745, as
amended by Ordinances 1764 and 1928. The site was automatically zoned General
upon annexation. The site was reclassified to M-P (Manufacturing Park) by
Ordinaece 2205 in January, 1966. While a variance from setback provisions had
been approved for the subject site in 1967, the applicant has not utilized the
variance, nor do they intend to do so.
7. The subject site could be described as two separate terraces with approximately a
6 foot ;difference in elevation, but both relatively level. The western portion of the
site is the lower area.
8. The site is vacant and is generally covered with scrub brush and grasses.
9. The map element of the Comprehensive Plan designates the area in which the
subject site is located'as suitable for the development of manufacturing type uses,
but does not mandate such development without consideration of other policies of
the plan.
10. The applicant proposes erecting a two-story tilt-up concrete building with painted
panels. The building; will serve both the applicant's office and warehousing needs.
The office use will be on a mezzanine.
11. The structure will contain approximately 21,500 square feet of space to be divided
between office and warehouse. The building will consist of 18,500 .square feet of
warehouse space and13;000 sq ft of office space.
12. - The applicant proposes providing 37 parking stalls whereas the proposed complex
would only require 28 stalls. The additional stalls would permit conversion of some
warehousing space to office space.
13. The applicant has proposed landscaping along the front yard and along the south
side yard as well as interior landscaping. The landscaping proposed is in excess of
that required by City Code.
14. Due to access and, maneuvering requirements the applicant may modify the
landscaping along the front yard.
15. The Fire Department Figs indicated a second access will be required together with a
marked fire lane through the storage yard`
CONCLUSIONS
1. The proposed site plan appears to serve the public use and interest. The two-story
warehouse/office will provide some additional employment opportunities in the
City and fills in an existing lot with access to the necessary utilities.
2. The building will blend with the other warehousing operations in the area, will
provide more than adequate parking, and will be landscaped.
3. Since conflicts between passenger cars and large trailer rigs can create a
dangerous situation,' maneuvering on the public right-of-way must be prevented.
Backing, turning and maneuvering should be confined to the industrial site and not
occur across either public sidewalks or streets. All maneuvering therefore, must
occur on the subject site. Landscaping modifications to allow this operation may
be req U ired but should not degrade the overall landscaping plan.
4. - The additional parking may permit alteration or conversion of some warehouse
space to office space which would allow internal expansion to occur.
5. Fire safety concerns of the City must be met and both a second access and a
designated fire lane established.

DECISION
The site plan is approved subject to the following conditions.
1. All truck maneuvering must occur on the subject site.
2. A second access point subject to approval of the Fire Department must be provided
to the subject site.
3. A marked fire lane through the storage area must be provided subject to approval
of the Fire Department.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before Setember 6, 1984. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further ction as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in th1e Finance Department, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur' concerning land use decisions. This means that parties to a
land use decision may not communicate in private with any decision-maker concerning the
proposal. Decision-makers ;in the land use process include both the Hearing Examiner and
members of the City Council.;
All communications concerning the the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to
openly rebut the evidence. Any violation of this doctrine would result in the invalidation
of the request) by the Court.
The Doctrine applies not ;only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

C. HISTORY/BACKGROUND:
The subject was annexed into the City of Renton by Ordinance #1745 of April 14,
1959, $which was later corrected by .Ordinance #1764 of May 19, 1959 and
Ordinance #1928 of December 12, 1961. The property upon annexation was zoned
G, General Use. This zoning designation was later changed from G. General Use,
to M-P. Manufacturing',Park, by Ordinance #2205 of January 17, 1966.
The subject property was then platted and became known as "Earlington Industrial
Park No. 1." Final approval of the plat was granted August 28, 1967, with the
passages of Resolution No. 1478 by the City Council (see filed PP-401-67,
V-409-67, and FP-415-67).
Later, July 1, 1968, the plat was amended allowing the subject property to become
a separate lot.

D. PHYSICAL BACKGROUND:
1. Topography: The western most portion of the property is approximately 6
feet lower .than the rest of the site. Both areas of the site tend to be
relatively flat.
2. Soils: Urban Land (Ur). This soil has been modified by disturbance of the
natural layers with additions of fill material several feet thick to
accommodate large industrial and housing installations. The erosion hazard is

L. DEPARTMENT ANALYSIS:
1. The applicant, Don Thomas, is seeking site plan approval to allow a
two-story, 21,500 square foot office and warehouse building. The building
01 consist of 0,500 square feet of warehouse space and 3,000 square feet of
office space.
2. A question was raised by staff as to the legality of the apparent short platwhichsegregatedthesubjectpropertyfromtherestofBlock4ofthe
Elarlington Industrial Park No. 1 Plat. Staff has since received documentation
showing that the property was made a legal lot as a result of the recording of
ah affidavit amending the plat on July 1, 1968. This procedure for
segregating the property was legal in 1968. This action occurred prior to the
adoption of State subdivision regulations in 1969 and the passage of a City
Subdivision Ordinance in 1971.
3. A variance to Attie sixty (60) foot setback requirement was approved by the
City Council on July 10, 1967. The Council approved a Planning Commission
recommendation to' allow a setback variance in the cul-de-sac of 17-1/2 feet.
This variance is no longer valid based on a decision made regarding the status
of variances approved prior to April 5, 1971, when Ordinance No. 262.5 was
passed placing) a two (2) year limitation on variances unless a site was
developed. The decision, based upon discussions with the City Attorney, is
that variances prior to April .5, 1971, were good only for two (2) years after
April 5, 1971 or April 5, 1973.
4.' The subject pr posal is consistent'with the intent of the Comprehensive Plan
designation of Manufacturing Park and the present zoning designation M-P,
Manufacturing Park.

5. The Environmental Review Committee has issued a final Declaration of
Non-significance for the subject proposal. As an informational note, the
Committee noted the following items which will be required:
a. The provision of a second access to the parking area south of the
building from the cul-de-sac.
b. Payment of an assessment for a traffic signal installed at S.W. Grady
Way and Powell Avenue S.W. and one installed at S.W. 7th Street and
Hardie Avenue S.W. as provided in a latecomer's agreement for the
Washington Technical Center. The applicant will be required to pay
220.68 for the signal at S.W. Grady Way and Powell Avenue S.W. and
107.69 for the signal at S.W. 7th STreet and Hardie Avenue S.W. The
total amount, $328.37, shall be due at the time of issuance of the
building permit.
6. The propsed site plan provides more parking spaces than required by the
Parking and Loading Ordinance. The applicant has 37 parking spaces when
the proposed project requires only 27.3 parking spaces.
7. The applicant's landscaping plan exceeds the amount of required landscaping
for the subject property.
8. The architectural treatment of the proposed building is compatible with that
of buildings within the immediate area of the subject property.
9. Various City departments have reviewed the subject proposal. The Policy
Development.Department, the Police Department, and the Parks Department
approved the proposal without conditions. Traffic Engineering, Engineering,
Utility Engineering and the Building Division approved the project subject to
the following conditions:
a. Traffic Engineering:
1) Payment of the assessment as provided for in the latecomer's
agreement for the Washington Technical Center.
b. Engineering:
1) Provide storm water retention/detention for the subject site.
2) Install a sidewalk across frontage.
c. Utility Engineering:
1) Approved subject to satisfying the Fire Department's
requirements.

d. Building Division:
1) Modify site plan to ensure that trucks can do all backing on
private property.
10.The Fire Prevention Bureau did not approve the proposed site plan. The
Department's comments are as follows:
a. Access to building perimeter does not meet City requirements.
b. Second access should be provided a point on the cul-de-sac in line with
south drive.
c. Sprinkler density will be required to meet demands according to type of
warehousing proposed and for high piled stock.
d. All hydrants within 300 feet of building to be depicted on plans.
e. BuildinIg design required to meet Uniform Fire Code requirements for
high piled storage.
The concerns of the Fire Prevention Bureau expressed in items a and b
should I be included in a modified site plan. Items c, d, and e can be
addressed at the time the actual building plans are submitted for
review. It should be, noted that the applicant may have to provide fire
hydrants on the site as well as a looping water system in order to
satisfy requirements of the Fire Prevention Bureau.

Based upon the above; analysis, the Building and Zoning Department recommends

a. The provision of a secondary access at a point on the cul-de-sac in line
with the south drive.
b. The striping of a twenty (20) foot fire lane through the storage area on
the east side of the property and along the north property line.

Acting as the Responsible Official, the ERC has determined this development does not
ihaveasignificantadverse. mpact on the environment. An EIS is not required under RCW
43.21C.030(2)(c). This decision was made after review by the lead agency of a complete
environmental checklist and other information on file with the lead agency.
Reasons for declaration of environmental non-significance:
The subject proposal will not adversely impact the environment or adjacent properties.
INFORMATION:
1. Second access is to be provided to the parking area south of the building from the
cul-de-sac.
2. Per a late corner's agreement (Washington Technical Center), assessment for
traffic signal installations at S.W. Grady Way and Powell Avenue S.W., and S.W. 7th
Street and Hardie.*Av,enue S.W. shall be $220.68 and $107.69 respectively, for a
total of $328.37. This amount shall be due at the time the building permit is issued.

Dear Mr. Sco zo:
The Zoning Division staff recently discovered a problem while reviewing the site approva
application for Don Thomas.' We cannot find a record of the short plat which would hav
divided Block 4 of the Earlin'gton Industrial Park No. 1 Plat into two lots. The City cannot
allow a project to develop on a non-legal lot. Therefore, we are withholding the,
application from further processing until we receive proof that the property was short
platted. Proof may be provided by submitting a copy of the deed. In addition, a copy of
the short plat as recorded by King County at the Department of Records and Elections
may also be provided to the Department.

Reasons for declaration of environmental non-significance:
The subject proposal will not adversely impact the environment or adjacent properties.
INFORMATION:
1. Second access is to be provided to the parking area south of the building from the
cul-de-sac.
2. Per a late corner's agreement (Washington Technical Center), assessment for
traffic signal installations at S.W. Grady Way and Powell Avenue S.W., and S.W. 7th
Street and Hardie Avenue S.W. shall be $220.68 and $107.69 respectively, for a
total of $328.37. This amount shall be due at the time the building permit is issued.

Introduction Tlhe State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
