Dear Mr. Blake:
After considerable debate surrounding the situation of the Fisher Rezone and the present
circumstances of your clients, Mr. & Mrs. John Qiuntinskie, it is our belief that the only
appropriate means to resolving the situation is to rezone the site and modify the
underlyirg restrictive convenants. As you are aware, the Building and Zoning Department
makes a recommendation to the Hearing Examiner, who then makes a recommendation to
the City Council concerning the rezone. Even though our recommendation generally
carries substantial weight with the Hearing Examiner and ultimately the City Council, we
are unable to guarantee that a rezone request would be successfull.
In any se, we are prepared to recommend approval of a rezone request if the uses are
limited to more transitional area activities, speficially uses such as general offices or
personal services. It is our belief that the Comprehensive Plan and Goals and Policies do
not support a general rezone to B-1 (Business Use) that would ultimately allow
retail/commercial activities.
In your setter of February' 13th, you stated that your clients would offer the property
based upon our recommendation. I would believe that this has no value at all to any
perspective purchaser that is aware of the due process system through the Hearing
Examiner and City Council. Even if the rezone is granted, any redevelopment of the site
or change in use would have to comply with other City codes relating to fire, building, or
parking requirements.

SUBJEC": Fischer Rezone Covenants, File R-076-84
The Fischer Rezone changed the zoning classification on a piece of property owned by Mr.
John Quintinskie from R-3, Residential - Multiple Family to B-1, Business Use. The
rezone was part of a real estate transaction between Mr. Frank Fischer and Mr. John
Quintinskie. The rezone action was based on the intent to use the subject property for a
non-retail commercial use, specifically a beauty shop. Covenants were ultimately filed as
a requir3ment of rezone, limiting use of the property to only that of a beauty shop. In
addition one of the conditions in the filed covenants states "no other uses may be
permitted on the premises." Since then, the real estate transaction has fallen through and
Mr. Qui itinskie called our office to see about modifying the covenants to allow more
types of business uses on the site. We have advised the owner that he may file another
rezone application. New covenants could then be placed on the subject property.
We would like two questions addressed. Firs; the immediate question is whether the
property' owner can legally continue to utilize the property as a single family residence
when such use seems contrary to the stipulations in the covenants? Conditions No. 2 & 3
of the filed covenants state:
2. The interior shall be utilized for a beauty shop of not more
than 1,500 square feet of interior space or as otherwise
limited by parking requirements.
3 . No other uses may be permitted on the premises.
The second question is whether covenants resulting from a new rezone application
actually replaces the covenants required by the Fischer Rezone (file R-076-84)?

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
RESIDENCE DISTRICT (R-3) TO BUSINESS DISTRICT
B-1) (FISCHER R-076-84)
WHEREAS under Chapter 7 , Title IV (Building Regulations)
of Ordinance No . 1628 known as the "Code of General Ordinances of the
City of Renton" , as amended, and the maps and reports adopted in
conjunction therewith, the property hereinbelow described has
heretofore been zoned as Residence District (R-3) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Building and Zoning Department
on or about June 26 , 1984, which petition was duly referred to the
Hearing Examiner for investigation, study and public hearing, and
a public hearing having been held thereon on or about August 7 ,
1984, and said matter having been duly considered by the Hearing
Examiner and said zoning request being in conformity with the City ' s

Ordinance #3842 An ordinance was read amending portions of Title V (Business
Police Regulations) of the City Code relating to police investigations
Investigations of business license applications. MOVED BY CLYMER, SECONDED BY
of Business MATHEWS, COUNCIL ADOPT THE ORDINANCE AS READ. City Attorney
License Warren cited State Supreme Court Case Myrick v. Pierce
Applications County in which certain regulations regarding police background
investigations of business license applicants have been
declared unconstitional since applicants are penalized for the
same crime twice. Upon inquiry by Council , he indicated that
adoption of the ordinance is advisory, not mandatory, to protect
the City from suit; that registering objections to the legislation
with the Court would be to little avail ; and the Council ' s only
course of action would be to petition the State Legislature.
It was noted that the cities of Kent and Enumclaw have also
passed similar legislation. For the record, Councilwoman
Keolker attributed timely adoption of this legislation to
City Attorney Warren' s conscientious attention to recent court
decisions. She noted that other cities are just now being made
aware of potential jeopardy as a result of this court case, and
City Attorney Warren should be commended for timely action.

Ordinance #3843 An ordinance was read amending portions of Title VI (Police
Massage Parlor Regulations) of City Code relating to regulation of massage
Regulations businesses, defining prohibited activities and declaring a
nuisance. It was noted that adoption of this ordinance is
also required to comply with aforementioned court case. MOVED
BY CLYMER, SECONDED BY MATHEWS, COUNCIL ADOPT THE ORDINANCE

Ordinance #3844 An ordinance was read changing the zoning classification of
Fischer Rezone property located at 426 Burnett Avenue South from Residence
R-076-84 District (R-3) to Business District (B-1 ) ; Fischer Rezone;
File No. R-076-84. MOVED BY CLYMER, SECONDED BY HUGHES,
COUNCIL ADOPT THE ORDINANCE AS READ. Councilman Stredicke
objected to approval of business zoning in a predominantly
single family neighborhood. Gene Williams, Policy Development
Department, indicated that although his department had
reservations regarding potential development under existing
R-3 zoning which allows a dense apartment building, approval
for business zoning had been recommended with certain conditions

Planning and Upon inquiry by Councilwoman Keolker, Gene Williams, Policy
Development Development Department, indicated that the City has not adopted
Committee Greenbelt Regulations prior to this time, and Committee changes
Greenbelt to Planning Commission recommendations are minor. These
Regulations relate to special studies exemption for steep slope areas for
continued only one single family home; and imposing a sliding scale for
greenbelt requirements within utility easements and rights-of-
way. Councilwoman Keolker also requested notification to
owners of property located adjacent to greenbelt designations
that "Greenbelt" allows certain low-density development and is
not limited to open space. Mayor Shinpoch indicated the matter
would be investigated. MOTION CARRIED.
G. M. Associates Referencing a letter from City Attorney Lawrence J. Warren
Rezone Request regarding the G. M. Associates request for extension of time
for Time Extension limit imposed for development during rezone approval , it was
R-019-82 MOVED BY STREDICKE, SECONDED BY REED, COUNCIL REFER THIS MATTER
TO THE PLANNING & DEVELOPMENT COMMITTEE. CARRIED.
Community Services Community Services Committee Chairman Keolker presented a
Committee report regarding the bid opening held for the Renton Area
RAMSC Parking Lot Multi-Service Center parking lot paving project. The low
Paving Project bid of G. C. Finn Construction Company was reviewed, and
the Committee recommends acceptance of the negotiated low
bid of $20,767.52 ( including tax) and authorization for
execution of necessary contract. The project is being
funded from the Housing & Community Development Block Grant
Program. Discussion indicated the matter should be held
in Committee until legal opinion on parameters of negotiable
bid is obtained.

Business License An ordinance was read amending portions of Title V (Business
Police Investigations Regulations) of the City Code relating to police investigations

ONE WEEK. CARRIED.
Massage Parlor An ordinance was read amending portions of Title VI (Police
Regulations Regulations) of City Code relating to regulation of massage
businesses, defining prohibited activities and declaring a
nuisance. Chairman Clymer explained both ordinances have
been proposed to comply with Washington Supreme Court decision
on Myrick v. Pierce County which declared unconstitutional
certain regulations concerning massage businesses. A
severability clause will be added prior to adoption. MOVED

BACK TO COMMITTEE FOR ONE WEEK. CARRIED.
Tischer Rezone An ordinance was read changing the zoning classification of
R-076-84 property located at 426 Burnett Avenue South from Residence
District (R-3) to Business District (B-1 ) ; Fischer Rezone;
File No. R-076-84) . MOVED BY CLYMER, SECONDED BY REED,
COUNCIL REFER THIS ORDINANCE BACK TO COMMITTEE FOR ONE WEEK.

Wall & Redekop An ordinance was read vacating a portion of Lakeview Avenue
Street Vac_,tion and Renton Avenue between NE 4th and NE 5th Streets and
VAC 9-78 amending the legal description contained in prior ordinance
No. 3341 (VAC 9-78) . Chairman Clymer stated that adoption
of the ordinance is required to reaffirm action taken by
the City Council in 1979. MOVED BY CLYMER, SECONDED BY
REED, COUNCIL REFER THIS ORDINANCE BACK TO COMMITTEE FOR ONE

NEW BUSINESS Council President Hughes referenced a letter from Mayor
Business Standards Shinpoch responding to the Council referral of 8/13/84
for Liquor regarding business standards for liquor establishments.
Establishments The recommendations were that the City should not impose
Slick Willy' s separate business standards for establishments selling
Tavern Referral ) liquor, particularly due to possible difficulties enforcing
local restrictions more stringent than imposed by the State.
Any new commercial use must comply with Zoning, Building
and Fire Codes which consider all facets of development
impact, and enforcement of these Codes shall continue in
protection of the public. And the City should not involve
itself in limiting competition in business or making
determinations about economic viability. Mayor Shinpoch
also indicated that Title 66 of the Washington Administrative
Code contains over 40 pages devoted to Liquor Board
regulations; one which provides the local elected official
an opportunity to request a hearing which the Liquor Board
may grant. Council President Hughes concurred in the
Mayor' s recommendations, and indicated that while the
Council had gone the "extra mile" in holding a public
meeting regarding the liquor license for Slick Willy' s,
any future public objections to business establishments
by residents should go through routine City and State
procedures.
Fischer Rezone Councilman Stredicke indicated concern regarding adoption
R-076-84 of an ordinance approving the Fischer Rezone (first reading
this date) since it allows business use in a primarily
residential area on Burnett Avenue.
ADMINISTRATIVE Mayor Shinpoch expressed sadness at the recent death of
REPORT Dick Seraile, 43, member of the City' s Library Board since
September of 1983, and well-respected by those who knew him.
Earlington Park Responding to Council inquiry 9/10/84 regarding the Earlington
Improvement Park Improvement Project, Mayor Shinpoch indicated that the
Project sole bidder was able to make a lower bid for the small project
since he is the contractor for another project in the City,
and his equipment is already transported to the area.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
RESIDENCE DISTRICT (R-3) TO BUSINESS DISTRICT
B-1) (FISCHER R-076-84)
WHEREAS under Chapter 7 , Title IV (Building Regulations)
of Ordinance No . 1628 known as the "Code of General Ordinances of the
City of Renton" , as amended, and the maps and reports adopted in
conjunction therewith, the property hereinbelow described has
heretofore been zoned as Residence District (R-3) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Building and Zoning Department
on or about June 26 , 1984, which petition was duly referred to the
Hearing Examiner for investigation, study and public hearing, and
a public hearing having been held thereon on or about August 7 ,
1984 , and said matter having been duly considered by the Hearing
Examiner and said zoning request being in conformity with the City ' s
Comprehensive Plan, as amended, and the City Council having duly

OLD BUS `NESS Community Services Committee Chairman Keolker presented a
Community Services report for information only regarding the Group W Cable TV
Committee proposed rate increase (referred 6/18/84) and matter of
Group W Cable TV completion of the cable system construction project (referred
7/2/84) . After meeting with representatives of the cable
company and the City' s cable consultant, Lon Hurd, the
Committee reported the following:
Rate Increase 1 . Group W Cable has withdrawn its request for rate increase
Witndrawn at this time. Letter from Group W Community Affairs
Manager Wm. Covington was read which reports delays in
completing cable system construction have caused withdrawal
of rate increase requests until such time as the work is
substantially completed. (See motion on page five. )
Refund to 2. Group W Cable has agreed to conditions of Resolution #2554
Commercial which directed that all commercial rate payers billed in
Customers excess of the basic service rate previously approved by
the Council receive a refund or a credit applied to future
billings. Letters are being sent to affected customers.
Construction 3. Group W has provided a schedule indicating cable system
Schedule construction completion dates, which reflects service by
cable to all areas of the City by the end of September,
1984, except Cedar Avenue South which should be completed
by the end of October, 1984.

Report, examining available information on file with
the application, and field checking the property and

hearing on the subject as follows:

Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.

The hearing was opened and Jeanette McKague, representing the Zoning Department,
presented the staff report. She stated the request is to allow a beauty shop to be located
in an already established residence. There is approx. 1500 sq. ft. of living space in the
residence, and the structure meets all the setback requirements for the B-1 zone. The
proposed use is compatible with the intent of the Comprehensive Plan It was noted that
the applicant is willing to sign restrictive covenants restricting the property to non-retail
commercial activities. This would create a use buffer between the commercial uses to
the north and the multiple family uses to the south. Mrs. McKague addressed the
timeliness of this application stating the creating of this use buffer would provide a
definite border and establish the concept of use buffers in the subject south Renton area.
The use 3f an existing structure for the proposed beauty shop would not intrude into the
single family area to the south as would a new structure. The remodeling of the existing
structure will have to meet all of the Building and Fire Department codes as well as the
parking code. It was noted that the dimensions in the rear yard would allow
approximately six parking spaces. Parking could face the existing parking for the VFW
hall and landscaping will be provided along the southerly property line. Improvements to
the alley and provisions for storm drainage would be required. Mrs. McKague said staff
would recommend approval of this request subject to restrictive covenants limiting the
on-site uses to non-commercial activities.
The Hearing Examiner called for testimony from the applicant or their representative.

Mr. Fischer stated he agrees with the staff report as presented and the Hearing Examiner
reiterated to Mr. Fischer the fact that even if the rezone is approved the structure itself
may not comply with the requirements of the building code and extensive modification
may be required to bring the building into conformance. Mr. Fischer acknowledged he is
willing to do what is necessary to comply with all city codes.
The Hearing Examiner called for further testimony in support of, or in opposition to this
proposal. There was no one else wishing to speak, the Examiner closed the public hearing
at 9:40 A.V1.
FINDING, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS:
1.The applicant, Frank Fischer, filed a request for approval of reclassification of
approximately .14 acres of property from R-3 (Medium Density Multi-family) to
B-l.
2.The application file containing the application, the State Environmental Policy Act
SEPA) documentation, the Building and Zoning Department Report, and other
pertinent documents was entered into the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C,
1971, as amended), a Declaration of Non- Significance has been issued for the
subject proposal by the Environmental Review Committee (ERC), responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5.There was no opposition to the subject proposal from any member of the public.
6.The subject site is located at 426 Burnett Avenue South. The property is on the
ea'3t side of Burnett and abuts the VFW Hall which is north of the site.
7.Ar existing single family home is located on the subject site. The home is
currently utilized as a dwelling.
8.The subject site was probably part of the original town site of the City. The site
was zoned L-1 (Light Industry) until reclassified to R-3, its current status, in 1980
by Ordinance 3490.
9. South of the subject site are residential uses. Similar uses are located across
Bt.rnett to the west.
10. TI-e map element of the Comprehensive Plan designates the area in which the
subject site is located as transitional, with areas nearer Houser and 4th apparently
suitable for the development of commercial uses, while the areas further from the
intersection suitable for residential purposes. The Comprehensive Plan does not
mandate such development without consideration of other policies of the plan.
11. The applicant proposes converting the existing residence to a beauty shop which
would be a permissible use in the B-1 district. While specific plans for use are not
required for a reclassification of property, the applicant has suggested that the site
be limited to only the beauty shop and only within the confines of the existing
st"ucture, a single family facade. The limitation would be implemented by the use
of restrictive covenants. This would enable the business to blend with the
residential uses immediately abutting the site to the south.
12. The area has seen a variety of both private development, new or renovated housing,
and public development, the Burnett Linear Park, within the last couple of years.

13. T he home is located on a lot 50 feet wide by 120 feet long. The front yard is
fifteen feet and a 10 foot side yard exists on the north adjacent to the VFW Hall,
wh'.le a 13 foot side yard separates the structure from the residential uses to the
south.
14. Immediately north of the subject site property is zoned B-1, south, property is
zoned R-3.
15. The Burnett parking area is located in the Burnett island just across from the
house. Parking is similarly available east of the subject site.
CONCLUSIONS
1.The proponent of a rezone must demonstrate that the request is in the public
interest, will not impair the public health, safety and welfare and in addition, is in
compliance with at least one of the three criteria found in Section 4-3010, which
provides in part that:
a. The subject site has not been considered in a previous area- wide rezone or
land use analysis; or
b. T he subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been a material and substantial change in the circumstances in
the area in which the subject site is located since the last rezoning of the
property or area.
The request to reclassify the subject site, with restrictions on use and appearance,
appears justified.
2.The proximity of the VFW Hall, a use which has evening events which conflict with
re .idential enjoyment, is located immediately to the north. Parking lots are
located both east and west of the subject site which also infringe on residential
enjoyment. Under the circumstances the site does not appear suitable for continued
use as a dwelling.
3. At the same time, total unlimited conversion of the structure to a possible wide
range of commercial or business uses would appear to jeopardize the residential
character south of the site. The Comprehensive Plan appears to sanction the very
difficult interface of commercial and residential in a mid-block transition. This
difficulty is evident in the applicant's request. The location of the VFW Hall has
interfered with the subject site's residential amenities but the transition of the
subject site to commercial should be limited so as to preserve and protect the
residential amenities of its next southerly neighbor.
4.As proposed by the applicant, conversion of the interior of the structure to a
beauty shop while preserving the external appearance would help blend the scale
an i character into the southerly residential uses. The beauty shop also should not
draw a large clientele since appointments and limited floor space dictate
limitations.
5.The reclassification to B-1 would be a logical extension of the B-1 district to the
subject site. Extension beyond this point would not appear reasonable in that a
firm limit of transition must be established.
6. Parking space for the proposed use is available and can be provided in the rear yard
while still preserving the necessary side yards for landscape buffering. Parking by
the VFW Hall patrons should be discouraged as the noise and use generated by the
Hall would be carried over to the parking area in the evening hours and could
conflict with the southerly residential uses.
7.The landscaping of the entire parcel, including the parking area shall be required to
be maintained in good condition and subject to approval by the City's landscape
Architect.
8.The City Council should approve the reclassification of the subject site as proposed
by the applicant.

The City 2ouncil should approve the reclassification of the subject site from R-3 to B-1
subject to the following conditions:

L. DEPARTMENT ANALYSIS:
1.The applicant, Frank Fischer, is requesting a rezone of approximately .14
acres of property from R-3, Multiple Family Residential, to B-1, Business

2.A Declaration of Non-significance was issued for the subject proposal on July
11, 1984. The appeal period expired on July 30, 1984.
3.The site is presently occupied by a single family residence that has
approximately 1500 square feet of living space. The house is located on the
western portion of the 50 by 120 foot lot with a 15 foot front yard along
Burnett Avenue South and a 10 foot side yard on the north side with a 13 foot
side yard on the south side. The structure complies with all the setback
requirements for commercial structures in a B-1 zone.
4. The Land Use Hearing Examiner must review four specific criteria under
Section 4-3014(C) to determine that the circumstances surrounding the
rezone request are adequate to recommend approval of the reclassification.
The following evidence clearly demonstrates the rezone request is
appropriate.
a. That substantial evidence was presented demonstrating the subject
reclassification appears not to have been specifically considered at the
time of the last area land use analysis and area zoning.
The subject property is part of the original township of the City of
Renton. Light Industrial zoning was applied at the time of
implementation of the zoning code and subsequently changed in 1980 by
Ordinance 3490 when the property was downzoned to R-3, Multiple
Family Residential from L-1, Light Industrial. In 1983, the
Comprehensive Plan covering the Central Area was modified by
Ordinance 3712. Therefore, the request complies with this criteria.
b. That the property is potentially classified for the proposed zone being
requested pursuant to the policies set forth in the Comprehensive Plan
and conditions have been met which would indicate the change is
appropriate.
The applicant has presented a very detailed case showing compliance
with the intent of the policies set forth in the Comprehensive Plan.
The site itself is in a transitional area between two land use
designations of the Comprehensive Plan. Commercial land use
activities are tended to be concentrated to the north, while medium
density multiple family uses are proposed to the south. In this specific
case, the applicant has an intended use of a personal service beauty
shop for the subject site.

In fact, the applicant would so stipulate in restrictive covenants
limiting the subject property to non-retail commercial activities. This
in affect, would create a use transition buffer between the commercial
uses to the north and the multiple family uses to the south. Use buffers
are as effective as setback and landscape buffers to create transitions
between difference intensity uses. The proposal seems to both
generally and specifically comply with the designation of the
Comprehensive Land Use Plan Map and the policies set forth in the
Comprehensive Plan.
c. That since the last previous land use analysis of the area zoning of the
subject property, authorized public improvements, permitted private
development or other circumstances affecting the subject property
have undergone significant and material change.
The general area has been going through gradual transitions from single
family to more commercial and multiple family uses. The
establishment of Burnett Linear Park in 1980 along with the
construction of associated parking allowed greater use of the area and a
focuses upon the park located. These public improvements alone
created a dramatic change in the focus of this area and has prompted
redevelopment along both sides of the street.
d. Timeliness: The final test to determine whether a rezone is appropriate
is to address the question of timeliness.
The subject property is on a boarderline between two difference
intented land uses. The applicant's proposal to specifically limit the
ultimate use and create a use buffer adds serious merit to the concept
of allowing the rezone to provide a use buffer between the commercial
uses to the north and the potential multiple family uses to the south. In
fact, it would create a definite border and strongly establish the
concept of use buffers in this south Renton area. All public utilities
and services are available to the subject site capapable of handling the
change in use. In addition, since the applicant is proposing utilizing a
single family residence in the same configuration that it presently
exists in, it would not intrude, such as a new structure would, into the
single family area to the south. Therefore, it does appear appropriate
and timely to rezone the property under certain limitation at this point.
6.The Police Department, Parks Department, Utilities Engineering Division,
and Traffic Engineering Division have all recommended approval without
conditions. The Building Department and Fire Prevention Bureau both state
that remodeling of the existing single family structure for a commercial use
would require compliance with not only the building and fire codes but also
the parking code for the specific use. The Engineering Division of the Public
Works Department points to the fact that storm water drainage plans would
also have to be approved for the modified parking area. At the same time,
the Policy Development Department has commented upon the change in use
and the have taken a strong position that the request should be approved with
limitations of use, if the building and parking can be provided.
The building itself complies with the requirements of the zoning code for the
B-1, Business Use zone. However, structural changes may have to take place
incuding fire breaks, etc., inside the building. This is not a land use decision,
but a technical implementation procedure that would be independent and
beyond the scope of the rezone request. The parking lot is shown as a vague
area. It does appear, from the dimensions in the rear yard, that
approximately six parking spaces could be provided. This would only allow
the conversion of the first floor or approximately 1200 square feet into
commercial office or personal service activity. The parking lot can be
constructed to focus towards the existing parking lot of the VFW hall while
landscaping of approximately 6 feet can be provided along the southern
property line. This will also require the improvement of the alley and
provisions for adequate storm drainage.

Based upon the above analysis, it is recommended that the rezone request, file
R-076-84, be approved subject to the filing of restrictive covenants to specifically
limit the uses on-site to non-retail commercial activities. In reverse, this will

SUBJEC T: Fischer Rezone
The Pclicy Development Department would like to offer the following comments
concerning the Fischer rezone as an expansion of our notes on the comment sheet. The
subject property is located in a transition area between the Commercial and Medium
Density Multiple Family designations on the Land Use Element Map. The potential for
either ise exists; therefore, other policies or facts must be used to determine the
appropriateness of the request.
Two questions seen pertinent. Where/how should a transition from commercial uses to
residential be provided? What intensity of development is appropriate?
Currently, the VFW Hall, located directly to the north, is a large barrier marking the
southeri edge of commercial uses along Burnett Avenue S. Commercial use south of the
VFW would seem like a leap past this barrier. However, the VFW -- though not a retail
use -- must have significant impact to the single family home on the subject property. A
municiral parking lot is located in front of the site. Therefore, some means of stepping
down tie intensity from the VFW to the residential uses south of the site might be
appropriate.
The intensity of potential uses in a B-1 zone on the subject site is a concern. Retail uses,
taverns high volume sales, extensive signage or any large customer or employee
generator would not be appropriate. Likewise, a large scale building would not serve as an
effective transition. The proposal presented by the applicant appears to alleviate these
concerns, but the applicants intentions must be enforced by covenant or appropriate
conditions. Approval of B-1 zoning on the subject site should be restricted to non-retail
service uses like a beauty shop or other quite similar use. Furthermore, the property
should he restricted to use of the existing structure or a structure of a similar nature and
scale to residential uses. The amount and type of signage should also be limited to that
compat.ble with the presence of adjoining residential uses.

In summary, this department recommends approval of the request with restrictive
covenants to limit the uses and intensity as discussed above. We believe this will provide
improved economic potential for downtown Renton while protecting residential uses from
most impacts of commercial uses. Also, this recommendation would allow a reasoned
future decision to be made about development on the adjoining vacant property to the
south.

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires

JUSTIFICATION FOR REZONE
The applicant seeks a change of zone from R-3 to
B-l. Applicant' s justification in part is based upon
the fact that the current R-3 zoning preceded the last
comprehensive plan amendment in the area.
The subject property falls within the area covered
by the "Central Renton Plan. " This comprehensive plan
was adopted by Ordinance No. 3712 on March 9 , 1983.
The subject property was rezoned by the City of
Renton under Ordinance No. 3490 on December 17 , 1980 .
At this time , the Property was down-zoned from L-1 to R-3 .
The subject property consists of a single family
residence located on a standard 50 ' by 120 ' city lot.
Adjoining immediately to the north is the parking lot and
VFW Hall. To the east of the property lies a strip of
blacktopped parking area designed as overflow parking
for the downtown business district. Immediately to the
south of the subject property is a vacant lot then single
family residences to Fifth Avenue. The property immediately
to the north and northeast of the subject property is
currently zoned and used as B-1 property. North of the
VFW Hall is a converted residential structure containing
three retail businesses. The structure one door farther

to the north is a community service type business .
On the northeast corner of the block lies the NAPA
Auto Parts store. The alley to the east of the subject
property is used extensively by the auto parts store , VFW,
and other businesses in the area as a business access.
To the southeast, the subject property looks on to
parking lots and a medical clinic and lab.
Applicant' s proposal for use as a B-1 lot is consistent
with the current usage in the area and would serve as a
buffer between the relative high volume and late hour operation
of the VFW and the residential uses to the south. It is
applicant' s intention to retain the residential appearance
of the building while converting it on the inside for use
as a hair styling salon. Such use would maintain the
essential residential character and be consistent with
surrounding uses.
The parking lot located on the public use property to
the west was paved in approximately 1982 and has resulted
in considerable use since that time as overflow parking
for the downtown core. This use detracts from the continued
use of the property as a single family residence.
Applicant further submits that the property is potentially
zoned for the reclassification being sought under the policies
and goals set forth in the comprehensive plan. Since the
plan is a generalized map of intended future uses and not
a precise boundary definition, it is arguable that the sub-
ject property in fact lies within the comprehensive plan' s

area for B-1 development. Even if this is not the case ,
it is clear that the site is immediately adjoining such
intended use area and that the area is currently being
used as B-1 property.
The proposed rezone is in line with general goals ,
objectives, and policies as set forth in the Compendium
dated June , 1983 . Specifically, the proposal is consistent
with the general economic goal of promoting a sound and
diversified economic base. The applicant' s proposed use
is a non-polluting, low traffic volume us and one which is
non-offensive to the surrounding uses . The proposed use
will also serve to provide employment and an added tax
base for the City. The proposal is also consistent with
the policy of encouraging development in and around the
urban core rather than "strip" or fringe area development.
The commercial goal of the plan to promote attractive
convenient commercial facilities would be served by the
requested rezone. Currently, South Fourth is used extensively
as an east/west bypass for South Second and particularly
for South Third. The subject site is readily accessible
from South Fourth and would not attract additional traffic
to residential areas. As stated above, the proposed use
is consistent with the present actual commercial or professional
uses in the surrounding area. Further, any on-site parking
could possibly be used as a joint parking facility with
surrounding businesses. Such joint parking facilities are
encouraged under the policies for commercial development.

This proposal is also consistent with the general
implementing policies for the central area plan which
provide that office uses should be utilized as a transition
between residential and commercial/industrial areas. This
policy states that where opportunities for adequate size
land parcels are available, office uses should be an alter-
native to multiple family development. A review of police
department records will indicate that a buffer use and zone
is desirable between the VFW Hall and residential uses.
Applicant' s proposal would provide this buffer with a
primarily daytime oriented use leaving the residential
uses to the south with a quiet zone between them and the
evening use of the VFW Hall.
In conclusion, applicant would agree as a condition
precedent to any approval of the proposed rezone that the
subject property be encumbered with reasonable restrictive
covenants limiting development to the proposed non-retail
use and that adequate screening and planting be provided
along any required parking areas.
