Citizen Comment: Schumsky Correspondence was read from Don Schumsky, owner of Schumsky's All City Card Room.Request for All Diner, 423 Airport Way, Renton, 98055, asking that he be granted a variance City Diner for an enhanced(house-banked)card room license at this location. Councilman Parker commented that the State Gambling Commission believes it possesses sole authority over gambling uses, leaving local jurisdictions little or no control. City Attorney Lawrence J. Warren confirmed that legislation is pending in the State legislature concerning mini-casinos. He agreed that local jurisdictions are awaiting the final word on State vs. local authority over gambling uses and related zoning restrictions. Mayor Tanner noted that the All City Diner abuts both single family residences and a public school, making it an inappropriate location for gambling activities. OLD BUSINESS Community Services Committee Chair Nelson presented a report Community Services recommending concurrence in the following Mayor's appointments to the Committee Municipal Arts Commission: Appointment: Municipal Arts Renne Sating to fill a vacancy for a three-year term which expires onCommission12/31/2001; and Marie Brown to fill a vacancy for a three-year term which expires on 12/31/2002. Planning&Development Committee Chair Keolker-Wheeler presented a report Committee recommending concurrence with the staff recommendation to authorize the Development Services: Q-1 removal of a restrictive covenant that was required as a condition of a rezone of Corp Request for Removal of a certain piece of property to L-1 (Light Industrial) in 1984. The covenant Restrictive Covenant requires: 1. A 20-foot landscaped setback along the front property line along Grady Way; 2. A 10-foot landscaped setback along the side property lines; and 3. The site plan for the subject property is to be reviewed at a public hearing. The covenant is no longer relevant to present conditions surrounding the January 24,2000 411 Renton City Council Minutes 41111 Page 26 Isubject site and unduly encumbers the property. Therefore,the Committee recommended allowing the applicants to proceed with removing the restrictive covenant from the land title. The Committee recommended that the City Council authorize the Administration to prepare documents for removal of the restrictive covenant. Transportation Committee Transportation Committee Chair Persson presented a report regarding the Vacation: Lace View Blvd N petition for a partial street vacation of Lake View Blvd. N. (The Bluffs) from TheBluffs), VAC-98-004 Legacy Partners. Council approved the petition to vacate the unimproved right- of-way following the public hearing held on January 25, 1999. The right-of- way was appraised at$170,000. The petitioner provided additional information about the steep slopes present in the right-of-way and current market data for the adjacent property. Staff reported that over the past several years the City of Renton has purchased property with steep slopes and wetlands to preserve them at$1.30 per square foot and that the information provided by the petitioner was accurate. Staff suggested that using the value of$1.30 per square foot would revise the appraised value to $122,000, and recommended that this value is reasonable and fair. State statute requires that the City Council accept the appraisal and set compensation. Since the right-of-way was dedicated in the plat, compensation may be set at up to one-half of the appraised fair market value. The Committee recommended that the City Council accept the appraisal and set compensation for the right-of-way at$61,000. Finance Committee Finance Committee Chair Parker presented a report recommending closing the Finance: Policy on Handling referral on the policy for the handling and collection of returned checks since and Collection of Returned the policy regarding this matter was changed on May 17, 1999. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on August 2, 1984. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 7, 1984, at 9:17 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application and other documents pertinent to this proposal. Exhibit #2 - Base Map of subject proposal. Exhibit #3 - Land Rights Work Map showing P-1 Channel and easements provided by Mr. Brown The hearing was opened and Jeanette McKague, representing the Zoning Department, presentec the staff report. She stated the Public Works Department will need an easement over the entire site to fill the property with spoils from the construction of the P-1 Charnel. It was mentioned that at the time the spoils are brought out it will then be determined if it is feasible for the applicant to use those spoils on his building site. The spoils that have come from the P-1 Channel so far have been very suitable for construction. Spoils are needed because the property is in a flood plain and will have to be filled before building can occur, as well as being in a critical position as far as the development of the P-1 Channel. This property was not considered at the time the last land use analysis was made. When annexed into the city the property was zoned GS-1 which was later changed to G-1, with a change in the zoning map classifications combining all of the G classifications into one zone. The comprehensive plan in the subject area shows it as Manufacturing-Park. This is a unique situation because there are several small lots. A policy was then developed to allow either B-1 or L-1 zoning in the area because of the size of the lots. The M-P zone requires a 60 ft. setback, and if applied to all of the property it would prohibit development by the individual owners. Therefore, a special policy was established whereby the city could allow a lesser zone with restrictive covenants which would reduce the front setbacks to 20 ft. and the side and rear setbacks to 10 ft. Mrs. McKague further stated there have been significant public and planned public improvements in the area thereby supporting this rezone request. It was pointed out that the Building and Zoning Department as well as the Fire Department is concerned about the access and location for emergency services, and because of these concerns it is recommended that site plan approval be required before any futux a development occurs. The Hearing Examiner inquired as to the size of the parcel on the south side of Grady Way, and it was determined it is approx. 7,260 sq. ft. LARRY M. BROWN R-077-8G August 16, 1984 Page 2 The Examiner called for testimony from the applicant or a representative. Responding was: Larry Brown 13975 Interurban Avenue So. Seattle, Wa. 98168 Mr. Brown referred to a map given him by the Utilities Dept. indicating about 50% of the property would be taken for easements or permanent use. He stated he basically concurred with the staff report, and corrected page 3 of the Staff Report to read 0.72 acres (Department Analysis - it L-1). Mr. Brown stated he felt he needed clarification from the City as to access on the southerly parcel which is under 7500 sq. ft. After the dedication there will be about 3200 sq. ft. He stated he has never seen a design for the new Grady Bridge so he does not know what will be available for access on the southerly parcel. Mr. Brown said it was his understanding that the property abutting the northerly parcel on the west is considering a rezone to Light-Industrial, and requested if a sideyard restriction is imposed on that site that it have a condition stating if the parcel is rezoned to Light-Industrial the sideyard setback will be eliminated. He stated that the northerly property tine of the northerly parcel, which abuts the Puget Sound Power transmission line right-of-way and zoned G-1, will probably have another setback requirement, and it was requested this setback be waived with the exception of a landscape strip, so the property can be developed to its maximum. Mr. Brown concluded by stating he was agreeable to participa°.ing in a LID for Grady Way Improvements; and the fill material that is used on the site will be buildable fill material. The Hearing Examiner called for further testimony, in support of, or in opposition of the application. There being none, the hearing was closed at 9:30 A.M. FINDING 3, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1.The applicant, Larry M. Brown, filed a request for approval of reclassification of approximately .72 acres of property from G-1 (General; Single Family Residential) to L-1 (Light Industrial). 2.The application file containing the application, the State Environmental Policy Act SE:PA) documentation, the Building and Zoning Department Report, and other pe.'tinent documents was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1911, as amended), a Declaration of Non- Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), responsible ofl icial. 4.Pans for the proposal have been reviewed by all city departments affected by the impact of this development. 5.The subject site is located in the 1300 block of S.W. Grady Way between Oaksdale Ave S.W. and Longacres Drive S.W. Grady Way divides the subject property into two segments. 6. The subject site was annexed into the city in April of 1959 by Ordinance 1745, as amended by Ordinances 1764 of May, 1959 and 1928 of October, 1961. 7.The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park type uses with large landscaped setbacks and yards, but does not mandate such development without consideration of other policies of the plan. 8.The subject site is currently undeveloped. The smaller southerly parcel is approximately 7,260 sq ft. The northern portion of the property is approximately 24 100 sq ft. The proposed P-1 Channel right-of-way coincides with the eastern po:-tion of both lots. The proposed easements and dedications will substantially reduce the developable acreage. LARRY M. BROWN R-077-84 August 16, 1984 Page 3 9.North of the subject site is a power line right-of-way, while more vacant property is located east of the site. I-405 is located to the south of the site, while a motel is :located west of the subject site. 10. Wz shington Technical Center has been developed generally north of the subject site, while new office and warehousing uses have been developed east of the site both north and south of Grady Way. 11. There have been a number of rezones of smaller lots to L-1 and B-1 in the area, ral her than the M-P (Manufacturing Park) designation indicated in the Comprehensive Plan. This is because of the substantial setbacks in M-P zones wt•ich would leave lots with unreasonably small building areas. These rezones have im)osed modified setbacks to provide some comparable fidelity to the open space features of the manufacturing park characteristics. Setbacks in front yards as well as side yards have been required in areas of the Green River Valley Comprehensive Plan while not ordinarily required in an L-1 zone. 12. The rezone was estimated to have only a minor impact upon traffic and err ployment opportunities in the City. 13. The applicant has proposed to use the property on the south side of Grady for an accessory parking lot to support proposed development on the north parcel. Those plans remain speculative at this time and have not been reviewed in any detail by City staff. The proposed plans at this time are not part of the analysis nor are they binding upon either the applicant or the City with respect to the instant re; one review. CONCLUSIONS 1.The proponent of a rezone must demonstrate that the request is in the public interest, will not impair the public health, safety and welfare and in addition, is in co npliance with at least one of the three criteria found in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. T here has been a material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The request to reclassify the subject site appears justified. 2. While the Comprehensive Plan designates the area in which the subject site is located as suitable for manufacturing park type uses, the size of the site would preclude reasonable development of the site given the substantial setbacks required in the M-P zone. Manufacturing park uses include uses permitted in the the L-1 zoning district proposed by the applicant. Therefore, the intensity of the uses allowed under the zoning proposed would not generally exceed those in an M-P zoi ie. 3.The imposition of reasonable setbacks, analogous to those of the M-P zone, but scaled down to allow reasonable development as has been done in other instances in tho immediate vicinity, would appear reasonable. The applicant would be left with a reasonable amount of building area and at the same time development with sel backs for landscaping would provide some loyalty to the Green River Comprehensive Plan. 4.A landscaped front yard setback of twenty feet has been utilized for similar rezones in the area and would appear reasonable in this rezone. Ten foot side yards ha e also been imposed to provide a reasonable spacing between uses, even industrial uses, to provide some sense of the park like facilities envisioned in the Green River Valley Comprehensive Plan. 5.To ensure sensitivity of the final site plan to the goals and policies of the Comprehensive Plan, a public hearing on the site plan should be required. RECOMMENDATION The City Council should approve the reclassification of the subject site from G-1 to L-1 subject to the execution of restrictive covenants requiring the following: 1. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. The App.arance of Fairness Doctrine provides that no ex parte (private one-on-one) communi rations may occur concerning land use decisions. This means that parties to a land use lecision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the the proposal must be made in public. This permits all intereste i parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, a final declaration of non-significance was issued on July 11, 1984, by the Environmental Review Committee. DE:PARTMENT ANALYSIS: 1.The applicant, Larry Brown, is seeking a rezone of 0.27 acres of property from G-1, General Use, to L-1, Light Industrial located on the north and south sides of S.W. Grady Way at approximately the 1300 block which is in between Oakesdale Avenue S.W. and Longacres Drive S.W. 2. The Environmental Review Committee has issued a Declaration of Non-significance subject to the following conditions: a. Access to the subject site along S.W. Grady Way shall be limited to right-in and right-out turning movements only. b. A dedication or easement shall be granted to the City of Renton for the P-1 channel waterway, per approval of the Public Works Department. c. A dedication or easement shall be granted to the City of Renton for future construction of Oakesdale Avenue S.W. per approval of the Public Works Department. As an informational note, it is stated that the Public Works Department will need an easement over the entire site to fill the property from spoils removed from the construction of the P-1 channel. 3.The property is located at a critical point where the P-1 channel will pass under S.W. Grady Way and then flow underneath I-405. All of the property north of the subject site has been acquired for the construction of the P-1 channel. This is the next incremental phase for the P-1 channel extension into the Green River Valley and is critical to the flood control management program for the Eastside Watershed. 4. The Land Use Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification. The following evidence clearly demonstrates the rezone request is appropriate. a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. PRELIMINARY REPORT TO THE HEARING EXAMINER LARRY M. BROWN: R-077-84 AUGUST 7, 1984 PAGE 4 The subject property was originally annexed into the City in 1959 with a corrected ordinance in 1961. Upon annexation, the property was zoned GS-1 which later was converted to G-1 in 1982 by general City Ordinance 3634. Therefore, the site has not been specifically considered since the classification was originally applied. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate. The proposed rezone request to L-1, Light Industrial Use, is in general conformance with the intent of the Comprehensive Plan which shows the subject site as a Manufacturing Park land designation. The parcel because of its size, only 3/4 of an acre, is severely limited as a result of adjoining streets and access and cannot be developed unless it is rezoned into a lower classification that has reduced setback standards, such as an L-1 zone. However, the City has approved a number of rezones in this general area to both B-1, Business Use, and L-1, Light Industrial use, as a result of the strict application of the 60 foot setback standards for the Manufacturing Park zone. In effect, the enforcement of these large setbacks would preclude any functional development of these smaller lots and deprive the property owner of all development value. The general policy has been established to impose restrictive covenants establishing minimum setbacks for buildings and specific landscape areas in this unique area. The policy was originally implemented in the late 1960's and has followed through with the last rezone to the area for Beckman Homes in the fall of 1983. In most cases, a front yard setback of 20 feet has been required with side and rear yards of at least 10 feet. Since there are no adjacent uses except public rights-of-way in the form of either the P-1 channel or state highways, it is felt that the restriction should not be imposed because Section 4-17716 would apply for design reviews. c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. Since 1975, the general area has undergone major development changes specifically to the east and north of the subject site. Development of OW Properties and Washington Technical Center suggest a scale of development impossible to be implemented on this site. This general area of the City has been severely limited by the size of the lots available for development. The area has actually undergone major significant public improvements and planned public improvements in the form of the METRO Sewage Treatement Plant expansion, the pending construction of Grady Way Bridge, improvements to I-405 anticipated in 1986 and 1987, and the construction of the P-1 channel. Therefore, it does appear that there are significant changes in the area warranting the rezone request. d. Timeliness: The final test to determine whether a rezone is appropriate is to address the question of timeliness. PRELIMINARY REPORT TO THE HEARING EXAMINER LARRY M. BROWN: R-077-84 AUGUST 7, 1984 PAGE 5 The subject property is the choke point for all storm water that would drain into the P-1 channel and north underneath I-405 and S.W. Grady Way. All of the necessary physical improvements for storm water drainage, access, and fill material seem to be coming together at this time. Prior to the awarding of the contract for the P-1 channel development on this site was impossible. 5.The Police Department and Utilities Engineering Division has recommended approval without conditions. The Policy Development requested additional information and that has been handled with the limitations by the Environmental Review Committee concerning water courses, access, filling of the site, and construction of the P-1 channel. They advise that there should be site plan approval through the Hearing Examiner process which has been a typical requirement with the implementation of the L-1 zone under the intent of the Manufacturing Park land use classification of the Comprehensive Plan. The issues specifically raised by Traffic Engineering and the Engineering Division of the Public Works Department have been clearly dealt with by the Environmental Review Committee. Again, the issues of access, road construction, and dedication for the P-1 channel. Both the Building and Zoning Department and Fire Department are concerned with the access and location for emergency services to the subject site. These concerns, with the unique location of the site, suggest that site plan approval is warranted for any future development. M. DEPARTMENTAL RECOMMENDATION: Ba;ed upon the above analysis, it is recommended that the rezone request, file R-377-84, be recommended for approval to the City Council subject to the condition that restrictive covenants be filed on the subject property that would rec uire: (1) a minimum front yard setback of 20 feet; and (2) site plan approval.
