BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT:received by the Examiner on July 23, 1984.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing was opened on August 28,.1984, at 11:00 A.M. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The following exhibits were entered into the record:
Exhibit #1 - Yellow file containing application and
other pertinent documents to this proposal.
Exhibit #2 - Site Plan of subject property.
Exhibit #2 - Elevation map for subject property
The hearing was opened and Roger Blaylock, Zoning Administrator was called upon to
present the staff report for this proposal. The Hearing Examiner questioned th
finalization of the short plat mylar, and the ownership of the property. Mr. Blayloc •
stated the applicant is the contract purchaser of the property with an unrecorde
contract. The applicant stated he thought the short plat had been filed but Mr. Blayloc
stated it had not been found. He stated that all of the approvals and deferrals have bee
granted for ;outside improvements. The Building and Zoning Department are waiting for
the finalization of the mylar. He said the site is part of a larger site under one ownershic
the Elks Cl 6 b); the present'zoning is B-1, with restrictive covenants. The roadway going
up from the site has a 14% grade which was approved by a variance granted by the PublicWorksDepartment. 'Road plans have been approved along Benson Road. The property i
located between 2 power liin;e 'locations., In the original approval of the rezone there was
requirement' that a minimum of 50% of the site be retained in natural vegetation unde
the power lines. This requirement was placed in the restrictive covenants for the subjec
site. It was' stated that parking does not comply and 5 additional spaces will be needed'.
There is a way the additional spaces can be provided close to the building on the same
level as the other parking, with only minor adjustments to the site design. Mr. Blaylock
stated the Fire Department wants to be sure the access roads are installed prior t
construction, and the grades are to be kept in an improved state so it is possible that
asphalt will'be applied to the grade to provide proper and safe access to the site. Mr.
Blaylock stated staff would recommend approval of the plan with modification of the site
plan to include five additional parking stalls and the filing of the short plat to be
accomplished prior to the issuance of a building permit.

The Hearing Examiner questioned the road stub shown on the site plan for future access
and inquired what the plan for that road would be. The Zoning Administrator stated the
Fire Department has a provision that whenever a commercial or other multi-family
facility is being constructed there must be two accesses to the site. The site on the S.E.
side would be for emergency access.

Testimony was called for from the applicant or his representative. Responding was:

Mr. Hancheroff replied to th Examiner's question regarding the road stub on the S.E. side
of the site. He said the south portion of the property is a parking area for additional
parking if it is needed, and, for possible future development on the property. He had
questions on the greenbelt area and the policy regarding the power lines, and what they
can or cannot do with more Of the acreage as to future greenbelts. The Hearing Examiner
stated that it was his understanding the power companies will keep anything growing
under the power lines very limited in height, and if need be, will come in and spray to
accomplish this end. He advised the applicant that he felt he could use his imagination,
within the confines of what the power companies may want, as to landscaping. The
applicant questioned why on the original short plat there was 50% useage of the site and
now it ;is -25%. Roger Blaylock explained to the applicant that when the short plat was
first completed there were' restrictive covenants which provided that a maximum of 50%
of the property could be developed to meet the intent of the greenbelt. Since that time,
the intent of greenbelts and ithe Comprehensive Plan have become more specific and now
states that greenbelts should'have a maximum of 25% development. With this proposal he
stated the applicant met both of those intents. Mr. Blaylock stated it would appear that
the underlying zoning would ,be the ruling characteristic because it is the implementation
of. the Comprehensive Plan et that time. Whether the new Comprehensive Plan would
force a lower use is questionable and speculative at this time as the Plan has not as yet
been adopted
There were no further comments from the Zoning Administrator, and no one else wishing
to speak for Or against the proposal. The hearing was closed at 11:13 A.M.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner- now makes and enters the
following:
FINDINGS:
1. The applicant, Robert W. Hancheroff, filed a request for approval of a site plan for
an approximately 6,788 sq ft professional office building.
2. The application file containing the application, the State Environmental Policy Act
SEPAi) documentation, the Building and Zoning Department Report, and othe
pertinent documents was entered into the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C,
1971, 'as amended), a Declaration of Non- Significance has been issued for th-
subject proposal by the Environmental Review Committee (ERC), responsibl
official.

4. Plans,for the proposal have been reviewed by all city departments affected by th
impact of this development.
5. There was no opposition to the subject proposal from any member of the public.
6. The subject site is located at 1600 Eagle Ridge Drive although access will be via a
driveway on Benson Road South.

7. The subject site was! annexed into the City by Ordinance 1547 in May, 1956, as
amended by Ordinance 1871 adopted in March of 1961. The site was rezoned fron
its original General) zoning to B-1 (Business/Commercial) in two stages. Ordinanc
2059 was adopted in October of 1953 while Ordinance 3442 was enacted in July o
1980. Two short plats were approved for the subject site but the first expired and
the second has not been recorded at this time. Without the formal recording of the
short ;plat the ownership interests remain unclear.

8. The map element of the Comprehensive Plan designates the area in which the '
subject site is located as suitable for the development of medium density
multi-family housing land greenbelt, but does not mandate such development
without consideration of other policies of the plan.
9. The applicant proposes developing a two-story office building to house a dental
practice. The building will be approximately 6,788 sq ft. The applicant proposes
five parking spaces I less than required, but analysis indicates that area for the
additional spaces is
lvailable. The building requires 33 parking stalls.
10. In conformity with covenants, approximately 50% of the site will be maintained in
natural vegetation. A driveway grade of up to 14% has been approved by the Board
of Public Works.
11. Detailed improvement plans were reviewed by the Board of Public Works when a
deferral was-granted.
CONCLUSIONS
1. The proposed site plan appears to serve the public use and interest. The two story
clinic will create additional employment opportunities in the city and will in-fill a
lot in a developed urban area which has supporting public services.
2. The building will be well integrated into the naturally landscaped site.
3. Preservation of the natural trees on the site will assure that the site is compatible
with the designation of portions of the site as suitable for greenbelt preservation.
4. The plans will have to be amended to provide the additional five parking stalls.
5. The short plat will have to be recorded as a condition of site plan approval.
Ownership is clouded and a building permit should not be issued for the subject site.
DECISION
The site plan is approved subject to the following conditions:
1. Increase the number of parking stalls to 33.
2. Recordation of the short plat prior to the issuance of any building permit for the
subject site

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before;September 20, 1984. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery off new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the 'Examiner's decision. This request shall set forth the specific
errors relied upon by such iappellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the jCity Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in the Finance Dejartment, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use decisions. This means that parties to a
land use decision may not communicate in private with any decision-maker concerning the
proposal. Decision-makers in the land use process include both the Hearing Examiner and
members of the City Council!
All communications concerning the the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to
openly rebut the evidence. Any violation of this doctrine would result in the invalidation
of the request by the Court.
The Doctrine applies not only' to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

C. HISTORY/BACKGRO 6 ND:
The subject site was annexed into the City by Ordinance #1871 of March 8, 1961,
and Ordinance #150 lof May 24, 1956, at which time it was zoned GS-1. The Elks
Lodge was constructed in 1967. A portion of the site not located under .the
power,ines was rezoned to B-1 by Ordinance #2059 on October 21, 1953. The
remainder of the site was rezoned to B-1 by Ordinance #3442 on July 16, 1980.
A short plat was approved on the subject site on May 27, 1980, by the Hearing
Examiner. The approval expired on May 27, 1981.
The applicant prepared a new application for a two (2) lot short plat on March 28
1983. I The short plat was approved by the City of Renton's Land Use Hearin
Examiner on June 91 1I983. (See file Short Plat-023-83, V-024-83.)

D. PHYSICAL BACKGROUND:
1. Topography: The site rises faily steeply from west to east.
2. Soils: Alderwood Gravelly Sandy Loam (AgC), 6 to 15% slopes. Permeability
is moderately, rapid in the surface layer and subsoil and very slow in the
substratum. Runoff is slow to medium and the erosion hazard is moderate.
This soil is used for timber, pasture, berries, row crops and for urban
development.
Alderwood Gravelly Sandy Loam (AgD), 15 to 30% slopes. Runoff is medium
and the erosion hazard is severe. The slippage potential is moderate. This
soil is used for timber and pasture.
3. Vegetation: The subject site is covered with deciduous trees, shrubs, and
grasses.
4. Wildlife: The existing vegetation on the site provides suitable habitat for
birds and small mammals.
5. Water: Water was not observed on the subject site during a field visit to the
site.
6. Land Use: The subject property is undeveloped.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are a mixture of undeveloped land, power transmission,
lines and rights-of-way, and some condominiums.
F. PUBLIC SERVICES:
1. Utilities:
a. Water: An eight-inch water main runs east-west on Eagle Ridge Drive
and a ten-inch water main runs in a northwesterly - southeasterly
direction in the easterly portion of the property.
b. Sewer: !An eight-inch sanitary sewer is located on Eagle Ridge Drive
and Benson Road.
c. Storm Water Drainage: Storm water drains into a man-made drainage
system for the area for which there are already easements.
2. Fire Protection: Provided by the City of Renton as per ordinance
requirements!
3. Transit: METRO Transit Routes #145 and #155 operate along Puget Drive
approximately 1/2 mile to the south of the subject site.
4. Schools:

impact on .the ;natural systems; however, the use of good . construction
practices can mitigate any adverse impacts.

5. Traffic: There is insufficient information to determine the impact on traffic
resulting from tenants in the proposed building.
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance and the State
Environmental Polic' Act of 1971, as amended, RCW 43-21C, a final declaration of
non-significance was I issued on August 1, 1984, by the Environmental Review
Committee.

L. DEPARTMENT ANALYSIS:
Robert W..Hancheroff, D.D.S., is applying for site plan approval to construct
a 6,788 square foot professional office building for his dental practice.
2. The building will be located on a parcel of approximately ±2.7 acres which is
still part of the; Elks Club property. Original approval of the short plat was
granted under file 023-83. The short plat will have to be recorded prior to
the issuance of el building permit for the professional office building.
3. The Environmental Review Committee has considered the site approval
application and issued a declaration of non-significance. The appeal date
expired on August 20, 1984.
4. The proposal a submitted complies with the underlying intent of the rezoning
Of property tio B-1, Business Use, which required restrictive covenance
maintaining at least 50% of the subject site in greenbelt and the intent of the
Comprehensive Plan which states that no more than 25% of the site shall be
paved or covered with impervious surfaces. The parking does not comply
with required standards under the municipal code and five (5) additional
parking spaces will have to be added to the subject site. These can be added
to the south of the building without creating major modifications to the site
design.
All of the off-site improvements have been deferred by the Board of Public
Works. The applicant has posted the necessary bonding based upon approved
street improvement plans for Benson Road South. In addition, the Board of
Public Works granted a variance to allow driveway grades upto 14%.

5. Various City departments have reviewed the subject proposal. Parks and
Recreation Department, Police Department, and Building and Zoning
Department have all recommended approval of the project, while the
Engineering E ivision, Policy Development Department, and Fire Prevention
Bureau have all recommended approval with conditions. The conditions of
approval by the various departments are as follows:
Engineering Divison:
1) Revise plans per comments.
2) Storm drainage plans to be on 22 X 34 inch original mylar and
submitted to the City after corrections have been completed.
Policy Devlelopment Department:
1) Site plan appears to be five parking stalls short of the 33 required by
code.
2) Several key questions regarding greenbelt policies were raised
recently regarding this area. These need to be delt with at this time.
3) Has the short plat been recorded?
Fire Prevention Bureau:
1) Fire j hydrants and access roadway shall be installed prior to
construction.
2) Maintain required turning radius for fire equipment (45' outside
radius).
The Traffic I Engineering Division has recommended to not approve the
proposal. They need a copy of the roadway channelization plans adjacent to
the Hencheroff site on Benson Road.
Based upon the roadway plans submitted with the application, 18 feet of
paving is being provided from the center line of Benson Road South to the
edge of the new curb on the subject property. Specific detailed improvement
plans were approved by the Public Works Department and a deferral of
off-site improvements was granted by the Board of Public Works.
6. The subject site is primarily encumbered with overhead powerlines and
associated landscaping typical of most greenbelts cannot be accomplished in
these areas. 1The applicant, therefore, believes leaving most of the site in its
natural state and placing a few ornamental trees along the accesses and
structure itself will provide sufficient landscaping.

M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the site plan approval, file
SA-085-84, be approved subject to the following conditions:
1. Modification of the site plan to include five (5) additional parking stalls to
meet code requirements.
2. Filing of the•short plat prior to the issuance of a building permit.

We find no corporation under the name Renton Lodge No. 1809 of the
Benevolent and Protective Order of Elks , Inc. on the list of active
corporations in the Office of the Secretary of State . If it is an
unincorporated association, title to real property so acquired
cannot be insured. A deed or contract to such association should
run to named individuals , as Trustees for Renton Lodge No. 1809
of the Benevolent and Protective Order of Elks , Inc.
NOTE 2 :
A satisfactory showing should be made of the authority of the
officers executing the proposed instrument on behalf of Renton Lodge
No. 1809 of the Benevolent and Protective Order of Elks , Inc.
Current Articles of Incorporation and By-Laws , if any, should be
furnished both for said lodge , and for any higher discipline or
organization to which it is responsible .
A. That the Board of Directors adopt a resolution recommending the
sale or mortgage and directing that it be put to a vote of the
membership.
B. That written notice of the meeting stating one of the purposes is
to secure approval of the Transaction to be given to each member,
in accordance with the Articles and By-Laws , but in no case to be,
delivered less than 10 or more than 50 days before the meeting.
C. That authorization at such meeting requires a two-third vote of
the membership present; and
D. That after such meeting the Board of Diredtors approve such trans-
action by appropriate resolution.
NOTE 3:
We call your attention to the fact that there is no recorded
easement providing access to the remaining land of the vestee after
the conveyance of the property herein described.
NOTE 4:
The sales price disclosed on the application is shown as tentative.
The premium shown herein is based on said tentative amount, and will
be adjusted when the correct sales price is disclosed.
NOTE 5 :
According to the application, title is to vest in Robert Hancheroff,
presumptively subject to the community interest of the spouse if
married. We find no pertinent matters of record against the name
of said party, however , the Company has been unable to search for and
does not insure against matters relating to the spouse, if any, which
encumber title to said property.
