As a result of staff review, this office believes that the traffic signal would. appear, in this case, to mitigate the adverse impacts of your project ' upon traffic circulation, and could serve to displace the original condition. While I now understand that your client would like to modify those conditions of the original approval, SA-099-84, pertaining to providing the 'an-type vehicles to mitigate environmental impacts of the project, the request does not include any justification for modifying those conditions. Taken together with your earlier letter of May 22, 1985, I might have concluded that in lieu of the van-type vehicles you have agreed to install the traffic signal at Edmonds, but it is not all that evident that such an agreement is apparent. I would therefre appreciate written clarification which I can submit to the Traffic Engineering Department for their review, per the earlier decision. Examiner: 0 behalf of Centron Corporation, , are writing to0requestsreconsiderationandelimination ©..the requirement that Centron provide two van-type vehiclesto the commuter pool as, one of the traffic mitigation measurs imposed on the Bright n Ridge Apartments project. Ci y of Renton staff (acting pursuant to Section 2 (aloftheBuildingCode) has additionally required that Cer-.}nf)install, at Centron's cost and expense, a traffic signaltheintersectionofNEThirdandEdmondsAvenueNE. Webelieverequiringthetrafficsignalforthisprojectisimproper. Nevertheless, the additional measure has beenrequiredasaconditiontoissuanceofthebuildingpermit.Because of the significant increased cost involved in sig- Ynalization, we respectfully request that Centron be relievedoftheyanpoolrequirement. Our request is based on thefollowingreasons. The traffic signal will benefit the entire surroundingareaandcommunitY. The need for it is not the result oftraffictobegeneratedbytheBrightonRidgeApartmentprojectonly. It is, therefore, not Centron's sole responsi-bility. In order 'to obtain a building permit, however,Centron is having to assume the full burden of providing thetrafficsignal. It is being provided in addition to manyotheroaf-site improvements required of Centron, includingthetot. l cost of improving Edmonds Avenue NE. Centron's development proposal is smaller than the priorapproveddevelopmentproposalfortheproperty, and isexpectedtohavefewerenvironmentalimpacts, includingdecreasedtrafficimpacts. Your prior Report and Decisionissuedohthelargerproposalforthisproperty (ECF-013-81) Mr. Fre J. Kaufman May 22, 1985 Page 2 concluded that the developer' s contribution for the traffic signal Should be only five percent (5%) based on traffic to be geneated by the project (Conclusion No. 4) . You also determi ed that it would be unreasonable to require that developer to provide the up front monies pursuant to a latecomers agreement, since the intersection serves extensive portions of the northeast part of the City and the benefit to the proposed development was only 5% (Conclusion No. 5) . These conclusions are based on the earlier, larger proposal for a 280-unit project compared to the present proposal for only 264 units. Yqur November 21, 1984 Report and Decision on Centron' s proposal specifically states that traffic impacts of their proposal do not appear to differ substantially from the larger proposal (Conclusion No. 4) . Yet, Centron is required to provide substantially increased mitigating measures. Centron is already required to expend approximately $300,000 in off site improvements and costs (more than was required of the pr4vious developer with a larger proposal) , and now Centro is being 'required to initially fund the entire cost of the traffic signal. In view of these substantial costs and mitigating measures now required to reduce the traffic impacts, Centron should not have the additional burden of providing vans for the commuter pool. The SEPA guidelines set forth limitations for imposing mitigating measures on development proposals . Specifically, Mitigating measures shall be reasonable and capable of being accomplished . . . " and "Responsibility for implementing mitigating measures may be imposed upon an applicant only to the extent attributable to the identified adverse impact of its prbposal. Voluntary additional mitigation may occur. " WAC 197-11-660 [1] [c] and [d] ) . At the time it was imposed, the van pool condition may have been a reasonable mitigating measure related to the traffic impacts of the development, but this was when this property was determined to have identified adverse impacts equivalent only to 5% of the cost of the traffic signal. Now, Centron is providing full funding for the traffic signal despite the smaller size of its development proposal. The van pool requirement is no longer a reasonable mitigating measure, nor attributable to the identified adverse impacts. We therefore respectfully request that the van pool requirement be eliminated. City staff has indicated to us that it supports this request to eliminate the van pool requitement in light of the traffic signal requirement. We respectfully request that we be given an opportunity at a hearing on this matter, if required, to present additional information as to why the van pool requirement should be eliminated. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on November 13, 1984, at 9:20 A.M. in the Council Chambers of the Renton Mu icipal Building. He began his review by stating the proposed site is designated on the'Comprehensive Plan as High Density Multiple Family. This request is a revision of the original proposal. The project is now a one-phased development. A short plat was also approved for this site but has not been recorded, and its approval will expire on July 1, 1985. The precious site plan lapproval required some improvements, and the applicant presently has a pending building permit which is still valid from the old site plan approval. Even with the approval of SA-099-84, the applicant would have an opportunity to build under the old building permit and site plan. There are 11 buildings in this proposal. Ther is a setback along the extension of Edmonds of approximately 77 ft.; along N.E. 4th Street of approximately 25 ft., and N.E. 3rd Street also has a 25 ft. setback. The buildings cover approximately 22% of the site; parking coverage is approximately 6% of the site and open space 42% of the site. ERC issued a declaration of non-signific nce with the!condition that the storm water retention system be designed so it recharges into the aquifer and the applicant is to participate in the amount of 5% toward the cos, of a traffic signal at the intersection of Edmonds Avenue N.E. and N.E. - 3rd Street. It was noted that the applicant is expected to complete the intersection of Edmonds Avenue N.E. and N.E. 3rd Street with 95% of the cost of the signal being refunded by a latecomer's agreement. Since the original decision, and this request, City statutes governing adjacent Toff-site improvements have changed, thus the need for the ERC conditions. CENTRON CO PORATION SA-099-84 November 21, 1 84 Page 2 Mr. Blaylock c ntinued stating construction plans for the extension of Edmonds Avenue N.E. east of the site are to, be approved by the Public Works Department prior to the issuance of a puilding permits Comparisons were made between the original proposal under the name of U.S. Homes and the current proposal as to off-site improvements, ' setbacks, and number of buildings/units. The Zoning Adminstrator stated the reason this application is back for consideration is there is no criteria to determine what is considered a "substantial change" in site plan approval, no administrative authority is suggested and the guidelines contained in the PUD ordinance are used. Staff comments focused mainly on off-site improvements and on-site recreational amenities. Discussions have been carried on since 1980 regarding the sight distance hazard. In 1971 and 1979 the City acquired 1/2 of the right-of-way for the Edmonds Avenue extension, so the City does have full right of-way for Edmonds Avenue at that location. It was noted by the Hearing Examiner that he subject site will not have direct access on to 3rd Avenue, it will be via Edmonds Aven e. The Zoning A ministrator addressed the land use concern regarding the location of Building K because it is only 25 ft. from a major arterial. He noted from the site plan that the rockery proposed did not state the height and advised the City does not accept a rockery that is over 4 ft. in height unless it is part of a retaining wall. He recommended approval of the plan with the,previous six conditons imposed on SA-010-81 which included a setback of 50 ft. from major arterials. The Hearing Examiner called for testimony from the applicant or their representative. Speaking for the applicant wails: John Phillips 2001 Western Avenue Suite #555 Seattle, Wa. 98121 Mr. Phillips reviewed the previous site plan submittal as it compares to the present plan. He noted such facts as the lower density of the units, the previous appeals on the N.E. 3rd St. and Edmonds Avenue street light and traffic in the area attributed to the proposal. Referring back to the traffic:light requirement at N.E. 3rd and Edmonds, he discussed the idea of the lat comer's agreement and the reimbursement schedule. He stated unless the developer is reimbursed from the latecomer's agreement within 3 to 5 years, they end up paying much more of the costs. Most developers would prefer to have an LID with the City. Mr. Phillips stated with this particular proposal, the developer is looking at 300-400,000. ih off-site improvements alone. He stated they are looking at sidewalks on N.E. 3rd and N.E. 4th Streets, improvements to Edmonds Avenue, street lights, two vans, metro passes, dhannelization! and feels this is a significant amount of money for just a 264 unit project. He reviewed ,some of the recommendations with respect to the site plan approval that ere suggested by staff, and also the Examiner's decision on the original proposal, beginiiing with the right turn only condition. Regarding recreational amenities, Mr. Phillips said the reason for the design change, reduction in units, etc. is really in response to a change in the economic market. The recreational amenities in this development are to be located indoors, thereby giving rise to the idea that they will be used more by he residents.' The setback from N.E. 3rd Street was addressed and Mr. Phillips pointe out that the Zoning Code provides a 30 ft. setback on a major arterial, and that is wha they believe is an appropriate setback. To address the concern of,noise it was proposed t at thee applicant will use extensive landscaping in the area between N.E. 3rd and the sou hern buildings as a buffer. The Hearing Examiner asked if the noise from the parking ar a diagonally across from Building K would be contributing to the noise in that building. fter consulting with the architect for the project, Mr. Phillips stated it is a function of the building itself, not the design of the building, to satisfy the noise requirements. He did suggest maybe it would be possible to extend the landscaping into a portion of the arking lot, thus eliminating one or two of the parking stalls, and thereby mitigate some f the noise concerns. Reviewing other conditions on,the previous site plan, Mr. Phillips stated as this is a one phase development he does noti feel the bonding should be required. The extension of sidewalks is no problem as it is felt this is an appropriate requirement. Mr. Phillips stated their objection to the requirement of having to put in the street light, and also be required to provide two 12 passenger van/pool vehicles as well as Metro transit passes for residents. He feels this is an excessive burden on a developer for a proposal this size. If required to put in the street light, he requested that the 2 vehicles and the Metro passes le deleted from the list of developer conditions. At this point the Hearing E1xaminerRenton called for further testimony in support of, or in opposition to t is proposal. Spieaking in opposition was: Ray E. Gervais. 98056 506 Windsor Wa Place N.E. Mr. Gervais st ted he has lid ed at the above location for over 25 years and watched the traffic proble s in the area increase. He feels if Edmonds Street is pushed through as shown on the site plan, there will be far too much traffic for that area. He feels the children and the school in that area should also be considered before opening up Edmonds Avenue as proposed. He asked that consideration be given to a change in plan for the traffic at 4th N.E. and Edmonds. i Calling for further testimony, ;responding was: I Ernie Tonda 528 Edmonds Avenue N.E. Renton, Wa. 98056 II Mr. Tonda has lived in the area for 30 years, and stated he is not against the proposed project itself, his concern is one of opening up Edmonds Avenue from 3rd to 4th. He understands the need for 2I entrances and exits from the proposal, but feels Edmonds should only be extended from 3rd to the property and the other entrance or exit approximately 200 ft. west oaf the intersection of 4th and Edmonds. The intersection right now is almost a blind intersection when you come from the north on Edmonds and make a right hand tur onto 4th because of the curve and depth of the grade in the road. He feels this is a very hazardous intersection now, and will be more so if Edmonds Avenue is opened up as proposed. Mr. Tonda questioned the fire department's comments regarding the need for this proposed extension on Edmonds. The Zoning Administrator stated to Mr. Tonda that the) Fire Department felt coming up Bronson St. and going past Group Health makes the response time much greater than coming up N.E. 3rd Street because of the grades in the streets. Using [the site plan, Mr. Tonda, formerly with the Fire Department, stated he felt responsel timeslwould be the same on the two routes he proposed. Speaking again, Mr. Ray Gervais questioned how wide Edmonds Street will be, and responding wasp the Zoning Administrator. He stated Edmonds Street will be 46 ft. wide after the extension - it is now 44 ft. wide. The Hearing Examiner advised he felt the matters of the streets, and the possibility of taking property from surrounding homeowners to widen the streets would best be addressed before the City Council. He advised Mr. Gervais that this site plan will not go before the City Council unless there is an appeal of the Decision Made from his office after today's hearing. He advised also that they could address the iCity Council by way of a letter. The applicant advised the project is currently in the beginning stages of construction, and should be further into construction byl February or March of 1985. Mr. Blaylock, Zoning Administrator commented on the 7 conditions attached to the original site plan proposal. Hei stated that after reviewing this new proposal for the same site it is felt that condition I67 regarding Edmonds Avenue N.E., should be 46 ft. by City design codes b t a latecomer's agreement could be requested. It is felt that conditions 5 and 6 of the a riginal decision) could be deleted; items 3 and 4 regarding sidewalks are appropriate and should remain, and conditions 1 and 2 regarding recreation and bonding should be deleted. He briefly reviewed the concerns regarding noise and the buildings setback 30 ft. from a major arterial. Building K will probably be the most expensive of the 11 proposed buildings due to the necessary soundproofing that will be needed, and he agreed the 30 ft. setback is appropriate if the developer includes substantial landscaping and berming above that which is required for the remainder of the project. He recommended approval with the suggested conditions set forth in the staff report. CENTRON CORPORATION SA-099-84 November 21, 1984 Page 4 1 1 '. Calling for further comments from the staff or audience, wishing to speak was: Bob Bergstrom I City of Renton, Department of Public Works I 200 Mill Avenue South- Renton, Washington, 98055 Mr. Bergstrom commented on the traffic signal at Edmonds Avenue and utilities. He feels the development is a good site for high density development from a utility point of view, has an excellnt water supply and sanitary sewers and infiltration system is adequate. The problem he wished to address was the transportation issue. This issue necessitated the condition iy the Public Works Department that sidewalks be extended east and west on N.E. 3rd; street improvements be made on N.E. 4th Street, and that Edmonds Avenue is extended thro l gh with a traffic signal in place on Edmonds Avenue and N.E. 3rd Street. He said he fel the traffic signal was the most important issue in this proposal and did not agree that the signal should! be deferred or waived because there is more and more development in that area and'1 the intersection of the proposed traffic signal is becoming more of a traffic hazard. He feels this is the only way to handle the current traffic in the area, plus the projected traffic from new developments, thereby providing residents with another way to go to work,' shop downtown, and alleviate the traffic congestion on Bronson Way. He feels it m'ay save lives in the long run if people are able to turn on and off N.E. 3rd at Edmonds Avenue where there is good sight distance, and far enough away from the Suns' t signal that a protected left turn can be installed. He requested the Hearing Examiner to approve the installation of a traffic signal as part of this proposed development. The Hearing Examiner again called for comments from the audience or staff. There being no one else wishing to speak, the hearing was closed at 10:30 A.M. FINDINGS, CONCLUSIONS & DECISION: 1 Having review d the record in this matter, the Examiner now makes and enters the following: li FINDINGS: I I 1. The applicant, Centron j Corporation, filed a request for approval of a site plan to allow co,struction of a 264 unit apartment complex on approximately 8.4 acres. 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered into the record as Exhibit #1. 1 3. Pursuan to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), and Environmental Impact Statement has been prepared for the subject jroposal. 4. Plans for the proposall have been reviewed by all city departments affected by the impact if this development. I 5. The subject site is located on the north side of N.E. 3rd Street, between 3rd and N.E. 4th Street, and west. of Edmonds Avenue N.E. if that roadway were extended. 6. Except for two areas 1 along the east and west boundaries of the site, the site is relativehr level. A majority of the site drains toward the north and N.E. 4th, while a smaller portion of the site drains to the southwest. 1 1 7. Douglas fir, shrubs and grasses exist on the site which was cleared under the original grade and file permit issued for the site. 8. The subject site was annexed into the City in June of 1956 by Ordinance 1549. The site was automatically zoned G-1 and R-1, both single family classifications, upon annexation. Ordinance 2029 adopted in May, 1963 reclassified the subject site to R-4 (High Density Multifamily Residential). 9. A special permit was sued for excavation in July of 1976 (SP-876-76) and a short plat (Short Plat-095-80)1 was approved in 1980, although it remains unrecorded. A site plan (SA-010-81) 'for a 280 unit complex was approved in September of 1981 and a bulding permit which is still valid was issued for that'proposal. i I CENTRON CORPORATION' SA-099-84 1 November 21, 1984 Page 5 10. An environmental appeal clarified participation in off-site improvements under the then ex sting City and State regulations. 11. The co pletion of the, now proposed development would decrease the number of units by 16, therebH decreasing the anticipated impacts of the proposal on population, schools land traffic. The current proposal would generate an approximately 660 person increase in population; add approximately 66 students to the school system; and increase traffic by approximately 1,610 vehicle trips per day. 12. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of high density multifamily development but does not mandate such development without consideration of other policies of the plan. 13. While t e water and sewer capacity is sufficient to serve the subject site, the area is in aIii sensitivedrainage basin and aquifer recharge has been suggested as an alternative to total diversion into a closed system. 14. The complete proposals will encompass 11 buildings covering approximately 22 percent of the site; paved parking areas would cover approximately 36 percent of the site; and total open space would approach 42 percent of the site, or approximately 3 and one half acres. 15. The ap licant proposees' an enclosed recreational facility containing racquetball court and other recreational amenities. The applicant agreed to provide a tot lot and picric area. A swi ming pool will also be located on-site. I1 16. The original report, as modified, and the Environmental Impact Statement still possess 'validity for the i new proposal and therefore those documents as applicable are adopted by reference. 17. The applicant has proposed modifying the setbacks along N.E. 3rd and N.E. 4th to comply with City standards of 30 feet. Setback from Edmonds Ave as proposed by the City would be approximatelyimately 77 feet. 18. Safety matters regarding the opening of Edmonds and turning movements onto 3rd will have to be addressed by the Police Department and the Traffic Division. i , 19. Questior1s regarding offsite improvements required by various City ordinances and regulati ns, the extent of those improvements, methods of finance, compliance and timing are not specifically part of this review nor is any decision made herein concerning them. 20. The applicant indicated that the distribution of Metro passes to familiarize occupants with mass, transit is usually only necessary for approximately one month. Such inducement is sufficient to acquaint patrons with Metro and its routes. 21. The applicant did not ,indicate any change which would negate the need to relieve traffic Congestion, which the contribution of "van pool" vehicles under the earlier approval was meant to address. The applicant only indicated that the economics of other requirements made the contribution of van pool vehicles unwarranted; contribu ions which the applicant indicated might well be challenged. 1 ' 22. The new proposal will be completed in one stage and therefore conditions relating to phasi g of the projects would be unnecessary. I CONCLUSIONS I 1. The proposed use appears quite similar to the earlier approved site plan, and subject tlo similar conditions should serve the public use and interest. 2. The reclamation of the old excavation site in itself is a reasonable proposal, and is especially so when coupled with a proposal generally compatible with the Comprehensive Plan. The 264 units will provide additional housing opportunities in an area already service4 by adequate utilities for water and sewer. The infilling of this urban area is preferable to forcing growth into areas without such services. 1 CENTRON C RPORATION SA-099-84 - November 21, 1984 Page 6 3. The location of the subject site astride two drainage areas makes the storm drainage questions morie cumbersome, but aquifer recharge could suitably serve the entire Site. Portions of the site naturally allow percolation to recharge into the ground and affect :the water table supplying- the Mt. Olivet Cemetery. A continuation of this , the is preferable, and the applicant, subject to review by the Department of Public Works, should use a recharge system for dealing with storm water and runoffil. 1 4. The traffic impacts oil the subject proposal do not appear to differ substantially from the prior proposal. The identified impacts of prior findings herein incorpor ated, regarding traffic, are still valid and therefore the conditions imposed do not ppear to be unreasonable. The trial period for monthly Metro passes can be modifi d since the record indicates a one month period can suffice to familiarize potenti 1 users with the advantages and disadvantages of mass transit. This system should not be limited to a specific monthly pass since new occupants generally could b expected to want to familiarize themselves with all aspects of their new locatio with reliance on automobiles during their initial occupancy. Therefore, one moths' passage;should be given to each adult occupant of the complex. Since occupancy of the entire 264 units will not be immediate, the passes should be given to all new occupants during the first year of occupancy. 5. The van pool arrangerrrn ent of the prior approval - conveyance of title to two (2) vehicle to the Commuter Pool - to mitigate the subject proposel's impact upon traffic as identified in the EIS as a potential mitigation method should stand. The applicant did not provide any justification to eliminate the requirement and the traffic impacts described in the EIS warrant the imposition of this condition. 6. The re reational amenities proposed by the applicant, an indoor complex with a racque ball court and separate pool, and supplemented by tot lot and picnic area appear, sufficient for Ion-site conveniences. Obviously the needs of 600 to 700 residen s will require additional amenities in the community. 7. The ap licant has agreed to abide by conditions requiring a linkage with existing sidewal s and provide continuous and safe pedestrian routes to Metro transit stops. Such sidewalk may, of necessity, extend beyond the ordinary boundaries of the subject site. DECISION I The subject p oposal for 264 dwelling units in eleven buildings is approved subject to the following con itions: 1. The provision of an indoor recreational facility which contains at a minimum a racquetball court; together with a minimum of such outdoor facilities as a swimming pool, tot lot and picnic area. 2. The provision of a sidewalk connecting the subject site via a continuous and safe series f pedestrian;, links to the Metro transit stops. Such sidewalk may, of necessi y, extend beyond the ordinary boundaries of the subject site. 3. The co veyance of title to two (2) van-type vehicles,acceptable to the Commuter Pool ag npy. 4. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from th date of the Examiner's decision. This request shall set forth the specific errors relied upon by such i appellant, and the Examiner may, after review of the record, take furtheraction as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the' City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirement . The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council; All communications concerning the proposal must be made in public. C., HISTORY/BACKGROUND: The subject site was annexed into the City of Renton by Ordinance #1549 of June 14; 1956J at which time the subject property was zoned G-1 (General Use) and R-1 Residential Single Family). This zoning designation was later changed from G-1 and R-1 to R-4, Residential Multiple Family with the approval of Ordinance #2029 on May 13, 1963. A special permit (SP-876-76) was granted to allow excavation of the site in July, 1976. Later, Short Plat' 095-80, was approved on the subject site in 1980 by the Hearing Examiner for phasing of the project: r PRELIMINARY REPORT TO __ 2i HEARING EXAMINER CENTRON: SA-099-84 NOVEMBER13, 1984 PAGE 2 Later, a site approval application (SA-O 10-81) was approved by the Land Use Hearing Examiner on September 8, 1981. The Board of Public Works granted a deferral on December 30, 1981, in two phases: (1) Edmonds Avenue N.E. to be completed by occupancy of Phase I; and (2) intersection improvements subject to resolution by the Hearing Examiner and covered by appropriate bonds. A short plat, Short Plat-040-82, was approved but has not been recorded. The short plat approval expires on July 1, 1985. D. PHYSICAL BACKGROUND: 1.Topography: The subject site slopes downward from northeast to southwest at grades between 5% and 16.5%. 2. Soils: Everett Gravelly Sandy Loam (EvD), 15 to 30% slopes. Soil type found in narrow areas along drainage ways or on short slopes between, terrace benches. Runoff is medium to rapid, and the erosion hazard is moderate to severe. This soil is used for timber. A large porticn of the site is part of a gravel pit. 3. Vegetation: The site consiste principally of scrub brush and weeds overlayering a sand and gravel surface with a few short to medium growth deciduous shrubs and trees present. 4. Wildlife: The existing vegetation may provide some habitat for birds and small mammals. 5. Water: No surface water was observed on the subject site. 6. Land Use: The subject site is undeveloped at this time. E. NEIGHBORHOOD CHARACTERISTICS: The subject site is west of the Vantage Point Condominiums and the undeveloped State gravel pit. South of the property is also vacant. The Puget Power transmission line right-of-way is adjacent to the west, while to the north is the Highbury Park development. F. PUBLIC SERVICES 1. Utilities: a. Water: Sixteen-inch water mains run north-south on Edmonds Avenue N.E. and east-west on N.E. 3rd Street adjacent to the subject site. b. Sewer: An eight-inch sanitary sewer extends northeast-southwest on Bronson Way N.E. within 1,000 feet to the southwest. c. Storm Water Drainage: Flows south and west to the Cedar River. Some upgrading of the system has been completed by U. S. Homes. On-site aquifer recharge is necessary. 2. Fire Protection: Provided by the City of Renton as per ordinance requirementsL 3. Transit: METRO Transit Route #110 operates along N.E. 3rd Street adjacent r to the subject site. 4. Schools: a. Elementary Schools: The Highlands Elementary School is within 3/4 of a mile to the north of the subject site. b. Middle 1Schools: McKnight Middle School is approximately 1-1/4 miles to the north of the subject site. c. High Schools: Hazen School is within 2-1/4 miles to the northeast of the subject site. d. Other: Renton Vocational Technical School is withih 1/2 of a mile to the east of the subject site. 5. Recreation: Windsor Hills Park is within 1/4 of a mile to the north of the site, while Cedar River and Liberty Park are within 3/4 of a mile to the southwest. Natural Systems:I Development of the site will remove the vegetation, disturb the soil land increase storm water runoff, traffic and noise levels in the area.. Application of proper development controls and procedures will help insure that t ese impacts are mitigated. 2. Population/Employment: Construction of 264 units would increase the area population by approximately 660 persons (2.5 persons/unit X 264 units). 3. , Schools: Approximately 66 additional pupils may be expected in nearby schools with completion of the proposal (.25 pupil/unit X 264 units). 4. ' Social: Increased opportunities for social interaction will be available with the introduction1of new residents to the area. 5. Traffic: The proposed development would generate approximately 1,610 additional vehicle trips in the area (264 units X 6.1 trips/unit). Additional information is provided in the Draft Environmental Impact Statement and Appendix C. J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, a final declaration of non-significance was issued on October 24, 1984 by the Environmental Review Commitee. The applicant, Centron Corporation, is requesting site plan approval to allow the construction of 264 multiple family residential units on an 8.4 acre site. The units will be evenly divided between one bedroom and two bedroom designs. A total of 11 buildings, in addition to the recreation building and swi ming pool, will occupy the subject site. 2. The Environmental Review Committee issued a declaration of non-significance on October 24, 1984, with the following conditions and informational notes: II PRELIMINARY REPORT TO E HEARING EXAMINER 1 CENTRON: SA-099-84 NOVEMBER 13, 1984 PAGE 4 Conditions: The storm water retention system shall be designed so that it recharges back into the aquifer. The applicant shall participate with 5% of the cost for traffic signal at the intersection of Edmonds Avenue N.E. and N.E. 3rd Street. Informational Note: The intersection of Edmonds Avenue N.E. and N.E. 3rd Street shall be completed by the applicant. Up to 95% of the cost of the signal can be refunded by latecomer's agreement. [RMC 4-103(A)(1)] Construction plans for the extension of Edmonds Avenue N.E., east of the subject site, shall be approved by the Public Works Departnient prior to the issuance of the building permit. 3.The subject site was originally considered and site plan approval granted in 1981 (SA-010-81) for U.S. Homes which proposed constructing 280 units on the subject site. This site plan approval review is required because it is a modification of a previous site plan approval (SA-010-81) which was a condition of the Mining and Grading Ordinance, Section 4-2303(2)(B) and (C). In 1976, Can-Am Properties under special permit (SP-876-76) was granted partial approval for excavation of the site subject to twelve (12) conditions. It appears that only six (6) of the twelve (12) conditions were complied with. U. S. Homes obtained a building permit which is still active under the previous site approval (SA-010-81). At that time, a series of appeals were heard by the Hearing Examiner concerning off-site improvements. This proposal is now governed by a series of different regulations in the Renton Municipal Code dealing with off-site improvements. The Building Official, Mr. Ron Nelon, decided that the amendments to the building permit were substantial and required a new site plan approval. The applicant did not appeal that decision and, in fact, applied for an new site plan approval. This was based upon the fact that even though the basic density of the project was reduced in scope, that the building locations, sizes, and elevations were all modified. PRELIMINARY REPORT tii'i THE HEARING EXAMINER CENTRON: SA-099-84 1 NOVEMBER.1 , 1984 1 PAGE 5' I It does not appear that there is a substantial difference in' the circulation pattern or function of the site and, therefore, the site plan approval should be granted based i on principal. However, there are some specific design q k estions that effect both on-site and off-site improvements that should be c refully evaluated and possibly conditioned. 5. U der Section 4-1103 of the Renton Municipal Code, off-site improvements will be required on adjacent dedicated public rights-of-way'at the time oftheconstructionofbuildingswithavalueofmorethan $25,000. Presently, NIE. 4th.Street and N.E. 3rd Street are public rights-of-way that are utilized as public streets. Edmonds Avenue N.E. is a dedicated public street without improvements. Therefore, under the above mentioned section, Edmonds 1AvenueN.E. would have to be improved by the developer, at this time. The 1 intent of the construction of Edmonds Avenue N.E. is well documented in the records. The west half was obtained in 1971, while the east half was obtained in 1979. In addition, the extension of Edmonds Avenue N.E., south of N.E. 3rd Street, is clearly designated as Item #28 in the City of Renton's Comrehensive 6!Year Transportation Improvement ' Program officiallyadoptedunderResolution #2558 on August 6, ' 1984. This clarifies the direction of .the City to assure that Edmonds Avenue N.E. as a through arterial street. The applicant has not shown off-site improvement plans for any of the adjacent public rights-of-way and the Environmental Review Committee has specifically noted that the applicant will have to provide those plans prior to issuance of a building permit. 6. Various City departments have reviewed the subject proposal. The Building I Division has recommended approval without conditions, while the Traffic Engineering, Parks and Recreation Department, Policy Development Department, Engineering Division, Utility Engineering Division, and Fire Department have all recommended approval with conditions. The following is a t reakdown of Those conditions and comments: i Traffic Engineering: 1. Off-site improvement plans required that include the following: a. Street lighting plans required for N.E. 4th Street, Edmonds Avenue N.E., and intersection of N.E. 3rd and Edmonds Avenue N.E. (to be installed per City standards, contact Clint Morgan, Traffic' Engineering Division for further information to meet standards). b. Traffic signal and left-turn channelization required at the intersection of N.E. 3rd Street and Edmonds Avenue N.E. 2. Driveway entrance is to be thirty (30) feet in width. 3. Applicant shell provide monthly METRO transit passes for residents to the homeowners' association in each phase of development. (This is a reiteration of the Hearing Examiner's conclusion on the initial proposal.) 4. The applicant is required to provide' title to two twelve (12) passenger van/pool vehicles to the commuter pool at the time the occupancy permit is' issued. (This is a `reiteration of the Hearing Examiner's previous decision.) Parks and Recreation Department: 1. Minor impact on nearby neighborhood parks. Will impact city tennis courts and athletic facilities. Proposed on-site recreation will not mitigate' irnpect on city park facilities. Dick Houghton had recently discussed the following development projects with Mr. John Phillipis1(tel : 467-7766). The following is summary of points discussed: 1 . CROWN Point - Original plan called for (2) access streets. ERC requested change - , one entry to be at Queen Ave. location. Proper- ty owner at that location refuses to sell . Crown Point developer is quite prepared to commit to future construction of Queen Avenue access (and closing of one of the original two) if property can be acquired by condemnation or whatever 2. THE TERRACE - Develloper was told he had to pay 100% of cost for new signal , then Hea,'ri'ng Examiner ruled that only 4% of cost applied. Since signal installation would thus be deferred, developer was told that as interim measure he would have to install channelization, etc. otherwise the "right-in/right-out" traffic pattern at Edmonds would be retained. Now I second application has been filed with.ERC (first one has not been cancelled) .; ,Question: what will happen with respect to signal installation requirement and apportionment of cost, ref. second application? At the request of City staff, the project proponent is investigating possible design solutions to mitigate impacts from creation oE this intersection. Preliminary] review of the situation, by the proponent, suggests several poslsible solutions including: 1. Proposed Edmonds Avenue be build from the projects southern access 'on Edmonds north to 4th Avenue N.E. This eliminates the proposed access to N.E. 3rd Street until such time as the intersection improvements are completed. 2. The Terrace property could be required to pay a proportionate share of the costs to fund intersection improvements including a signal if warranted. This could be funded through an LID or area wide project assessment. 3. A turn lane could be installed to serve the proposed inter- section on 4th Avenue N.E. The Terrace proponent could be accessed a fair share cost of the required improvements. We are more than willing to meet with the ERC to discuss these alternatives or others or any combination of the above.
