SA-103-84 LOCATION: Philip Arnold Park at 720 Jones Avenue So. SUMMARY OF REQUEST: Site Plan approval to allow construction of an auxiliary parking lot containing four parking spaces. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval. Hearing Examiner Decision: Proposed parking lot is approved. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT:received by the Examiner on November 6, 1984. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing w s opened on November 13, 1984, at 11:25 A.M. in the Council Chambers of the Renton Mu icipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, staff comments, and other documents pertinent to this request. Exhibit #2 - Site Plan The hearing was opened and Roger Blaylock, Zoning Administrator was called upon to review the staff report on this proposal. After entering the exhibits shown above, Mr. Blaylock stated this is a request for approval of an auxiliary parking lot, in a P-1 zone, to be located in Philip Arnold Park. The park is designated on the Comprehensive Plan as recreational acid on the zoning map as P-1. This proposal is exempt from the State Environmental Policy Act because the request is for less than twenty parking spaces. Currently parking is provided on the north side of the park adjacent to the Seattle pipeline right-of-way. The additional parking will be the first parking provided on the west side of the park. The proposed parking would provide access to the tennis courts and the existing playground equipment. Various department comments have stated there would be only minor impacts from this proposal, and recommended approval without conditions. Mr. Blaylock did q estion why the Parks Department did not put in the additional 4 parking spaces (for a otal of 8) at this time. He stated staff recommends approval without conditions. The Hearing Examiner called for testimony from the applicant or their representative. Responding on behalf of the Parks and Recreation Department was: Randy Berg City of Renton 200 Mill Avenue South Renton, Wa. 98055 Mr. Berg state the reason parking is being provided is because the neighbors along Jones Avenue have cobnplained of traffic parking in front of their homes, turning around in their driveways, and creating a nuisance. He advised that it is not felt that a great deal of parking is needed in that &alai, this area was selected because it is an area where they would not have to remove any trees; and in reply to Mr. Blaylock's previous question I City of Rent n, Parks ana 'rcecreation Department SA-103-84 November 15, 1984 Page 2 regarding the additional 4 spaces - Mr. Berg testified that the additional 4 spaces were not pursued et this time due to the grade of the site. There are rolling hills that drop steeply to the north, and rather than change the site, they decided on just the proposed 4 parking spaces that would not require extensive grading or create an impact on the area. He said the existing parking is enough to accommodate the users of the park, but people using the tennis courts would now have the proposed parking available as well as parents and children using the childrens recreational area close-by. He requested favorable consideration by the Examiner. The Hearing Examiner requested the record reflect that there was no one else in attendance, aid there were no further comments from staff. At this point he hearing was closed at 11:50 A.M. FINDINGS, CONCLUSIONS &.DECISION: Having reviewed the record' in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, City of Renton, Parks and Recreation Department, filed a request for approval of site plan for a parking lot containing four stalls, for Philip Arnold Park. 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), the subject proposal has been determined to be exempt from the threshold determination by the Environmental Review Committee (ERC). 4. Plans .4ir the proposal have been reviewed by all city departments affected by the impact Hof this development. 5. There was no opposition to the subject proposal from any member of the public. 6. The subjectject site is located along the southern boundary of Philip Arnold Park adjacen to Jones Avenue South. 7. The sit. was annexed into the City in February of 1961 by Ordinance No. 1871. The park site is zoned P-1 (Public/Quasi Public). 8. All development in P-1 zones is subject to a site plan review. 9. The pro osal would establish four parking spaces in an area of the park which has no off-street parking available. Patrons of the park are parking on local streets causing (congestion on the narrow dead-end streets. 10. The fou' stalls can be accommodated without removing any trees and without the need for substantial grading. Any additions would require more work and the possible loss of trees. 11. The map element of the Comprehensive Plan designates the area in which the subject site is located las suitable for the development of recreational uses, but does no mandate such development without consideration of other policies of the plan. 12. The parking will be near'the tennis courts and the children's play area. CONCLUSION 1. The subject proposal appears to serve the public use and interest. The four parking spaces will not appreciably detract from the park nor injure neighboring property. 2. The parking will, in fact, alleviate traffic congestion in the neighborhood immediately adjacent to the southern boundary of the park where parking has been a problem for park patrons approaching from the west. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the 'date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further ac ion as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be iled with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements,. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communication may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decis'on-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know tI a contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. HISTORY/BACKGROUND: The subject site was annexed into the City of Renton by Ordinance No. 1871 of February 28, 1961, at which time it was zoned GS-1 (a single family residential zone). The subject property was later rezoned to P-1, Public Use. D. PHYSICA BACKGROUND: 1. Topography: The subject site is relatively flat. 2. Soils: Arents, Alderwood Material (AmB). This soil type has been disturbed through urbanization and no longer can be classified as part of the Alderwood serias. The soil is moderately well drained. Permeability in the upper, disturbed soil material is moderately rapid to moderately slow, depending on its compaction during construction. The substratum is very slowly permeable. Available water capacity is low. Runoff is slow, and the erosion hazard is slight. This soil is used for urban development.
