APPLICANT: WILLIAM HUNT

LOCATION: Corner of Lind Avenue S.W. and S.W. 29th Street.
SUMMARY OF REQUEST: Approval of site plan to allow construction of a
building for the firm of Modern Manufacturing, said
building having 72,000 square feet for office,
manufacturing and warehouse use.
SUMMARY OF ACTION: Building and Zoning Department Recommendation:
Approval with conditions contained in staff report.
Hearing Examiner Decision: Approved with conditions.

BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on January 23, 1985.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing w s opened on January 29, 1985, at 9:05 A.M. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.

Exhibit #1 - Yellow file containing application, proof
of posting, and other information pertinent to this
proposal.
Exhibit #2 -- Site Plan
Exhibit #3 -- Elevation drawings
The hearing w-s opened, and after entering the above exhibits, Roger Blaylock, Zoning
Administrator, reviewed the report and comments from staff for this proposal. He
indicated this request is a portion of replated lot #7 of the Burlington Northern plat which
was revised in 1979. Full improvements are on-site and surrounding zoning consists of
light-industrial heavy-industrial and manufacturing park. The areas around the subject
site are in a eveloping pattern at this time. The applicant is also known as Modern
Manufacturing, a firm that has been in the area for several years. The employee count
will be appro 'mately 90. The proposal does not comply with parking requirements, and
parking provid d limits future modifications of the warehouse area into manufacturing
areas.
Mr. Blaylock continued with a review of concerns expressed by the Fire Department. The
Fire Department is concerned about the provision of a fire turnaround on the southeast
corner of the building. There is an existing fire lane on the north side of adjacent
property, and consideration c,ould be given to connecting the two fire lanes, or possibly to
providing a hammerhead turnaround in the southeast corner of the building site. The
hammerhead approach could materialize if the building was moved 10 ft. to the north. He
continued, commenting on the question of whether or not landscaping areas should be
reduced along Lind Avenue S.W. and S.W. 29th Street. The applicant shows 20 ft. of
landscaping with the City code only requiring 10 ft. When questioned by the Examiner as
to why staff takes issue witNthe applicant's provision of more landscaping than required --
Mr. Blaylock r Isponded that it was felt the landscaping would be better placed along the

southern pro erty line which would allow moving the building to the north to obtain the
necessary fine turnaround 'in the southeast corner. The building is designed to provide
limited parking for warehouse and manufacturing. If there is a move to additional
manufacturing which would require more parking, utilizing a double loaded aisle and 10 ft J
of landscaping would enable the applicant to move the building 10 ft. to the north to meet
the requirements of the parking ordinance. If the building were moved, the loading area
to the north would still be approximately 120 ft., which is necessary for a 55 ft. trailer rig',
to maneuver. The move would provide better landscaping, better parking on the south,
and addresses the issue of the emergency turnaround.
It was noted that the site plans for this proposal did not show the location of fire hydrants
or off-site landscaping that is required, and it was stated that the information would have
to be submitted at the time the building plans are presented for approval. Mr. Blaylock
referred to the South Valley area and the L.I.D. for that particular area and stated the
recent Comprehensive Plan indicated development in this area would be generating
approximately 130,000 vehicle trips out of the area. This will have a severe effect on
internal circulation. There]needs to be improvements to the roads in this area. The new
proposed arterial would offer another way to exit out of the valley. He explained the
rationale behind the suggestion by the ERC to assess a trip generation fee from a facility,
based on emp oyees. It was felt by the ERC that the amount of $22.88 per vehicle trip
should apply, per employee, as they are unable to use the square footage of the building
due to the va iance of footage in individual buildings. Mr. Blaylock completed his review
by stating staff recommends this proposal subject to the nine (9) conditions outlined in the
staff report to the Hearing Examiner dated January 29, 1985. He had no further
comments.,

The Hearing Examiner called for testimony from the applicant or their representative.
Wishing to testify was:

Mr. Sconzo stated the applicant has reviewed the recommendations contained in the staff
report and they are willing to comply with same. He questioned the proposed L.I.D. and
Mr. Blaylock ¶esponded stating the proposal is for a "special'\benefit area" and not an
L.I.D. Cumul tive funds are accumulated and a priority set for improvements: An
assessment wod be made at the time of actual construction. The funds in this instance
would be based on 90 employees making 2.04 trips per employee per day at a rate of
22.88. Responding to a question from the Examiner regarding the type of manufacturing
to be accomplished in this (warehouse, Mr. Sconzo replied they would be making metal
parts for Boeing Company and various computer companies. Calling for further testimony
in support of this proposal, responding was:

Mr. Hunt questioned the fees that may be imposed for vehicle trips, and the Hearing
Examiner resp Inded saying he does not feel his office has the authority to impose such
fees; and until some definite direction is given from the City Council and some policies
are set down, he may not recommend a fee for this project. Mr. Blaylock responded
adding that ev n though the Hearing Examiner feels his office does not have the authority
to impose this fee, the City Council may come back and create a policy that may request
this fee in a diferent form, such as a fee through the business license. At this time the
process is uncertain. Mr. Hunt feels his presence as a businessman in this area for some
time places a burden on him to pay for a street he has already contributed to, when
persons already in the area do not have to contribute.

FINDINGS, CO CLUSIONS &dDECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the
following:

FINDINGS:
1. The a plicant, William Hunt, filed a request for approval of a site plan for a 72,000
sq. fgot combination office, manufacturing and warehouse building on an
appro ately 4.34 acre site.
2. The a plication file 'containing the application, the State Environmental Polley Act
SEPA) documentation, the Building and Zoning Department Report, and other
pertinent documents,was entered into the record as Exhibit #1.

3. Pursuant to the City, of Renton's Environmental Ordinance and SEPA (RCW 43.21C,
1971, as amended), , a Declaration of Non-•Significance has been issued for the
subject proposal by, the Environmental Review Committee (ERC), responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. The su ject site is located on the southeast corner of Lind Avenue S.W. and S.W.
29th Street.
6. The subject site is relatively level and is undeveloped.
7. The subject site is zoned M-P (Manufacturing Park), a classification it received in
December of 1969. (Ordinance 2533). The property was annexed into the City by
Ordinances 1745, 1764 and 1928 adopted in April and May of 1959, and December
of 1961, respectively
8. The area in which the subject site is located has been sparsely developed up till
now. CAI ady Hardwoods is located immediately south of the subject site and Mystic
Corporation has just received site plan approval of property across S.W. 29 Street.
Other applications in the area are also pending review.
9. The building will be divided between approximately 20,000 sq ft for manufacturing,
approximately 40,000 sq ft for warehousing, and the remaining approximately
12,000 q ft for office use.
10. The bui ding will be approximately 18 feet tall, 300 feet long and 240 feet wide.'
11. The facility will employ approximately 90 employees. The plans originally
proposed 104 parking ,stalls whereas, 107 are indicated by the current plans. Staff
suggested relocation of the building 10 feet north to provide for emergency access
and additionally allow parking for 120 vehicles. The additional parking would
permit future modification of the facility, allowing the applicant flexibility
betwee office, warehousing, and manufacturing.
12. The pro osal is projected to generate approximately 2.04 vehicles trips per day, per
employe Overall increases in traffic in the Valley area generally defined as that
area so th of I--405,1 north of S.W. 43rd Street, West of SR--167 and east of
generally the West Valley Road are expected to reach approximately 130,000
vehicle trips per day. 'Such increase could result in an LOS (Level of Service) of F,
or very poor traffic flow into or out of the Valley.
13. Based upon the anticipated traffic of the subject site, staff has taken the position
that nevY development should pay a proportional share toward eventual area wide
traffic improvements. The costs of those improvements range from approximately
2 to 9 million dollars. This office has taken the position (See File SA--112--84)),
that the imposition Of such fees at this time is inappropriate without further
review by the City.
14. The Fire Department and staff have concluded that fire access to the south side of
the building is required. Therefore, the recommendation, agreed to by . the

CONCLUSIONS
1. The proposed plan appears to serve the public use and interest. The proposal will
compl with the Manufacturing Park standards for setback and landscaping and,
should present an attractive facade to passersby.
2. Development of the site will increase the tax base of the City. The utility,
infrastiucture is sufficient to accommodate the proposed use.
3. The incremental traffic impacts of the proposed use will not impact the overall'
level of service in the vicinity. The total of the traffic of the proposed facility
together with other development, will apparently affect the level of service. Until
policy s formulated Ito address the potential traffic problems of a build out of the
valley area, this office as indicated above, cannot impose conditions related to
traffic with a potential funding of anywhere from 2 to 9 million dollars.

4. The applicant has agreed to comply with access provisions required by the Fire
Department, and will also shift the location of the building north to provide not
only better access but increased parking.

DECISION
The site plan s approved subject to modification as agreed as follows:
1. The no hem landscaping will be shifted to the south property line.

2. Additional parking will be established south of the building which will be shifted
north 10 feet.

Pursuant to 1 itle IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before February 19, 1985. Any aggrieved person feeling that the
decision of t e Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new'evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from t1e date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the examiner may, after review of the record;
take further ction as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal e filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in t e Finance Department, first floor of City Hall.
The Appearafice of Fairness Doctrine provides that no ex parte (private one--on--one)
communications may occur concerning land use decisions. This means that parties to a
land use decision may not communicate in private with any decision-maker concerning the
proposal. Decision-makers in the land use process include both the Hearing Examiner and
members of the City Council.
All communisations concerning the proposal must be made in public. This permits all
interested parties to know,the contents of the communication and would allow them to
openly rebut the evidence. , Any violation of this doctrine would result in the invalidation
of the requests by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

G. DEPARTMENT.ANALYSIS:
1. The applicant, William.Hunt (Modern Manufacturing), is requesting site plan
approval to allow construction of a 72,000 square foot industrial building.
The building will consist, of 20,000 square feet of manufacturing, 40,000
square feet lof warehouse, and 12,000 square feet of office. Approximately
90 employee' are anticipated at the beginning of the operation.
Total employee counts can be evaluated on a yearly basis through the
business license process and subsquent increases in any manufacturing or
warehousing activity can be picked up and assessed at that time.
2. The proposals complies with the intent of the Manufacturing Park - Multiple
Option classification of the subject site and the specifics of the
Manufacturing Park Zone.
3. The proposall does not comply with the specific requirements for parking.
Only 104 parking spaces are provided and based upon the square footage
calculations is total of 107 will be required. In addition, the parking provided
limits future modification of the warehouse areas into manufacturing areas
and the site plan should be adjusted to allow for more parking spaces.
ISSUE
5. Various City departments have commented concerning the proposal.
Substantive comments have primarily been from the Fire Department in
reference to 'access and discrepancies with the building floor plan versus the
west elevation.
The issue is providing adequate fire turnaround on the southeast corner of the
building.
Presently, the adjacent development to the south, Brady International
Hardwoods, has an emergency gravel fire lane along its northern property
line. Access designed with a gate allowing emergency access between the
two sites could meet the intent. If this is not possible, a hammerhead
turnaround of approximately 100 feet by 40 feet could be utilized on the west
side of the loading dock area.
Final approval should be conditioned upon the Fire Department approving the
emergency access design on the south side of the building.

ISSUE
6. Should the landscaping areas be reduced along Lind Avenue S.W. and S.W.
29th Street and what benefit would it serve?
Reducing the 1 landscaping along Lind Avenue and S.W. 29th Street to 10 feet
would allow the building to be relocated 10 feet to the north and provide
sufficient area for emergency access for fire apparatus in the southeast
corner. In addition, it would provide enough space so that 10 feet off
landscaping could be placed along the southern property line and help blend
the project proposal to Brady International Hardwood site and in the Building
and Zoning Department's opinion this would meet the spirit and intent of the
Manufacturing Park Zone to provide a park--like setting for industriai.
Ievelopment. This 10 foot landscaped area along the southern property linewouldbecountedinwiththe5% internal landscaping required for the parkin
lot.

In fact, the redesign would allow the applicant to locate approximately 25
tLiew parking stalls on the south side of the proposed parking lot. Thi
redesign is probably better for the developer because it would allow th-
lexibility to convert internal space from warehouse to manufacturin ,
without the possible legal violation of the Parking and Loading Ordinance.

8. I also should be pointed out that the legal description shown on the plans is
not specifically correct. In 1980, the City of Renton approved under final
plat file, FP-069-80, a replat of lot 7 of Burlington Northern Orillia
Industrial Park 'of Renton, Division One. This parcel is subsequently known as
Pt rcel A of that replat.
9. Irl conclusion, the site plan needs extensive revisions to comply with City
codes and intent of the Manufacturing Park Zone. Off-site improvements
s1iould also be shown as part of the plans. The Examiner has the option of
continuing the public hearing so that the applicant can submit new plans or
approving the site plan with conditions.
H. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the Hearing Examiner
approve the site plan request, file SA-110-84, subject to the following conditions:
1. R location of the building approximately 10 feet to the north.
2. R duction of on-site landscaping along Lind Avenue S.W. and S.W. 29th
St
k eet to 10 feet.
3. Addition of 10 feet of landscaping along the southern property line, except
fo the area of emergency fire access.
4. In reasing the number of parking spaces to 120 to allow full conversion of the
building to manufacturing operation at some time in the future. (These
spices can be installed along the southern property line.)

5. Provide fire access to the southeast corner of the building per satisfaction of
the Fire Prevention Bureau.
