BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on January 22, 1985.
PUBLIC HEA NG: After reviewing the Building and Zoning Department
Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing was opened on January 29, 1985, at 9:45 A.M. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The following exhibits were entered into the record:
Exhibit #1 -- Yellow file containing application, proof
of posting and other documents pertinent to this
proposal.
Exhibit #2 -- Site Plan including landscaping.
Exhibit #3 -- Elevation drawings.
Roger Blaylock, Zoning Administrator, introduced the above exhibits and presented a
review of the Staff report. He stated the proposed building will be utilized for office and
warehouse use . Approximately 71,000 sq. ft. will be occupied by a warehouse; 6,000 sq.
ft. will be use as office space; and approximately 28,000 sq. ft. will be leased. This may
eventually be a joint tenant venture and may utilize the entire building. There are'
railroad rights-of-way to the south and west which will be buffered, but rail service to
the site will not be used. The property around the site is currently undeveloped, all public
services are vailable, and water and sewer were installed by Burlington Northern
Railroad as pa it of the plat.
Mr. Blaylock 9ontinued stating initially there will be approxiately 30 employees at this
site occupying the office and warehouse. It was noted that the Fire Department:
suggested that 5250 gallons of water per minute be provided for adequate fire flow. The
area currently carries a pressure of approximately 6,000; but the Fire Department still,
feels hydrant testing should be carried out. It was noted that fire flow requirements are
different for warehouses as compared to manufacturing and office space. The fire access'
on the south side of the building meets the required 20 ft. width. Traffic was discussed,
and Mr. Blaylock stated there may be a significant cumulative impact in the future. It
was noted that a warehouse will generate more traffic than a manufacturing facility
because in a manufacturing operation the material is shipped in, worked on and then
shipped out. Intl the warehouse, the turnaround of the product is much more rapid, creating
an increase inhe vehicle trips per day. It is estimated for this business that 128 trips per
day will be involved, based on the number of projected employees. Mr. Blaylock stated
the site plan meets the requirements regarding the loading doors, access for fire,
buffering, Comprehensive Plan, landscaping; and recommended the proposal be approved
subject to payment of a fee into a fund for the installation of traffic improvements in the
area.

The Hearing Examiner called for testimony from the applicant or their representative.

Mr. Mueller stated he agreed with the staff report as presented, but did ask fo
clarification on the fire flow figure used. Mr. Blaylock stated a previous test on the line
in the area `iad been done and the closest fire hydrant in that area showed a flow o'
approxiately 6000 gallons. The Fire Department is still requesting a flow test on the
nearest hydrant to the project to be sure there will be sufficient fire flow pressure whe
needed. Mr. ueller stated he had no further questions or comments.
Calling for f ther testimony in support of the application, there was no one else wishing
to testify, but the owner was in attendance and stated he would like to receive a copy of
the Hearing xaminer's Decision. He left his name and address for the record, as follows:

attendance w shing to testify. No further comments were offered from staff, and the
hearing was closed at 10:00 A.M.
FINDINGS, CONCLUSIONS & DECISION:
Having revieihred the record in this matter, the Examiner now makes and enters the
following:
FINDINGS:
1. The applicant, Reliable Distributors Inc., filed a request for approval of site plan
for an approximately 107,100 sq. ft. combination office and warehouse facility.
2. The application file containing the application, the State Environmental Policy Act
SEPA) documentation, the Building and Zoning Department Report, and other
pertinext documents was entered into the record as Exhibit *1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C,,
1971, ads amended), a Declaration of Non--Significance has been issued for the
subject proposal by the Environmental Review Committee (ERC), responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. The subject site is located at the southwest corner of Lind Avenue S.W. and S.W.
34th Stret.
6. The subject site is a level and currently undeveloped parcel approximately 5.15
acres in ize.
7. The map element of the Comprehensive Plan designates the area in which the
subject site is located as suitable for the development of manufacturing
park/m tiple option uses, but does not mandate such development without
consideration of other policies of the plan.
8. The subject site is zoned M-P, a classification adopted in December of 1969 by the
enactmeit of Ordinance 2533. The site itself was annexed into the City by
Ordinances 1745, 1764 and 1928 adopted in April and May of 1959, and December
of 1961, Respectively.
9. The applicant proposes using approximately three quarters of the facility for its
own war housing, leasing the remaining approximately 30,000 sq ft to other parties.
10. The app cant anticipates employing approximately 30 people. Warehousing traffic
is calcul ted at 4.26 trips per day per employee. The proposed use would therefore
be expec ed to generate approximately 128 trips per day.

11. The staff and ERC has recommended the imposition of a fee of $22.88 per vehicle
trip. This fee has been recommended in two previous applications. The response ofthisofficehasbeenthatspecificauthoritytoimposethefeehasnotbeapproved,
and a review by the City Council is necessary. See Files SA-110- 84 and SA- 112- 84
for a discussion of the issue.
12. The Fire Department has indicated that fire flow requirements for warehousing are
at le Est 5,250 gallons per minute, and this must be confirmed for the subject site
Previous analysis showed a flow of approximately 6,000 gallons available.
13. Staff has raised the subject of on- site maneuvering room but indicates that
sufficient clearance is provided for 55 foot trucks on the subject site. The
provisions of the code indicate that all maneuvering must take place on-site, and is
other rise a violation subject to citation.
CONCLUSIOINS
1. Aside from the traffic issue which cannot be fully addressed at this stage, the
subject proposal appears to serve the public use and interest.
2. The applicant will be adding to the tax base of the city by developing a raw site.
Utilities are available, although fire flow will have to be calibrated for the
proposed use.
3. The applicant will also lease space, providing an opportunity for a smaller
organization to locate in the Valley area, thereby providing a choice of locations
for another use.
4. The plan appears to comply with the requirements of the M-P zone and provides
landscaping, emergency access and parking as required.
5. Staff's concerns regarding maneuvering room should be studied. While
maneuvlering is not permitted upon the public right-of-way, if sufficient space is
not provided because the Code permits too large a building, enforcement may
present a problem. Staff should therefore review each application with reference
to on-site maneuverability. If clearance is not provided, the plan should be
modified accordingly.
DECISION
The site plan is approved subject to verification of the Fire Flow for warehousing, subject
to approval of the Fire Department.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must b-
filed in wriing on or before February 20, 1985. Any aggrieved person feeling that they
decision of a Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at th
prior hearin may make a written request for review by the Examiner within fourteen (14
days from the date of the Examiner's decision. This request shall set forth the specifi
errors relied upon by such appellant, and the Examiner may, after review of the record
take further ction as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal e filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in the Finance Department, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one- on--one)
communicatigns may occur concerning land use decisions. This means that parties to a
land use decMion may not communicate in private with any decision-maker concerning the
proposal. Decision--makers in the land use process include both the Hearing Examiner and
members of tie City Council.
All communications concerning the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to
openly rebut the evidence. Any violation of this doctrine would result in the invalidation
of the request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

1. Ut lities:
a. Water: A 16-inch water line is located along Lind Avenue S.W. and a
12-inch water line is located along S.W. 34th Street. Both lines are
located adjacent to the subject property.
b. Sewer: An 8-inch sanitary sewer line is located along Lind Avenue S.W.
adjacent to the east property line of the subject site.
c. Storm Water Drainage: Storm water drains into constructed storm
drains then into Springbrook Creek and the P--1 Channel.

G. DEPAR MENT ANALYSIS:
1. T e applicant, Reliable Distributors, Inc., is requesting site plan approval to
co struct approximately a 107,000 square foot building for a combination of
w rehouse and office uses. Reliable Distributors will utilize 78,280 square
fe t for their operation with the remaining 29,812 square feet proposed for
fu ure lease area. A total of 30 employees will be hired during the initial
st ges of Reliable's operation.
2. Th proposal complies with the intent of the Manufacturing Park -- Multiple
O tion land use classification of the Valley Comprehensive Plan and the
sp cific Manufacturing Park zoning designation.
3. Va ious City departments have commented on specific technical details. The
Fi e Department notes that fire lanes on the south side must be at least 20
fe t. The applicant has shown it at 24 feet. In addition, fire flows must be
at least 5250 gallons per minute. This will require specific tests of the water
lin s. It does appear from general testing in the area in 1982 that
ap roximately 6000 gallons is available. Other improvements will include
fir hydrants, side walks, and necessary street lighting.
ISSUE
4. T s project is identical in respect to nearby project for Mystic Company
S -112-84) in that cummulative traffic impacts resulting from this
de elopment and other industrial development projects should prompt the
He ring Examiner to apply specific conditions to provide funds for off;-site
tr ffic impacts. Should the Hearing Examiner use his authority to condition
la d use decisions to provide such mitigation?
Th• Environmental Review Committee has previously recommended to the
He=ring Examiner, that a special fund should be established to mitigate
cu mulative traffic impacts that result from the incremental development
of all physical construction within the Green River Valley south of I- 405.
Ba.ed upon the specific traffic analysis done in 1982 by U.R.S. Consultants
C. .G.-039-.80) and the update of that information dated December 27,
19:4, there is sufficient justification for the Examiner to exercise his
authority under Section 4-3014(B). This is also supported by the legal
authority in the case of Miller vs City of Port Angeles.
In calculating what monitary contribution should be acquired from this
specific developer, similar standards to those in the Mystic Company
ap.lication were, utilized. The case is slightly different in that the building
wo d be utilized for warehouse and not manufacturing. Based upon the ITE
ma ual, the average trip rate for warehousing is 4.26 trips per day per
em.loyee instead of 2.01 trips per day per employee for manufacturing
pr.cess. The applicant has stated that 30 employees will be used in the
op:ration. Applying the trip rate of 4.26 daily trips a total of 127.8 vehicle
tri Is would be anticipated from Reliable Distributors.

nfortunately, the lease area use is unknown and it may be either
anufacturing or warehousing at this time. The applicant has provided more
han enough parking to revert the building into manufacturing use instead of
olely warehouse use. The Environmental Review Committee originally
recommended,' based upon the calculation of necessary improvements in the
a rea and the ' anticipated traffic volume according to the Comprehensiv
Ian, that a trip rate of $22.88 per vehicle trip should be applied for th
pecific benefit area.
ISSUE
5. he City of Renton, in reviewing applications for site approval in the Gree
iver Valley, typically looks at on-site impacts and concerns such a
1 ndscaping, building height, setbacks, parking lots and, sometimes,

aesthetics. Approvel of a site plan does not necessarily stop at the physics
building. Often, the operational features of the business utilizing tha
tructure will, affect the site design. The issue of serious concern fo
peration in a manufacturing or warehouse area is generally the movement of
cks from the'public right-of--way onto the site and to the loading docks.
at should be, the minimum standard for on-site maneuvering space?
resently, there are no dimensional requirements for on-site maneuvering
s ace. However, projecting the worse case, a truck-trailer unit of
pproximately 55 feet would need between 110 and 120 feet of maneuvering
s ace from the dock door out to the street right-of-way to provide adequate
access. The Building and Zoning Department's concern is that as traffic
creases we do not want to introduce a lot of truck maneuvering on public
ghts--of--way or actually the storage of trucks on public rights-of-way. This
s to plan provides four of the ten project loading doors with sufficient area to
aneuver 55 foot truck-trailer rigs. Therefore, the site plan would appear to
b adequate to meet the specific needs of most operators.
e problem may not necessarily be a land use issue, but it is subsequently an
e forcement and possibly a public safety issue, if too much truck
aneuvering activity is conducted on the public rights-of-way.
6. conclusion, the application for site plan approval complies with the intent
a d specific details of the plans and ordinances of the City of Renton. The
o y real issue is the contribution of money to mitigate cummulative adverse
t affic impacts. 1
T e Building and Zoning Department has taken the position and will continue
t take the position that proportionate contributions for off-site
i provements that provide a general benefit in the areas of traffic or public
s rvices are necessary to continue an appropriate level of public service in
t e land use development process.
H. DEPA TMENTAL RECOMMENDATION:
Based pon the above analysis, it is recommended that the site plan approvel,
SA--111 .84, be approved subject to the one condition that the applicant pay a total
of $2, 24.06 into a special cummulative reserve fund for the installation of
area-wide traffic improvements.
