office space, and to add 110 new parking stalls on the
subject site.

BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on March 5, 1985.
PUBLI_C HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing was opened on March 12, 1985, at 9:05 A.M. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
I he following exhibits were entered into the record:
Exhibit #1 - Yellow file containing application, proof
of posting and other documents pertinent to this
proposal.
Exhibit #2 - Site Plan Map.
Exhibit #3 - Elevation Map.
The Zoning Administrator, Roger Blaylock, entered the above exhibits into the record, and
presented a review of the staff report. Mr. Blaylock stated the proposal is to make
modifications to a warehouse approved in 1979. The functions in the building would
change into office, manufacturing and warehousing operations. The site now contains one
building with a large vacant portion that will now be utilized. The modifications will be
to the eastern half of the building, with the western portion of the building to remain in
warehousing and office. On the far eastern portion of the building a new parking lot will
be built to contain 110 new parking spaces. Mr. Blaylock continued stating the site is 4.93
acres, with access directly onto S.W. 41st Street. Services are available to the site, and
fire protection is provided from the downtown station. He advised that the parking lot
will be the most visible change on the site. Parking requirements for the entire structure
would be 202 parking spaces, 207 spaces are provided. The only issue raised was the
question of shared parking and building facilities. It was felt that the potential problem
could be one where interior modifications were made without permits, creating more use
than demand, and ending up with insufficient parking available. This will have to be
checked on a permit-by-permit basis by the building inspectors in the field. The site plan
is consistent with the Comprehensive Plan. The Hearing Examiner questioned if the
streets in the area would be able to handle the traffic that will be generated by this
project. Mr. Blaylock replied the streets do have the capacity to handle the traffic.
Concern has been expressed by the ERC in the past regarding the increase in traffic in the
area, however, the City Council has not enacted a benefit area, and it is inconsistent to
recommend that one be imposed at this time.

The Hearing Examiner called for testimony from the applicant or their representative.
Responding was:

Mr. West advised that a large portion of the proposed office modifications will
accommodate showrooms for furniture products and the products of proposed tenants.
There will be approximately 80 employees in that end of the building supporting showroom
and office functions. There will be minimum retail sales in the building. He continued
stating the upstairs portion of the building will house the offices and executive personnel,
the downstairs will be mostly warehouse. Mr. West had no further comments.
Calling for further testimony in support of, or in opposition to the application, there was
none. Final comment from Mr. Blaylock was made regarding retail sales in the
manufacturing zone. He stated there is a consideration presently being submitted to the
City Council to eliminate retail sales in the manufacturing zone unless they are
supportive of the industrial area. Unless a business is vested by obtaining a building or
occupancy permit, the uses may change.
There being no further comments, the hearing was closed at 9:20 A.M.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS
1.The applicant, Property Management Systems, has requested approval of a site plan
to remodel an existing warehouse building in the M-P (Manufacturing Park) zone.
2.The application file containing the application, the State Environmental Policy Act
SEPA) documentation, the Building and Zoning Department Report, and other
pertinent documents was entered in the record as Exhibit #1.
3.Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.2IC,
1971, as amended), a Declaration of Non-Significance has been issued for the
subject proposal by the Environmental Review Committee (ERC), the responsible
official.
4.Plans for the proposal have been reviewed by all City departments affected by the
impact of this proposal.
5.There was no opposition to the subject proposal from any member of the public.
6.The subject site is located at 333 S.W. 41st Street, on the northeast corner of the
intersection of Lind Avenue S.W. and S.W. 41st Street.
7.The subject site was annexed into the City by Ordinance 1745 which was adopted
by the City Council in April, 1959, as amended by Ordinances 1764 and 1928
adopted in May, 1959 and December, 1961, respectively. The site was reclassified
to M-P, its current classification, in December, 1969 by the enactment of
Ordinance 2533. Grade and fill was authorized by special permit (SP-812-75) in
April, 1975. The subject site was platted in March, 1979 and site approval for the
original construction was approved in January, 1980, with supplemental
construction approved later that same year.
8.The map element of the Comprehensive Plan designates the area in which the
subject site is located as suitable for the development of manufacturing
park/multiple option types of uses, but does not mandate such development without
consideration of other policies of the plan.
9.The existing complex is approximately 125,000 sq ft. Two tenants will occupy the
structure. The existing tenant occupying the western portion of the building uses
approximately 66,000 sq ft of space apportioned between office (approximately
12,000 sq ft) and warehouse (approximately 54,000 sq ft).

10. The proposed remodel will result in a combination of office (13,331 sq ft),
warehousing (47,965 sq ft) and manufacturing (6,313 sq ft).
11. Parking for the proposed combination of uses amounts to a required 202 parking
stalls, whereas the applicant proposes providing 207 stalls, 5 more than necessary.
12. Staff raises concerns regarding the tenant mix and usage mix as those relate to
parking requirements and potential remodeling. While notification to the owner of
the potential problems of future modifications is justified, the mix and landlord
tenant responsibilities are beyond the concerns of the site plan review process.
13. Concerns regarding future parking adequacy must be handled by staff as building
modificatiions are proposed. A building modification should be no different for any
proposal - the floor areas of any use or mix of uses be it warehousing, office, retail
or restaurant must be evaluated and sufficient parking provided.
14. Save for the increase in parking stalls, all modifications will be to the interior of
the structure and will not affect the appearance of the building from the outside.
The parking lot will have to be appropriately landscaped and the 2% landscaping for
wildlife will have to be provided.
15. The applicant proposes utilizing portions of the building as a showroom for office
furniture and supplies. The Comprehensive Plan indicates that the area is not
entirely compatible with retail sales functions and while the model
display/showroom is not quite the same as retail sales the distinction is slight. The
proposed use will generate more ordinary passenger traffic than would the routine
manufacturing park use and conflicting heavy truck and passenger traffic could
result. The use for retail-like facilities will also result in land particularly well
suited to large warehouse and manufacturing operations being usurped for retail or
retail related uses. The M-P zoning currently permits such uses.
CONCLUSIONS
1.The site plan submitted by the applicant appears to serve the public use and
interest. The proposed remodeling will have a minimal impact on the existing
structure's appearance since, with the exception of parking, all remodeling efforts
will be directed at the building's interior.
2. The increase in parking stalls will serve both the proposed use and the existing
building. The staff report does not make clear whether the subject site has
sufficient landscaping. Therefore, as a condition of approval the applicant will
have to provide landscaping which meets the minimum requirements of the Parking
and Loading Ordinance and the requirements of the policy requiring 2% of the site
area for landscaping in mitigation for loss of wildlife foliage materials.
3. The proposed modification is compatible with the Comprehensive Plan which
designates the area in which the subject site is located as suitable for a variety of
manufacturing and support type activities although the proposed retail-like
operation may be somewhat at variance from the Comprehensive Plan.
DECISION
The site plan is approved subject to review of the landscaping of the subject site and
approval of the materials used, by the city's Landscape Architect.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before April 2, 1985. Any aggrieved person feeling that the decision
of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment,
or the discovery of new evidence which could not be reasonably available at the prior
hearing may make a written request for review by the Examiner within fourteen (14) days
from the date of the Examiner's decision. This request shall set forth the specific errors
relied upon by such appellant, and the Examiner may, after review of the record, take
further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in the Finance Department, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use decisions. This means that parties to a
land use decision may not communicate in private with any decision-maker concerning the
proposal. Decision-makers in the land use process include both the Hearing Examiner and
members of the City Council.
All communications concerning the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to
openly rebut the evidence. Any violation of this doctrine would result in the invalidation
of the request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

The only solution that we can offer is to maintain a permit by permit review
of required parking and designate those structures where common parking
may be a problem.
6.In conclusion, it appears that the site plan request is consistent with the
Comprehensive Plan and can be functionally implemented under the
limitations of the Parking and Loading Ordinance and the Manufacturing Park
Zone.
H. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the site plan approval, file
SA-014-85 for Property Management Systems, be approved.

G. DEPARTMENT ANALYSIS:
1.The applicant, Property Management Systems, is requesting modification of a
portion of an existing warehouse located at 333 S.W. 41st Street. The
modification would include creation of 13,331 square feet of office; 6,313
square feet of manufacturing space; and 47,965 square feet of warehouse
space. All of the improvements would be interior improvements except for
the associated parking.
2.The other portion of the building is composed of 12,000 square feet of office
with 54,000 square feet of warehouse space.
3.The proposal is consistant with the Comprehensive Plan designation of
Manufacturing Park - Multiple Option and the existing M-P (Manufacturing
Park) zoning.
4.Department comments focus primarily on providing detailed improvement
plans of the proposed modification.
5.The on-site improvements would include the construction of a new parking
lot. The proposed parking area complies with the minimum requirements for
landscaping and setbacks. Total parking for both facilities would require 202
spaces. A total of 207 parking spaces are provided.
Based upon the site plan for the entire facility, only 84 parking spaces are
provided on the half of the property presently occupied. A total of 96
parking spaces are required. On the east half of the property, where the
subject proposal is located, a total 123 parking spaces are provided. Only 106
parking spaces are required by the proposed development. The end result is
that the western half of the property is short in parking while the eastern
portion of the property is heavy in parking.
These do not appear to be separate buildings but joint tenants in one building,
possibly sharing all of the parking spaces.
ISSUE
The issue arises over shared buildings and shared parking. Should the City
require specific agreements to be filed that allows joint use parking in areas
of multiple tenants?
Presently, the Zoning Division looks at property based upon the legal
descriptions and what can actually be accomplished on the site. However,
the Building Department, in looking at tenant improvements, often looks at
the lease area designated on the site plan accompaning the building permit
application. In some cases, we have kept running totals of parking allowable
such as for the Koll Business Center or for Washington Technical Center.
The problem that could arise is that one tenant is allowed to improve to the
detriment of his adjoining neighborhood.

The only solution that we can offer is to maintain a permit by permit review
of required parking and designate those structures where common parking
may be a problem.
6.In conclusion, it appears teat the site plan request is consistent with the
Comprehensive Plan and can be functionally implemented under the
limitations of the Parking and Loading Ordinance and the Manufacturing Park
Zone.
H. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the site plan approval, file
SA-014-85 for Property Management Systems, be approved.

Purpose of Checklist:
The State Environmental Policy Act (SEPA), chapter 43,21C RCW, requires all
governmental agencies to consider the environmental impacts of a proposal before making
decisions. An environmental impact statement (EIS) must be prepared for allproposals
with probable significant adverse impacts on the quality of the environment. The purpose
of this checklist is to provide information to help you and the agency identify impacts
from your proposal (and to reduce or avoid impacts from the proposal, if it can be done)
and to help the agency decide whether an EIS is required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about your
proposal. Governmental agencies use this checklist to determine whether the
environmental impacts of your proposal are significant, requiring preparation of an EIS.
Answer the questions briefly, with the most precise information known, or give the best
description you can.
You must answer each question accurately and carefully, to the best of your
knowledge. In most cases, you should be able to answer the questions from your own
observations or project plans without the need to hire experts. If you really do not know
