APPLICANT: SHOHEN LIMITED PARTNERSHIP FILE NO. SA-017-85 LOCATION: 1420 Maple Avenue S.W. SUMMARY OF REQUEST: Site Plan approval to allow the construction of a two-story building containing 6,486 square feet of office space and 6,804 square feet of warehouse space. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approved. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on March 12, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on March 19, 1985, at 9:05 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting, and other documents pertinent to this application. Exhibit #2 - Site Plan. Exhibit #3 - Elevation Map. Exhibit #4 - Revised Site Plan. The above exhibits were entered into the record by Roger Blaylock, Zoning Administrator. He then proceeded with a review of the staff report stating this property is north of S.W. 16th Street, which is its primary access. The proposal is to construct a two-story industrial building to house office and warehouse facilities. The warehouse portion of the building will be only one story, approxmately 20 ft. in height, while the office portion will be two stories, with an approximate height of 23 ft. Parking will be along Maple Avenue on the south side of the parcel. Mr. Blaylock advised this proposal complies with the Comprehensive Plan and the ERC has declared the impacts as non-significant. Thirty-seven (37) parking spaces are provided, 38 are necessary. The additional parking space can easily be accommodated on-site. The Hearing Examiner asked Mr. Blaylock or the applicant if they cared to address the idea of reflection and/or glare onto I-405 from the windows in the building and whether or not it could be a problem. Mr. Blaylock stated the building will be mostly concrete and the glass should not be of a height where it will create a glare problem. He said the freeway in that area is higher than the building. He continued expressing concern that the applicant shows exactly the right number of parking spaces for the complex as proposed and the fact that the warehouse could be converted later on by another occupant to manufacturing which would change the parking requirement as well as the needs of the building. He wanted the record to show at this point, that some time in the future it may be necessary to deny a revision for this site. He wanted the applicant to be on notice that modifications could create a problem in the future. Wildlife mitigation area is not met, and the landscape plan could be modified to correct this concern. The ERC desires the applicant to construct half-street and sidewalks on the east side of Maple Avenue S.W. There will be system development charges for water and sewer, and the Fire Department requests the SHOHEN LIMITED PARTNEf [P SA-017-85 March 22, 1985 Page 2 sprinklering of the building because of its size. Upon reviewing the recommendation of staff, Mr. Blaylock requested approval of the proposal with the two conditions set out in the staff report. The Hearing Examiner called for testimony from the applicant or their representative. Wishing to speak was: Harold Nesland, Architect 450 Shattuck Avenue So. - Suite #105 Renton, Wa. 98055 Mr. Nesland submitted a revised site plan which was entered as Exhibit #4. He explained this site plan was revised to include 39 parking spaces; they have designated an area on the north side of the office structure (15 X 41 ft.) for the 2% wildlife mitigation required and will use a berry-type plants. They would like to keep the area to the east in gravel as proposed so upkeep can be kept to a minimum. Mr. Nesland advised the procedure used for increasing the parking spaces, and noted at some time in the future, should the use of the building change, they could use some of the truck turnaround space to provide an additional 7 parking spaces. He feels this proposal meets all city requirements, and had no further comments. The Hearing Examiner called for further testimony in support of or in opposition to this proposal. There was no one else wishing to speak, and no further comments from staff. The Hearing was closed at 9:27 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Shohen Limited Partnership, has requested approval of a site plan for a combined office/warehouse building. 2.The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5.There was no opposition to the subject proposal from any member of the public. 6.The subject site is located at 1420 Maple Avenue S.W., just southwest of the intersection of I-405 and Rainier Avenue. 7.The subject site is relatively level and is approximately 0.7 acres in size. 8.The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park/multiple option type uses, but does not mandate such development without consideration of other policies of the plan. 9. The subject site was annexed into the City by Ordinance 1745 which was adopted by the City Council in April, 1959, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December, 1961, respectively. The site was reclassified to L-1, its current classification in May, 1968. A site approval, together with a variance, was approved in March, 1984. The applicant has chosen not to act on that site approval and has applied for a new site approval. 10. The proposed building will contain approximately 6,486 sq ft of office space spread over two floors and approximately 6,804 sq ft of warehouse space on one floor. The warehouse will be concrete tilt up material approximately 20 feet in height. The two story office portion will be approximately 23 feet in height. The windows are not anticiapted to cause any glare problems along I-405 since the building is located below I-405's grade, and the windows themselves should not create any adverse glare. 12. The applicant proposes providing 39 parking stalls in response to staff calculations that the originally proposed 37 stalls was 1 less than required. The site will have one more than is ordinarily required. 13. Staff has placed the applicant on notice that the site plan utilizes the site to the fullest extent, and unless additional parking can be provided, no alteration to the structure will be permitted. 14. The applicant has proposed placing berry producing plants to the north of the proposed building to mitigate the loss of wildlife habitat and to comply with the 2% habitat replacement directive. CONCLUSIONS 1.The proposed plan appears to serve the public use and interest and appears to be more appropriately scaled to the site than the previous office building. It will blend in with the surrounding properties which range in height from one to two story buildings or equivalent. 2.The proposed building will increase the tax base of the City and provide additional employment opportunities in the City. It will also continue, and may hasten the trend toward redevelopment of the area. 3.The plan provides sufficient parking and the parking lot will be landscaped in accordance with the Parking and Loading Ordinance. In addition, the exterior of the building will be landscaped and habitat will be replaced to provide forage for wildlife. DECISION The site plan is approved subject to approval of the landscaping plan by the City Landscape Architect. ORDERED THIS 22nd day of March, 1985. FRED J. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. DEPARTMENT ANALYSIS: 1.The applicant, Shohen Limited Partnership, is requesting site plan approval to allow the construction of a two-story industrial building containing 6,486 square feet of office space and 6,804 square feet of warehouse space on a 30,408 square foot parcel. The warehouse section of the building will be constructed of concrete tip-up panels approximately 20 feet in height. The office portion of the structure will be two-stories with an approximate height of 23 feet. The exterior treatment of the office area will utilize corrigated metal siding with standard heat absorbing plate glass for windows. 2.The Environmental Review Committee issued a Declaration of Non-significance on February 27, 1985. No appeals have been received on the decision today. 3.The proposal complies with the intent of the Comprehensive Plan, land use classification for Manufacturing Park - Multiple Option, and the present L-1, Light Industrial Use zoning of the subject property. 4. The 37 parking spaces provided on-site comply with the dimensional requirements on the Parking and Loading Ordinance. Based upon exact calculations, the total of 36.96 parking spaces are required for the structure. However, the Building and Zoning Department does not generally combine the required parking calculations down to one hundredth of a space. Normally, the different uses of the building are calculated at the different ratios and are rounded to the higher figure. Therefore, we would calculate that 38 parking spaces should be required for the building. ISSUE: 5. Should the City approve site plans that are the maximum utilization under the parking and zoning codes and do not allow any flexibility for future use? The City reviews specific plans submitted for code requirements. In this case, the square footages as designated comply precisely to the specifics of the Parking and Loading Ordinance requirements for the number of parking spaces. In doing so, the architect has eliminated any potential modification of the warehousing space into manufacturing space. This has limited the future flexibility of the anticapated tenants or owners. PRELIMINARY REPORT TO T HEARING EXAMINE. SHOHEN L.IMITED PARTNERSHIP: SA-017-85 MARCH 1 ), 1985 PAGE 3 The situation may become an enforcement problem when the City refuses to issue occupancy permits to a business that would be manufacturing and warehousing. This situation may be resolved at the time it actually occurs by modifying some of the office space into warehouse space or other functions, or by providing additional parking, possibly on an adjacent lot. However, in any case, the applicant should be put on notice that only warehousing can occur in that section of the building. Reuse of the site will not require a new site plan approval. The underlying covenants associated with the rezone (R-426-67) only addresses development of the site. The site is not zoned in a manufacturing classification which would require future site plan approval by the City. Therefore, it is our believe, that the modifications to the building should occur at this time. The office portion of the building should be reduced to a maximum of 6,000 square, which would require 30 parking spaces, and the warehouse portion of the building could then be converted at some future date to manufacturing. 6. The on-site landscaping does not meet the minimum code requirements for 2% wildlife mitigation. This can be easily corrected by landscaping that area designated as being surfaced with crush rock along the northern property line. This was specifically recommended in the comments from the City's Landscape Architect. 7. The Environmental Review Committee, in their separate memorandum of February 27, 1985 to the Hearing Examiner, states that the applicant should provide off-site improvements consistent with those required for the previous development. Those would specificially include the construction of a half-street and the side walks on the east side of Maple Avenue S.W. 8. Various City departments have commented on the proposed project. Detailed plans for engineering and construction of on- and off-site improvements will be required as part of the building permit. The Fire Department notes that the buildings will have to be sprinklered because of its size, while Utilities Engineering Division notes that system development charges will be required for both water and sewer. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the site plan approval request by Shohen Limited Partnership, file SA-017-85, be approved subject to the fo lowing conditions: 1. Reduction of the office portion of the building to a maximum of 6,000 square feet. 2.
