SUMMARY OF REQUEST: Site Approval to allow the construction of a 28 foot wide hexagonal picnic shelter including a paved picnic patio, and the demolition of the old picnic shelter. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval Hearing Examiner Decision: Approved. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on March 26, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on April 2, 1985, at 10:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and other documents pertinent to this request. Exhibit #2 - Site Plan A review of the subject proposal was given by Roger Blaylock, Zoning Administrator. It was noted that this request is to demolish the old picnic shelter and construct a new 28 ft. wide prefab hexagonal picnic shelter, complete with a paved picnic patio. The project is within 200 ft. of the shoreline and will require a separate Shoreline Management Permit, which has already been applied for. The Comprehensive Plan designates the park as a public use facility, and it is presently zoned P-1. The only concern expressed was that a fire hydrant be located within 150 ft. of the facility. There being no further comments, the Hearing Examiner called for testimony in support of the application from the applicant or their representative. Responding was Randy Berg City of Renton Parks and Recreation Department 200 Mill Avenue South Renton, Washington, 98055 Mr. Berg stated he concurred with the recommendation of staff, and asked if there were any questions from the Hearing Examiner or staff. There being none, it was noted for the record that there was no one else in the audience and no further comments received from staff. The hearing was closed at 10:15 A.M. City of Renton, Parks and RGt.d.eation Department SA-020-85 April 11, 1985 Page 2 FINDINGS 1. The applicant, City of Renton, Parks and Recreation Department, has requested approval of a site plan for a picnic shelter in Liberty Park. 2.The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit it 1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5.There was no opposition to the subject proposal from any member of the public. 6. The subject site is located along the north bank of the Cedar River in Liberty Park. The site is located between Bronson Way North and Houser Way North. 7. While the entire park is approximately 12 acres, the structure is approximately 28 feet wide along its longest dimension. A paved patio will also be installed adjacent to the structure. 8.The subject site is zoned P-1 (Public) and all structures in the zone require site plan approval. 9.The proposed addition will replace a deteriorated old shelter recently removed from the site. 10. A Shoreline Management Permit will be required since the site is located within 200 feet of the Cedar River. 11. The structure will be hexagonal in shape and has been approved for installation by the Park Board. 12. The patio area will carry over the hexagonal motif in a plaza type of arrangement. 13. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of public uses, but does not mandate such development without consideration of other policies of the plan. CONCLUSIONS 1.The subject proposal appears to serve the public use and interest. The new structure actually replaces a well used but deteriorated picnic shelter. The design has been approved by the Park Board and should blend with the surrounding play area. 2.The design feature, a hexagonal shape, will be carried over to the laying of concrete for the adjacent patio creating a small plaza effect at the site. 3. Landscaping will remain along the water front site and will not have any impacts on the site. 4. The proposal for a picnic shelter in an existing park also is compatible with the Comprehensive Plan which designates the site for public uses. DECISION The site plan is approved. Warren, City Attorney Renton Record-Chronicle Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed in writing on or before April 25, 1985. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. G. DEPARTMENT ANALYSIS: 1.The applicant, the City of Renton, Parks and Recreation Department, is requesting site plan approval to allow the construction of a twenty-eight (28) foot wide hexagonal picnic shelter including a paved picnic patio adjacent to the structure. The facility will be within two hundred (200) feet of the Cedar River and a Substantial Development permit (SM-001-85) has been requested. 2.The proposal will also include new concrete plazas based on the hexagonal design system interfacing with existing concrete walks in the area. The proposal will replace an old picnic shelter that had basically deteriorated from use over the years. 3.The proposal complies with the intent and designation of Public Use designated by the Comprehensive Plan for Liberty Park. It also complies with the Comprehensive Park Plan. 4.The Environmental Review Committee has issued a Declaration of Non-Significance for the subject proposal. 5.Review of the proposal by City departments has yielded no apparent issues to be resolved. A fire hydrant will be located so that the facility will be within one hundred and fifty (150) feet of a fire hydrant. Some concern was expressed by the Building Division to require site plan approval of replacement of facilities and points to the waste in time and monies for such a review. H.
