Monnahan: I have reviewed your request for an extension of the permit issued in the above entitled matter .end must admit to some confusion. After a public hearing, which was continued to permit a thorough review, a permit was issued which was to have permitted compensating storage north of Grady Way. The facts at that time were well understood. Your property was south of Grady Way and south of I-405. fhe permit was issued, and under the permit, you remain entitled to fill your site as long as you remove an equal amount of material north of Grady Way. The material removed north of Grady does not have to be used on your site, but can be if it is consistent with fill standards. Of course, if the material removed is not to be used for fill on your property it will have to be disposed of in a location where it does not adversely affect tie compensation ratio. We would like to request an extension for the period through the end of June of 1986. The reasons for this request are shown below: 1) The property is in the process of being put under an option agreement and the optionee is planning on filling the property at some time in the near future. 2) The City Public Works Department determined after considerable research , which took them approximately three months , that our compensating storage material could not be taken from the area North of Grady Way and deposited on `our property but could be deposited on the adjoining Puget Power property North of Grady Way (per Bob Bergstrom) . As of this writing we have no agreement from the City in writing . We are in the process now of acquiring the fill and grade permit from the City Building Department and intend to have the optionee begin some filling work as soon as possible . We will do as much as possible to make progress on this fill and grade work given the weather conditions at this time of year. APPLICANT: SOUND STEEL FILE NO. SP-025-85 LOCATION: Located on the west side of East Valley Road at the 1600 block. SUMMARY OF REQUEST: Approval of a special permit to allow fill and grading on a 0.72 acre site with approximately 4200 cubic yards of material. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval with modifications and conditions. Hearing Examiner Decision: Approved. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT:received by the Examiner on May 7, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 14, 1985, at 9:40 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and other documents pertinent to this request. Exhibit #2 - Grading Plan The hearing was opened and the Zoning Administrator, Roger Blaylock, reviewed the staff report for this proposal, presenting the following information. The requested permit is for fill and grade of approximately .72 acre, with 4200 cubic yards of material. It was noted that the borrow pit to be used is located off S.W. 27th Street, which is the alignment for the P-1 Channel, on property owned by Valley Office and Industrial Park. The property is designated as L-1 on the zoning map and MP on the Comprehensive Plan. The applicant is proposing 2 alternative sites to obtain material to meet the intent of compensating flood storage. One site is on S.W. 27th Street and the second alternative is north of Grady Way in an area that has been previously excavated by METRO and is under a special permit with the City of Renton and King County. Mr. Blaylock continued with a review of staff comments which included the requirement of a bond for roadway clean-up, a systems development charge for water and sewer, and staff concerns over the borrow site located on S.W. 27th Street. Continuing on, Mr. Blaylock discussed the issues regarding borrow sites being functional as pertains to positive drainage; lack of right-of-entry to use property owned by Glacier Park Company and alternative mitigation for minor developments as opposed to an alternative for all developers to assist in meeting the requirements of storm drainage as required by the City. There is positive drainage to Grady Way with the next segments at 16th, 19th and 27th Streets which is such a long distance it really does not provide positive drainage for the site. At this point the Hearing Examiner advised he would like clarification as to what the ultimate aim is of the P-1 Channel, and which developers in the Valley must pay additional compensating storage, or, is the P-1 Channel suppose to provide protection for everyone in the Valley? Mr. Blaylock responded that the Channel is to provide protection for everyone in the Valley, with Phase I construction providing excess compensating storage. He said this applicant must provide additional compensating storage as the ERC believed the provision of storage should be equal for each site. The Hearing Examiner questioned if there would not be some point in time when an applicant would not have to provide compensating storage as the P-1 Channel would have been constructed. Mr. Blaylock responded explaining the need for outfall and the P-1 project which included storm drainage and wetland mitigation. SOUND STEEL SP-015-85 June 14, 1985 Page 2 The charge of $2.00 per cubic yard was discussed, and the Hearing Examiner at this this point stated he felt he must continue this application as there is no set standard to apply with respect to the forebay, mitigation measures and compensating flood storage policies as they apply to the P-1 Channel. He stated he wanted to have a policy from the ERC that would apply fairly to not only this application, but to all applications in the future. Although the Hearing Examiner advised he wished to continue the hearing for more information from staff, he called for testimony or comments from the applicant, or staff. Wishing to testify for the applicant was: Robert F. Monnahan P.O.Box 25191 Seattle, Wa. 98125 Mr. Monnahan stated he felt their small section of land was being penalized by all of the new requirements set out in the staff report, or by way of testimony from staff today, and did not understand why they did not meet the standards for wetlands or the 100 year flood plain. He requested the Examiner to consider the P-1 project on the segment north of Grady Way stating they will add to it, and did not feel the suggested $2.00/cu. yd. charge would be out of line. He stated they will not be affecting the channel as their property is so small they will not be taking much of the fill anyway. He agreed there should be a policy with regard to the Channel and the mitigation measures, but expressed disappointment that it had to begin with their small property. Further wishing to testify from the audience was: William Fetterley Austin Company 800 S.W. 16th Street Renton, Wa. 98055 Mr. Fetterley concurred with the applicant's frustration with the evolution of the P-1 Channel and compensating flood water issue. He suggested if there is any kind of a stockpiling of available compensating flood water storage areas, that his previous project for Valley Office and Industrial Park be considered as being "prior to" the application now being heard. He also added that the time frame being used to work out the problem of the P-1 Channel is beginning to impact projects they are proposing. He feels the City should develop a scheme as soon as possible to obtain the right-of-way for the Channel and use it for other projects that will be taking place in the Valley. The Hearing Examiner advised the applicant that he would like to continue the hearing for one month so staff can work toward the completion of the P-1 Channel problem. The date of June 4, 1985 was set. Calling for any further testimony from the applicant or further comments from staff, wishing to speak was: Chan Chou Stephen & Associates 913 So. 336th Street Federal Way, Wa. 98033 Mr. Chou wanted to express concern over what he felt was the instigation of a land acquisition program through a grading permit process and feels it is setting a dangerous precedent because the program would have city wide implications. He does not feel this is the proper avenue, and would like to see more thought and discussion go into a program that would meet the needs of the City and be fair to all parties concerned. Mr. Chou raised a question regarding the basis for the grading fee, whether it was to be charged against the volume below the 100 year flood plain or gross yardage, as their application is for 4200 cu. yds. and the yardage below the flood plain is only 920 cu. yds.. The Hearing Examiner acknowledged that Mr. Chou's concern was yet another issue that staff was going to have to resolve, preferably before the date of the continued hearing on this application. There was no further testimony and no further comments from staff. The hearing was closed at 10:05 A.M. SOUND STEEL SP-015--85 June 14, 1985 Page 3 CONTINUED HEARING - June 4, 1985: The hearing opened at 9:00 A.M. Parties wishing to testify were affirmed by the Examiner. The Zoning Administrator was called upon to summarize the application up to this point. Mr. Blaylock presented the review and used an area wide map to designate the fill site and the location of the proposed borrow pit. He stated the hearing was continued to provide staff with sufficient time to evaluate the problems surrounding the compensating flood storage issue in the valley. The issue not only involves the City, but the State and the Federal government. The Public Works Department was to present a report to the Hearing Examiner and the Building and Zoning Department has not received a written report from that department to submit to the Examiner as of this date. It was confirmed that there are provisions in the Valley Comprehensive Plan indicating that compensating flood storage should be provided either on-site or in alignment with the P-1 Channel. Calling for testimony from the applicant or their representative, responding was: Robert F. Monnahan P.O.Box 25191 Seattle, Wa. 98125 Mr. Monnahan 's comments included a request for approval and stated he does not know of any compensating storage within miles of their site; their property is so small in comparison to others around that the amount of fill they would be minimal. He stated it was his preference to use the secondary site which is north of Grady Way. When asked why he preferred that site, Mr. Monnahan replied that it is already open and being used by other contractors and is more desireable than driving back into the valley and digging a hole where the P-1 Channel may be later on. Also wishing to speak was: William Fetterley Austin Company 800 Southwest 16th Renton, Wa. 98055 Representing the Austin Company, owners of property in the area, Mr. Fetterley expressed disappointment in the fact the information on the P-1 Channel that was to be presented by the Public Works Department was not available. He stated they have filed an application to do essentially the same operation this applicant is proposing and believes it was in compliance with the desires of the Comprehensive Plan. Their application has been rejected for further study. He thought by attending this meeting today he would be obtaining some guidance for his application. He inquired if all of the areas the City has gained access to are available for flood water storage excavation and if secondary permits are required for excavation in those areas. He felt if a Resolution was presented by the City Council in this regard he did not want it to apply to only one property but felt it should apply to all applications caught up in the same situation. At this time the Hearing Examiner stated he wanted to convey his interpretation of the requirements for grade and fill and stated his understanding is that each site or separate parcel that is to be filled or excavated requires a permit. He also stated that staff is still reviewing the issue of positive drainage that had been raised at the previous hearing. He said if the site north of Grady Way is chosen for the excavation then there would be no concerns regarding positive drainage as the site would be part of an active channel. Any property south of Grady Way that would be used would only be a hole that would serve no function unless it was in alignment with the creek. Calling for further testimony from the applicant, or comments from the audience or staff, there was no one else wishing to speak. The Examiner requested Mr. Blaylock to work with Mr. Fetterley and staff to resolve the issue of "positive drainage". There was no further discussion. The hearing was closed at 9:25 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: SOUND STEEL SP-015-85 June 14, 1985 Page 4 FINDINGS: 1. The applicant, Sound Steel, has requested approval of a special permit to allow the subject site to be filled and graded with approximately 4,200 cubic yards of material. 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5.There was no opposition to the subject proposal from any member of the public. 6.The subject site is located on the west side of East Valley Road, just south of S.W. 16th Street. 7. The subject site is zoned L-1 (Light Industry). 8.The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of Manufacturing Park/Multiple Option office uses, but does not mandate such development without consideration of other policies of the plan. 9. The subject site was annexed into the City by Ordinance 1745 adopted in April, 1959, as amended by Ordinances 1764 and 1928, adopted in May, 1959 and December, 1969, respectively. 10. The applicant has proposed filling the subject site with approximately 4,200 cubic yards of material to prepare for eventual development and to bring the site and structures above the 100 year flood level. 11. The Green River Valley Comprehensive Plan indicates that any filling within the limits of the P-1 Channel drainage area be matched by excavating an equivalent amount of compensating storage. 12. The applicant has proposed alternative sites which could be excavated to provide the compensating storage. Staff recommended originally that positive storage which would actively contribute to the ultimate flood control measures being adopted in the valley be provided, rather than an isolated site which is not either tied into the P-1 system, or one which will eventually be part of the system but is not near any functional channel. 13. The applicant indicated that the site north of Grady Way would be a reasonable borrow pit for compensating storage because the area is already opened to construction, a permit for its excavation has been issued to the City, and it would provide positive drainage. CONCLUSIONS 1. The proposal to fill and grade the subject site subject to the condition of requiring the compensating storage area to be excavated from the same drainage basis appears to serve the public use and interest. 2. The fill and grade will permit the applicant to bring the site's elevation to a grade which will permit use of the site in a manner not subject to periodic flooding as it now occurs. 3. Eventual construction will increase the tax base and provide additional employment opportunities in the City. 4. The excavation of compensating storage in an area which is already serving as active storm drainage will further the project while also providing active retention. Therefore, the excavation should occur on that portion of the P-1 Channel for which the City has already issued a permit, in that area north of Grady Way. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. G. DEPARTMENT ANALYSIS: 1.The applicant, Sound Steel, is requesting a special permit to allow the filling of a .72 acre site with approximately 4,200 cubic yards of material. The property is located on the west side of East Valley Road, approximately the 1600 block. In addition, they would excavate from a borrow site on the south side of S.W. 27th in the alignment of the P-1 Channel. 2.The Environmental Review Committee has issued a declaration of non-significance for the proposed project. 3.The Policy Development, Police, Fire, and Traffic Engineering Departments have all recommended approval subject to the filing of appropriate bonding for roadway cleanup. This is a standard condition which is generally imposed either by the Police or Public Works Department, as needed. The Utilities Engineering Division notes that there shall be a systems development charge for both water and sewer in the amount of $2,522 and should be paid with the actual filling of the site. The Engineering Division of the Public Works Department and the Building Division of the Building and Zoning Department notes that the borrow site is a problem in both its location and the known calculation to show that compensating storage is actually provided. ISSUE: 4. Should the borrow site be functional as it relates to positive drainge? The Public Works Department states that the borrow site is not part of an existing positive drainage and therefore is not acceptable in this configuration. Plus, we do not know if the applicant has a right-of-entry to utilize property owned by Glacier Park Company. Their alternative borrow site may be acceptable because it is presently under the permits issued for Phase I construction, and it would be the next incremental addition to the P-1 Channel. However, that does not really mitigate since the SCS has already agreed to dig that portion of the P-1 Channel. Instead, it would be more appropriate to provide a different type of mitigation for the total P-1 Project. PRELIMINARY REPORT TO THE HEARING EXAMINER SOUND STEEL, SP-025-85 PAGE 3 ISSUE: 5. Should alternative mitigation be provided in cases of minor development or as an alternative for all developers in reaching the storm drainage solution as designated by the SCS in the City of Renton? The Environmental Review Committee has primarily said that compensating flood storage should be provided. In the SCS Eastside Drainage Project proposal two factors make up the total program. First is the item of storm water drainage, and second is wildlife mitigation. Presently, the City of Renton has excess storage capacity in the construction that is taking place in the P-1 forebay and channel north of Grady Way. However, the City has not acquired any additional property designated for wildlife and wetland mitigation. Specifically, the area of the Panther Creek wetlands should be purchased by the City in an on-going process. The issue at this point is whether instead of providing exact compensating flood storage, should the Examiner require the applicant to provide wetland mitigation. The Building and Zoning Department believes it is within the scope to the Hearing Examiner to require additional conditions of the applicant. This may be in the form of a contribution to a monetary fund for the purchase of wetland areas or an actual presentation to the City of property for wetland maintenance. Actual dedication would appear to be more appropriate, since there is not a specific fund established for the City to purchase portions of the Panther Creek wetlands. The applicant could obtain title or easement rights to a portion of property that's within the scope of the Panther Creek wetlands and transfer that easement or title to the City of Renton. 6.Since the Environmental Review Committee did not impose any specific conditions upon the proposal, the Hearing Examiner we believe has the authority to add additional conditions and, therefore, the appropriateness of the "contribution" whether it is in compensating flood storage or in wildlife mitigation is an appropriate discretionary power of the Hearing Examiner when considering a special permit for fill and grade. The Building and Zoning Department does believe that the Environmental Review Committee has probably not given the Examiner very much guidance in the situation, but we believe, on the other hand, the City Council with its adoption of the SCS project has provided some basic ground rules and direction for the administrative staff to evaluate. Renton, WA 98055 Reference: Sound Steel Dear Mr. Blaylock: Enclosed herewith is the application to fill a .72 acre site on the west side of East Valley Highway (see attached vicinity map) . The site is currently in the flood plain. The site will be filled level with adjacent street. The total fill required is 4200 cubic yards. Only 920 cubic yards of fill is necessary to fill the site to elevation 16, the 100-year flood plain elevation in the area. The preferred borrow site is in the P-1 channel just south of S.W. 27th Street. All of the site is lower than the 100-year flood plain in that area (elevation 17) . Therefore, an additional 3280 cubic yards of floodway is being excavated above what is being filled on East Valley Highway. The alternate borrow site is the existing permitted borrow area just north of Grady Way. If material is excavated from this area, again more than three times the floodway will be excavated than required to replace the fill site. The project is to fill the site approximately 4' to make it level with street and surrounding area. The site contains 31,500 s.f. and will be filled with approximately 4200 cubic yards of fill.
