APPLICANT: SOLLY DEVELOPMENT COMPANY FILE NO. SA-029-85 LOCATION: 4010 West Valley Road SUMMARY OF REQUEST: Site Plan approval to allow the construction of a tilt-up concrete building having approximately 55,000 square feet for office/manufacturing and warehouse use. The applicant has also applied for a shoreline substantial development permit. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approved with conditions. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT:received by the Examiner on May 21, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 28, 1985, at 9:05 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting, and other documentation pertinent to this request. Exhibit #2 - Site Plan with landscaping shown for subject site. Exhibit #3 - Elevation Map. The above exhibits were entered into the record by the Zoning Administrator, Roger Blaylock. He then proceeded to review the report from staff for this proposal stating the proposed building is located on approximately 3 acres of land, and will house office, warehousing and manufacturing uses. Property in the general vicinity of this site is also manufacturing, with undeveloped properties located to the south and west of the site. Public services are available to the subject property, with storm water drainage flowing into the Green River. Sewer service is provided approximately 250 ft. west of the property. Mr. Blaylock continued stating the parcel has direct access on to West Valley Highway, with no access to any other streets. The proposal within the building will include 4,000 sq. ft. of office space, 17,290 sq. ft. for manufacturing and 33,000 sq. ft. for warehousing operations. Parking requirements have been met by the applicant. The only issue raised was the matter of fire access completely around the building. It is recommended that the fire lane be located along the eastern edge of the property because of the distance between the two fire accesses along the south side of the building. Mr. Blaylock stated there were no other concerns expressed by the various City departments. Therefore, staff would recommend approval of the Site Plan subject to the placement of a fire lane on the eastern side of the proposed building. The Hearing Examiner called for testimony in support of this proposal from the applicant or their representative. Responding for the applicant was: David Kehle, Project Architect 1932 First Avenue, Suite #302 Seattle, Washington, 98101 SOLLY DEVELOPMENT L_. .PANY SA-029-85 June 4, 1985 Page 2 Mr. Kehle commented on the placement of the fire lane and advised the Examiner that the matter will be worked out with the Fire Department. The Examiner expressed his concern regarding the design of the building due to the Fire Department desiring access to the building within 150 ft. He questioned if by not moving the building slightly to the north, future expansion would be precluded. Mr. Kehle stated the lot is very narrow, with 20 ft. between buildings, with a building on the south side being located within 10 ft. of the property line. It was clarified that the setback requirement for M-P property is not required when an easement is provided for rail or water rights-of way. Mr. Kehle had no further comments. The Examiner called for further testimony in support of, or in opposition to the application. There were no further comments from staff. The Hearing was closed at 9:20 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS 1. The applicant, Solly Development Company, has requested approval of a site plan for an approximately 55,000 square foot building on an approximately 3 acre parcel. 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.2IC, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5.There was no opposition to the subject proposal from any member of the public. 6. The subject site is located at 4010 West Valley Road, and is located on the east side of the roadway, across from the Green River. 7.The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of Manufacturing Park/Multiple Option uses, but does not mandate such development without consideration of other policies of the plan. 8. The subject site was annexed into the City in April, 1959 by the adoption of Ordinance 1745, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December of 1974, respectively. 9. The site was rezoned to M-P ((Manufacturing Park) from its original G (General) zoning in July 1974 by the adoption of Ordinance 2870. 10. The proposed approximately 55,000 sq ft building will contain approximately 4,000 sq ft of office space; 17,290 feet of manufacturing space; and approximately 33,710 feet of warehousing space. The combination requires 61 parking stalls, and the applicant has proposed providing 72 stalls, or 11 more than are required. 11. The applicant has indicated that an expansion of the building may be planned for the future. The additional footage would be provided on the east side of the existing building. The applicant has, therefore, proposed placing a required fire access lane along the extreme eastern property line, approximately 90 feet from the building. The Fire Department has indicated the lane should be adjacent to the building now proposed. Depending upon the ultimate length of the structure, the Fire Department could require additional access. SOLLY DEVELOPMENT C PANY SA-029-85 June 4, 1985 Page 3 CONCLUSIONS 1. The subject proposal appears to serve the public use and interest. The design permits the applicant to develop an enterprise which will expand both the tax base and the employment base of the City. 2.The proposed complex and industrial facility are compatible with the designation of Manufacturing Park found in the Comprehensive Plan. The use is also consistent with the zoning of M-P. 3. Fire access will have to be re-analysed by the Fire Department. Access around and to the building will have to meet life safety requirements of that department, and will have to provide access which meets the current configuration proposed. Any future redevelopment will also have to meet continuing emergency provisions. DECISION The site plan is approved subject to approval of the easterly emergency access by the Fire Department. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. I have contacted Mr. Jim Mathews, Fire Marshal , and discussed fire access problem. The solution approved was to provide a paved 20' fire lane on the east side of the property. The impact is to reduce the expansion 2,600 s.f. Phase I is not changed. I also contacted Mr. Jim Hanson, Asst. Building Director, whose concern was allowable area. The building will be of III-N construction, sprinklered with an area separation at the expansion if necessary. He just wanted to make me aware of the areas. The applicant proposes the following breakdown of uses internal to the structure: Office space, 4,000 square feet; Manufacturing space 17,290 square feet; Warehouse space, 33,710 square feet. Based upon the above calculations, a total of 61 parking spaces would be necessary for the approximtely 55,200 square foot building. Seventy-two parking spaces are provided. 5. Various City departments have commented on the proposal. The Policy Development Department along with the Traffic Engineering and Engineering Divisions of the Public Works Department, and the Parks Department have recommended approval. The Utility Engineering Division is reserving judgment subject to the Fire Department requirements. ISSUE: 6. The Fire Department has stated that per code requirements, even though the building has a sprinkler system, that they must have access to get around the building. The applicant's plans submitted on April 3, 1985, do not comply. A fire lane will be required at the eastern end of the proposed building. This will modify the expansion potential of the subject site as tentatively anticipated by the applicant. In fact, it could preclude expansion under the existing City Code. The issue originally raised by the Building Division has been clarified by the applicant in the type of construction that will be utilized. This was instrumental in the Fire Department's decisions on access surrounding the building. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the Hearing Examiner approve the site plan request by Solly Development Company, Inc., file SA-029-85, subject to the condition that the fire lane be moved to the eastern edge of the b_ilding per approval of the Fire Deparatment.
