Austin Company is in need of a conclusion to this in order to conduct their business. We understand this and want to assist if we are able. I have talked to Mr. Houghton about the timing. We are not able to agree fully with your proposals, as stated in your letter of June L4, 1985. The additional meetings with FEMA may resolve or make more clear what latitudes could be allowed to the City. Keep in mind what comes of all of this must meet the Hearing Examiner's standard for approval but first, the Environmental Review Committee must also find no significant impacts and that has not happened as yet. Based upon the comments that have been received from various city departments and the plans themselves, they believe that the proposal is environmentally significant. It is significant for the following two reasons: 1.Tre plans do not comply with the approved cross-section diagrams for the P-1 Channel in this location. 2.It would not meet the intent of providing compensating storage under the total Eastside Watershed Project. Instead, they believe that the work on the P-1 Channel and the drainage system is really at a new phase with the completion of the P-1 Forebay and the channel south to Grady Way. It is their position that there are new grounds for discussion concerning the actual requirement of cubic foot for cubic foot for compensating flood storage. Specifically, the Eastside Watershed Project includes various levels of mitigation for the entire program. Therefore, the Committee believes that the Austin Company can present a new program which would allow the excavation of the area under their control for the P-1 Channel to the configuration of the P-1 Channel with either an agreement to: (1) provide additional compensating storage at the time the ground becomes available in the future; (2) provide additional wetland for wildlife mitigation; or (3) provide funds for the acquisition of additional right-of-way for the P-1 Channel or acquisition of mitigiting wetlands. Fetterley May 1, 1'985 Page 2 We realize that the program that was presented under special permit SP-030-85 represents a tremendous financial cost to the Austin Company and subsequently the underlying developer. That cost is a result of having to extract materials that are saturated with water below the water table. The ERC would like the Austin Company to present a proposal that would address their properties in the Valley and how compensating storage could be provided. This gives the Austin Company a large degree of flexibility within the above suggested guidelines. The Environmental Review Committee, therefore, will not to take any action on the pending special permit until the Austin Company reevaluates their position as it relates to their total land holdings within the Green River Valley.
