SUBJECT.. DEVELOPMENT OF TRACT 'Bs OF SPRINGBROOK TECHNICAL CENTER
The ERC i:onditions at the time of plat approval required the dedication and construction
of Oakesdale Avenue (2 lanes) along the west side of Tract 'B' from S.W. Seventh Street
to S.W. Grady Way prior to the development of Tract 'B'. Development of the parcels
adjacent t) Tract 'B' by First City Equities and Holvick, deRegt and Koering (HDK) have
been short of parking spaces on existing lots. In order to accommodate proposed parking,
lot line ac justments have been approved in which a portion of Tract 'B' is added to the
adjacent lbs. These lot line adjustments for parking lot areas raised the question of
whether O,Ikesdale needed to be constructed.
On October 30, 1985, the ERC upon review of a new traffic analysis determined that "...
parking lots can be constructed on Parcel B without the implementation of the condition
to constru':t Oakesdale Avenue. This interpretation does not include the construction of

SUMMARY OF REQUEST: Site Plan approval to allow construction of four
one-story tilt-up concrete and glass store front
buildings totalling 85,200 square feet, for office and
warehouse use, on 6.5 acres.

BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on July 30, 1985.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing was opened on August 6, 1985, at 9:55 A.M. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The following exhibits were entered into the record:
Exhibit #1 - Yellow file containing application, proof
of posting and other documents pertaining to this
application.
Exhibit #2 - Site Plan
Exhibit #2 - Revised Site Plan
The hearing opened with the above request being reviewed by Roger Blaylock, Zoning
Administrator. The following information was presented. On approximately 6.5 acres of
property the applicant proposes to build 4 one-story buildings totalling 85,200 sq. ft. of
warehouse and office space. These are two platted lots and sole access is from Powell
S.W.. Mr. Blaylock offered 6 Site Plan review criteria to be discussed for all Site Plan
proposals, in an effort to be consistent in the review process. The matters to be reviewed
are compatibility with adjacent structures; complaince with the Comprehensive Plan and
Zoning Code; access, functionality of a parking lot; traffic and pedestrian circulation.
Mr. Blaylock reviewed staff comments in the 6 areas noting the Site Plan does not show
how it will intertie with adjacent manufacturing developments by providing pedestrian
corridors linking the buildings. The parking lot is designed for the maximum amount of
parking spaces but the Site Plan is not specific with dimension requirements and does not
allow for conversion of warehouse space. It was noted that all of the buildings in the
previous development at Washington Technical Center have been converted from
manufacturing and warehousing to office due to demand, and there is no adjacent land left
that is useable for access or parking for the future. This statement was placed into the
record to put the applicant on notice that they may have problems with future expansion
proposals.
Continuing with the review it was pointed out that the plan meets the intent of the
Comprehensive Plan and Zoning Code, but there is not much outside open space provided
for people. It is felt this matter needs to be addressed more in depth by the applicant.
Mr. Blaylock stated the Fire Department expressed concern over the emergency access
and circulation matters and the Utility Engineering Department is concerned about water
and sewer plans for the proposed site. It is the belief of staff that the application should
be continued to permit the applicant to prepare and submit more specific plans to show
pedestrian circulation, specific parking layouts, and compliance with

on-site circulation for emergency access. He stated the Building Department would
withhold a final recommendation until the applicant made his presentation to the
Examiner this date.
Calling for testimony in support of this application from the applicant or their
representative, speaking was:

Mr. Maehlum submitted a revised Site Plan as an exhibit. He advised the Examiner that
the applicant has tried to provide the pedestrian circulation and interties as recommended
by the City. He stated all the buildings have sidewalks along the frontage and provide
pedestrian connections through the parking lots to the buildings. He reviewed the traffic
circulation shown on the new site plan and feels as now proposed is adequate, with future
access points also shown. Circulation on-site is around all buildings, and the access does
comply with the Fire Department requirements as pertains to width and turning radius.
Mr. Maehlum referred to accessibility and the open space as referred to in the
Comprehensive Plan. Landscaping is more than required by City code and reference was
made to a retention pond on the original Washington Technical Center development that is
now located on the First City Equities property. Mr. Maehlum stated if the City would
like to recommend additional features on the site that are not now shown, the applicant
would be willing to consider them so they may move ahead with this proposal.
The Hearing Examiner called for further testimony in support of the application. Wishing
to speak was:

Mr. Davis testified that the applicant will have no problem with the City's
recommendation to provide pedestrian corridors and traffic circulation. They are in the
process of completing final drawings for this proposal and requested approval of this Site
Plan as revised. Mr. Davis commented on open space developments and feel they have
provided additional landscaping above what is usually seen in comparable projects within
the City. He indicated at the time the Washington Technical plat was approved, 17 acres
of the P-1 Channel retention pond was dedicated to the City and will also become open
space.
Calling for further support for this application, there was none. There was no one in the
audience wishing to speak in opposition to this application. Comments from staff were
received from Mr. Blaylock advised that staff would now recommend approval of this
project subject to the Fire Department approving the turning radius provided. It was
clarified that future access could be obtained through Lot #1, currently owned by the
applicant. It is felt the concerns of staff have now been met with the submittal of the
new Site Plan.
The Examiner again called for testimony from the audience or general comments from
staff. No one else wished to speak, the hearing closed at 10:15 A.M.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS:
1. The applicant, Holvick, deRegt, Koering, has requested approval of a Site Plan
which includes four one-story tilt-up concrete and glass store front buildings.
2. The application file containing the application, the State Environmental Policy Act
SEPA) documentation, the Building and Zoning Department Report, and other
pertinent documents was entered in the record as Exhibit #1.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before August 26, 1985. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in the Finance Department, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use decisions. This means that parties to a
land use decision may not communicate in private with any decision-maker concerning the
proposal. Decision-makers in the land use process include both the Hearing Examiner and
members of the City Council.
All communications concerning the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to
openly rebut the evidence. Any violation of this doctrine would result in the invalidation
of the request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

G. DE?ARTMENT ANALYSIS:
1.The applicant, Holvick, deRegt, Koering (HDK), is requesting site plan
approval to allow the construction of four one-story tilt-up concrete
buildings totaling 85,200 square feet of office and warehouse on a 6.5 acre
site. In addition, 278 parking spaces are proposed on the design plans.
2. The Environmental Review Committee has issued a declaration of
non-significance concerning the proposed construction of the three office
buildings. The appeal period expired on Monday, July 22, 1985.
3.In the review of the site plan, the staff and the Hearing Examiner should
consider the following criteria:
a, Compatibility with adjacent structures.
b. Compliance with the Comprehensive Plan and Zoning Code.
c. Access.
d' Functionality of a parking lot.
eI Traffic circulation.
f. Pedestrian circulation.
This project will be the continuation of the basic style developed in the first
three construction phases of Washington Technical Center by HDK.
4. The following is an analysis of design points of concern for the project:
a. Pedestrian Circulation: The site plan does not show how it interties
with the adjacent manufacturing park development. Functional
relationships between the previous phases should include pedestrian
corridors linking these buildings. The site plan does not suggest how
this can be accomplished.
b. Traffic Circulation: Three direct accesses are provided off of Powell
Avenue S.W. The southern most access point is a shared driveway.
c. Functionality of the Parking Lot: The parking lot is designed at
maximum capacity; 278 parking spaces are required, 278 are provided.
The site plan is not specific enough to totally evaluate whether all of
the parking spaces comply with the City Code. This proposal does not
allow for any conversion of warehouse space to office space.
Circulation appears to be very good with the common easement along
the southern property line. Based upon the parking requirements and
design requirements, it appears that the buildings have been maximized
for the subject site. The Fire Department has commented that they do
not believe that the plans are adequate to review emergency access.

d. Access: As stated above, access is at three points off of Powell Avenue
S.W.
e. Compliance with the Comprehensive Plan and Zoning Code: The
building plans as submitted comply with the requirements of the Zoning
Code and the Parking and Loading Ordinance. The intent projected
provides a manufacturing park atmosphere but does not really provide
very much outside open space for people. These buildings, since they
are being utilized by office and warehousing workers, will have a high
demand upon both active and passive recreational areas. Washington
Technical Center has not addressed the issues on on-site open space for
people.
f. Compatibility with Adjacent Structures: This project is a continuation
of the existing development to the east and north and suggests a
continuation of the basic theme for Washington Technical Center.
Therefore, it can be determined to be compatible with the adjacent
uses.
5. Various City departments have commented and, with the exception of the
Fire Department and Utilities Engineering Division, have recommended
approval of the project. The Fire Department's concerns rests primarily with
the emergency access and circulation, and Utilities Engineering Division is
concerned about water and sewer plans which will be a requirement of the
building permit.
H. DEDARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the site plan approval
request. file SA-045-85, be continued until August 27, 1985, to allow the applicant
to prepare specific plans to show the following:
1.Pedestrian circulation to intertie with the adjacent complex and future
complexes.
2. A revised site plan showing specific parking layouts with individual stalls and
the reduction of building space to show compliance with on-site circulation
standards for emergency access.

concerns of the City of Renton in regards to the trip generation from

The following documentation has been submitted to the City of Renton's
Environmental Review Committee to help facilitate their review of Holvick
deRegt Koering's request to waive the requirement of the additional traffic
study for the portion of property controlled by Holvick deRegt Koering in
the Washington Technical Center plat.
Holvick deRegt Koering has been aware of the constraints of the daily trip
generation from the Washington Technical Center plat as defined in the final
Environmental Impact Statement. Holvick deRegt Koering has, at several
meetings with Mr. Blaylock, indicated that they do not intend to exceed
their allocated prorata share of daily trips as defined in the Final Environ-
mental Impact Statement. Mr. Blaylock has indicated his concern about the
additional traffic that may be generated from the site if the buildings are
100% office and has been monitoring the potential daily trips from the site
based on site plans approved to date. Mr. Blaylock has been concerned that
the 6600 trips associated with Phase I will be used up before the land area
defined as Phase I on the revised site plan of the Final E.I.S. is actually
built out. It has been my contention with Mr. Blaylock that the revised
site plan of the Final E.I.S. is a preliminary site plan and that the trip
generation of Phase I should be associated with daily trips generated, not
the land area. Once the 6600 trips have been used up in Phase I, then the
City of Renton could require the developer to update the City with their
proposed build-out of the site versus the daily trips defined in the Final
Environmental Impact Statement.
Holvick deRegt Koering has worked with the City of Renton and with Mr. Blaylock
in particular, at great length to answer his concerns about the daily trips
generated from the site at the present and in the future. Mr. Blaylock met
with Barb Moss of First City Equities and myself recently to discuss the daily
trip generation totals to date. Last week I submitted to Mr. Blaylock a
calculation of the potential daily trips based on existing buildings built
and buildings submitted to the City of Renton for site plan approval at this
time (See Exhibit 6) . Based on those calculations, the 6600 trips associated
with Phase I of the development would not be exceeded.
Due to the dedication of the 17 acres of Tract A for the retention pond for
the P-1 Channel, the amount of trips associated with the remaining developable
portion of the land has increased. I have discussed this issue with Mr.
Blaylock several times, but have not seen Mr. Blaylock take into consideration
this transfer of trips from the retention pond site to other areas of the site.
The retention pond site was originally defined as the office park portion of
the site, but due to the dedication of 17 acres of that tract, office buildings
have been developed more fully in the portion of the site along Powell Avenue.
This elimination of 17 acres of the site allows for a higher density of office
park to be developed in other areas of the site based on the total Daily Trip
Generations defined in the Final Environmental Impact Statement. In addition,
the heavy warehousing that was indicated on the revised site plan of the Final
L.I.S. assumed that the site coverage for heavy warehousing would be 50% of the
site.

Holvick deRegt Koering's development to date and site plans submitted for
approval assume approximately 30% of the lot area covered with building
for the business park portion of the site and 35% of the lot area covered
with building for the office park portion of the site. These reduced
building coverage areas also allows for a heavier concentration of office
development than was originally proposed in the revised site plan of the
Final Environmental Impact Statement.
Holvick deRegt Koering understands the concerns of the City of Renton
regarding the daily trip generation of the Washington Technical Center
plat. Holvick deRegt Koering feels that the documentation submitted with
this letter indicates that Holvick deRegt Koering has not exceeded the
original daily trip generation associated with its portion of the Washington
Technical Center plat. Based on the submitted documentation, Holvick deRegt
Koering requests that the City of Renton proceed with processing the site
plan submitted for Lots #3, 4, and 7 of the Washington Technical Center plat.
I look forward to hearing from the City of Renton as to the acceptability of
those site plans and the documentation submitted here. If you have any

These ranges reflect the various types of business that occupy a given
land use type. Not knowing the exact character of the businesses that
will occupy this development, an average or slightly above average trip
generation rate was selected by combining these nationally observed rates
with observations at local developments of similar character.
When these rates are applied to the phased development profile shown
on Figure 1 , the daily and peak hour trips shown on Table 2 result. This
shows that at full development the proposal will generate about 19,825
one-way trips per day (9,915 round trips) and about 2,650 one-way trips
during the evening peak hour (the majority of trips - approximately 70% -
1 will be traveling away from the industrial park). About one-third of
the total daily and about 40 percent PM peak hour trips will be generated
during Phase I of the development. Difference in trip generation in Pha-
ses I and II is due to the relatively large portion of office development
typically a high traffic generator per unit floor area) .
These figures reflect conditions on weekdays and reflect all vehicle
trips including those made by employees, service and support services
and truck pick-up and delivery. Except for isolated studies which are
site or industry specific, there are no universally accepted standards
for estimating the amount of weekend vehicle activity at a complex like
Earlington Park. These studies suggest, however, that the weekend day
traffic volume is less than 10 percent of the average weekday volume.
Most weekend traffic at this development is likely to be associated
with the office and business park. Weekend truck activity should be
very limited (less than 5 percent of the average weekday truck volumes)
because the overtime labor costs associated with driver and warehouse-
men make normal truck transfer operations uneconomic. Thus any weekend

Phase I - Parking Reconfiguration
First City Equities is requesting the Environmental Review Committee review
the enclosed proposed drawing delineating an additional 114 parking spaces
behind our existing Phase I office/warehouse building. As I discussed with
Ron Nelson on Friday, July 5, First City Equities is in a position to
accommodate a potential Boeing lease of 100% office use for our existing
building. In order to transform the office/warehouse building into pure office,
it is necessary to provide an additional 114 parking spaces. In order to this,
we have extended the parking lot onto Tract B directly behind the existing
building.
Conditions of development for the Valley 405 Business Park include building
Oakesdale from 7th to Grady Way concurrent with development of Tract B.
First City Equities is requesting the Environmental Review Committee work
with us to accommodate the market place by parking on Tract B for Phase
I only without triggering the condition of construction of Oakesdale Avenue.
I am working diligently with Metro, Container Corporation, Burlington Northern,
and the City of Renton Public Works Department in order to finalize details
of an L.I.D. formation to construct Oakesdale from Monstor Road to Grady
Way. Finalization of the L.I.D. and formal petition signing should occur this
month. By allowing us to provide parking for Boeing on our existing building
in Phase I, the City of Renton is working with us in a logical rational program
of development which best meets the needs of the community.
I have reviewed the traffic impact as a result of our use of 100% office in
Phase I. The attached chart represents the current Washington Technical
Center (HDK) and First City Equities' existing and proposed use of their land.
Please note that in identifying Phases I and II of First City Equities' properties
to be office use entirely, the daily trips generated when added to the total

HDK's generated trips, amount to 6,352 total daily trips. Trip generation as
identified in the original EIS for this project specified 6,660 daily trips as
the threshold for the first phase of development. Since we are under this
threshold even with the additional parking requirement, we feel that this is
a logical solution to accommodate a potential Boeing lease. Our hope is that
Boeing will find our project desirable enough to not only lease Phase I buildings
but to continue in the future to absorb the leaseable space as it is developed.
Phase II - Site Plan Review
The Environmental Review Committee has requested First City Equities provide
an updated traffic analysis to consider traffic impacts for HDK's and First
City Equities' properties. As a result, the site plan review for our Phase
II property has been stopped pending receipt of the analysis. We expect to
have completed our traffic analysis for the entire plat next week. At that
time I will see to it that the Environmental Review Committee receives a
copy of the report for their review. However, given the enclosed analysis
of trip generations as currently built and proposed by HDK and FCE, it is
clear that all current proposals being reviewed by the City of Renton to date,
are within the original final EIS projections for first phase of development.
I therefore can see no logical reason for requiring an updated traffic analysis
as input for our pending site plan review. I therefore request that the
Environmental Review Committee proceed with review of our Phase II
development and issue a declaration this week. Of concern to the ERC besides
the traffic counts, is also the removal of 10th Street and its impact on fire
access. My architect, Royce Berg of LPN, will be contacting Jim Matthews,
the Fire Marshall, to discuss fire protection and to work out adequate access
to serve the development without 10th Street. We feel confident a workable
solution is attainable.
General Development - Certificate of Occupancy
A third item I would like to bring to the attention of the Environmental Review
Committee at this time is that of the general development process for Valley
405 Business Park. The committee has already acknowledged its approval
of First City Equities pulling building permits during the L.I.D. process on
Oakesdale Avenue. However there was some concern as to our ability to
follow through with a certificate of occupancy once the buildings were
complete. Assuming the L.I.D. process is ongoing for Oakesdale, First City
Equities proposes to develop buildings in a logical fashion. Obviously, if
Oakesdale is the necessary access in order to reach a given building, and if
it is not yet accessable, there would be no reason to request a certificate
of occupancy. However, if First City Equities has constructed a building
abutting S.W. 7th Street with full access provided to that building and adequate
fire protection as well as adequate traffic flow, it seems reasonable to expect
a certificate of occupancy to be issued on that building. Again, logic and
reason would prevail in determing which building would receive a certificate
of occupancy and which building would not receive a certificate of occupancy,
tied to completion of Oakesdale Avenue.
I understand the committee will be reviewing and commenting on these requests
on Wednesday of this week. I am available to meet with you at that time
or at your convenience should other concerns be raised. Please feel free to
contact me at my office, if I can assist in this decision.

Holvick deRegt Koering is requesting that the Environmental Review Committee
reconsider the requirement of an updated traffic study for the portion of
the property in the Washington Technical Center plat owned by Holvick deRegt
Koering. I have met with Mr. Blaylock twice to discuss this matter. Holvick
deRegt Koering does not intend to exceed their prorata share of the daily
trips generated from the Washington Technical Center plat as defined in the
Environmental Impact Statement.
In order to allow the Environmental Review Committee to assess Holvick
deRegt Koering's development plans for its portion of the Washington Technical
Center plat, I am submitting the following information.

The following documentation has been submitted to the City of Renton's
Environmental Review Committee to help facilitate their review of Holvick
deRegt Koering's request to waive the requirement of the additional traffic
study for the portion of property controlled by Holvick deRegt Koering in
the Washington Technical Center plat.
Holvick deRegt Koering has been aware of the constraints of the daily trip
generation from the Washington Technical Center plat as defined in the final
Environmental Impact Statement. Holvick deRegt Koering has, at several
meetings with Mr. Blaylock, indicated that they do not intend to exceed
their allocated prorata share of daily trips as defined in the Final Environ-
mental Impact Statement. Mr. Blaylock has indicated his concern about the
additional traffic that may be generated from the site if the buildings are
100% office and has been monitoring the potential daily trips from the site
based on site plans approved to date. Mr. Blaylock has been concerned that
the 6600 trips associated with Phase I will be used up before the land area
defined as Phase I on the revised site plan of the Final E.I.S. is actually
built out. It has been my contention with Mr. Blaylock that the revised
site plan of the Final E.I.S. is a preliminary site plan and that the trip
generation of Phase I should be associated with daily trips generated, not
the land area. Once the 6600 trips have been used up in Phase I, then the
City of Renton could require the developer to update the City with their
proposed build-out of the site versus the daily trips defined in the Final
Environmental Impact Statement.
Holvick deRegt Koering has worked with the City of Renton and with Mr. Blaylock
in particular, at great length to answer his concerns about the daily trips
generated from the site at the present and in the future. Mr. Blaylock met
with Barb Moss of First City Equities and myself recently to discuss the daily
trip generation totals to date. Last week I submitted to Mr. Blaylock a
calculation of the potential daily trips based on existing buildings built
and buildings submitted to the City of Renton for site plan approval at this
time (See Exhibit 6) . Based on those calculations, the 6600 trips associated
with Phase I of the development would not be exceeded.
Due to the dedication of the 17 acres of Tract A for the retention pond for
the P-1 Channel, the amount of trips associated with the remaining developable
portion of the land has increased. I have discussed this issue with Mr.
Blaylock several times, but have not seen Mr. Blaylock take into consideration
this transfer of trips from the retention pond site to other areas of the site.
The retention pond site was originally defined as the office park portion of
the site, but due to the dedication of 17 acres of that tract, office buildings
have been developed more fully in the portion of the site along Powell Avenue.
This elimination of 17 acres of the site allows for a higher density of office
park to be developed in other areas of the site based on the total Daily Trip
Generations defined in the Final Environmental Impact Statement. In addition,
the heavy warehousing that was indicated on the revised itt o.. _ he Final
E.I.S. assumed that the site coverage for heavygvY._ r g 911- •_ "5 of the
site.

Holvick deRegt Koering's development to date and site plans submitted for
approval assume approximately 30% of the lot area covered with building
for the business park portion of the site and 35% of the lot area covered
with building for the office park portion of the site. These reduced
building coverage areas also allows for a heavier concentration of office
development than was originally proposed in the revised site plan of the
Final Environmental Impact Statement.
Holvick deRegt Koering understands the concerns of the City of Renton
regarding the daily trip generation of the Washington Technical Center
plat. Holvick deRegt Koering feels that the documentation submitted with
this letter indicates that Holvick deRegt Koering has not exceeded the
original daily trip generation associated with its portion of the Washington
Technical Center plat. Based on the submitted documentation, Holvick deRegt
Koering requests that the City of Renton proceed with processing the site
plan submitted for Lots #3, 4, and 7 of the Washington Technical Center plat.

These ranges reflect the various types of business that occupy a given
land use type. Not knowing the exact character of the businesses that
will occupy this development, an average or slightly above average trip
generation rate was selected by combining these nationally observed rates
with observations at local developments of similar character.
When these rates are applied to the phased development profile shown
on Figure 1 , the daily and peak hour trips shown on Table 2 result. This
shows that at full development the proposal will generate about 19,825
one-way trips per day (9,915 round trips) and about 2,650 one-way trips
during the evening peak hour (the majority of trips - approximately 70% -
will be traveling away from the industrial park) . About one-third of
the total daily and about 40 percent PM peak hour trips will be generated
during Phase I of the development. Difference in trip generation in Pha-
ses I and II is due to the relatively large portion of office development
typically a high traffic generator per unit floor area) .
These figures reflect conditions on weekdays and reflect all vehicle
trips including those made by employees, service and support services
and truck pick-up and delivery. Except for isolated studies which are
site or industry specific, there are no universally accepted standards

Dear Gary:
Pursuant to our conversation of today's date, please provide me with a
recorded copy of the latecomer agreements for the traffic signals at the
intersection of Powell Avenue/Grady Way and S.W. Seventh Avenue/Hardy Ave-
nue. Holvick deRegt Koering's mailing address is 725 Powell Avenue, S.W. ,
Suite A.
The latecomer agreement for the traffic signal at Powell Avenue S.W. and
Grady Way requires that O.W. Properties provide 17.9% of the cost for the
traffic signal. It is my understanding that this percentage was based
upon the requirements imposed by the hearing examiner at the time of their site
plan approval. Holvick deRegt Koering was unable to negotiate an agreement with
O.W. Properties for their contribution towards the signal cost at the time
we constructed the signal. Therefore, Holvick deRegt Koering is anxious to
receive O.W. Properties fair share apportion of the traffic signal at this time.
It is my understanding that the City of Renton will issue a request for payment
from O.W. Properties for their fair share apportion of the signal.
I have attached to this letter Attachment A of the latecomers agreement for
the traffic signal at Powell Avenue S.W. and Grady Way. The Attachment A
defines First City Equities Phase II property description in footnote no. 1.
In addition to the attachment, I have provided you with a marked up copy of
the plat showing First City Equities Phase II property. Also shown on the
plat is a portion of Holvick deRegt Koering's property that was released to
First City Equities in December of this year. That portion of the plat is
highlighted in red and was included in Holvick deRegt Koering's Phase I portion
of Washington Technical Center plat as defined in Attachment A of the latecomers
agreement.
