REPORT AND DECISION.
APPLICANT: COMPREHENSIVE CARE CORPORATION

of 19,700 cubic yards of material on a 3.75 acre site
which will house a 100 bed private hospital.

DEPARTMENT REPORT: received by the Examiner on August 6, 1985.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing was opened on August 13, 1985, at 9:05 A.M. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The following exhibits were entered into the record:
Exhibit #1 - Yellow file containing application, proof
of posting and publication, and other' documents
pertinent to this application.
Exhibit #2 - Temporary Erosion Control Plan.
Exhibit #3 - Letter dated August 13, 1985 from
Hall-Troxell Associates, to the Hearing Examiner.
The hearing began with a review of the staff report by the Zoning Administrator, Roger
Blaylock. He related such information as the proposal consisting of the placement of
19,700 cu. yds. of material on 3.75 acres which will eventually house a 100 bed private
hospital. Most of the site grading was accomplished with the final plat. Public services
and streets are already in the neighborhood. He continued with a review of five criteria
to be considered, stating this is the final grading to be done on the project. The applicant
proposes beginning construction on the hospital by December 1st, with the fill being placed
on the site between the end of the appeal period and December 1st. Traffic to the site
will be coming mainly from SR-167. Because the intersection at Davis and S.W. 43rd is
not a controlled intersection, left turns for the trucks should not be encouraged at that
point. It was suggested that operating hours be limited from 9:00 AM to 3:00 P.M. due to
the large traffic volumes on S.W. 43rd during the morning and evening hours. Landscaping
has been approved; noise should be limited due to adjacent uses; tracking may occur on
public streets and for that reason there should be a a bond required to cover clean-up
costs. The storm drainage plan has been revised to contain 3 ponds instead of 2, and also
consists of an increase in the hay bales and erosion control devices around the end of the
ponds.
Mr. Blaylock continued with the review stating staff was concerned as to whether or not
the City is giving approval to a Special Permit prior to the end of the appeal period for a
Conditional Use, or prior to PPUD approval by the City Council. It is felt this case does
not reflect prior approval as there is another existing PUD which sets out how this area is
to be developed. What this approval will do is grant the applicant the time needed to
complete the work before the wet season. At this time Mr. Blaylock had no further
comments, and recommended approval with conditions as shown in the staff report.

The Hearing Examiner called for testimony in support of this application from the
applicant or their representative. Responding on behalf of the applicant was:

Mr. 1 roxel reaffirmed the company's objectives in submitting the application. He stated
they have been advised by the Contractor that they should not begin any later than late
September in order to have the grading completed by their projected building date in
December, or they could be delayed for as long as six months until the wet weather is
past. The Hearing Examiner inquired of Mr. Troxel as to the time frame they are using
for the grading and filling of the site. Mr. Troxel advised the contractor felt it would
take about 4 weeks to complete the grading and sub-surface drainage. He also felt the
applicant would wish to further discuss the hours of operation proposed by staff. They
requested 8 hours each day for their operation and did not feel they would impact traffic
during that time. At this time the Engineer for the project was asked to testify.
Speaking further in support of the application was:

Mr. Pine discussed the volume of material to be used, hours of operation, frequency of
trips, storm drainage, and type of fill material. He reviewed the Summary of Quantities
used in the information provided, and stated they will strip about 5400 cubic yards of top
material with possibly half of that material to be used on the site. Excavation will
consist of approximately 2300 cubic yards of material that will be used on the site as fill.
There will be approximately 9700 cubic yards of material imported to the site. Mr. Pine
continued with a review of the traffic volumes projected and suggested there would be
possibly 650 vehicle trips, and with the operation spread over a potential 4 week period,
they would average about 33 trips per day or 4 truck trips per hour in a normal 8 hour
work day. The trucks will go east on 43rd Street when delivering and north on Talbot
Road when empty, which the applicant feels will not impede traffic at peak hours. With
that input, Mr. Pine requested longer hours for hauling, namely 7:00 A.M. to 3:30 P.M..
He addressed the dust and mud concerns stating they will be extending the cleaning pad
and have a sweeper made available at all times to clean the trucks. There will be no
problem providing the third pond as requested by staff. He had no further comments.
Roger Blaylock wanted to note for the Examiner that the local hospital employees usually
work on a shift from 7:00 A.M. to 3:00 P.M. thereby creating a large amount of traffic in
that area around the 3:00 P.M. hour. He then suggested that the hours of operation could
be extended in the morning and limited to 3:00 P.M. in the afternoon.
There was a call for testimony in opposition to this application. There was no one else
wishing to speak for or against the project, and no further comments from staff. The
Examiner declared the hearing closed at 9:35 A.M.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS:
1. The applicant, Comprehensive Care Corporation, has requested approval of a
Special Permit to fill and grade approximately 3.75 acres of property with
approximately 19,700 cubic yards of material.
2. The application file containing the application, the State Environmental Policy Act
SEPA) documentation, the Building and Zoning Department Report, and other
pertinent documents was entered in the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C,
1971, as amended), a Declaration of Non-Significance has been issued for the
subject proposal by the Environmental Review Committee (ERC), the responsible
official.

4. Plans for the proposal have been reviewed by all City departments affected by the
impact of this proposal.
5. There was no opposition to the subject proposal from any member of the public.
6. The subject site is located on the east side of the 4400 block of Davis Avenue South
in the One Valley Place PUD complex.
7. The subject site was annexed into the City in May, 1976 by the adoption of
Ordinance 3031, at which time it was automatically zoned G (General; Single
Family Residential; Minimum lot size - 35,000 sq ft). The site was rezoned to P-1
Public/Quasi-Public) by the adoption of Ordinance 3569 in August of 1981.
A Preliminary Plat and original PPUD were approved in September, 1981. The
Final Plat was approved by the adoption of Resolution 2505 in May, 1983. A new
proposal for the subject site to erect a 100 bed private hospital catering to patients
with drug dependencies is pending and will be reviewed by the City Council.
8. The map element of the Comprehensive Plan designates the area in which the
subject site is located as suitable for the development of public and quasi-public
uses, but does not mandate such development without consideration of other
policies of the plan.
9. Valley Medical Center is located north of the subject site across S.W. 43rd Street.
A series of independent medical clinics are located near the intersection of Talbot
Rd. So. and S.W. 43rd. Scattered single family homes are located south and east of
the subject site. An apartment complex is located immediately south of the
subject site.
10. The fill materials are necessary to bring the site up to final grade for the
construction of the proposed hospital. The applicant indicated that actual
importation of material to the site would be closer to approximately 9,700 cubic
yards, as redistribution of materials on site will accomplish a majority of the fill
results desired.
11. Staff analysis predicated on a worst case scenario indicated that approximately
1,300 vehicle trips would be necessary to fill the site. This would result in
approximately 11 trips per hour over a three week fill period. The applicants
additional information could cut those trips to approximately 650 trips total, 33 per
day, or approximately 4 per hour.
12. The haul route agreed to by the applicant would provide access to the site from
SR-167 to S.W. 43rd Street, Davis Avenue through the site with egress from So.
45th Place to Talbot Rd So., and then the controlled intersection of Talbot and
S.W. 43rd. This route will minimize interference with traffic in and around the
hospital.
13. Staff recommended that the hours of operation be limited because of the large
traffic volumes on the arterials adjacent to the subject site. The applicant had
requested use of the haul route from 7:00 A.M. to 3:30 P.M. Staff initially
recommended the hours between 9:00 A.M. to 3:00 P.M. Staff further indicated
that the Valley Medical shift coincided with a 3:00 P.M. release.
CONCLUSIONS
1. The proposed grade and fill appears to serve the public use and interest. Subject to
the conditions enumerated below, the operation should not have an undue impact on
the general public or neighboring properties.
2. The grade and fill is not intended to measurably alter the topographic
characteristics of the site. The fill is intended to prepare the site for building pads
and foundation work.
3. The actual fill material which will have to be imported to the site appears to be
approximately 50% less than originally estimated since much of the material may
only have to be redistributed on-site. This would result in significantly less truck
trips per day.

4. Under the circumstances, the applicant should be permitted to operate for an 8
hour day from 7:00 A.M. to 3:30 P.M. as long as the number of truck trips does not
exceed the estimated 4 per hour during the morning peak from 7:00 A.M. to 9:00
A.M. and the evening peak from 3:00 P.M. to 4:30 P.M. Four additional trips per
hour should not interfere significantly with the peak hour traffic in the area. If the
number of trips exceeds this estimate, the applicant will be limited to the hours
between 9:00 A.M. to 3:00 P.M.
5. The grade and fill permit for such a limited operation should not be extended for an
undue period, and should be limited to six months from the date of issuance in
order to limit the time window in which the site will have to be monitored by staff.
6. In order to assure that streets are kept free of debris the applicant will have to
post a revolving cash bond of $500.00 to permit the City to draw on the fund if the
applicant fails to keep the streets along its haul route clean.
7. The applicant agreed to provide the necessary ponds and impoundments, and will
provide the required ballast pad adjacent to the entrance to the site.
DECISION
The Special Permit for fill and grade is approved subject to the following conditions:
1. The permit shall be limited to six months from the date of issuance of the
license.
2. The hours of operation shall be limited as follows:
a. As long as the number of truck trips per hour remains at four or less the
operation shall be limited to 7:00 A.M. to 3:30 P.M.
b. If the truck trips per hour exceed four per hour the hours shall be
limited to between 9:00 A.M. to 3:00 P.M.
3. The posting of a revolving cash bond of $500.00.
4. Compliance with the requirements of the Public Works Department's
standards for temporary sedimentation controls.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before September 4, 1985. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in the Finance Department, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use decisions. This means that parties to a
land use decision may not communicate in private with any decision-maker concerning the
proposal. Decision-makers in the land use process include both the Hearing Examiner and
members of the City Council.
All communications concerning the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to
openly rebut the evidence. Any violation of this doctrine would result in the invalidation
of the request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

G. DEPARTMENT ANALYSIS:
1. The applicant, Comprehensive Care Corporation, is requesting a fill and
grade permit to fill a 3.75 acre site with 19,700 cubic yards of material to
allow the construction of a 100-bed private hospital. The subject site is
located on the east side of Davis Avenue South at the 4400 block.
2.The Environmental Review Committee has issued a Declaration of
Non-significance at their regular meeting on July 24, 1985. The appeal
period will expire on August 12, 1985, at 5:00 p.m.
3. Under Section 4-2303(2) of the Mining, Excavation, and Grading Ordinance, a
series of seven criteria are established to determine whether the excavating
or filling operation is compatible with the existing or future land uses. The
following analysis demonstrates that the special permit is appropriate and
complies with the intended approved use of the subject site.
a. SIZE AND LOCATION OF THE ACTIVITY:
The 3.75 acre site is actually two lots of the One Valley Place
subdivision and planned unit development designed to allow supporting
activities for Valley Medical Center. The 19,700 cubic yards of fill
material are necessary for the final grading to allow the construction of
the private hospital. It is anticipated that the actual construction of
the buildings will begin no later than December 1, 1985, which staff
anticipates it will be probably more reasonable to consider a January 1
starting date.
b. TRAFFIC VOLUME AND PATTERNS:
The total traffic generated by utilizing 15-yard dump trucks to the site
will be slightly more than 1300 vehicle trips. If this is concentrated in
a one-week period with operating hours of 9:00 a.m. to 3:00 p.m., 44
trips per hour will be necessary. It is unlikely that it will be completed
that fast. A more reasonable scenario would include a three-week fill
operation averaging approximately 11 trips per hour.
The traffic will generally be using SR-167, S.W. 43rd Street, and Davis
Avenue South for access to the site. The trucks should exit onto Davis
Avenue South going south to South 45th Place, then out onto Talbot
Road, and north through a controlled intersection because the
intersection of Davis Avenue South and South 43rd Street is not
completed to date. This would help reduce the confusion and
congestion at the uncontrolled intersection.

The operating hours should be limited to from 9:00 a.m. to 3:00 p.m.
even though the applicant has not directly specified any certain times.
These hours should be established primarily because of the heavy a.m.
and p.m. traffic levels around Valley Medical Center.
c. SCREENING, LANDSCAPING, FENCING, AND SETBACKS:
The applicant has proposed and presently has approved by the Hearing
Examiner a Conditional Use Permit with a specific site plan and
landscape plan to develop the subject 3.75 acres. This assures
development of the site in a timely manner; and the normal screening,
landscaping, fencing, and setbacks that would be required as part of an
actual mining operation is not necessary in this case.
d. UNSIGHTLINESS, NOISE, AND DIRT:
The site will be filled rather quickly to allow timely development of the
private hospital. The impact of noise and dirt should be minimal by
limiting the operational hours; however, there may be some tracking on
the public streets as the result of the operation.
e. SURFACE WATER:
The City of Renton Surface Water Ordinance will take effect on the
ultimate development of the site. Temporary sedimentation and storm
water control measures have been included but apparently are not
satisfactory to the Public Works Department. These will have to
specifically comply before the annual license can be issued.
Development of the site will require the standard public storm water
detention and retention facilities according to code.
f. LENGTH OF TIME THE APPLICATION THE EXISTING OPERATION
HAS TO COMPLY WITH NON-SAFETY PROVISIONS OF THIS
ORDINANCE:
This proposal does comply with the safety provisions and the specific
requirements of the Mining, Excavation and Grading Ordinance. This is
not an enforcement action to correct an existing violation.
g. USE OF SITE:
The use of the site is for the construction of a 100-bed private
hospital. The specific use has been approved as a Conditional Use by
the Hearing Examiner, and the Preliminary P.U.D. has been
recommended for approval to the City Council. In any case, there
would be the necessity for on-site grading prior to the actual
construction of any building on the site.
4. The various City departments have commented, and their review has focused
on the issue of traffic routes and approved storm water drainage plans. The
Public Works Department will require that final storm drainage plans be
approved for temporary erosion control measures prior to the issuance of the
annual license. The Traffic Engineering Division wants approval of the final
traffic route to the site.
5.The only apparent issue arising from the proposed Special Permit is whether
approval should be granted prior to the end of the appeal date for the
Conditional Use and approval by the City Council of the Preliminary P.U.D.
The error in logic for considering a Special Permit prior to a Preliminary
P.U.D. being accepted by the City Council is that the staff and the Examiner
would be presuming that the P.U.D. is acceptable. However, in this specific
case, there is a past planned unit development action dealing with the subject
site. A preliminary planned unit development has been approved to allow
uses that support Valley Medical Center. In addition, both a preliminary and
final plat have been approved and constructed to tie the specific project into
a final design. Therefore, we have actual physical improvements, specific lot
dimensions, and known uses to support the granting of the Special Permit.

H. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the Hearing Examiner
approve the Special Permit request, SP-055-85, by Comprehensive Care
Corporation subject to:
1) The annual license cannot be issued until the City Council has approved the
Preliminary Planned Unit Development for the subject site.
2) A time limit of 6 months.
3) Hours of operation limited to 9:00 a.m. to 3:00 p.m.
4) A $500 cash street clean-up bond be posted.

Administration Building which serves as a public recreation facility. Also
included in the proposal is to demolish a portion of the existing building file
SA-050-85; located on the east side of Edmonds Avenue N.E. at 800

ALBOT ROAD SOUTH STREET IMPROVEMENTS. The subject project
proposes 4,000 feet of roadway improvements including installing curbs,
gutters, sidewalks, storm sewers, and widening from two lanes to 44 feet
curb to curb in the northern third of the project area and widening to 36
feet doved shoulders on the southern two thirds of the project area; located
on Talbot Road South from S. 19th Street-SR 515 new spur south to S. 40th

grading operations and the proposed groundwater interceptor to be
installed along the east property line. Overall storm drainage for
One Valley Place has been addressed in the plans for L.I.D. 325.
Plans detailing the final storm drainage system will be provided as
part of the P.U.D. that is in progress for Lots 9 through 12, One
Valley Place.
Since the site grading being proposed is the first phase of what
ultimately will be the development plan that was set forth in the
P.J.D. and Conditional Use Permit Applications for this site, a copy
of the site plan, as submitted with the previous application, is
included and is intended to serve as the rehabilitation plan for this
project.
Grading operations will be performed in accordance with the standard
specifications of APWA as noted on the plans. Standards for work in
progress (including hours of operation, work procedures, and measures
to control mud, dust, and noise) have been specified in the Renton
Mining Excavation, and Grading Ordinance. Fill material to be
imported to the site has been specified in the grading notes and the
Geotechnical Engineering Study prepared by Terra Associates, Inc.,
dated July 9, 1985. The probable routes to be used for fill
importation include SR167, S.W. 43rd Street, and Davis Avenue South.

P ENVIRONMENTAL CHECKLIST
Purpose of Checklist:
The State Environmental Policy Act (SEPA), chapter 43,21C RCW, requires all
governmental agencies to consider the environmental impacts of a proposal before making
decisions. An environmental impact statement (EIS) must be prepared for allproposals
with probable significant adverse impacts on the quality of the environment. The purpose
of this checklist is to provide information to help you and the agency identify impacts
from your proposal (and to reduce or avoid impacts from the proposal, if it can be done)
and to help the agency decide whether an EIS is required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about your
proposal. Governmental agencies use this checklist to determine whether the
environmental impacts of your proposal are significant, requiring preparation of an EIS.
Answer the questions briefly. with the most precise information known, or give the best
description you can.
You must answer each question accurately and carefully, to the best of your
knowledge. In most cases, you should be able to answer the questions from your own
observations or project plans without the need to hire experts. If you really do not know
the answer. or if a question does not apply to your proposal, write "do not know" or "does
not apply." Complete answers to the questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations. such as zoning, shoreline, and
landmark designations. Answer these questions if you can. If you have problems, the
governmental agencies can assist you.

The immediate proposal is to perform necessary site grading operations prior
to construction of a 57,400 sq. ft. building on a 3.75 acre (163,457 sq. ft.)
site. The building will be a private hospital of 100 beds for treatment of
chemical dependency illnesses.

A temporary erosion/sedimentation control plan will be designed and
