associated with said removal including interest, if
applicable, as well as any subsidiary or indirect costs, and
shall operate as a lien against the property, with the city
of Renton being held harmless.
4 . In addition, other consequences or costs of removal of
the underground system, including any adverse but reasonably
anticipated costs of removal such as closure of, or
interference with current on-site enterprises, shall be
solely the responsibility of the property owners.
DURATION
These covenants shall run with the land and expire on
December 31, 2025. If at any time improvements are
installed pursuant to these covenants, the portion of the
covenants pertaining to the specific installed improvements
as required by the Ordinances of the City of Renton shall
terminate without necessity of further documentation.
Any violation or breach of these restrictive covenants may
be enforced by proper legal procedures in the Superior Court
of King Cqunty by either the City of Renton or any property

APPLICANT: PLAID PANTRY MARKETS, INC.

SUMMARY OF REQUEST: Approval of a Conditional Use Permit to allow gasoline
pumps in a B-1 zone, and Site Plan approval to allow a
4,268 sq. ft. building consisting of convenience store spa
and retail space.
SUMMARY OF ACTION: Building and Zoning Department Recommendation:
Approval with conditions.

BUILDING & ZONING The Building & Zoning Department Report was received
DEPARTMENT REPORT: by the Examiner on December 2, 1986
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with the
application, and field checking the property and
surrounding area, the Examiner conducted a public hear i
on the subject as follows:
The hearing was opened on December 9, 1986 at 9:30 A.M. in the Council Chambers of the Renton
Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The following exhibits were entered into the record:
Exhibit #1 - Yellow File containing application, proof of postin
and publication and other documentation pertinent to this reque,
Exhibit #2 - Site Plan
The hearing opened with a presentation of the staff report by the Zoning Analyst, Jeanette Samek-
McKague. After entering the above exhibits, Mrs. McKague reviewed the surrounding uses and state
site plan review and conditional use approval is being sought for a convenience store which would al`
contain additional rental space, as well as self-service gasoline pumps being located in front of the sti
on subject property. She pointed out such information as the ERC issued a mitigated determination
that the tanks be double walled, monitoring devices are to be placed on the tanks, and the need for tl
applicant to work closely with the Fire Department to ensure all safety measures are taken; stated a
well-field in the area, although not being used, was thought to be an issue by the Public Works
Department thereby upholding the need for double walled gasoline tanks. Mrs. McKague continued
with a review of the criteria to be considered for a conditional use request and stated the proposal is
located on two arterials; satisfies the requirements of the Comprehensive Plan goals and policies for tl
area; is compatible with the surrounding buildings; the applicant has provided plans for traffic flow i
and out of the site; there will be sufficient parking provided for the two separate uses proposed for tl
site; and the applicant will work with the Public Works and Fire Department personnel to ensure thei
will be no contamination of the area.
Reviewing the Site Plan proposal, it is felt the applicant has provided a plan that conforms to the
policies of the Comprehensive Plan; there should be no impacts on surrounding properties as the
building is located so the traffic movements will be directed toward the arterials and not the residence
to eliminate the possibility of light and glare problems; she stated staff does not feel the project will
affect property values in the area; will not add a burden to public services in the area, and reviewed
some of the comments received from other City departments. A brief review was given of the traffic
circulation plan; secondary containment; minimal impacts of noise, light and glare on the surrounding
area, and with the above information, on behalf of staff, Mrs. McKague requested approval of the
Conditional Use and Site Approval requests by the Examiner.
The Hearing Examiner called for testimony in support of the proposal from the applicant or their
representative. Responding for the applicant was Richard Piaceltini, 601 Valley Street, Suite #309,
Seattle, Washington, 98109. He stated the applicant agrees with the recommendations of staff, and

proceeded to respond to some questions raised by the Examiner earlier in the hearing. Mr. Piacestin
stated the tanks will definitely be double walled with a lining to be placed in the hole the tanks will
set in; if there are any old tanks remaining on the site they will be removed; there are two pump un i
with a total of six pumps, and Mr. Piacestini stated the applicant does feel there is a need for their
business in the surrounding area, mentioning the site was previously a service station. He feels the
proposal will not present any adverse impacts on the community, and requested approval as presentes,
The Examiner called for further testimony regarding this project. There was no one else wishing to
speak, and no further comments from staff. The hearing closed at 9:55 A.M.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the following:
FINDINGS:
1.The applicant, Plaid Pantry Markets, Inc., filed a request for approval of a Conditional Use
Permit to establish a gasoline filling station in a B-1 (Business/Commercial) zone, together wi
a request for approval of a retail convenience store.
2.The yellow file containing the staff report, the State Environmental Policy Act (SEPA)
documentation and other pertinent materials was entered into the record as Exhibit #1.
3.The Environmental Review Committee (ERC), the City's responsible official, issued a
Declaration of Non-Significance (DNS) for the subject proposal.
4.The subject proposal was reviewed by all departments with an interest in the matter.
5.The subject site is located at 2801 N.E. Sunset Boulevard which is located on the northeast
corner of the intersection of Sunset and N.E. 10th Street.
6.The subject site is part of the original townsite of the City of Renton. It was reclassified to i
current B-1 zoning with the adoption of Ordinance 1612, enacted in August, 1982.
7.The map element of the Comprehensive Plan designates the area in which the subject site is
located as suitable for the development of commercial uses, but does not mandate such
development without consideration of other policies of the plan.
8.The subject property is the former site of a gasoline service station and is currently used as at
automobile sales lot.
9.The subject site is approximately .465 acres in area. The lot is approximately 135 feet wide 1)
approximately 150 feet deep.
10. The proposal consists of a retail building containing approximately 4,268.5 sq ft of retail space
Part of the space would be used by the applicant in establishing a convenience store, the
remainder would be used for other retail space.
11. The gasoline sales function would be provided by 6 hoses served by 2 separate pump units.
12. The proposed building will be flush with the northeast corner of the lot, while the gasoline
island will be located along the Sunset frontage.
13. The building will be one story high and will be served by the proposed 21 parking spaces.
14. Staff analysis indicates that circulation around the pump island and generally on the site appe:
satisfactory, although when the large gasoline tanks are filled by tanker trucks, some access
could be impaired.
15. An inactive but valuable domestic water well is located in close proximity to the site and coup
be adversely affected if any leaks or spills occurred on the site. The applicant therefore, has
agreed to provide double wall tanks meeting strict Steel Institute standards, a monitoring syste t
capable of detecting leaks before they migrate off- site and providing a secondary containmen
system consisting of a relatively impermeable liner under the tank, dispensing lines and pump
area. Monitoring will occur in both the double tank and between the tanks and the liner
system.
16. The area is generally developed with commercial uses along the Sunset corridor, while
residential uses are located off the main thoroughfare.
17. The applicant has agreed to remove the old tanks, if they have not already been removed, to
assure that no problems develop as a result of their deterioration.

18. The applicant proposes landscaping along both the Sunset and 10th Street N.E. frontages.
Landscaping will be planted both on the subject site and along portions of the public right-c -
way adjacent to the subject site. Existing trees will be maintained to enhance the new
plantings. Staff has suggested that the size of proposed plants is not adequate and need to b,
sized upward to adequately provide landscaping and viability.
CONCLUSIONS
1.The applicant for a Conditional Use Permit must demonstrate that the use is in the public
interest, will not impair the health, safety or welfare of the general public and is in complia :e
with the criteria found in Section 4-748(C) which provides in part that:
a.The proposal generally conforms with the Comprehensive Plan;
b.There is a general community need for the proposed use at the proposed location;
c.There will be no undue impacts on adjacent property;
d.The proposed use is compatible in scale with the adjacent residential uses, if any;
e.Parking, unless otherwise permitted, will not occur in the required yards;
f.Traffic and pedestrian circulation will be safe and adequate for the proposed project:
g.Noise, light and glare will not cause an adverse affect on neighboring property;
h.Landscaping shall be sufficient to buffer the use from right-of-ways and neighborin
property where appropriate; and
i.Adequate public services are available to serve the proposal.
The requested conditional use appears justified and should be approved subject to the condit ns
enumerated below.
2.The designation in the Comprehensive Plan, recognizing the commercial character of the are:
when coupled with the B-1 zoning, suggests that the proposed service station is suitable for t
subject site.
3.While the question of community need is quite subjective, the applicant undoubtedly believe'
the enterprise is necessary even though a former gasoline service station on this site ceased
doing business. Since it would be unnecessary to retain the storage system if the business w<
to fail, and the substances and residues contained within the system can prove harmful to th€
public health, safely and welfare, the applicant will have to provide covenants which guarani
removal if the service station use is abandoned for more than 12 consecutive months. This v Il
assure that the tanks and contents do not remain, posing a potential problem in the future.
4.The containment system proposed, along with the existing well identified commercial charact
of the Sunset corridor, suggests that the proposed use will have no adverse impacts on
surrounding property. The containment system should adequately protect the domestic well-
field and the double containment system shall be required as a condition of approval.
5.The building and pumps will be contained on a relatively small corner lot. The building will he
one story high and will be in scale with the general low rise profile of development in the
immediate vicinity.
6.Staff has indicated that the parking stalls will have to be enlarged to meet the requirements c
the code, but will still have sufficient parking per code requirements. Stall widths must be
resized to meet the 8.5 foot requirements.
7.While some problems could occur on site when tanker trucks are refilling the gasoline storage
tanks, staff has indicated that interference will be minimal and infrequent. The circulation
patterns appear reasonable.
8.The proposed complex is located on a busy, well lighted arterial, and any additional noise, li it
or glare will be masked by existing conditions. There does not appear to be any indication t it
adverse consequences will result to neighboring properties.
9.With supplementation and adequate plantings, both as to quantity and size, the landscaping
proposed appears reasonable. To assure suitable materials both as to character and size, such
planting shall be subject to approval by the City's Landscape Architect.

10. Sunset Boulevard is a wide arterial. Sewer and water service is available to the site. It appea
therefore, that adequate public services are available to the site.
Site Plan
11. The criteria for site plan review more or less parallel those for a conditional use permit. The
proposed use appears to provide an acceptable site plan and image for this corner. As indica l
above, it complies with the Comprehensive Plan, provides reasonable circulation patterns, is
convenient to arterial access, has adequate public services and again, with the proposed
containment system, should not adversely affect the public health, safety or welfare.
DECISION
The Conditional Use Permit and Site Plan requests are approved subject to the following conditions:
1.The installation of state-of-the-art double wall gasoline storage tanks and subsystems which
shall include monitors between the tank walls.
2.The installation of impermeable barriers between the tanks, pumps and pipes, and the
underlying and surrounding soils; and the installation of monitors between the gasoline systen
and the barrier.
3.For purposes of this decision "state-of-the-art equipment" shall mean and be defined as: the
most modern and technologically advanced system known for gasoline containment purposes,
and shall be of the type of equipment which is installed where the strictest of leak detection
and prevention is required.
4.The execution of Restrictive Covenants assuring the removal of the entire underground syste l
if the operation should cease or be discontinued for more than 12 consecutive months. The
covenants shall require that the then property owner has the legal and economic responsibilit
for removing the system, but failure to do so shall entitle the City to accomplish that purpos
by entering onto the property and removing such equipment in any reasonable manner
necessary.
5.The Covenants shall grant the City all costs associated with removal including interest, if
applicable, as well as any subsidiary or indirect costs, and shall operate as a lien against the
property, and the City shall be held harmless. In addition, other consequences or costs of
removal including any adverse but reasonably anticipated costs of removal such as closure of )r
interference with current on-site enterprises, shall be solely the responsibility of the propert\
owner.
6.The parking stalls shall comply with the minimum size requirements of the City of Renton.
7.All landscape materials and landscaping shall be subject to the approval of the City's Landsc )e
Architect. Larger, more mature specimens shall be placed as required by the Landscape
Architect.

The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communication

not communicate in private with any decision-maker concerning the proposal. Decision-makers in tl
land use process include both the Hearing Examiner and members of the City Council.
All communications concerning the proposal must be made in public. This public communication
permits all interested parties to know the contents of the communication and would allow them to
openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the
request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as
well as Appeals to the City Council.

G. STAFF ANALYSIS
1. The applicant, Plaid Pantry Markets, Inc. , is requesting approval of
a conditional use applicantion to allow gas pumps in a B-1 zone and
approval of a site plan to allow gas pumps to construct a
convenience store having 4,266.5 square feet.
2. The applicant has submitted an application for a conditional use
permit for the construction of a gasoline service pumps and
underground storage tanks as required under Section 4-711(B)(3)(d).
Site plan approval was also required since developments in the B-1
zone under Section 4-738(B)1 for the combination mini-market and
retail space building proposed by the applicant.
3. The Environmental Review Committee issued a mitigated determination
of non-significance on August 27, 1986. The Environmental Review
Committee upon review of the project felt that measures were needed
to prevent contamination of a nearby domestic water well site. The
applicant revised the application by letter on April 21, 1986,
stating that they plan to install double wall tanks and monitoring
devices for the project. They propose working with the Fire
Department on the specific design of the protection system.
Conditional Use Permit
4. The subject proposal generally complies with the eleven conditional
use criteria listed in Section 4-748. The following highlights some
of the more pertinent criteria:

Comprehensive Plan: The subject site is shown as commercial on the
Northeast Renton Area Plan and the proposed use is in keeping with
uses allowed under this designation. The proposed use conforms with
Policies 1-4 listed under the Commercial Development Objective
Northeast Renton, Comprehensive Plan Compendium, March 1986, p.
57).
Compatibility: The proposal appears to be compatible with
surrounding uses in terms of scale and bulk of existing uses in the
area. The project meets the development standards of the Business
zone. In addition, any adverse impacts resulting from the
storage/pumping of vehicular fuels will be reduced through
conditions imposed on the applicant by the ERC and those recommended
in this report.
Circulation/Parking: The applicant appears to comply with all
parking and loading requirements specified in Chapter 22 of Title
IV. The applicant appears to have provided the minimum 20'
clearance for a fire lane between the parking stalls in front of the
store and the canopy over the pumps. Only when tankers are on-site
will possible conflicts arise. There appears to be sufficient
parking spaces to accommodate traffic to the site without causing
conflicting vehicular movements when tankers are on site. Conflicts
may arise for vehicles manuvering into and out of parking stalls in
front of the building when the tankers are on-site.
5. The major issue regarding the gasoline pumps and underground storage
tanks is the potential for leaks from the tanks in a sensitive area
due to the close proximity of an existing domistic well site.
Public Works staff has indicated that the well is not currently in
use, but that it is a good well and may be activated in the future.
The applicant, following the environmental review committee's review
of the project, has modified the the application to include
protection measures to mitigate possible contamination of the well
field.
Site Plan Approval
6. The site plan for the retail building meets the site plan review
criteria as listed in Section 4-738(D)1. Specifically the plan:
a. Conforms with the Comprehensive Plan, its elements and policies;
b. Conforms with existing land use regulations stated in Section
4-711, Business Zone.
c. The applicant has mitigated impacts to surrounding properties
and uses by proposing a building compatible with those in the
surrounding area; it is located on a corner lot with the
majority of activities nearest the major arterials;
d. The applicant's project does not adversely affect the site
which was previously used as a gasoline service station.
e. Area-wide property values will not be adversely affected;
f. Safety and efficiency of vehicle and pedestrian circulation.
There will not be adverse conflicts between vehicular and
pedestrian circulation on site.
g. Provision of adequate light and air;

h. The proposed project will have a minimal impact with respect to
noise, odors and other harmful conditions.
i. There are sufficant public services and facilities available to
accommodate the proposed use;
j. The project will not lead to neighborhood deterioration and
blight.
7. The applicant's site plan will need to be revised to reflect
comments from the Zoning Division. The revised plans need to show
1) the off-site landscaping along N.E. Sunset Blvd. and N.E. 10th
St. ; 2) compact stalls which are 8 1/2' wide instead of the 8' as
shown on the existing; and 3) propose larger sized initial plants
will need to be provided.
8. Various City Departments have reviewed and commented upon the
project. Some of the more pertinent comments are as follows:
Policy Development: Approved the application subject to the
required (CUP) for gasoline pumps appears justified, provided that
no more than the number of pumps prposed in this application are
permitted.
Police: Approved the application subject to gas pumps must be in
view of cashier in convenience store.
Note: The Plaid Pantry as part of their policy tries to orient the
cashier stands so that the pumps are in view of the cashiers.
Design Engineering: Design Engineering did not approve the
application due to the lack of:
1) Detailed on and off-site grading, paving, and utility plans on
22" x 34" original mylars.
2) Providing oil/water separation required if not already provided.
Fire Prevention Bureau: The Fire Prevention Bureau did not approve
the project due to:
1) Install to U.F.C. standards and Uniform Fire Code.

Note: The applicant has satisfied the Fire Prevention Bureau's
concerns either through information in the files or through

H. DEPARTMENTAL RECOMMENDATION:
Based on the approved analysis, it is recommended that the conditional
use permit, file CU-061-86, and the site plan approval application, file
SA-061-86, be approved subject to:
1. The applicant install a secondary containment system for the
gasoline tanks subject to the approval of the Fire Department and
the Public Works Department.
2. Providing revised site plans showing 1) landscaped areas along N.E.Sunset Blvd. and N.E. 10th Street; 2) larger plants in landscaped
areas on-site; and 3) revised compact stall widths showing 8 1/2
feet.

Street Vacation: This being the date set and proper notices having been posted and
Nelson Place published in accordance with State and local laws, Mayor Shinpoch
VAC-002-86 opened the public hearing to consider the petition to vacate Nelson Place
located between the Northern Pacific Railroad right-of-way near South
153rd and Grady Way, requested by the heirs of Joseph Nielson (Nielson
Dairy). Letter from Public Works Director Richard C. Houghton was
read indicating the findings of the Board of Public Works that the area i
not needed for traffic circulation, and the Police Department has no
objection to the vacation; zoning on the site, which contains 42,000
square feet, is G-1, General; the petitioners represent 100% of the
abutting property owners; and due to existing public and quasi-public
utilities, an easement will be required over the entire right-of-way. The
Board of Public Works recommended approval of the vacation request,
and assignment of Class "A" classification, requiring appraisal and
payment, since the area has been improved and maintained by the City.
Audience comment was invited. Thomas E. Sprague, legal counsel for tt
petitioners, 4534 87th SE, Mercer Island, offered to respond to questions
regarding the proposal. Upon Council inquiry, Mr. Houghton indicated
that although the subject property lies within the area proposed for
annexation to the City of Tukwila, no comments were received from tha
City regarding the proposal; the subject site is not located within propert
designated for a proposed bicycle trail near Fort Dent; and the concern
that the proposal would result in landlocking the subject site no longer
exists since both parcels are owned by the petitioners. MOVED BY
MATHEWS, SECONDED BY REED, COUNCIL CLOSE THE PUBLIC
HEARING. CARRIED. MOVED BY MATHEWS, SECONDED BY
REED, COUNCIL APPROVE THE NELSON STREET VACATION,
VAC-002-86, WITH THE CONDITION THAT UTILITY EASEMENTS
BE RETAINED ON THE RIGHT-OF-WAY, AND THE PETITIONER
BE REQUIRED TO PAY ONE-FOURTH OF THE APPRAISED VALU
OF THE PROPERTY. CARRIED.

Correspondence was read from Public Works Director Richard C.
O ' -Houghton summarizing the findings of the Board of Public Works that th
area is not needed for traffic circulation, and the Police Department has
no objection to the vacation; zoning on the site, which was platted in
1957, is B-I, Business; the petitioners represent 100% of the abutting
property owners; retention of an easement is not required by City
departments, and approvals have been received from Group W Cable,
Puget Power, Washington Natural Gas, and Pacific Northwest Bell. The
Board recommended approval of the vacation request with the condition
that a public sidewalk located within the proposal be relocated to the
public right-of-way; and a bond in the amount of $1,500 be posted to
ensure that the relocation occurs. Since City funds have been expended
to improve and maintain the area to be vacated, the Board of Public
Works recommended assignment of a Class "A" classification, requiring
appraisal and payment.
Audience comment was invited. Richard Piacentini, Plaid Pantry
Markets, Inc., 601 Valley Street, Seattle, concurred in the
recommendations of the Board to relocate the sidewalk and post a bond.

Houghton reported that the existing large trees and most of the planter

PROCLAMATION A proclamation by Mayor Shinpoch declared the period August 11-17,
Renton River 1986, as Char and Mike Appreciation Week in the City of Renton to
Days salute Charmaine Baker and Mike Parness with pride and praise and
gratitude for coordinating Renton River Days, celebrated August 6-10.
Charmaine Baker accepted the award with gratitude on behalf of the
entire Renton River Days Task Force. She credited Council members
with starting the ball rolling by offering a City match for cash donations
up to $5,000, noting actual receipt of over $6,000 with sponsorships in
the amount of $3,000 as well as other donations. Special thanks were
extended to City employees who assisted in preparation for the
celebration, particularly information desk volunteers who sold T-shirts,
mugs and buttons. Mike Parness added that from his perspective there is
nothing wrong with the City's image, spirit of cooperation or enthusiasm.
He noted that people in the community really care as evidenced by
generous donations of money, time and equipment to make Renton River

PUBLIC This being the date set, Mayor Shinpoch reopened the public hearing to
HEARINGS consider the Ridgeview 75% Annexation Petition, continued from July 21,
Annexation: 1986, to allow residents of the Brier's Terrace area the opportunity to
Ridgeview 75% comment on the proposal. Letter from Policy Develoment Director was
Petition read reporting that a public meeting was conducted on 7/31/86, with
Brier's Terrace residents to answer questions regarding the Ridgeview
Annexation, located along the south side of 136th Avenue SE,
approximately 120 feet north of NE 24th Street. As a result of that
meeting, 16 to 18 residents joined the annexation. Added to the two
original annexation parcels, these signatures represent 90.19% of the total
assessed valuation of the potential expanded area. Therefore, the Policy
Development Department recommended that the City Council close the
public hearing on the original 75% Annexation petition and set a new
public hearing on 9/15/86, to consider the expanded annexation area.
Since there was no audience comment, it was MOVED BY MATHEWS,
SECONDED BY KEOLKER, COUNCIL CLOSE THE PUBLIC

Dear Mr. Struck:
The Environmental Review Committee (ERC) considered the environmental
impacts of your proposed development of a convenience store containing
4,266 square feet along with construction of gasoline pumps in a B-1 zone
located at 2801 N.E. Sunset Blvd. on Wednesday, July 16, 1986.
Their opinion, based upon recommendation from the Fire Prevention Bureau
and the Utilities Engineering Division of the Public Works Department
that additional information should be provided that addresses the issue
prior to the Committee reaching a environmental determination.
The ERC finds that the issue of contamination from the proposed gasoline
tanks needs further analysis and additional information is requested.
The concern is based upon the fact that the City has a constructed public
domestic water supply well within one block of the proposed location. You
should contact Mr. Glen Gordon, Fire Marshal, at 235-2528 and Mr. Robert
Bergstrom, at 235-2631 for further information.
In the past the City has required additional measures including double
wall tanks, electronic monitoring systems and secondary containment if
there is potential hazard to the general public.
The Committee would appreciate your addressing the specific issue and
respond in writing to them no later than Friday, August 15, 1986. If
you have difficulty in meeting this deadline, please contact me directly
at 235-2550 to determine an appropriate schedule necessary to provide
the information.

Plaid Pantry - Gas Pump Island
NE Sunset Boulevard and NE 10th Street
CONDITIONAL USE PERMIT
June 10, 1986
This proposal consists of the construction of a gas pump island, canopy and
underground fuel storage tanks in a paved area of a Plaid Pantry convenience
store, to be constructed. The site is zoned B-1 Business District, which
allows for "gasoline service stations" under a conditional use permit.
It should be noted that this proposal includes gas, pumps only. It does not
include any of the many other activities normally associated with a gasoline
service station, including lube and oil changes, tune-ups, auto repair, parts
replacement, auto storage, towing, etc. ; activities which have the greatest
impacts for this use category.
Justification of the appropriateness of this permit is founded in all of the
criteria used by the Examiner.
A. Comprehensive Plan:
The site is'designated Commercial in the Comprehensive Plan of August,
1985. This designation and the particular reference to "Community
Commercial" is to promote "attractiveness, convenience and viability" as
well as "clusters of commercial development. . .located to minimize travel
and congestion", in addition to other goals. This proposal meets and
exceeds all of these goals by providing a concentration of uses "at the
intersection of two arterials" while "not encroaching on another's service
area."
B. Community Needs:
1. Community need for this proposal is best demonstrated by the fact that
only one opportunity for gas service exists within 1/2 mile; this in a
community which is fast growing, not only with single-family
development but also, and in particular, multi-family development.
Thus, the ever increasing needs of these more dense populations must be
met outside of the immediate community which conflicts with the goal of
the Comprehensive Plan. Permitting this request will allow for a total
of two opportunities for gas service in this immediate community; a
situation which would "not result in either the detrimental
overconcentration of a particular use within the City or within the
immediate area".
2. The proposed location is particularly well suited for this use. The
on-site condition allows far greater services concentration while not
increasing impervious areas, decreasing landscaped areas, or increasing
traffic congestion. The off-site conditions allow far greater
utilization of existing arterials, as well as a concentration of uses
at an existing commercially zoned major intersection.
C. Effect on Adjacent Properties:
The proposal will have no adverse affect on adjacent properties. Adjacent
properties are currently zoned and developed as commercial usage. The
proposal has been coordinated with these adjacent properties to minimize
traffic congestion, light and glare impacts and noise.
Lot coverage when this proposal has been implemented will total 4,266.5
SF, or 21.07%. In addition, all other bulk regulations including
setbacks, landscape buffers, height, parking, signage and light and glare
will be met or substantially exceeded.
D. Compatibility:
The proposal is compatible with adjacent uses due to common zoning, as
well as being reinforced by the equal scale and character of all other
adjacent improvements.
E. Parking:
Parking will be unaffected by this proposal. CITY OF RENTON

E. Traffic and Circulation Patterns:
Traffic and circulation patterns of vehicles and pedestrians have been
designed to reduce congestion and increase safety both on and off-site.
Drives have been coordinated with adjacent and cross drives as well as
being located distant from the intersection.
G. Noise and Glare:
Noise and glare impacts are mitigated in this proposal by placing the gas
island at the center of the Sunset Boulevard frontage, shielded from view
to a great extent by existing and proposed landscaping at this point. The
adjacent property to the north is separated by this distance as well as an
intervening parking area along the subject site's northerly property line.
H. Landscaping:
Landscaping will be provided as shown in the submitted plan. The ;design
includes a 10 foot wide buffer of ground cover, shrubs and trees along the
entire length of the proposed gas island and auto lines.
We are confident that this proposal meets or exceeds all of the criteria for
justification required for the Examiner to favorably consider this
application. We therefor request that a Conditional Use Permit to allow the
subject site to be developed with a gas island, canopy and underground
storage tanks be granted. We look forward to your conclusion.

Purpose of Checklist:
The State Environmental Policy Act (SEPA), chapter 43,21C RCW, requires all
governmental agencies to consider the environmental impacts of a proposal before making
decisions. An environmental impact statement (EIS) must be prepared for allproposals
with probable significant adverse impacts on the quality of the environment. The purpose
of this checklist is to provide information to help you and the agency identify impacts
from your proposal (and to reduce or avoid impacts from the proposal, if it can be done)
and to help the agency decide whether an EIS is required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about your
proposal. Governmental agencies use this checklist to determine whether the
environmental impacts of your proposal are significant, requiring preparation of an EIS.
Answer the questions briefly, with the most precise information known, or give the best
description you can.
You must answer each question accurately and carefully, to the best of your
knowledge. In most cases, you should be able to answer the questions from your own
observations or project plans without the need to hire experts. If you really do not know
the answer, or if a question does not apply to your proposal, write "do not know" or "does
not apply." Complete answers to the questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and
landmark designations. Answer these questions if you can. If you have problems, the
governmental agencies can assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do
them over a period of time or on different parcels of land. Attach any additional
information that will help describe your proposal or its environmental effects. The
agency to which you submit this checklist may ask you to explain your answers or provide
additional information reasonably related to determining if there may be significant
adverse impacts.

2. Air Emissions
During construction there will be construction equipment
exhaust which will be of a minor and temporary nature. These
impacts will be held to a minimum by properly maintaining the
equipment and by shutting the equipment off when not in use.
After construction, the gas pump nozzles will allow vapors to
emit during the fueling operation. This impact is
intermittant and will be mitigated by the use of automatic
nozzle shut-offs and fuel tank/nozzle gaskets maintained to
meet or exceed standards set by the EPA, PSAPC and the City
of Renton.
Vapor emission during fueling from the delivery trucks to the
storage tanks will be controlled by a Stage I Vapor Recovery
system conforming to current law.
3. Water
The underground fuel storage tanks are Type III double lined
steel , are pressure tested prior to installation and again
on-site. The inner and outer surfaces will be electronically
monitored at all times to warn the operator in the unlikely
event of seepage and ground contamination.
