Dear Mr. Miller:
We have received your letter informing us that Kiewit
Construction Company is interested in now developing the Food
Service Brokerage (above-referenced) approved in September, 1987 .
You requested waiver of environmental review for this project,
based upon the fact that only minor modifications are being
proposed for the previously approved development and also,
because, the initially approved application expired recently.
Staff has researched the files and determined that the building
permit for Food Service Brokerage expired in December, 1989 . The
zoning permit expired in September, 1989 ; the Environmental
Checklist was, as is customary, valid only for a period of one
year.
Research into SEPA Rules and the City's Environmental Review
Ordinance indicates that these guidelines require new
environmental review and new administrative site plan review for
the project. Application forms have been sent to Cindy Larson.
Once we receive the revised application materials, we will
immediately begin the review process, and provide periodic
progress reports.

WHEREAS , the owner( s ) of said described property desire to
impose the following restrictive covenants running with the land as
to use , present and future , of the above described real property .
NOW , THEREFORE , the aforesaid owner( s ) hereby establish ,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned ,
their successors , heirs , and assigns as follows :
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner( s ) of the above described property , their suc-
cessors , heirs and assigns , hereby agree and covenant to
participate in , sign a petition in support of , and accept
a future Local Improvement District ( LID)
for the
following
purposes of providing thennecessary off-site improvements
required by the Renton Subdivision Ordinance :
the installa-
tion of curbs , gutters , sidewalks , street paving , sanitary
sewers , storm sewers , undergrounding of utilities , and
street lighting .
These covenants are imposed in lieu of Section 9- 1105 (6 )
of Title IX of Ordinance #1628 of the City of Renton .
DURATION
These covenants shall run with the land and expire on
December 31 , 2025 . If at any time improvements are
installed pursuant to these covenants , the portion of
the covenants pertaining to the specific installed improve-
ments as required by the Ordinances of the City of Renton
shall terminate without necessity of further documentation .
Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of King
County by either the City of Renton or any property owners adjoining
subject property who re adversely affected by said breach .

APPLICANT: Gerald Grieve
LOCATION: Property located on the east side of Lake
Washington Boulevard N.E. at the 4900 block.
SUMMARY OF REQUEST: The applicant seeks site plan approval to
allow the construction of a two-story office
building having approximately 13 , 157 square
feet on a 1. 26 acre site.
COMMITTEE REVIEW: The review was conducted at 10: 00 a.m. on
May 20, 1987, in the third floor conference
room of the Renton Municipal Building.
The Committee review was conducted after receiving written comment
from all divisions of the Public Works Department, both divisions
of the Building and Zoning Department, and the Fire, Police, Parks
and Policy Development Departments.
The following exhibits were entered into the record:

FINDINGS, CONCLUSIONS AND DECISION
Having reviewed the written record in the matter, the Site Plan
Review Committee, the Site Plan Review Committee now makes and
enters the following:
Findings:
The applicant, Gerald Grieve, has requested site plan approval
to allow the construction of a two-story office building
having approximately 13 , 157 square feet on a 1. 26 acre site.
2 . The applicant' s file containing the application, the State
Environmental Policy Act (SEPA) documentation, the comments
from various City departments, the public notices requesting
citizen comment, and other pertinent documents was entered as
Exhibit No. 1.
3 . Pursuant to the City of Renton's Environmental Ordinance and
SEPA (RCW 43 . 21C 1971 as amended) , a Determination of Non-

3 . Pursuant to the City of Renton's Environmental Ordinance and
SEPA (RCW 43 . 21C 1971 as amended) , a Determination of Non-
Significance - Mitigated was issued for the subject proposal
on June 3 , 1987, with the following conditions:
a. That the owner or future assignee agrees to participate
in a local assessment district to cover their fair share
of the interchange improvement costs on Exit 7 .
NOTE: These costs will be levied on a regional basis.
b. That the applicant bond for their estimated fair share of
these improvements at a rate of $91. 44 per vehicle trip
prior to the issuance of the occupancy permit for the
first building.
c. That the applicant provide covenants to the City to
ensure:
That the property owner will participate in any future
LID in the area.
4 . Plans for the proposal have been reviewed by all City
departments affected by the impact of this proposal .
b>. The map element of the Comprehensive Plan designates the
subject property as low density-multiple family. This type of
development is not mandated where other Comprehensive Plan
policies or other circumstances may affect the type of
development on the subject property.
6. The subject site was annexed into the City in April of 1960 by
the adoption of Ordinance 1823 . The site was automatically
zoned G-9600 upon annexation. A rezone request R-217-78 to
reclassify the site to R-3 was dismissed by the City. The
site was rezoned to R-2 in July, 1980, by the adoption of
Ordinance 3446. The site was later reclassified B-1, Business
Use, with the adoption of Ordinance No. 3952 adopted in
October 1985.
As part of the rezone action to B-1, Business Use, the City
Council approved covenants limiting the height of buildings on
the property to a maximum of 35 feet and restricted
development on the site to office uses only. Development
would be subject to site plan review.
7 . The subject site is surrounded by residential uses to the
north and east; commercial and multiple-family development to
the south; and I-405 to the west.
Ez . The applicant's site plan complies with the requirements for
information for site plan review.
Conclusions:
7_. The subject proposal generally complies with the policies and
codes of the City of Renton.
Specific issues raised by various City departments and
focused on:
a. Compliance with the parking and loading
requirements/driveway widths.
b. Landscaping.
c. Rockery standards.
d. Off-site improvements.

e. Traffic mitigation.
3 . The site plan as proposed needs to be revised to comply with
the requirements of the parking and loading ordinance. The
following lists the changes which will bring the proposal into
compliance:
a. Revising the driveway shown on the site plan to reflect
the code requirement of a maximum width for commercial
driveways is 30 feet (52 feet is shown on plans) . A
variance may be sought with the Board of Public Works.
b. Revising handicap parking stall widths to reflect a
requirement of 12 1/2 feet for width.
c. Revising the number of parking stalls to 49 instead of
the 48 .
d. Revising the number of compact parking stalls to 15
instead of the 16 shown on the plans.
t . Section 4-716 requires a ten foot landscaped setback from the
street property line. This requirement is met or exceeded for
most of the frontage area along Lake Washington Boulevard.
Only by parking stall No. 42 do the plans show less than 10
feet of landscaping to the street property line. This must be
revised.
The site plan shows the use of rockeries along Lake Washington
Blvd. in front of the building and around the northern most
parking stalls. Rockeries over 4 feet in height are not
allowed in the City of Renton unless a geotechnical study is
prepared and signed by an engineer verifying that the rockery
will hold. The applicant will need to have such a study
prepared and submitted to the Building and Zoning Department.
6. The Public Works Department has identified a number of
improvements along the frontage of the property. These
improvements have been deferred for one year which ends
November 13 , 1987. In addition the original property owner
filed a covenant on the property agreeing to participate in
any future LID.
The subject proposal will generate additional trips to a
corridor which is becoming congested and needing roadway
improvements. The Public Works Department has established a
Benefit Area and per trip fee.The Environmental Review
Committee has required conditions of the applicant to
participate in any future LID and to pay their fair share of
local area improvements.
E . The Traffic Engineer, in looking at the island in the
driveway, has suggested that the island be better designed in
order to more clearly define the access and control
circulation through the parking lot. The applicant should
work with the Building and Zoning Department and the Traffic
Engineer on additional landscaping and redesign of the island.
c . The garbage bin is located on the south side of the parking
lot near the loading area. Garbage trucks will be required to
drive through the full length of the parking lot to reach the
garbage bin. In order to eliminate potential problems between
vehicles and the garbage trucks, the applicant shall work with
the Building and Zoning Department staff on relocating the bin
closer to the driveway.

10. The proposal is consistent with the requirements of the B-1,
Business Use Zone and covenants on the property with respect
to height, use, and site plan review. The proposed
architecture and quality of design is compatible with the
adjacent residential uses and a good addition to the City of
Renton.
Decision:
The site plan for Gerald Grieve, file SA-029-87, is subject to the
following conditions:
L. That the applicant shall comply with the conditions of the
Environmental Determination of Non-Significance - Mitigated.
The the applicant should provide a ten foot landscaped setback
from parking stall No. 42 to the street property line.
3 . That the applicant shall provide a geotechnical study approved
by an engineer supporting the use of rockeries as shown on the
site plan.
1 . That the applicant shall work with the City's Landscape
Architect and the Traffic Engineer to redesign and provide
additional landscaping for the island located in the driveway.
5. That the applicant work with the City' s Landscape Architect on
suitable locations for relocating the garbage bin.
For the purpose of these decisions, the term "should" and "shall"
are to be considered mandatory and the term "may" is considered
discretionary.

REQUESTS FOR RECONSIDERATION must be filed in writing on or before
September 7, 1987 . Any aggrieved person feeling that the decision
of the Site Plan Review Committee is based on erroneous procedure,
errors of law or fact, error in judgment, or the discovery of new
evidence which could not be reasonably available prior to the
meeting date of , 1987, may make a written request to the Zoning
Administrator for review by the Site Plan Committee within fourteen
14) days of the decision. This request shall set forth the
specific errors relied upon by such appellant, and the Committee
may, after review of the record, take further action as it deems
proper.
AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section
3011 (B) (1) , which requires that such appeals be filed directly with
the Hearing Examiner. Appeals must be made in writing before
5 p.m. on September 7 , 1987 .
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte
private one-on-one) communications may occur concerning land use
decisions.
ill communications after the decision date must be made in writing
through the Zoning Administrator. All communications are public
record and this permits all interested parties to know the contents
of the communication and would allow them to openly rebut the
evidence in writing. Any violation of this doctrine could result
in the invalidation of the request or appeal by the Court.
The Doctrine applies not only to the initial committee decision,
but to all Requests for Reconsideration as well as Appeals to the
Hearing Examiner.

Comprehensive Plan designates low density multi-family.
Samek-McKague noted three major issues - whether sufficient informationhasbeenprovidedwithrespecttocontrollingsurfacewaterrunoffandpotentialerosion; whether sufficient measures have been taken tomitigatetrafficimpacts; and whether sufficient measures have been takentoprovideon-site recreation amenities for employees. Three issues were noted: amenities, the need to break the scale of the
building, and parking. Erickson suggested a running tab on all parkingforthisfacility. Boeing responded that it was a temporary building and
that parking was therefore temporary.
Discussion followed regarding the definition of temporary. There was
general disapproval expressed regarding these kinds of building and thatitwasfeltthatthebuildingneededtobetreatedasapermanent
structure.

MOVED BY NELSON, SECONDED BY SPRINGER, THAT MORE INFORMATION IS NEEDED
REGARDING AETHETICS, A DEFINITION OF TEMPORARY, THE DESIGN OF THE

that there are problems with loans and the process. He said they are
putting into writing regarding the delegation of responsibilities. He

Erickson referred the Committee to the staff recommendations regarding
areas to be addressed. He reported that they have met with the applicant
and his architect and that they have already got statements of
qualifications from five consultant firms that do EIS's. He asked that a
subcommittee be established to start screening those applicants. The
following people were designated to comprise the committee: Erickson,
Springer, and Adamson.
With regard to the area under review, Springer suggested the possibility
of transferring the commercial designation to the Sabey site, inasmuch as
the area intended for commercial use has been developed in office park
and manufacturing park.

Boulevard N.E. at the 4900 block: Samek-McKague noted that the property
had been rezoned to B-1, business, due to its proximity to I-405. The
Comprehensive Plan designates low density multi-family.
Samek-McKague noted three major issues - whether sufficient information
has been provided with respect to controlling surface water runoff and
potential erosion; whether sufficient measures have been taken to
mitigate traffic impacts; and whether sufficient measures have been taken
to provide on-site recreation amenities for employees. She noted the
presence of restrictive covenants on the site requiring limiting
development to office uses, requiring site plan review, and limiting the
height of future structures to 35 feet. Also, the property was short
platted last year and the Board of Public Works granted a deferral of the
off-site improvements. She advised that the site is located in the
benefit area for N.E. 44th - Lake Washington Blvd. , and the applicant
will be assessed $103.63 per trip. With regard to the control of
stormwater runoff, it appears that the applicant has provided sufficient
measures to control the erosion. Relative to the fairly steep north side
of the site, the applicant has proposed to stay out of up to 35% of the
steep slopes on the north side and southwest tip of the site. There will
be landscaping, and grading operations will be excluded. Provisions for
employees have been proposed for the employees on the east side.

portions of the site where people could walk down to and suggested the
possibility of a platform.
Samek-McKague advised that staff is recommending that the Environmental
Review Committee issue a Determination of Non-significance - mitigated
with conditions that the applicant participate in the Area Benefit
District and pay an assessment fee and that there be covenants to keep
development out of the steep slope area of the site.
Discussion followed. Norris stated that they are working to have a
package put together to make the Area Benefit District more formal and
confirmed that the assessment would be at $103.63 per trip generated. He
recommended that be paid by the applicant at the time an occupancy permit
is issued.
Nelson noted that they have been talking about 'an L.I.D. for all
improvements along Lake Washington Boulevard and N.E. 44th. Springer

A. BACKGROUND:
PROJECT: Gerald Grieve (Foodservice Brokerage Company
Building)
ENVIRONMENTAL CHECKLIST: ECF-026-87
APPLICATION NO. : SA-029-87
DESCRIPTION OF PROPOSAL: Application for site plan approval to allow the
construction of a two-story office building
having approximately 13,157 square feet on a
1.26 acre site.
LOCATION OF PROPOSAL: Located on the east side of Lake Washington
Boulevard N.E. at the 4900 block.
B. HISTORICAL BACKGROUND: The property at one time was zoned R-2,
residential-two family. In 1985, the property
was rezoned to B-1, business, due to the noise
from I-405 which made the site undesirable for
residential use. When the property was rezoned,
the following restrictive covenants were
required limiting development on the site to
office uses, requiring site plan review and
limiting the height of future structures to 35
feet.
C. ISSUES: 1. Whether sufficient information has been
provided with respect to controlling
surface water runoff and potential
erosion.
The applicant in the checklist and on the
plans shows the measures to control surface
water runoff. The existing seasonal
drainage ditch on site will be directed to
an on-site retention area and existing
storm drainage system. Filter fences will
also be used to control erosion. Finally,
in addition to these measures, the
applicant proposes to stay out of the steep
sloped areas. These areas should not be
disturbed.
2. Whether sufficient measures have been taken
to mitigate traffic impacts.
The proposal is expected to generate
approximately 233 trips. The Public Works
Department has established a Benefit
District for off-site improvements required
along Lake Washington Blvd. N.E. The
applicant will be assessed $103.63 per trip.

Policy Development: More information requested on environmental
health, recreation and transportation. Major

comments were made:
1. The north side of the site is fairly steep,
with an elevation change of approximately
20-30 feet. This area should be left
undisturbed as is indicated on the site
plan.
2. An easement should be provided to protect
the drainage channel on the south side of
the site.
3. A temporary erosion control plan should be
provided as part of the checklist.
4. Information needed on mitigating measures
that will be taken to lessen the noise
impact from I-405.
5. The proposed use is consistent with
existing zoning. The Comprehensive Plan
designates the site as low density
multi-family.However, the aesthetic
quality and design of the proposed building
is compatible with neighboring residential
uses.
6. Information needed on what types of offices
will occupy the building.
7. Passive recreation amenities should be
provided. The potential exists for a trail
linkage between the site, adjacent to
I-405, to May Creek.
8. Accuracy of the projected 60 trips/day for
an office complex housing 20-40 employees
should be checked.
