SUMMARY AND PURPOSE OF REQUEST: Application for conditional use permit to allow the expansion of an industrial use on property zoned B-1, Business Use. The expansion will add 2,800 sq. ft. to the second floor. In addition, the applidant will be remodeling 2,775 sq. ft. on the second floor and a new !roof over 4,500 sq. ft. of work space. Water: A 16-inch water line is located along Main Avenue South; an 8-inch water line along South 4th Street; and a 4- inch water line is located along Wells Avenue South. These lines are adjacent to the subject site. b. Sewer: 8-inch sanitary sewer lines are located along Main Avenue South and along Wells Avenue South adjacent to the the subject property. c. Storm Water Drainage: Storm Water flows into an existing storm water drainage system. 2 . Fire Protection: Provided by the City of Renton as per ordinance requirements. 3 . Transit: N/A 4 . Central Area Plan, City of Renton Comprehensive Plan Compendium, March 1986, pp. 61-67. G. DEPARTMENT ANALYSIS: 1. The applicant, Azaria Rousso for Service Linen, seeks approval of a conditional use permit to allow the expansion of an industrial use on property zoned B-1, Business use. This expansion will allow for additional office space as well as a storage room for linen, shirts and other laundry. In addition the, applicant will be remodeling 2,775 square feet on the second floor currently used for office space and will add a new roof over 4,500 square feet of the work area. BUILDING AND ZONING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING February 9, 1988 Page 3 The applicant, in 1985, sought a conditional use permit to allow the expansion of the commercial laundry by a 3,587 square foot addition to the building. This application was approved with conditions by the City Council following an appeal of the Hearing Examiner's decision. One of the conclusions reached by the Council was as follows: "The laundry operation of the applicant is a legal non-conforming use in the B-1 Zone at the subject site. " (Note: Conclusion 1 of revised conclusions of the Hearing Examiner's Report. 2 . As noted above the subject property is zoned B-1, Business Use which does not allow commercial laundries outright but rather allows them through a conditional use permit. At one time, the commercial laundry at the subject location was allowed as an outright permitted use. However when the portions of the Zoning Code were amended in 1983, commercial laundries were allowed by conditional use permits and allowed outright in the L-1, Light Industrial Zone. 3 . Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, the Environmental Review Committee issued a Determination of Non- Significance- Mitigated on December 23, 1987, with the following. conditions: a. That the applicant hire a State certified consultant to conduct a Product Tightness Test on the existing underground storage tanks on the site and report the findings to the City's Fire Prevention Bureau and the Environmental Review Committee. b. That the applicant agree to carry out further mitigation measures as necessary if the existing tanks prove to be faulty. 4. Asinoted above, the subject site has been found to be a legal • non-conforming use and is subject to the City's regulations on non-conforming uses. In Section 4-726 on non-conforming uses, there are specific sections which deal with alterations and extensions of a non-conforming use. The first code section, Section 4-726 (2) and (3) state: 1 Alterations: A nonconforming building or structure may be altered, improved or reconstructed in compliance with the requirements of the City Code, provided such work is not to an extent exceeding an aggregate cost of fifty percent(50%) of the value of the building or structure, unless the building or structure is changed to a conforming use. " I "Extension: A nonconforming use shall not be extended, but the extension of a lawful use to any portion of a nonconforming building or structure which existed prior to the enactment of this Code shall not be deemed the extension of such nonconforming use. "t In reviewing the subject application in light of the above Code sections, staff believes that Section 4-726 (3) will not allow the requested addition to the building. As we read the Section, the use would have to be contained entirely within the existing building's footprint. The applicant's request is for approval of a new addition to the building, not a modification of existing space within the current building. Therefore, even if a conditional use permit is applied for and the applicant satisfies the requirements of Section 4-726 (2) with respect to alterations, Section 4-726 (3) would override the other code sections and would not allow the City to approve the application. In ;addition to the above, the applicant has not asked that the entire use be reviewed under a conditional use permit so that the use can be brought into compliance with the the requirements of ;Section 4-711 on Business Use (B-1) or Section .4-748 on Conditional Use Requirements. Until such time that the applicant provides a revised application for the entire use, staff can only recommend denial of the application based on City codes and City policy which support the phasing out of non- conforming uses. Please note that we are NOT suggesting that we the City will approve a conditional use permit for the entire site. Such an application will need to be evaluated on its own merits in light of City policies and regulations as well as impacts on the surrounding neighborhood. H. DEPARTMENTAL RECOMMENDATION: Based 'upon the above analysis, it is recommended that the conditional use permit for Azaria Rousso (for Service Linen) be denied. 1 e 4. 11--,..J II 1!' The applicant, Azaria Rousso for Service Linen, seeks approval of a conditional use permit to allow the expansion of an industrial use on property zoned B-1, Business use. This expansion will allow for additional office space as well as a storage room for linen, shirts and other laundry. In addition the, applicant will be remodeling 2 ,775 square feet on the second floor currently used for office space and will add anew roof over 4,500 square feet of the work area. BUILDING AND ZONING .__PARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING February 9,, 1988 Page 3 The applicant, in 1985, sought a conditional use permit to allow the expansion of the commercial laundry by a 3,587 square foot addition to the building. This application was approved with conditions by the City Council following an appeal of the Hearing Examiner's decision. One of the conclusions reached by the Council was as follows: "The laundry operation of the applicant is a legal non-conforming use in the B-1 Zone at the subject site. " (Note: Conclusion 1 of revised conclusions of the Hearing Examiner's Report. 2 . As noted above the subject property is zoned B-1, Business Use which does not allow commercial laundries outright but rather allows them through a conditional use permit. At one time, the commercial laundry at the subject location was allowed as an outright permitted use. However when the portions of the Zoning Code were amended in 1983, commercial laundries were allowed by conditional use permits and allowed outright in the L-1, Light Industrial Zone. 3 . Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, the Environmental Review Committee issued a Determination of Non- Significance- Mitigated on December 23, 1987, with the following conditions: a. That the applicant hire a State certified consultant to conduct a Product Tightness Test on the existing underground storage tanks on the site and report the findings to the City's Fire Prevention Bureau and the Environmental Review Committee. b. That the applicant agree to carry out further mitigation measures as necessary if the existing tanks prove to be faulty. 4. As noted above, the subject site has been found to be a legal non-conforming use and is subject to the City's regulations on non-conforming uses. In Section 4-726 on non-conforming uses, there are specific sections which deal with alterations and extensions of a non-conforming use. The first code section, Section 4-726 (2) and (3) state: Alterations: A nonconforming building or structure may be altered, improved or reconstructed in compliance with the requirements of the City Code, provided such work is not to an extent exceeding an aggregate cost of fifty percent(50o) of the value of the building or structure, unless the building or structure is changed to a conforming use. " Extension: A nonconforming use shall not be extended, but the extension of a lawful use to any portion of a nonconforming building or structure which existed prior to the enactment of this Code shall not be deemed the extension of such nonconforming use. "t In reviewing the subject application in light of the above Code sections, staff believes that Section 4-726 (3) will not allow the requested addition to the building. As we read the Section, the use would have to be contained entirely within the existing building's footprint. The applicant's request is for approval of a new addition to the building, not a modification of existing space within the current building. Therefore, even if a conditional use permit is applied for and the applicant satisfies the requirements of Section 4-726 (2) with respect to alterations, Section 4-726 (3) would override the other code sections and would not allow the City to approve the application. In addition to the above, the applicant has not asked that the entire use be reviewed under a conditional use permit so that the use can be brought into compliance with the the requirements of Section 4-711 on Business Use (B-1) or Section .4-748 on Conditional Use Requirements. Until such time that the applicant provides a revised application for the entire use, staff can only recommend denial of the application based on City codes and City policy which support the phasing out of non- conforming uses. Please note that we are NOT suggesting that we the City will approve a conditional use permit for the entire site. Such an application will need to be evaluated on its own merits in light of City policies and regulations as well as impacts on the surrounding neighborhood. H.
