S.,RENTON WA 98055 Dear Mr. Carlson: Through the Consent Agenda process, the Board of Public Works members have reviewed your request to waive the curb,gutter and sidewalks at 1509 Davis Ave. S. and recommended denial. The Board further recommended that the short plat be granted a deferral to install the curbs, gutter and sidewalks with the condition that the applicant sign a Restrictive Covenant, agreeing to participate in any future LID or other City initiated roadway improvement project. Kaufman, Hearing Examiner City of Renton Municipal Building, Third Floor Renton, WA 98055 Gentlemen: REFERENCE: LUA-97-178,SHPL I would like to appeal the decision with reference to my short plat application and request reconsideration. The Administrative Short Plat Report and Decision document states under G. DEPARTMENT ANALYSIS, 5. Consistency Short Plat Criteria, c) Compliance with Subdivision Regulations, Streets: No new streets will be created by this short plat. The applicant will be required to install all appropriate Code required improvements. I asked for a waiver on sidewalks and gutters as well as the requirement regarding a sprinkler system. There are no sidewalks in this neighborhood. As of the writing of this letter, I have not heard back on this matter. An access and utility easement document was submitted at the time of the application by the surveyor, Tom Touma. I am appending a second copy for your review. With reference to the Article H. Decision, 7, I spoke with and met with Fire Marshall Art Larson and Abdoul Gafour, civil engineer. At that time, they assured me that the four-inch water main an the six-inch water main on 15th Avenue were in such close proximity and hooked together so that the fire hydrant now located just of 15th and Davis Avenue would have the necessary 1,000 GPM capacity needed for my home and would obviate the need for a sprinkler system. They assured me that the sprinkler system requirement would be removed. I am appending a copy of their memo addressed to Mark Pywell, Planner, and directing deletion of all but the first sentence of Article 7. At the present time, there are street lights on Davis Avenue. However, there are no curbs, sidewalks or gutters, just berms which seem to be ample at the present time. I would like to request a waiver of these items being required before I can short plat my property and am enclosing drawings for your perusal. Your consideration would be appreciated. Based on the information provided by Abdoul Gafour on October 17th relating to the installation of the new hydrant at S 15th and Davis Ave. S and that it would be able to deliver the required 1000 GPM. I am requesting that Item 7 in this decision be modified for the permanent file, to read as follows: 7. The applicant is required by Code to install a fire hydrant within 300 feet of the location of a home on the new lot. ( Delete the rest of the paragraph relating to the sprinkler requirements). The hydrant will be connected to an existing 4" looped water main in Davis Avenue So. CC: Lys Hornsby - Water Utility Supervisor Ray Sled - Water Maintenance Manager ii/wtr/phut w/carlsonl Renton /B/PW Department Administrative Land Use Action JRT AND DECISION DATED January 12,1998;PROJECT LUA-97-178,SHPL Page 5 The Code-required improvements for short plat include the requirement that a fire hydrant capable of delivering 1,000 gpm be located within 300 feet of each new home. In this case there are no existing fire hydrants within 300 feet of the rear lot. The applicant can locate a fire hydrant along the street that will be within 300 feet of the rear lot. The new hydrant would be served by a four inch water main that is only capable of providing 624 gpm. The Fire Prevention Bureau notes that in lieu of installing a new water main the applicant can choose to sprinkler the rear house. The applicant will need to record a note on the face of the plat that the rear home Recreation: The applicant will not be providing on-site recreation facilities. The closest park to this location is the Lake Street Park. It is anticipated that the new residents allowed by this subdivision will use the existing City parks and recreational facilities. The Community Services Department has established a Parks Mitigation Fee of$530.76 per new single family lot. As one new lot are being created, the mitigation fee for this short plat will be $530.76. Schools: It is anticipated that the proposed short plat will only generate one new school age child. The Renton School District has the capacity to accept new students. Storm Water: This short plat will not create a large enough impervious surface area that is subject to vehicular travel to trigger the need for an on-site storm water system. Existing storm water sheet flows across the site. This action will continue after the new house is constructed on the site. Water and Sanitary Sewer Utilities: Adequate water and sanitary sewer service exists in the adjacent streets. The applicant will need to provide service to the new lot. The existing service lines should not have to be replaced. H. DECISION: The Short Plat, File No. LUA-97-178,SHPL-A, is approved subject to the following conditions: 1. The applicant shall submit a Transportation Mitigation Fee of$716.50 to mitigate the impact of this development on the City's street system. This fee shall be submitted prior to the recording of the short plat. 2. The applicant shall submit a Fire Mitigation Fee of$488 per new single family residence prior to the recording of the shot plat. 3. The applicant shall submit a Parks Mitigation Fee of$530.76 per new single family residence prior to the recording of the short plat. 4. The applicant shall record an access and utility easement across the southern portion of Lot 1 for Lot 2 prior to the recording of the short plat. The easement will need to be prepared to the satisfaction of the Development Services Division. 5. The applicant shall move the shed from Lot 2 to Lot 1 prior to the recording of the short plat. 6.
