Renton,WA 98055 Subject: Property Owner and Taxpayer Opposition to Project Rezone re:oject LUA-98-047 ,CPA,ECF/KENNYDALE EXIT 7 CPA/REZONE Ms. Lind., This letter transmits comments to the proposed project application to rezone property from current R-10 status to a R-14 status per the subject project reference. The rezone will not provide the development of attractive and safe neighborhoods, therefore the undersigned are against the proposed rezone for the following reasons: i 1. Density contrast with current adjacent property 2. Public services will suffer unacceptable quality strains (fire,police, water, sewer, street maintenance,library, parks, etc.). These services are typically mitigated at the owners expense, but long term expansion issues are not addressed. Do we need an additional fire station, police patrols, side walks, increased water runoff capacity, increased capacity to current water supply (quantity, pressure and quality), emergency services upgrades? 3. Public school system is already at a maximum and expansion issues not addressed 4. Traffic safety will decrease with the increase in automobile traffic. There is a blind corner on steep hill at this site. Will we need additional street lighting and traffic signals? How about more traffic patrols and reduced roadway speeds? In conclusion, the landowner of this property should be able to develop profitable enterprises with current R-10 zone and therefore a new rezone is unnecessary. A new rezone will cause no benefits to the community. There is sufficient evidence that suggests a new rezone will degrade the current community quality. The parcels are located at Exit 7 adjacent to Lincoln Ave. NE between NE 43rd Street and NE 40th Street. Figures 1 and 2 show the study area boundary. The existing Residential Options designation includes eight parcels held by six different owners. The majority of the property is undeveloped acreage, however, there are 4 existing residential structures with accessory buildings within this designation. The area is at the Renton/Newcastle City limits. The adjacent parcels' designations in Renton are Single Family Residential with R-8 zoning to the south and Commercial Arterial designation to the west. ISSUE SUMMARY 1. Is a higher density residential designation appropriate for this site? 2. What is the appropriate designation from the vacated right-of way adjacent to Lincoln Ave.? 3. Are 100%attached unit types appropriate for this site compared with 50%attached unit types? RECOMMENDATION SUMMARY Designation of the study area as Residential Planned Neighborhood with concurrent R-14 zoning is recommended with the condition that the vacated right of way occurring along portions of Lincoln Ave. N. E. be designated Commercial Arterial. ANALYSIS The Residential Options and the Residential Planned Neighborhood designations have similarities of purpose and intent. Single family unit types are an allowed use in both zone designations. Both designations permit a range of unit types and are intended to allow alternatives to larger apartment complexes consisting of smaller scale multi-family buildings designed to look like or include characteristics of single family unit types. The difference between the designations is that the Residential Option (R-10 zoning) is a mixed use single family/attached townhouse zone while the Residential Planned Neighborhood (R-14) is an attached townhouse/small scale multi-family zone. The Residential Options (R-10) limits density to 10 dwelling units per acre and only allows attached units to comprise 50%of a project. A proposed Comprehensive Plan Text Amendment (98-T-4) would allow up to 13 dwelling units per acre as a bonus for an R-10 single family detached project. Residential Planned Neighborhood (R-14 zoning) allows 14 dwelling units per acre and up to 18 dwelling units per acre with a bonus. Under specific conditions relating to size of building clusters, height, and length of structures,all units in the R-14 zone may be attached unit types. The site is sloped with average slopes ranging between 15 to 21 percent. The northeast portion of the site includes a wetland (shown as W-17) on Figures 1 and 2. Parcels to the north in the City of Newcastle are developed with multi-family. Other parcels in Newcastle are developed with or proposed for single family and attached single family uses. To the west(Renton) a condominium project is approved at 20 dwelling units per net acre. The site is on the boundary of a commercially zoned but underutilized area. Parcels in this proposed amendment area could reasonably be developed at either R-10 or R-14 densities and provide a transitional land use between the commercial and multi-family areas and the single family areas. Issue 2 -What is the appropriate designation for the vacated right-of way adjacent to Lincoln Ave.? A portion of the site along the old right-of-way on Lincoln Ave. N. E. is physically separated from the bulk of the site. This portion of the right-of-way eventually may be vacated. Upon future vacation,the portion of land adjacent to the commercial designation should be designated Employment Area Commercial rather than Residential Planned Neighborhood because the land area will become contiguous to commercial rather than residential lands. At this level of review it is not clear whether this right-of-way area would have any development potential,however, future uses would be best realized through the Employment Area Designation. PI anning/amends/98M-7 DEVELOPMENT PLANNING 98-M-7 CITY OF RENTON Page 3 MAR 3 1 1998 Issue 3 -Are 100%attached unit types appropriate for this site compared with 50%attache}Ee E D Since the intent and allowed unit types are similar in these two designations, the difference in project type depends as much on the number of attached units and building height, scale and length as on density. This site has features (slope and wetland) which make it difficult to use all of the site in a conventional plat with street grid road network and 50%detached units. Consequently a clustering of units is likely to occur with either the R-10 or the R-14 development standards. Residential Planned Development provides greater flexibility for developing the site because it does allow all of the units to be attached. CAPACITY ANALYSIS These properties were included in the partially developed category in the 1993 capacity analysis in recognition of the existing single family structures on the sites. Additional capacity forecast for the parcels is 46 units with R-10 zoning, 23 single family and 23 multi-family. If the zoning is changed to R-14 for this area, capacity would increase to approximately 80 multi-family units. This would increase multi-family capacity in the City by 57 units and decrease the single family capacity by 23 units. Areas may be mapped Residential Planned Neighborhood on the Land Use Map where the site meets the following criteria: a. adjacent to major arterial(s); b. adjacent to employment area and/or Centers; c. part of a designation totaling over 20 acres (acreage may be in separate ownership); d. site is bufferedfrom single family areas or other existing incompatible uses; and e. development within the density and unit type range is achievable given environmental constraints. Policy LU-48. Residential neighborhoods may be considered for the Residential Options Designation if they meet three of the following criteria: a. The area already has a mix of small scale multi family units or had long standing duplex or low density multi family zoning; b. Development patterns are established. c. Vacant lots exist or parcels have redevelopment potential. d. Few new roads or major utility upgrades will be needed with future development. RECEIVED The study area generally conforms to the Residential Planned Neighborhood criteria better than the Residential Options criteria. It is approximately 20 acre is size. It is located adjacent to an Employment Area rather than a Center. The study area is effectively buffered from single family areas due to slope. It is located adjacent to I-405. The study area includes environmentally constrained areas, notably steep slopes and wetlands. Attached units may be accomplished on the site with less grading and soil disturbance than a conventional subdivision with detached housing. The study area fails to conform to the Residential Options criteria(compliance with three mapping criteria are required). a)The area does not have existing small scale multi-family uses or a pattern and history of duplex uses. b) The area is does not have a defined development pattern. c) The area does include vacant and redevelopable properties. d) Development can occur will few roads or major utilities upgrades. e) The study area no longer is adjacent to a Center designation. The adjacent commercial area was originally designated Suburban Center in 1993. At that time, the existing Residential Options designation was established as a transition to single family uses anticipated to occur in the area. This adjacent area eventually incorporated as Newcastle. In 1996 the Center designation was removed and the commercial area at Exit 7 was re-designated Employment Area-Commercial. ZONING CONCURRENCY A concurrent re-zone from R-10 to R-14 is part of this application. No zoning text amendments are required. 1. The CPA/Rezone bears a substantial relation to the public health, safety or welfare because it creates an opportunity to re-develop land in an urban form which is consistent with the overall intent of the Comprehensive Plan: single family detached, attached single family, and small scale multi-family structures designed to resemble and incorporate features of single family housing and neighborhoods. The Comprehensive Plan envisions residential growth in the City in both single family and multi-family unit types. This change would increase the multi-family unit types in the City modestly (57 units) but would limit those units types to a smaller scale developments which the City has favored in its policy direction. 2. The CPA/Rezone addresses the changing circumstances and needs of the City as a whole because it responds to the need to provide capacity for smaller scale multi-family and townhouse type developments which can encourage homeownership opportunities. This form of development is an alternative to large scale multi-family development. The identified "changing need" in this instance is the market for townhouse and attached single family development. The citizens and property owners in Renton have indicated stronger support for these alternative forms of higher density housing than was originally considered in the original mapping of this site. In addition,the adjacent commercial area was originally a"Center Designation". Center designations are intended to be buffered by lower density Residential Options uses as a transition to single family. This area was changed to Employment Area-Commercial, with Commercial Arterial zoning which is the most intensive commercial/retail designation in the City. The Plan does not identify Residential Options as a transition designation between Commercial Arterial and other land use designations. 3. Comprehensive Plan compliance is better achieved by the mapping criteria for Residential Planned Neighborhood (LU-55) than Residential Options (LU-48) as is discussed in the preceding analysis section. The proposal complies with the Comprehensive Plan residential policies Objective LU-K which applies both to Residential Planned Neighborhood and Residential Options. 4. The CPA/Rezone is compatible and not materially detrimental to adjacent land uses. There are commercial and multi-family uses to the north and west of the designation. The slope of the site and adjacent areas provides a buffer and transition due to limitations on access and site design which protect single family areas to the north, east and south of the site. Planning/amends/98M-7 98-M-7 Page 5 5. The CPA/Rezone will not adversely impact community facilities. Growth of this type is anticipated in the Capital Facilities Element of the Comprehensive Plan. The amount of growth supported by the capacity of this site as RPN is somewhat larger than envisioned for RO. However, this increment of growth should have a negligible impact on utilities,transportation, parks and schools. CONCLUSION These parcels could reasonably be developed with either Residential Options or Residential Planned Development unit types and style of development. The environmental features of the area, particularly the steep slope and wetlands, encourage more of a clustered approach with attached unit types than a more conventional single family plat. In addition, the area no longer meets the mapping criteria for Residential Options. Re-designation to Residential Planned Neighborhood is a more viable option for redevelopment of these properties than retaining the existing Residential Options land use category.
