WHEREAS the City Council' authorized the vacation of: an

Uniform Plumbing Code, Uniform Housing Code, repealing Private Swim-
ming Pool Code and Fallout Shelters Code. Refer to the Ways and

Consent Agenda - Continued
Interlocal Letter from Mayo Delaurenti presented a proposed interlocal
Agreement agreement betwee King County, Cities of Auburn, Kent, Renton and
Green River Tukwila regarding the Green River Valley, along with Executive
Summary of the ereen River Interim Policy and Regulatory Plan and
Basin Wide Mana ement Program. The letter outlined the history and
background of v.rious actions to date. The letter recommended
referral to the Committee of the Whole and to the Community Ser-
vices Committee in order to expedite consideration of the proposed
agreement and p ogram. Council concur.
Summons and Summons and Complaint No. 841875 filed by Lois Joan Farris vs.
Complaint City of Renton .nd The Boeing Company with the Superior Court of
Lois J. Farris for personal injuries from fall when walking from Building 476 at
the Boeing plant approximately 300 ft. west of Logan N. The
complaint claim-d negligence. Refer to City Attorney.
Claims for Claim for Damag-s was filed in amount of $100,000 by Lois Joan
Damages Farrish, 30664 second S. , Federal Way, for personal injuries in
fall on her rig t elbow, alleging failure of the City to maintain

Pacif NW Bell Claim for Damages was filed in amount of $114.12 by Pacific North-
west Bell Telephone Co. as cost to repair buried cable at 1244
Benson Hwy. alleging damage by backhoe on 1/19/78. Refer to City

Proclamation Proclamation o ' Mayor Delaurenti declared March 12 to 19, 1978 as

SW Harris Place Letter from Ci y Clerk Mead reported all fees have been collected

as invitatio to burglars. The letter explained attempts to keep
materials from being delivered and police departments instructions

Monster Road Renton Chamber of Commerce, Manager, Kay Johnson, 300 Rainier Ave. N. ,
Crossing requested Council to take action regarding the Washington Utilities &
Transportation Commission decision and Railroads'action in the closing
of the Monster Road in the area of Black River Junction. Mr. Johnson
urged the City file appeal or protest or ask for a rehearing by the
Commission in effort to reopen Monster Road until adjustments are made
to the Grady Way Bridge for safe passage of vehicles underneath;
Johnson noted 10 day appeal period. Acting City Attorney Warren
explained several meetings to determine means of gaining access in the
Monster Road area and explained different possible actions, i .e.,
Move for new hearing, ask reconsideration (within 10 days) , appeal to
Superior Court (within 30 days) or option of improvement to roadway.
Johnson asked City intervention, as the railroads have 90 days before
bridge repairs must be commenced. Public Works Director Gonnason
reported the Administration has been proceeding with negotiations with
the railroads regarding this order; also reporting request for re-
placement of Grady Way bridge; explaining 47% of bridge in Tukwila
and 53% in Renton, certain repairs needed to eliminate 15 ton load
limit and advised repairs on Tukwila side. Gonnason reported in the
order the Commission handed down, it is the railroads' responsibility
to maintain the substructure of the Grady Way bridge. Gonnason fur-
ther explained Consultants' expense will be shared with railroad for

WHEREAS theCity of Renton, on its own initiative,
pursuant to the requirement of RCW 35 .79 , 030 wishes to vacate all
or any portion of a certain alley as hereinafter more particularly
desc ibed , to-wit:
See Exhibit "iV" attached hereto and made a part
hereof as if fully set forth herein

WHEREAS it is deemed advisable to fix a date for public II
hearing thereon, NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON? WASHINGTON DO I
RESOLVE AS FOLLOWS :
SECTION I: That the 27th day of February 19 7 8 , at
the h ur of 8 ; 00 P .M. at the City Council Chambers in the Municipal
Buildkng , Renton, King County, Washington, be and is hereby fixed 1
as th time and place for hearing on the vacation of the aforedescribed 11
portion of alley which said hearing date is not more than sixty (60)

days Tor less than twenty ( 20) days from the date of passage of this
Resol tion,
SECTION II ; The City Clerk is hereby authorized and

directed to give notice of said time and, hearing as provided by
RCW 3 . 79 . 020 and any and/or all persons interested therein or
objecting to said vacation may then appear and be heard thereon, or

at or prior to the time of hearing on said vacation.
SECTION III ; The City Council may deter'ni.ne at or prior
to sa 'd hearing whether an appraisal shall be secured to determine
the f- ir market value of the property sought to be vacated as provided
for in Ordinance No. 2349 ; the City likewise reserves the right to
retain an easement for public utility and other public purposes over
any of the portion determined to be vacated .

PUBLIC HEARING This being the date set and proper notices having been published and
Proposed TV Cable ' posted, Mayor Delaurenti opened the Public Hearing to consider
Rate Increase the proposed rate increase of 4% to subscribers requested by Tele-
Northwest prompter Corporation dba Northwest Cablevision, Inc. James W.
Cablevision Hurd, Director of the Office of Cable Communications , reported
the current charge within the city limits of Renton is $8.95, that
the increase would bring the rate to $9.31 per month; that Tele •
prompter has been operating under the present rate since 10/75
and expressed the belief that the increase should be approved.
Mr. Hurd noted materials explaining details of the request have
been previously distributed to the Council members. Councilman
Stredicke noted this has been the first hearing for cablevision
rate increase. Councilwoman ThoPpe inquired whether Clearview
TV Co. would be granted increase, as toeir rate recently raised to
that of Teleprompter; being advised by Mr. Hurd that he would not
recommend another increase. MOVED BY STREDICKE, SECOND CLYMER,
CLOSE THE HEARING. CARRIED. MOVED BY STREDICKE, SECOND SHINPOCH,
COUNCIL APPROVE THE RATE INCREASE AS RECOMMENDED. CARRIED.
PUBLIC HEARING This being the date set and proper notices having been published ,
Alley Vaca1tion posted and mailed according to law, Mayor Delaurenti opened the
Kennydale Area Public Hearing continued from 12/12/77 to consider the vacation of
a 12 ft. wide alley lying, between lots 1 through 3 on the north and
lots 48 through 50 on the south within Block 18 of C.D. Hillman' s
Lake Washington Garden of Eden Dv. #1 , lying easterly of Burnett N.
The vacation was petitioned by Brown/Strand and represented 100
of property abutting proposed alley vacation. Public Works Director
Gonnason explained his letter:of 12/13/77 to all property owners
regarding the proposed vacation, inquiring if all property owners
desired vacation of the alley or objected to vacation to a portion.
Four property owners were present, each desiring vacation: Henry
Roche, lots 31 , 32 and 33; Harold Hardesty, lot 50; W. Provin,
1117 N. 34th; W. Olson, 1207 N. 34th St. Councilman S erdicke
inquired of the-zoning and was advised by Planning Director Ericksen
that property is G 7200; no multiple-residential zoned property
abuts the alley, but does abut Lake Washington Blvd. N. MOVED by
SHINPOCH, SECOND THORPE COUNCIL CLOSE THE HEARING. CARRIED.
Continued Councilwoman Shinpoch, Chairwoman of the Transportation Committee,
reported, committee meeting and concurrence in the vacation as
petitioned. Councilwoman Shinpoch inquired regarding Council ' s
intent to consider the vacation of entire alley. Upon inquiry
Public Works Director Gonnason explained approximately 40 lots abut
the alley, of property owners notified three letters returned.

Brown, Fawcett alleyway has width of 12 ft, lying between lots 1 through 3 inclusive

Block 18 as mentioned, lying easterly of the right-of-way line
of Burnett Avenue North, extended. Letter from the Board of Public
Works Director Gonnason reported no objections to the vacation based I
on the finding that the right-of-way is not required for present or '1
future city street system and that retention of utility easements
is not required. The letter recommended vacation fee be calculated

the issuance and stale of $900.000 oar value of "Limited General Obli-
Senior Citizen gation Bonds, 1978"' for the purpose of paying cost of land acquisition
Center Financing construction, and/'or acquisition of a Senior. Citizen Center and
matters related thereto. The letter reported veto of the ordinance,
asked Council to reconsider and gave the following- reasons for the veto:
a)The Senior Citizens, as other groups of citizens in the community,
are entitled to an adequate, convenient and safe facility; being in
support of such facility; (b) Need for appropriate method of financ-
ing center in view; of City's present financial condition and fiscal'
projections; many ;citizens questioning bonds in lieu of vote of people;
c) Principal issue of $900,000 plus 20-year repayment expense of
615,305, or total outlay of principal and interest would be over
1 ,500,000 which would require first priority from designated millage
requiring curtailment of other necessary expenditures from the City's
limited budget. Also noting cost of removal, of present shop facility
and maintenance costs of the new center would add $100,000 cost per
year; these costs would be incurred regardless of the type of funding.
The letter explained 1979 cost for interest - $50,000 and principal
and interest in future years $80,000. The letter explained belief •
that such financing would not be responsible and not in the best inter-
est of the• City as a whole. The letter asked reconsideration of the
previous action, that council pursue different approach to financing
a new center, such` as improvement to existing facility over the next
few years in the hope the City's financial condition may improve.

Senior.. Citizen down salary increase and asked for reconsideration .of recent action
Center Financing in approving an ordinance to sell councilmanic bonds to pay for a
new, Senior Center. The letter explained belief that the matter should
be put to vote of `the people, that the center would serve only a small
minority of all senior citizens and that 'the present Sartori facility
is working fine.

advised by Architect, that the bid had been withdrawn, noting the
City has the right to force forfeiture of 5% bid bond, but cannot

Dear Property Owner :
The. City Council held a hearing on the petition for the vacation
of the alley located at the rear of your property on• December 12 ,1977 . The property owners of the westerly 150 feet of this I '
alley , lying between North 33rd Place and North 34th Street
running from Burnett Avenue North to Park Avenue North , had n'
petitioned the, City Council for vacation of the westerly 150
feet of this alley.
At he hearing the CityCouncil was concernedn about the interests
of all the remaining property owners abutting on the alley and 11
fel that all should be notified by means of this letter as to
the hearing on this matter . Therefore, the ' City Council continued
the hearing on this matter until 8 : 00 p.m. January 16 , 1978, at II
which time the Council desires to hear from all interested property I
owners . In the event it is the desire of all property owners to
hav the alley' vacated, the abutting owners then would split
the 12.-foot wide alley, and each abutting owner would acquire li
the 6 feet adjacent to his property. Normally an appraisal of
the value of this property is made and a Vacation charge not to
exceed one-half the appraised value is levied by the City Council
as a vacation fee. In this case the Council has indicated that
the vacation charge for a 50-foot lot would not exceed $100 .

The Renton City Council , at its regular meeting of December 12,
1977, has referred the above-referenced alley vacation to the
Public Services Committee of the Council for recommendation and
has set the date of January 16, 1978 for further hearing on the
matter.
There was some Council concern expressed regarding theLffectof-
the vacation on those properties abutting the balance of—the
alley, present utilizations discussed, along with feasibility of
vacating the entire alleyway.

Eastside Airport Letter from James P. Curran, Curran, Kleweno, Johnson & Curran, attor-
Development neys representing Bernie Guthmiller of Airport Specialties at Renton
Airport, explained lease on the northeast side of the Airport since
8/1/75 and lease secured on assignment known as the Cheesman and
Peterson lease which will expire 7/1/78. The letter noted Fancher
Flyways lease property in between Airport Specialties leases; that
Fancher lease expired and that Mr. Guthmiller has been in active
Renton City Council

Eastside Airport negotiations. The letter asked Council give serious consideration
Development to ultimate leasing of the properties previously leased to Fancher
Continued Flyways and listed seven points of consideration. The letter further
noted understanding that recommendation would be made 11/7 that the
Airport Director be permitted to enter into negotiations with Fancher
Flyways for continued leasing on long-term lease. The letter requested
opportunity to present their position to Council on 11/7 with equal
opportunity to present proposal .
Aviation Aviation Committee Chairman Stredicke requested committee report read
Committee at this time explaining the committee has had under study proposals by
Report Fancher Flyways and Airport Specialties for development of property
Eastside Airport on the east side of the field for aircraft storage. The report noted
Development committee' s responsibility to make decision in the best interest of
the airport and was based on the distinction between the role each
plays within the aviation community on Renton Airport; that Airport
Specialties basically provides a single support service (hangar rental
and tiedown); Fancher Flyways is one of three fixed-base operators
which provide maintenance service, flight training, aircraft sales,
fuel and support a number of employees. The committee recognized pri-
ority responsibility to ensure healthy business climate and provide
facilities needed by airport users . The committee recommended Council
authorize the Airport Director to proceed with negotiations for a
long-term lease between the City and Fancher Flyways for aircraft
storage facilities on the eastside of Renton Airport, and that an
area to the north of the FAA transmitter site be offered to Airport
Specialties for the negotiation of lease to provide additional air-
craft storage facilities. MOVED BY STREDICKE, SECOND PERRY, COUNCIL
CONCUR IN COMMITTEE REPORT AND HEAR PRESENTATION OF MR. CURRAN ON
BEHALF OF MR. GUTHMILLER. Wall maps were used to explain area along
Cedar River and Mr. James Curran, 213 4th Ave. S. , Kent, explained
benefit to airport from lease to his client. Bernie Guthmiller reported
plans to continue same type of development in the area. CARRIED,
Aviation Committee Member Thorpe presented verbal Minority Committee
report explaining that Mr. Guthmiller first brought in proposal and
showed intent to develop and expand; that both Mr. Guthmiller and the
committee report noted shortage of hanger space in this area and a
waiting list at the airport. She further noted that during discussions
on Fancher lease, it was noted the property was not well maintained
nor utilized; feeling that the Guthmiller hangars are positive addition
to the Airport, as well as economic addition. Councilwoman Thorpe
determined better use of the airport should be the deciding factor on
the lease, contending that the Guthmiller hangars are definite addition
to the Airport and that Mr. Guthmiller should be allowed to continue
development. ROLL CALL ON MOTION TO ADOPT THE AVIATION COMMITTEE
REPORT: 3 AYE: PERRY, SHINPOCH, STREDICKE; 2-NO: CLYMER AND THORPE.
