RE : CAN-AM SPECIAL PERMIT NO . SP-876-76
AND ANNUAL LICENSE FOR FILL AND GRADE
Pursuant to my on-site field inspection with you and
Mr. Jack McCann , grading operator , on January 26 ,
1978 , we have no objections to the completion of the
project by extension of the annual license for a six
week period .
The operation shall be subject to all the conditions
established in the Planning Commission special permit
approval and shall be further limited to only those
areas discussed with Mr. McCann ( i . e . , No -encroach-
ment into existing vegetation and trees around the
entire site shall occur. ) .
Upon completion of this work , the site shall be
cleaned and final slopes established and rehabilitated
ner ordinance requirements . If we can be of any fur-
ther assistance , please advise .

RE: Can Am Grading
Gordon Ericksen and I met with the contractor, Jack McCann, on the site
.yesterday, Tuesday,. September 7. The contractor was notified that part
of the fifty (50) foot buffer on the north had been eliminated and Would
need a screening berm and/or a restored planting buffer.
The large evergreen trees that are to remain on the site needed to have
the stacked brush and dirt pulled away from their base so they will
survive. In addition, the contractor was cautioned that cutting and •
filling should be held back from the base of the tree stands and he should
preserve the underbrush in that area as well as the trees.

Dear Mr. Platt :
The Renton Planning Commission at its July 28 , 1976 public
hearing approved your application for fill and grade with the -
following conditions .
1 . Provide 140 foot setbacks on the south and west
property lines , or to the existing major tree line ,
whichever is less .
2 . Specifically locate and preserve the larger evergreen
trees along the western portion of the site and off of
N . E . 3rd street .
3 . Provide a 50 foot, natural landscaped buffer from N , E . 4th
street to protect the adjacent residential area .
4 . Posting of a bond , certified check , or depositing in
a special bank account funds sufficient to insure
proper hydroseeding that you indicated on your plans .
5 . Drainage control and retention pond will be subject
to Public Works Department approval and designated
on the final plan .
6 . All flagging operations and traffic control must be
approved by the Traffic Engineering Division of the
Public Works Department .
7 . The applicant will meet with the Utilities Division
prior to grading to determine any potential conflicts
with existing utility lines , particularly along the
eastern portion of the site .

8. Hours of operation shall be from 8 : 00 a . m. to 4 : 30 p . m.
on weekdays only.
9 . Any additional excavation and grading shall be subject
to review and approval of the Planning Commission and
Planning Department .
The approval period is for one year with provision for possible
extension if necessary . We have discussed the conditions of
apprval with Mr. Pat Easter , your representative , on August 2 ,
1976 . It was agreed at that time that the approval offered
sufficient flexibility for your needs and those of the city . A
field trip to the site was also discussed to review more accurately
the trees and vegetation that might be retained until more detailed
site development plans are prepared .
When you are ready to proceed , please inform us of a time that is
convenient to you for such a meeting . If you have any further
questions , please do not hesitate to contact this department.

The July administrative meeting of the Renton Planning
Commission was called to order at 8 : 05 p .m. by Chairman '
Garrison , who led the Pledge of Allegiance .
2 • ROLL CALL was taken by Secretary Gist. All members
responded present with the exception of Scholes ( to
arrive later) and Wik (vacation ) . IT WAS THEN
ACTION:
MOVED BY MOLA, SECONDED BY TEEGARDEN, THAT THE ABSENT
MEMBERS BE EXCUSED . MOTION CARRIED. •

The Chairman called for corrections or additions to the
minutes of July 14 , 1976 , public hearing. Commissioner
Gist noted that with reference to the application for
rezone by Jay E . Holmes , the Planning Commission had
indicated that landscaping along Grady Way and Lind
Avenue was to be accomplished outside of the existing
fence , in the public right-of-way , to form a buffer
screen . The Planning Director noted that the applica-
tion had been reviewed by the Council on July 26 , 1976 ,
and that Mr . Holmes has agreed to landscaping outside
of the fence and the posting of a certified check to
insure installation in the fall . Following further
discussion , IT WAS
ACTION:
MOVED BY TEEGARDEN, SECONDED BY MOLA , THAT THE MINUTES
• OF JULY 14, 1976 , BE APPROVED TO INCLUDE THE ADDITION

The application was opened for consideration by the
Chairman and staff comments were invited .
Noting the continuation and, referral to Special Studies
Committee. for study , the Planning Director reviewed the
characteristics of the request , including a- .description
of the location , size , zoning , development in the vicinity ,
and proposal for excavation and grading. He advised

that the site had been visited by the members of the Special
Studies Committee , who have a report to present , and that no '
additional input has: been received from the applicant..
The Chairman invited any comment from the applicant i,n addi -
tion to those presented at th'e previous meeting . Mr. Jim
Platt stated that he had no further comments at this time .
Chairman Garrison then invited questions of •the applicant or
staff from the Commission . Hearing none , he called for the
committee report .
Commissioner Mola, Acting Chairman of the Special Studies
Committee , reported that the committee had completely walked
through the site ; and they are of the opinion that there are
items that should be considered before the entire site is
excavated and graded . He reviewed those items as follows : .
provision for a screening buffer from adjacent uses until
such time as a development proposal is submitted ; provision
for setbacks on the south , west and north in order to pre-
serve existing vegetation for future development consideration ;
preservation of the evergreens ; posting of bond for operation
and rehabilitation of the site ; drainage control and retention ;
traffic control ; location of utilities prior to excavation ;
control of any additional excavation and grading ; hours of
operation ; and provision for filling of large existing holes .
Review of the requirements of the Mining , Excavation and
Grading Ordinance was provided by the Planning Director.
Comments from the applicant were again invited by the Chair-
man . -
Jim Plat , 601 - 140th N . E . , Apartment 257 , Renton , noted
their desire to see the property developed to its highest
and best use and to take advantage of views offered in the
most economic and practical manner . He questioned the
committee ' s recommendation to provide for filling, of the
large existing holes prior to planned excavation and grading ,
indicating that- it would be accomplished at a later stage in
the operation . He stated that it was their hope that the
operation would provide a developable site when completed .
Discussion followed among the Planning Commissioners relating
to impact on the adjacent properties , effect of the buffers and
recommended setback dimensions , preservation of evergreens ,
location of utilities , and hours of operation . Mr . Platt indi -
cated that .the setbacks should not be a problem' but, that the
engineer would have to study the matter. He also noted their
hiring of a landscape architect- land use planner for the
project.
Comment was invited from the audience by the: Chairman . .
Pat Easter, 3016 Benson Road , Renton , noted his association
with Mr . Platt and inquired about the bond that was suggested .
He was advised by. the Planning Director that the purpose of a
bond is 'to assure rehabilitation o.f the site and is based on .
a mutual agreement in terms of the rehabilitation that is
required to prevent erosion . Mr. Ericksen noted that submittal
of a specific development proposal might preclude the need for
rehabilitation . In addition , he noted that provision for set-
backs could assist in eliminating some of the need for drainage
control and rehabilitation .
There was discussion among Mr . Easter , ' the Planning Commissioners ,
and the Planning Director. With ,regard to the recommended .setbacks ;
preservation o.f trees , Mining , Excavation and Grading Ordinance
requirements., and flexibility of the administration of the con-
ditions .

was offered . IT WAS THEN MOVED BY WALKER , SECONDED BY
GIST , THAT THE PUBLIC HEARING BE CLOSED . MOTION CARRIED .
Following further discussion and deliberation , IT WAS
ACTION:
MOVED BY TEEGARDEN, SECONDED BY MOLA , THAT THE APPLICA-
TION BE APPROVED WITH THE CONDITIONS AS STATED IN THE
COMMITTEE REPORT AS FOLLOWS:
1 . A PARTIAL PERMIT SHALL BE GRANTED SINCE NO DEVELOP-
MENT PLANS ARE PROPOSED AT THIS TIME PROVIDING. A
SCREENING BUFFER FROM ADJACENT USES . AT SUCH TIME
THAT DEVELOPMENT IS PROPOSED, THE REMAINING PORTION
MAY BE INCLUDED, SINCE LIMITED GRADING IS PROPOSED
IN THE PRESENT REQUEST. A DECLARATION OF NON-
SIGNIFICANT IMPACT WILL BE SUBMITTED ON THE BASIS
OF THE PARTIAL PERMIT. (MORE EXTENSIVE GRADING WOULD
COMPLETELY DENUDE THE SITE AND COULD HAVE SIGNIFICANT
IMPACT. )
2 . PROVIDE 140 ' SETBACKS ON THE SOUTH AND WEST PROPERTY
LINES OR TO THE EXISTING MAJOR TREELINE, WHICHEVER
IS LESS, SUBJECT TO THE APPROVAL OF THE PLANNING

COUNCIL REFERRALS :
A. REVIEW OF COMPREHENSIVE PLAN - RIPLEY LANE AREA
NORTH OF MISTY COVE APARTMENTS
The Chairman assigned this referral to the Land Use Com-
mittee for study and report back to the Commission-as-a-
Whole .
B. REAL ESTATE ONE REQUEST REGARDING MULTIPLE DWELLING PARKING II
Staff review was invited by the Chairman . The Planning
Director advised that a request had been received from
Real Estate One , 10500 Carr Road , for review of the present
parking and landscaping requirements -for multiple dwell -
ings . It has been studied by the Council Planning and
Development Committee , and it is their recommendation that
no changes be made at this time but that the matter be
referred to •the Planning Commission for consideration in
their review of the new Zoning Ordinance . Chairman Garri -
son assigned the matter to the Land Use Committee with the
concurrence of Commissioner Teegarden , Chairman of the
Land Use Committee .
C. VICTORIA PARK HOMEOWNERS ASSOCIATION REQUEST
REGARDING ACCESS
Staff review was requested by the Chairman . The Planning
Director noted that a second access to Victoria Park at
the time that the remainder of the subdivision is platted
has been requested by the Victoria Homeowners Association .
It was decided that rather than referral to a committee ,
the matter would be held in abeyance until further infor-
mation is available to the staff regarding future develop-
ment in the area , when it will again be presented for
Planning Commission review.
D. L-1 ZONE EAST SIDE OF BURNETT. AVE . S . , SOUTH OF V. F .W.
HALL - REQUEST FOR REVIEW AND RECOMMENDATION
The Chairman reminded the Commission that this matter had
been considered at the previous Planning Commission meeting
in conjunction with their review of the John C . Corwin
rezone and invited staff comment . Mr . Ericksen reported
that the Council had also reviewed the conflict of the
zoning with the Comprehensive Plan in the subject area
and has requested Planning Commission consideration .
Noting that the matter had been tabled at the last meeting ,

MOVED BY TEEGARDEN, SECONDED BY WALKER, THAT WE TAKE THE •
MATTER FROM THE TABLE AND REFER IT TO THE SPECIAL STUDIES

LOCATION : Property between , N . E . 4th Street and N . E . 3rd
Street , immediately south of Windsor Hills Park .
COMMENTS : 1 . The site consists of approximately 8 acres
with sand and gravel humps along the eastern
and northern portion of the site . Mature
stands of evergreens exist along the western
portion of the site in the vicinity of the
Puget Sound Powerline right-of-way , and a
large stand is located in the central portion
off of N .E . 3rd Street . Mixed brush exists
on the remaining portion of the site .
2 . Windsor Hills Park and residential area are
directly to the north , Puget Sound Powerline
R/W borders the western boundry , the Washing-
ton State Equipment Storage is located on the
eastern property line , and a gravel pit opera-
tion exists south of N .E . 3rd Street.
3 . N .E . 4th Street is a residential collector
arterial and N . E . 3rd Street is a city major
arterial .
4 . The ordinance requires proper screening on
the periphery of the site .
5 . Graded areas to be hydroseeded for erosion
control .
6 . There is no proposal to extend Edmonds Avenue
within the current 6-year plan .
DECISION
CONSIDERATION : Approval should be subject to the following :
1 . A partial permit shall be granted since no
development plans are proposed at this time
providing a screening buffer from adjacent
uses . At such time that development is pro-
posed, the remaining portion may be included ,
since limited grading is proposed in the
present request . A declaration of non-
significant impact will be submitted on the
the basis of the partial permit (More extensive
grading would completely denude the site and
could have significant impact. )
2. Provide 140 ' 'setbacks on the south and west
property lines 6r to the existing major tree-
d line , whichever is less , subject to the
approval of the Planning Department in order
to preserve existing vegetation buffer for
future development consideration .
3 . Specifically locate and preserve the large
stand of evergreens off of N . E. 3rd Street.
4 . Provide a 50 ' natural landscaped buffer from
N . E . 4th Street to protect adjacent residen-
tial area .
5 . Posting of bond for operation and rehabili -

property lines has been proposed to preserve a screening buffer from
adjacent uses and preserve stands of large trees . A retention pond
will control surface runoff . Traffic control will be provided during
operation and meet city standards . Hydroseeding will be provided on
graded areas .

environmental impacts to such an extent that the lead agency would
withdraw its declaration of significance and issue a ( proposed/final )

Jim Platt , 6001 - 140th N . E . , Redmond , representating the
• applicant, advised the Commission of previous use of the site
which had created mounds of sand that required removal and
grading . He stated that while an architect had made a recom-
mendation regarding site development , there were no specific
plans at present. He responded to queries by the Commis-
sioners regarding preservation of natural vegetation and
plans for movement and removal of material . Mr. Platt
advised the Commission regarding their response to staff
inquiries relating to time limits , proposed date of opera-
tion , proposed drainage facilities , the amount of fill ,
traffic , noise and future plans for the property . He stated
they are anxious to begin operations prior to the rainey
season in anticipation of construction in the spring .
Discussion among the Commissioners ensued relating to environ-
mental impact.
Noting no further questions of the staff, the Chairman called '
for comments in favor or opposition from the audience , but

Dear Mr. Smith:
We have received your letter dated July 13, 1976 requesting additional
information on our request for a special permit--even though we have
complied with all the provisions of the city mining and grading ordinance .
We hope the additional information you have requested will further
clarify the intention of our project.
1 . As you are aware, the permit is for a one year period of time. It
would be our intention to begin the grading and excavation process immedi—
ately upon the issuance of the necessary permit, and will be completed
within the time duration of the permit period.
2. At this time we do not have a specific date for further development
of this property. The ultimate development will conform to the cities
existing zoning and land use plans. It is essential that this property
be- graded in order to properly accommodate any further development. There
' are substantial areas that must be filled to accommodate the further
improvements . The fill area will require either a pre—load for a period
of time for the earth to stabilize prior to development. It is therefore
essential that this process be undertaken as soon as possible as any
development can be started within the next two years. It would be possible
to accomplish the grading and excavation as part of the actual develop—
ment, however, because of the length of that process it could unduly
delay the actual construction.
3. We are presently negotiating with a contractor for grading our property
and removing the excess material. He has indicated that he plans to
deliver the material to sites outside the city limits of Renton that have
been approved by the responsible governing agencies.///r15

4. At the present time there is no existing drainage facilities. The
new grading plan will provide a retention pond that will control the
surface run-off, which will be nonexistent because of the existing soil
condition, ie (98% sand) .
5. We as property owners could eliminate all vegetation prior to
making this application without approval from any governmental agencies ,
however, this was not done since it is our intention to preserve the
evergreens adjacent to the powerline right-of-way, which will be used
as a buffer for further development. Existing vegetation is basically
scotchbroom and scrub growth that will repropagate itself within a
few years . It is not our intention to provide screening and fencing
at this time since finished grade will be an improvement. It will
eliminate irregular topography presently utilized by trespassers for
' motorcycling and used for other multi-terrain vehicles.
6. Because of the minimum amount of fill material to be removed from the
property the anticipated truck traffic will be light and will probably
not exceed four trips per hour.
7. Access to and from the site will be from the 3rd Avenue extention, a
major arterial presently utilized by the adjacent properties for major
excavation and filling operations . The traffic generated from our
proposed operation will have little or no impact upon the surrounding
community and minimul effect on the existing streets and traffic pattern.
The contractor will provide flagmen and other operational and safety
controls that may be required by the Traffic Division of the Public Works
Department. The contractor will not utilize any residential streets
for the delivery of excess materials.
8. The property is isolated and removed by considerable distance from '
any residential neighborhoods or developments. Any noise generated from
this use would be no different from present uses of the adjacent properties.
We hope that the response we have provided to your letter will enable
the Planning Department and Planning Commission to act favorably upon
our request. We feel that this phase of our proposed development must
be completed before the rainy season, as a delay in time will result in
additional costs. '

Upon reviewing the information presented and conducting
a site inspection, this department feels that additional
information is necessary prior to making a determination
of environmental significance pursuant to state law.
This includes detailed clarification and explanation of
the following items : •
1. What is the anticipated timing of the proposed
project, including expected beginning and
completion dates?
2 . Provide further clarification on the planned
reuse of the site, timing, and relationship
to the proposed project. It appears that
the proposal could be .accomplished as part
of the actual development of the site.
3 . Where will the material be disposed?
Is it to be sold off-site?
4. More detailed drainage plans should be pro-
vided, especially with regard to the proposed
retention pond.
5 . What mitigating measures are proposed to
preserve some of the existing larger evergreen
trees and vegetation? Will screening and fencing
for visual and safety purposes be provided?

6. How many truck trips per day will be generated
by the project?
7. What access is proposed to and from the site,
and how will this impact the surrounding
community, existing streets , and existing
traffic patterns? What type of traffic and

8. Additional information is needed with regard
to possible noise impacts of the project.
We would appreciate a detailed response to these items
as soon as possible to expedite the environmental and
planning commission review process. If you have any
