The Grantor shall fully use and enjoy the aforedescribed premises, including the right to retain the right to use the surface of said right-of-way if such use does not interfere with installation and maintenance of the utilities. However, the grantor shall not erect buildings or structures over, under or across the right-of-way during the existence of such utilities. This easement, shall be a covenant running with the land and shall be binding on the Grantor, his successors, heirs and assigns. Grantors covenant that they are the lawful owners of the above properties and that they have a good and lawful right to execute this agreement. We have not received drafts of special provisions for review. Are those forthcoming? We have the following comments or questions from our review of the plans: Sheet C 1: Is it possible to add a second post, three feet from the westerly post of the gate? If possible, it would help to anchor the walkway to prevent the potential of vehicles trying to force their way around. I would also like to add a note to the detail to specify that the gate should open to the northeast and that the gate "at rest" (by gravity) should settle parallel with the road. This will allow users to open the gate and let it settle open rather than have to hold it open as they drive through. Sheet C2: Either on this sheet, between stations 10+20 & 10+55, or in Detail 2/C6, show an approximate location for the placement of the maple stump. It can have a note that provides for approval of the City as field conditions warrant, but we think that we should provide a starting point. Sheet C4: Provide a note for gate, similar to C 1 that allows for the gate to stay open as we drive through. Sheet C5: Detail 4/C2 does not appear to provide enough information. What is the contractor supposed to do with the westerly bank? Do they dig through the slough to relocate the flow, then construct? Do they build the wall and weirs and let the stream cut its way through the slough? The downstream boulder weir is shown as cut into the westerly bank with no indication of what has been done to the bank. Do we need some sort of construction schedule on how we want the contractor to go about repairing the washout and relocating the stream? Also, the note by the upstream weir (6' Wide, Typ.) needs clarification. What is supposed to be 6' Wide? We did not receive clear response on a couple of questions we had about Detail 1. First, would you provide confirmation that we are going to have a good bonding between the existing roadway surface, the geotextile fabric, and the new road. Second, are there any drainage impacts on the uphill side of the new road? Are we creating a 10" deep open channel on that side of the road? Are we going to have to create places for the water to go? Sheet C6: On detail 3/C2 you delete the quarry spalls behind the rockery. How do you plan to fill the void between the wall and the existing bank? Don't we need something to fill the voids of the two and three man rocks? This detail gives the impression that the entire width of the road is import and we don't believe that this is the case in any of the road repairs Sheet C9: We found this sheet a little confusing. Please revise the Plan View to suppress the existing water main and identify the call outs as `EXISTING'. Show the proposed water main relocation, including dead -man blocks, in the Plan View (see attached markups). Change the note on the Plan View to `RELOCATE 60 LF W/ NEW 8" ...'. The note, as is, could confuse someone to think they are just supposed to reuse the existing pipe. The water department would like to see: • 4' deep and 18" wide dead -man blocks, • Four shackle rods out of each dead -man block, • A minimum of 2 feet clearance between the bottom rock and the casing, • Show elevations of the stream bed and bottom of rockery wall, • Three spacers per section of pipe. See attached special provision for casing spacers, • Call out size and type of pipe as shown on marked up drawing, • Specify 18" Outside Diameter Casing, We also need sequencing for the removal of the culvert. Do we allow or require the existing culvert to remain in place as a bypass during the relocation of the water main? Do we require a new smaller pipe to be used as a bypass while the water main is being constructed? Do we give the contractor a choice? Also, to keep you updated on where the City is on this project, the funds for the Thunder Hill Access Road Repairs have been reallocated to other projects that have risen in priority. We will not be constructing this project in 2000. Our goal is to construct next year, so we will keep the project moving to assure that we complete all necessary permitting as soon as possible. Trees shall be excavated and replanted with equipment specifically designed for this purpose and by individuals with at least 5 years of successful experience in relocating trees. After the bid award, a list with the qualifications of individuals and equipment that the contractor will use shall be submitted to the City for approval. Tree sizes shown are approximate, for information only, based on a survey performed over two years ago. Tree sizes may be larger than shown due to growth and should be verified by contractor prior to bidding. Trees identified to be removed and replanted shall be dug up with firm, natural balls of earth of sufficient diameter and depth to encompass the fibrous and feeding root system necessary for full recovery of the plant, and shall be replanted immediately after they are excavated. The Contractor shall water as needed to maintain trees in good condition. Trees must be watered immediately upon transplanting and as needed until final acceptance. Water shall be free of substances harmful to plant growth. Water, hoses, and all Mequipment needed shall be furnished by the Contractor. Hoses and equipment for watering shall be free of contaminants which may reduce groundwater quality or water quality of Maplewood Creek and Cedar River. The Contractor shall warrant transplanted trees to remain alive and be in healthy, Y vigorous condition for one year from the date of final acceptance of the work. The Contractor will be obligated to replace any dead or defective trees during or at the end of the one year period with healthy trees within 1/" diameter of the originals at no additional expense to the City. The City will notify the Contractor of any observed defects at the end of the one year period, or earlier. Measurement will be based on the number of trees removed and replanted, as shown on the Drawings and as directed by the City. Payment to Remove and Replant Trees will be made at the per each unit price bid, which payment will be considered complete compensation for all labor, equipment and materials required to complete this item of work in accordance with the Contract Documents. Maplewood Creek Fish Channel Contract - Special Provisions Page 23 98-478.DOC /DWC/tb Furnish and install about 32 lineal feet of 30 inch O.D. steel casing, 0.375" thickness, pipe skids and casing spacers, end seals. • Installation of a temporary 8" by-pass water line, at ground level, consisting of about 120 feet of 8" D.I., restrained joint, 2-16"x8" tees, 2-8" gate valves, miscellaneous fittings as required, and removal of by-pass assembly after completion of the lowering of the above 16" water main. • Excavation, fencing, shoring, pipe bedding, dewatering, backfill native material, compaction, erosion control, restoration and clean-up. All water shutoffs shall occur after 11:30 p.m., Monday through Thursday, and shall be completed by no later than 6 a.m. the next day. Bedding shall be as shown on the Waterline Relocation Additional Drawings and Special Provisions Section 9-03. Backfill material shall be a compactible material, placed and compacted to 90% of maximum density per Section 2-09.3(1)E. Native backfill shall be used, if it meets material specifications, moisture content, and can be compacted to specifications. Any import backfill needed will be paid for under a separate bid item. Bid Item 11: Power Relocation (LS) The work of this section shall include providing excavation services and safe access for the power utility to relocate their lines below the new channel as shown on the Private Utilities Relocation Additional Drawing. The Contractor shall locate all buried utilities in the area prior to excavation, and shall coordinate work with the other utility relocation work. The Contractor shall coordinate with the power utility to provide all excavation needed to relocate the existing line below the new channel, install replacement lines and new structures, provide and install bedding material needed for structures and utility lines, remove the old utility lines, and backfill and compact all excavations. Any dewatering needed shall be considered incidental. The top of the relocated utility line shall be at least 1 foot below the bottom of the deepest excavation needed for the new channel, or greater if required by the utility owner. You should be able to find a single wide gate detail similar to this or create a new detail. I have some ideas to consider for the gate design and installation. First is gate location. I think that the upper gate should be located about 13 feet farther down the road, about where the pk nail is. This will give the workers the ability to pull their vehicle off the road prior to getting out to open the gate. I think that the second gate needs to be either omitted or placed down the road where it starts to drop away from the level that the apartment rests. There is a storage shed back there and I don't think we can block access to it. The second idea that I had was to incorporate a pedestrian or bicycle opening in the upper gate. If there is room, we could consider a gate with a 10-foot clear opening with a third post spaced to allow free passage. We would place angle braces from the outside posts to discourage "pass around". If there isn't room for the pedestrian opening, we would just put in the vehicle gate. The lower gate, if installed, would be to discourage vehicle traffic. I don't think we can install one that could effectively block all access. I have included some sketches on photos of the site to try to illustrate my ideas. These are just ideas from looking at the site. We are open to being told all positives and negatives of these suggestions. Based upon our field meeting with Phil Schneider, it is our understanding that there will be several changes to the preliminary design. Those changes include the elimination of the new 72-inch culvert. Another change that we understood came out of that meeting was revising the log weirs with rock weirs. It would be of benefit to us if you could provide a summary of the meeting with Mr. Schneider. Enclosed is a set of red -lines from our review. The most significant item that we noticed on the preliminary plans is the lack of topo information along the East Side of the road. Based upon the plans, one would not know whether there is a gentle slope or vertical wall along the side of the road. We think that more information needs to be provided to identify site conditions along the easterly side of the road. Also, the shaded area is not explained. For example, on Sheet 3, there is a lot of shaded area along the East Side of the road. Does this mean the contractor is going to need to cut into the bank? Reconstruction of the culvert inlet at station 3+60 would indicate that there is a lower spot east of the road, but the plans don't show a transition in elevations east of the road. The City has also decided to not provide for the installation of new surfacing on the existing utility access road north of Station 21+00 in this contract. We will leave the installation of the chain gate at station 21+00 and the clean up and quarry spalls at the outlet at Station 22+40. Sheets 7 and 8 can be eliminated and the rest renumbered accordingly. The Water Utility recently designed a water line relocation at a creek crossing. I have included in this package a print of that crossing detail, a disk with the CAD file, and a copy of the as -built for the water line we are planning to relocate. They will be reviewing the water line relocation as part of this project. Please use this detail as a basis for a cross section detail of the relocation. I will be on vacation until February 15. Culvert is oversized and designed per WDFW for fish passage. • At first culvert removal/new walkway bridge area (approx. STA 8+30), rock weirs are fine; show at 5' and 20' upstream from culverts. Place weirs in a "U" shape. Also, provide a landing for stepping up off bridge. • Show a detail of rock weirs for stream bed controls. Phil Schneider will furnish us a detail. • At second culvert removal/new walkway bridge area (approx. STA 10+45), provide rock weirs for bed controls also, 5' and 20' upstream of culvert. Maintain 5 ft. minimum width for stream; place step-up landing from walkway. • At third culvert removal/new bridge, use rock weirs for streambed controls in lieu of log weirs, side slopes banks at 2:1 and provide jute mat with plantings. Maintain a 6 ft. stream channel width. Protect side slope with rock adjacent to City's SS MH No. 46. • Re -review the proposed large culvert at STA 7+00. As our chief design concern is minimizing disruption to the westerly streambank and "toe", decide, with Fisheries Biologist's approval, to rebuilt road to sufficient widths and place rockery wall on the stream side of the road fill. This will effectively act as an energy dissipater, plus this allows us not to have to excavate, modify, or otherwise disrupt the opposite stream bank or toe. • Will wait for further written comments from Phil Schneider regarding WDFW recommendations for finalizing plans. STA 7+000 - In place of culvert a rock bulkhead will be built to repair the road washout. Minor excavation will be require to realign the channel. Road width should be minimized. 2. STA 10+25 - Delete bank protection on left bank (looking downstream), add 2 "u "shaped rock weirs with open end downstream to divert flows away from bank and prevent down cutting. Bed controls could work here. 3. If it is at all possible I would rather see the big leaf maple stay. Could a small barrier fence be constructed to define road edge. If the maple has to come out a few conifers should be planted in its place. 4. STA 15+94 - The stream bed could be stabilized using rock weirs at this culvert removal site. The channel width should be at a minimum the average channel width measured at various points upstream and downstream. Any bank rock used along the channel should be limited to protecting the toe and extend to the ordinary high water line. The banks should be sloped as much as possible and protected from erosion using coir fabric and replanted with native vegetation. 5. I am concerned that the culvert removal site has the potential cause erosion due to the road access , the steep grades , and the amount of material that will be removed. An erosion control plan should be part of the project plans. General Comments 5. The stream will be required to diverted either by pump or temporary bypass culvert so the work can be done in the dry. 6. The plans should include a landscape plan for all the sites that are disturbed along the creek. Plants should be planted a 3 foot centers and maintained to ensure survival. 7. The weirs span the entire channel bed and are imbedded in each bank. They may be used to arrest channel incision and enhance fish passage and habitat. Boulder weirs are not recommended for channel slopes above 5 percent. In the future they may find application in higher gradients. Design: In plan view boulder weirs form an upstream -facing arc, horseshoe or "V." The degree of angle is decided by the engineer. Flow and scour are concentrated in the center of the channel as a result of this shape. Up to a point this dconcentration e increases with decreasing radius. � by approximately one half a channel apex of the arch should be offset from the width. In cross section the crest of the weir slopes toward the middle and approximates the cross section of the stream. One foot of relief from the bank to the center is considered a starting point on smaller streams. A minimum of two rows of boulders form the weir; t n front of the crest and prevents scour weir row creates the crest over the flow drops, the foundation row 1s below and slightly beneath the weir boulders. In fine grained stream beds, or where the weirs are constructed above the existing bed, a third row of boulders, placed upstream and beneath the top row, may be necessary to form a complete foundation. Where soils are soft or organic, a gravel filter or rip rap bed may have to be placed under the foundation to prevent the boulders from sinking. The non -uniformity and complex hydraulics of boulder weirs make analysis complicated. For the time being the engineer will have to approximate scour and flow depth for design purposes. References are provided below. A scour pool should be formed downstream of the weir.
