Said heretofore mentioned grantee, its successors or assigns, shall have
the right, without prior notice or proceeding at law, at such times as may be
necessary to enter upon said above described property for the purpose of construct-
ing, maintaining, repairing, altering or reconstructing said utilities, or making
any connections therewith, without incurring any legal obligations or liability
therefore, provided, that such construction, maintaining, repairing, altering or
reconstruction of said utilities shall be accomplished in such a manner that the
private improvements existing in the right(s)-of-way shall not be disturbed or
damaged, they will be replaced in as good a condition as they were immediately
before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises, including
the right to retain the right to use the surface of said right-of-way if such use
does not interfere with installation and maintenance of the utilities. However,
the grantor shall not erect buildings or structures over, under or across the
right-of-way during the existence of such utilities.
This easement, shall be a covenant running with the land and shall be binding
on the Grantor, his successors, heirs and assigns. Grantors covenant that they
are the lawful owners of the above properties and that they have a good and lawful

Said heretofore mentioned grantee, its successors or assigns, shall have

This easement, shall be a covenant running with the land and shall be binding
on the Grantor, his successors, heirs and assigns. Grantors covenant that they
are the lawful owners of the above properties and that they have a good and lawful
right to execute this agreement.

Project Location:
The project will be located along the Thunder Hill Sanitary Sewer Access Road from
just north of the intersection of South 18th Street and Grant Avenue South to a point
that is approximately 2,250 feet north west along the access road. The project is in
the west half of Section 20, Township 23 North, Range 5 East.

PROJECT DESCRIPTION/BACKGROUND
The City of Renton Wastewater Utility owns and operates a sanitary sewer main that is installed in
an unpaved access road that parallels and un-named (officially) creek that is known as Thunder
Hill Creek or the North Fork of Rolling Hills Creek. The existing road and sewer are within 15-feet
of the stream.
The project consists of repairs to a utility access road that is approximately 2,250 feet long and
ten feet wide and parallels a section of Thunder Hill Creek. The road has been damaged by
storm runoffs. The proposed project involves repairing the damaged portions and resurfacing the
existing road with crushed ballast rock.

A short segment of the road will be raised above the normal high water mark. Three culverts in
the stream are to be removed. The existing utility pipes that cross the stream at these locations
will be supported by wooden bridges. While the primary purpose of the bridges is to provide
support of the pipes, they will also provide more stable pedestrian access where people have
been historically crossing on the pipeline. Bank stabilization (rock and vegetation) and new
boulder weirs will be installed adjacent to the washout areas and where the utility bridges are
installed. A water main will be relocated from above to under one of the culverts that is being
removed so that, when the culvert is removed, the water main will be buried in a sleeve under the
creek bed.
The project will require grading and the import of approximately 850 cubic yards of fill material to
the site. The majority of this material (655 CY of ballast) will be graded onto the existing road as
the new driving surface. Approximately 50 CY of gravel borrow backfill will be used to rebuild a
section of the road that has been washed out. A small portion of the road surface will be filled
with approximately 40 CY of quarry spalls before final grading to raise the road surface above the
stream level.
The City of Renton Wastewater Utility is requesting a variance to Title 4, Section 4, 130D.4b,
which prohibits working within 25-feet of the ordinary high water mark of a stream except for the
development of public parks and trails systems and enhancement activities.
2. ENVIRONMENTAL REVIEW
Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971 as
amended), on March 27, 2001 the Environmental Review Committee issued a Determination of
Non -Significance, Mitigated. The appeal period ended on April 16, 2001. No appeals to the
threshold determination were filed.
3 COMPLIANCE WITH ERC MITIGATION MEASURES
Based on an analysis of probable impacts from the proposed project, the following mitigation
measures were issued for the Determination of Non -Significance, Mitigated.
1. The applicant shall follow the Regional Road Maintenance Endangered Species Program
Guidelines for all construction activities adjacent to Thunder Hill Creek.
2. All restoration shall be completed to the satisfaction of the Development Services Division
within 30 days of construction completion.
4. STAFF REVIEW COMMENTS
Representatives from various city departments have reviewed the application materials to identify
and address site plan issues from the proposed development. These comments are contained in
the official file, and the essence of the comments has been incorporated into the appropriate
sections of this report and the Departmental Recommendation at the end of the report.
5. CONSISTENCY WITH VARIANCE DECISION CRITERIA
The Reviewing Official shall have authority to grant a variance upon making a determination, in
writing, that the conditions specified below have been found to exist (RMC 4-9-250B).

A. That the applicant suffers undue hardship and the variance is necessary because of
special circumstances applicable to subject property, including size, shape, topography,
location or surroundings of the subject property, and the strict application of the Zoning
Code is found to deprive subject property owner of rights and privileges enjoyed by other
property owners in the vicinity and under identical zone classification.
The road is essential for access to the sewer main for inspection, maintenance, and repair (if
needed). If the road is not properly maintained, portions of the sewer may become inaccessible. If
the sewer is not maintained, it may back up or fail which could cause damage to the environment
in general and the stream in specific.
Portions of the road have been eroded by storm flows in the stream and a washout area currently
restricts passage of maintenance vehicles. The City is proposing to rebuild the damaged portion
of the road and allow the stream to return to its original locations.
B. That the granting of the variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone in which the subject
property is situated.
Granting the variance will not be detrimental to the public welfare or injurious to the property or
improvements in the vicinity. The project will actually enhance stream functions by removing four
culverts and replacing them with wooden bridges to support sewer pipes from adjacent apartment
buildings. Areas disturbed during construction will be restored upon completion. The banks will
be stabilized with jute fabric, hydroseeded and live staked with Willow, Salmonberry and Red -
Osier Dogwood.
Adolfson Associates, Inc. conducted a Biological Evaluation and a report dated July 28, 2000 was
submitted for review. The report analyzed the potential impacts of the project on species that are
federally listed as endangered or threatened under the ESA. The report concluded that it is
unlikely that any endangered or threatened species utilize the creek and that any short term
increase in sediment generated by the project should be settled out before the water drains into
salmonid bearing streams.
C. That approval shall not constitute a grant of special privilege inconsistent with the
limitation upon uses of other properties in the vicinity and zone in which the subject
property is situated.
The fact that this is a City Utility intended to the serve surrounding development makes it different
than other types of development allowed in the zone. The sewer main and the access road are
existing facilities that require ongoing maintenance.
The approval does not constitute a grant of special privilege. RMC 4-4-130 G.12 allows
modifications to existing utilities located in critical areas and their buffers provided the work does
not increase the footprint of the facility by greater than 10%. The need to make the improvements
within the stream corridor and the use heavy equipment entails the enhanced level of review
required for the variance process.
D. That the approval, as determined by the Hearing Examiner, is a minimum variance that will
accomplish the desired purpose.
The existing road is located in a steep ravine adjacent to the stream. Attempting to relocate the
road and the sewer pipe would result in much greater impacts to the stream do to erosion and
sedimentation. Repairing the road and modifying the utility crossings will improve the stream
functions.

The Washington State Department of Fish and Wildlife has reviewed the project design and their
comments were incorporated into the final design. Work is limited to the 60 days between July 15
and September 15 when the flows are low.
F. RECOMMENDATION
Staff recommends approval of the variance from Land Clearing and Tree Cutting Regulations (RMC 4-4-
130D.4b for the Thunder Hill Sanitary Sewer Access Road Repair, Project File No. LUA-01-013.

The hearing opened on Tuesday, April 24, 2001 at 9:02 a.m. in the Council Chambers on the seventh floor of the
Renton City Hall. Parties wishing to testify were affirmed by the Examiner.

Staff recommends approval of the variance from Land Clearing and Tree Cutting Regulations (RMC444-4-
130D.4b for the Thunder Hill Sanitary Sewer Access Road Repair.
Mike Benoit, Wastewater Utility, 1055 S. Grady Way, Renton, WA 98055 stated that the sewer was installed
over thirty years ago as part of the development of the apartments in the area. At the time of construction, the
standards we have today were not in place. The sewer would not have been able to be built in such a low lying
area today without a lot of stringent mitigation measures imposed. The City is simply trying to restore the road
and put it back into a condition where it can be accessed. The City believes this project meets all the criteria for
an exemption from the required Code.
The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and
no further comments from staff. The hearing closed at 9:22 a.m.
FINDINGS, CONCLUSIONS & DECISION
1. The applicant, City of Renton Waste Water Utility, filed a request for approval of a variance from
stream regulations to work within 25 feet of a stream.
2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation
and other pertinent materials was entered into the record as Exhibit #1 .

3. The Environmental Review Committee (ERC), the City's responsible official, issued a Determination of
Non -Significance (DNS) for the subject proposal.
4. The subject proposal was reviewed by all departments with an interest in the matter.
5. The subject proposal covers a corridor approximately 2,250 feet long. The corridor parallels a portion
of a creek variously known as Thunder Hill Creek or the North Fork of Rolling Hills Creek. The
segment of the creek involved runs east of Eagle Ridge Drive and north of S. 18th Street.
6. The corridor is an easement granted to the City for a sewer line that runs through nine (9) separate
parcels.
7. The property is located in two zoning districts. It runs through both an R-8 (Single Family; 8 dwelling
units per acre) Zone and the RM-I (Residential, Multiple family infill) Zone.
8. The map element of the Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of residential uses, but does not mandate such development without
consideration of other policies of the Plan.
9. The applicant proposes restoring, repairing and resurfacing an access road that runs along the sewer
corridor. The roadway was damaged by flooding and its surface has proven unsuitable. The roadway is
located within 15 feet of the creek.
10. The road would be resurfaced with crushed ballast rock which would allow drainage and provide a road
with better traction for access. A portion of the road would be moved above the normal high water
mark of the creek.
11. Since the road is located within 25 feet of the high water mark of the adjacent creek, a variance is
required for any work in this sensitive location.
12. Along with the roadway work, the applicant will remove three culverts and replace them with bridges.
These bridges will be wooden and are designed to carry utilities that cross the creek in these three
locations. These bridges will also provide a pedestrian route, since social trails have developed in the
area.
13. The project has been reviewed by the Washington State Department of Fish and Wildlife. Their
suggestions were incorporated into the project. They have also limited the work, with a window of 60
days between July 15 and September 15 when stream flows are low.
14. A Biological assessment determined that it was unlikely that any threatened or endangered species
would be affected by the proposal. They also determined that particulates or sediment should settle out
before reaching any salmon bearing waters.
15. The applicant will be importing approximately 850 cubic yards of crushed rock for the project.
16. The sewer line and road have been in this corridor for approximately 30 years.

CONCLUSIONS:
Variances may be granted when the property generally satisfies all the conditions described in part
below:
a. The applicant suffers undue hardship caused by special circumstances such as: the size, shape,
topography, or location where code enforcement would deprive the owner of rights and
privileges enjoyed by others similarly situated;
b. The granting of the variance would not materially harm either the public welfare or other
property in the vicinity;
C. The approval will not constitute a special privilege inconsistent with the limitations on other
property in the vicinity; and
d. The variance is the minimum variance necessary to allow reasonable development of the subject
site.
The applicant's property appears ripe for the variance requested.
While to some extent the hardship is self-created since the applicant placed the sewer line and roadway
in an area subject to erosion or flood damage, replacing the sewer line with another would create more
problems than restoring the roadway and enhancing its elevation in some places. The sewer line has
been in this location for 30 years and its location in the creek corridor creates undue hardships.
Approving the variance will not materially harm the public welfare or other properties. The road is
already located in this location. The project merely is intended to stabilize it and fix a few flaws in its
current alignment and restore the creek to the surface where it is not located in culverts.
4. The permission to restore the road and reduce erosion problems by relocating small sections should not
create any special precedent. There would be few situations that are similar to the circumstances
involved in this case.
It appears that the applicant is doing about the least amount of intrusive work in this corridor as
possible.
DECISION:
The variance is approved.

PURPOSE OF CHECKLIST:
The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions. An Environmental Impact
Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be
done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your
proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most
precise information known, or give the best description you can.

11. Give brief, complete description of your proposal, including the proposed uses and the size of the
project and site.
The project consists of repairs to a utility access road that parallels a section of Thunder
Hill Creek. The road has been damaged by storm runoffs. The proposed project involves
repairing the damaged portions and resurfacing the existing road with crushed ballast
rock. A short segment of road will be raised above the normal high water mark. Three
culverts in the stream are to be removed. The existing utility pipes that cross the stream at
these locations will be supported by wood bridges. While the primary purpose of the
bridges is to provide support for the pipes, they will also provide a more stable pedestrian
access where people have been historically crossing on the pipeline. Bank stabilization
(rock and vegetation) and new boulder weirs will be installed adjacent to the washout
areas and where the utility bridges are installed. A water main will be relocated from above
to under one of the culverts that is being removed so that, when the culvert is removed,
the water main will be buried in a sleeve under the creek bed.
12. Location of the proposal. Give sufficient information for a person to understand the precise
location of your proposed project, including a street address, if any, and section, township, and
range if known. If a proposal would occur over a range of area, provide the range or boundaries
of the site(s). Provide a legal description, site plan, vicinity map, and topographic map, if
reasonably available. While you should submit any plans required by the agency, you are not
required to duplicate maps or detailed plans submitted with any permit applications related to this
checklist.
The project will be located along the Thunder Hill Sanitary Sewer Access Road from just
north of the intersection of South 18' Street and Grant Avenue South to a point that is
approximately 2250 feet north west along the access road. The project is in west half of
Section 20, Township 23 North, Range 5 East.
B. ENVIRONMENTAL ELEMENTS
EARTH

There are some sideslopes where the existing road has been cut into the bank that
are nearly vertical. Natural slopes can be as steep as 100% to 150%

Based upon the 1973 United States Department of Agriculture Soil Conservation
Service survey, we would expect to find Alderwood gravelly sandy loam and Kitap
silt loam.

d. Are there surface indications or history of unstable soils in the immediate vicinity? If so,
describe.
The soils in the area seem fairly stable although, where impacted by water such as
the stream or concentrated runoff from adjacent developments, erosion or sloughs
can appear.
Describe the purpose, type, and approximate quantities of any filling or grading proposed.
Indicate source of fill.
Construction of this project will require grading and the import of approximately
850 cubic yards of fill material to the site. The majority of this material (655 CY of
ballast) will be graded onto the existing road as the new driving surface.
Approximately 50 CY of gravel borrow backfill will be used to rebuild a section of
the road that has been washed out. A small portion of the road will be filled with
approximately 40 CY of quarry spalls before final grading to raise the road surface
above the stream level. The remaining materials will be used for bank stabilization
and the construction of the rock weirs in the stream.
Could erosion occur as a result of clearing, construction, or use? If so, generally
describe.
Erosion could occur on -site if proper precautions are not taken during
construction. Erosion control measures, as mandated by the Washington State
Dept. of Fish and Wildlife (WDFW) and as outlined in the City of Renton Surface
Water Design Manual will be employed to reduce erosion potential during
construction. All exposed areas will be immediately hydroseeded following
construction. Exposed areas will be planted with native vegetation to reduce both
short and long-term erosion hazards. Use of the road after construction will be
restricted to periodic visits by maintenance vehicles and should not result in any
significant adverse long-term erosion problem.
g. About what percent of the site will be covered with impervious surfaces after project
construction (for example, asphalt or buildings)?
Presently, areas of the gravel road are essentially impermeable due to compaction.
The addition of shoulder ballast as a surface treatment should not add any more
impervious surfaces.
Proposed measures to reduce or control erosion, or other impacts to the earth, if any:
Erosion control measures, as outlined by the WDFW and in the City of Renton
Surface Water Design Manual will be employed to reduce erosion potential during
construction. All exposed areas will be immediately hydroseeded following
construction. Some exposed areas will be planted with native vegetation that has
good soil retention capabilities, such as willow, red -osier dogwood, and
salmonberry.

It is estimated that the project will require approximately 850 cubic yards of
imported fill material including ballast for surface roadway improvements (655 CY),
gravel borrow backfill (50 CY), rockery rock (70 CY), quarry spalls (50 CY) and 25
CY for round rock material to be used in the bolder wiers. The project plans
provide information regarding where, how much and what type of fill will be placed
within Thunder Hill creek and its flood plain. Generally, fill will only be placed
within Thunder Hill Creeks flood plain in the area that was previously the existing
shoulder of the access road. Some native material will be dredged from Thunder
Hill Creek to allow for the placement of fish habitat improvement structures.
Excavated (dredged) material will not be placed within Thunder Hill Creek or its
flood plain except as specifically directed by the engineer for backfill in the areas
where improvement structures are to be installed. Other required fill will be clean,
specified material obtained from a quarry.

Storm water runoff flowing over and through the gravel surface of the road is
collected in culverts and dispersed into the creek or it enters the creek as sheet
flow. Present storm water runoff from upstream properties appears to be fairly
clean. The access road repairs will include improvements to some of the culverts
in an effort to mitigate existing problems with erosion.

There is a risk, at any construction site, that fuels or lubricants can inadvertently
enter either the ground or surface water onsite. The contractor will be required to
take precautions and to be prepared to take necessary corrective action in the
event of a spill.

Project Narrative:
The project consists of repairs to a utility access road that is approximately 2,250 feet
long and ten feet wide and parallels a section of Thunder Hill Creek. The road has been
damaged by storm runoffs. The proposed project involves repairing the damaged
portions and resurfacing the existing road with crushed ballast rock. A short segment of
road will be raised above the normal high water mark. Three culverts in the stream are
to be removed. The existing utility pipes that cross the stream at these locations will be
supported by wood bridges. While the primary purpose of the bridges is to provide
support for the pipes, they will also provide a more stable pedestrian access where
people have been historically crossing on the pipeline. Bank stabilization (rock and
vegetation) and new boulder weirs will be installed adjacent to the washout areas and
where the utility bridges are installed. A water main will be relocated from above to
under one of the culverts that is being removed so that, when the culvert is removed, the
water main will be buried in a sleeve under the creek bed.

Reauest For Variance
The City of Renton Wastewater Utility is requesting a variance to Title 4, Section 4-130134,
which prohibits working within fifteen feet (15') of the top of the bank of a stream except for the
development of public parks and trail systems and enhancement activities.
The City of Renton Wastewater Utility owns and operates a sanitary sewer main that is installed
in an unpaved access road that parallels an un-named (officially) creek that is known as
Thunderhill Creek or the North Fork Rolling Hills Creek. The existing road and sewer are within
fifteen feet (15') of the stream.
The road is essential for access to the sewer main for inspection, maintenance, and repair (if
necessary). If the road is not properly maintained, portions of the sewer may become
inaccessible. If the sewer is not maintained, it may back up or fail which could cause damage to
the environment in general and the stream in specific.
The road is in need of resurfacing. The road has developed a grass surface. The road is in a
shaded area so the grass stays damp which creates a slick driving surface. Because of this and the
fact that the road is steep, access to the sewer is treacherous. The City is proposing to resurface
the road with shoulder ballast (rock) to allow safe access by our maintenance vehicles.
In addition, there is one location along the road that has been eroded by storm flows in the stream.
This washout of the road restricts passage of maintenance vehicles. The City is proposing to
rebuild that portion of the road to allow the stream to return to its original location.
For stream enhancement purposes, the City is also proposing to remove a total of four culverts
from the stream in three locations. These culverts were installed to allow three sewer mains, from
the apartments above, to bridge over the stream to connect into the main in the access road. The
sewer pipes were also being used as footbridges to cross the stream. The City is proposing to
install glue -laminated wood bridges at those locations, under which the sewer pipe will be
supported. The removal of the culverts will open up the streambed, which the City will restore
with boulder weirs and vegetation.
The City and our consulting engineer have been in communication with the State of Washington
Department of Fish and Wildlife. They have walked the site with us, reviewed the plans, and
have provided suggestions to enhance the project. We have also contracted with a environmental
consultant to do a biological review of the proposed project related to potential effects on species
listed or proposed to be listed under the Endangered Species Act (ESA). They anticipate that the
proposed project `would have no impact on listed or proposed species. Following completion of
the SEPA process, the City will be submitting the project for JARPA (Joint Aquatic Resource
Permits Application).

within 25-feet of the ordinary high water mark of a stream.
LOCATION OF PROPOSAL: The project will be located along the Thunder Hill Sanitary Sewer
Access Road from just north of the intersection of South 181h Street and Grant Avenue South to a point
that is approximately 2,250 feet north west along the access road. The project is in the west half of
Section 20, Township 23 North, Range 5 East.

SUBJECT: THUNDER HILL ACCESS ROAD REPAIR PROJECT BIOLOGICALREVIEW
Dear Mike:
Adolfson Associates, Inc. (Adolfson) has prepared this Biological Evaluation (BE) to facilitate discussion
of the proposed Thunder Hill Access Road Repair project, related to potential effects on species listed or
proposed to be listed under the Endangered Species Act (ESA). A field review of the project was
conducted by a biologist and planner from Adolfson in July 2000. This letter report includes an analysis
of the potential impacts of the proposed project on species that are federally listed as endangered or
threatened under the ESA and which may occur in the project area or be affected by the proposed action.
You have indicated that there is currently no federal nexus for this project. Lacking a federal nexus, the
proposed project does not appear to require the completion of a Biological Assessment (BA) as required
under section 7(c) of the ESA. Should a BA be necessary, this BE will facilitate future coordination with
federal and state agencies pertaining to ESA issues, but would not meet all regulatory requirements of
the BA process.
The project area is located within the range of the Puget Sound Evolutionary Significant Unit (ESU) chinook
salmon (Oncorhynchus tshawytscha), listed as threatened under the ESA. Coho salmon (Oncorhynchus
kisutch) also occur in the vicinity of the project area and are a candidate species under the ESA. Chinook and
coho salmon and other anadromous fish are under the jurisdiction of the National Marine Fisheries Service
(NMFS) which regulates marine fish and wildlife species (USNMFS, 2000). The U.S. Fish and Wildlife Service
(USFWS) regulates terrestrial wildlife and inland fish species. The USFWS has informed us that the bull trout
(Salvelinus confluentus) is the only listed, proposed or candidate species under their jurisdiction in the project
area (USFWS, 2000; Attached). The following table summarizes the species listed under the ESA that are
addressed in this report.

HABITAT DESCRIPTION AND ENVIRONMENTAL BASELINE
The project area is located within the City of Renton, Washington. The project site is in a developed
urban area surrounded by multi -family housing. The proposed construction site is located along a creek
known locally as Thunder Hill or the north fork of Rolling Hill. The unpaved road paralleling the creek is
located along the existing Thunder Hill Sanitary Sewer Interceptor. City of Renton staff uses the road to
access culverts and sewer facilities along the creek. This creek is not named or classified on USGS
topographic maps. The project is located approximately 3 miles from the shoreline of Lake Washington
and over 6 miles from Puget Sound. The project area is within the Duwamish/Green River drainage
basin.
Thunder Hill Creek is culverted above the project area, flows free for approximately 0.5 miles through the
project area, then flows through culverts and flumes for approximately 2 miles before draining into the
Panther Creek Wetlands (See Figure 1). The wetlands drain into Springbrook Creek, which drains to the
Black River and then to Puget Sound via the Green/Duwamish Rivers.
In its open section, Thunder Hill Creek is very shallow with a steep gradient. The creek bottom is
dominated by gravel and cobble and it is very clean (See Photo 1). During the site visit on July 14, 2000,
water was flowing in the creek, but the flow was only 2-3 inches in depth. The stream experiences much
higher flows during the wet season as evidenced by water marks and storm damage to the adjacent road.
The creek is surrounded by a healthy riparian area consisting of alder, maple, and some cedars in the
tree layer; and Indian plum, swordfern, Robert's geranium, salmonberry, thimbleberry, Pacific willow and
reed canary grass in the shrub/herb layers (See Photo 2). There are some blackberries, but they are not
dominant.
The streambank is eroded where storm damage occurred and the stream cut into the access road. There is
some existing rock gabion riprap along the east bank of the creek (See Photo 3). The creek and riparian area
appear to be a popular recreational area for residents of the adjacent apartments. Trails from the apartments
have eroded into the hillslopes beside the creek (See Photo 4). These trails approach culverts that are
apparently used as pedestrian bridges across the creek.
PROPOSED ACTION
The Thunder Hill Access Road Repair Project consists of repairs to a utility access road that parallels a
section of Thunder Hill Creek (See Photo 5). The road has been damaged in the past by storms. The
proposed project involves repairing the damaged portions and resurfacing the existing road with rock
(shoulder ballast). New boulder weirs will be installed in the washout areas. Short segments of road will
be raised with fill. The creek is crossed by several pipelines, and stormwater pipes drain into the creek
(See Photo 6). Three culverts in the stream are to be removed. In all three locations pipes cross over
and use the culverts for support. As noted, these pipelines are used by local residents as pedestrian
bridges to cross the creek. After the culverts are removed, utility walkway pedestrian bridges will be
installed. The primary purpose of these bridges is to support the pipelines, but they will also provide
pedestrian access. "U" shaped rock weirs will be installed in the creek at the bridge locations. A high
rockery wall will be installed on both sides of a short section of the stream where a culvert is being
removed and utility structures can't be supported by the sloping banks.
The project will require the use of heavy construction equipment along the creek. The surrounding
neighborhood will experience increased truck traffic. The creek will be temporarily diverted during
construction. Areas disturbed during construction will be restored to existing conditions upon completion.
The banks will be stabilized with coir fabric and replanted with native vegetation.
The project design has been reviewed by WDFW Area Habitat Biologist, Philip Schneider. His
recommendations have been incorporated into the final design.

ANTICIPATED PROJECT IMPACTS
Erosion and stormwater runoff could result from project construction. Filter fabric fences will be constructed
according to City standards. A Temporary Erosion and Sedimentation Control (TESC) plan meeting City
standards will be required. Construction work will take place during the low flow period of July 15 to September
15.
Because the construction activity will occur along an access road that is closed to the public, the project is
unlikely to disrupt traffic in the neighborhood. Increased truck traffic during construction hours may have limited
impacts on the neighborhood. Heavy construction equipment and increased truck traffic in the area will
generate additional noise. Construction will take place only between the hours of 8 a.m. and 5 p.m. to
minimize noise impacts to the neighborhood. These impacts will cease when the project is complete.
LISTED AND CANDIDATE SPECIES WITHIIN THE PROJECT VICINITY
Threatened Species
Coastal/Puaet Sound Bull Trout
There are two life history forms among bull trout: a resident form and a migratory form. The individuals of
the migratory form may be stream dwelling (fluvial), lake -dwelling (adfluvial), or ocean -or estuarine -
dwelling (anadromous) (USFWS, 1998). Most migratory coastal bull trout are anadromous, migrating to
the ocean in the spring and returning in the late summer and early fall (Wydoski and Whitney, 1979). Bull
trout are most commonly associated with pristine or only slightly disturbed basins and spawn in streams
with clean gravel substrates and cold (less than 490 F) water temperatures.
Bull trout are not known to occur as residents in the Duwamish/Green River system. There have been reports
of native char in the basin; however, extensive surveys in the upper watershed above Howard Hanson Dam
have not identified a resident population in this relatively undisturbed watershed (WDFW 1998). Warner and
Fritz (1995) reported the capture of one bull trout adult in the lower estuary downstream of the City during their
seine surveys in the Duwamish/Green River estuary and confirmed the identification of the fish by genetic
testing. It is not known whether this individual fish was an anadromous or fluvial fish from the Duwamish/Green
system or an opportunist from another basin feeding on outmigrating fish in the lower river (Warner and Fritz
1995). There is no documented evidence of bull trout in Thunder Hill Creek. Because the creek is culverted for
long stretches above and below the project area, it is unlikely to be suitable habitat for bull trout.
Puget Sound ESU Chinook Salmon
Chinook salmon are anadromous. They require varied habitats during different phases of their life. Chinook
typically spawn in the mainstem of larger rivers and tributaries. Juvenile Chinook rear in the lower mainstem of
rivers before entering the estuary. Chinook generally migrate to salt water in the summer and fall and spend
from two to four years rearing in Puget Sound and/or the North Pacific before returning to spawn. Native stocks
of fall chinook salmon are known to exist in the mainstem of the Cedar River (WDFW, 1994).
Chinook are present within the mainstem of the Duwamish/Green River during their outmigration as juveniles
and during their return migration as adults. Chinook salmon stocks in the Duwamish/Green River have been
identified as "healthy" based on escapement levels (WDFW, 1994). Given the habitat conditions of Thunder Hill
Creek with culverts upstream and downstream of the proposed project area, it is unlikely that chinook salmon

utilize the creek.
NMFS has designated critical habitat for the chinook salmon. That habitat includes the Duwamish/ Green River.
Candidate Species
Puaet Sound/Strait of Georgia Coho Salmon
Coho salmon, like chinook, are anadromous. Adults spawn in freshwater streams in the late fall and early
winter. Juvenile coho rear in freshwater for 12 to 18 months. Rearing juveniles prefer off -channel pools
with complex cover including both large and small woody debris (Henry, 1995). Most coho spend from 16
to 20 months rearing in the ocean and return to spawn in fresh water as three-year old adults.
Coho salmon stocks in the Duwamish/Green River have been identified as "healthy" based on escapement
levels; however, data showed a decrease in escapement that may lead to the stocks being determined
"depressed" in the future (SASSI 1994).
IMPACTS TO LISTED AND CANDIDATE SPECIES
Based on habitat considerations and expected species occurrence in the project area and surrounding
vicinity, it is anticipated that the proposed project would have no impact on bull trout because there is no
habitat in the project area to support the species.
The proposed project will also have no affect chinook and coho salmon. Both salmonids exist in the
Duwamish/Green River basin. However, because Thunder Hill creek is culverted for long stretches
downstream of the project area, it is unlikely that chinook or coho utilize the creek. The project area
drains to the Duwamish/Green Rivers, but passes through culverts, a wetland area, and another creek
before reaching the Black River. Any increased sediment generated by the project should be settled out
before water drains into salmonid bearing streams. If appropriate management practices are employed
during construction, that risk should be further minimized. Any effect that might occur would be limited to
the construction period. It is expected that if a BA were prepared for this project, the resulting
determination of effect would be "no affect' on both chinook and coho salmon.
To ensure future concurrence with the ESA, we request that Adolfson be informed of any proposed
changes to this project that may involve a federal nexus such as funding or permitting. The project may
need to be re-evaluated upon changes in status to these species, new listings, or significant alterations in
the proposed scope of work.

FEDERAL AGENCIES' RESPONSIBILITIES UNDER SECTIONS 7(a) AND 7(c)
OF THE ENDANGERED SPECIES ACT OF 1973, AS AMENDED
SECTION 7(a) - Cons ultation/Conference
Requires: 1. Federal agencies to utilize their authorities to carry out programs to conserve endangered and
threatened species;
2. Consultation with FWS when a federal action may affect a listed endangered or threatened
species to ensure that any action authorized, funded, or carried out by a federal agency is not
likely to jeopardize the continued existence of listed species or result in the destruction or
adverse modification of critical habitat. The process is initiated by the federal agency after it
has determined if its action may affect (adversely or beneficially) a listed species; and
3. Conference with FWS when a federal action is likely to jeopardize the continued existence of
a proposed species or result in destruction or an adverse modification of proposed critical
habitat.
SECTION 7(c) - Bioloizical Assessment for Construction Projects *
Requires federal agencies or their designees to prepare a Biological Assessment (BA) for construction projects only.
The purpose of the BA is to identify any proposed and/or listed species which is/are likely to be affected by a
construction project. The process is initiated by a federal agency in requesting a list of proposed and listed
threatened and endangered species (list attached). The BA should be completed within 180 days after its initiation
(or within such a time period as is mutually agreeable). If the BA is not initiated within 90 days of receipt of the
species list, please verify the accuracy of the list with the Service. No irreversible commitment of resources is to
be made during the BA process which would result in violation of the requirements under Section 7(a) of the Act.
Planning, design, and administrative actions may be taken; however, no construction may begin.
To complete the BA, your agency or its designee should: (1) conduct an onsite inspection of the area to be affected
by the proposal, which may include a detailed survey of the area to determine if the species is present and whether
suitable habitat exists for either expanding the existing population or potential reintroduction of the species; (2)
review literature and scientific data to determine species distribution, habitat needs, and other biological
requirements; (3) interview experts including those within the FWS, National Marine Fisheries Service, state
conservation department, universities, and others who may have data not yet published in scientific literature; (4)
review and analyze the effects of the proposal on the species in terms of individuals and populations, including
consideration of cumulative effects of the proposal on the species and its habitat; (5) analyze alternative actions that
may provide conservation measures; and (6) prepare a report documenting the results, including a discussion of
study methods used, any problems encountered, and other relevant information. Upon completion, the report should
be forwarded to our Endangered Species Division, 510 Desmond Drive SE, Suite 102, Lacey, WA 98503-1273.

"Construction project" means any major federal action which significantly affects the quality of the human
environment (requiring an EIS), designed primarily to result in the building or erection of human -made structures
such as dams, buildings, roads, pipelines, channels, and the like. This includes federal action such as permits,

SUBJECT: Rolling Hills Sanitary Sewer Pipeline Road Access Repairs; Comments from
site review
The following are my comments from our site review on January 20, 2000:
1. STA 7+000 - In place of culvert a rock bulkhead will be built to repair the road washout.
Minor excavation will be require to realign the channel. Road width should be minimized.
2. STA 10+25 - Delete bank protection on left bank (looking downstream), add 2 "u "shaped
rock weirs with open end downstream to divert flows away from bank and prevent down cutting.
Bed controls could work here.
3. If it is at all possible I would rather see the big leaf maple stay. Could a small barrier fence be
constructed to define road edge. If the maple has to come out a few conifers should be planted in
its place.
4. STA 15+94 - The stream bed could be stabilized using rock weirs at this culvert removal site.
The channel width should be at a minimum the average channel width measured at various
points upstream and downstream. Any bank rock used along the channel should be limited to
protecting the toe and extend to the ordinary high water line. The banks should be sloped as
much as possible and protected from erosion using coir fabric and replanted with native
vegetation.
5. I am concerned that the culvert removal site has the potential cause erosion due to the road
access , the steep grades , and the amount of material that will be removed. An erosion control
plan should be part of the project plans.
General Comments
5. The stream will be required to divprted either by pump or temporary bypass culvert so the
work can be done in the dry.
6. The plans should include a landscape plan for all the sites that are disturbed along the creek.
Plants should be planted a 3 foot centers and maintained to ensure survival.
7. Work should occur between July 15 and September 15 when flows are low.

We understand that plans are to use 2-inch diameter Schedule 80 pin piles for support of the
new pedestrian bridges which �e streeam lxank'cwt constructed

development of lateral loads on the pin piles.
We recommend that a downward axial capacity of 4 kips per pile be used for the 2-inch
diameter pin piles. A minimum Center -to -center spacing of 3 pile diameters should be used between
the pin piles. As is common practice, the 2-inch diameter pin piles should be driven with a minimum
90-pound jackhammer to a nominal refusal criteria of 60 seconds per inch of penetration.
We have been asked to provide a "guesstimate " regarding the likely length of the pin piles.
The available information regarding subsurface conditions at the pedestrian bridge sites is very limited.
No deep subsurface explorations were completed at the bridge sites. The Preliminary Geologic Map
of Seattle and Vicinity, Washington, USG,S Map I-354, dated 1962 appears to indicate that the site
vicinity is underlain by glacial till. However, it is likely that alluvium has been deposited over the
glacial till within the limits of the historic stream channel. Based on this very limited subsurface
information, we suggest that an assumed length of 15 feet be used when setting up the plans and
specifications for the pin piles. The actual length of the pint piles will be established during

COMPLETE APPLICATION REQUIRED: The City will not accept an application that does not
have all of the required items. In order to accept your application, each of the following must be submitted
at the same time. If you have received a prior, written waiver of a submittal item(s) during a preapplication
meeting, please provide this form in lieu of any submittal item not provided.
APPLICATION TIMES: All applicants are encouraged to bring in one copy of the application
package for informal review by staff prior to formal application and fee payment in order to ensure the
application is complete. This should be done prior to making the requested number of copies.
Applications will be accepted at the 6th floor counter of the Renton Municipal Building, 1055 South Grady
Way, between 8:00 A.M. and 4:00 P.M. Monday through Friday. No appointment is necessary. Please
allow for 20 to 30 minutes for application screening. Due to the screening time required, applications
delivered by messenger cannot be accepted.
EARLY CONSULTATION: Prior to submitting an application, the applicant should informally
discuss the proposed development with the Development Services Division. The Development Services
Division will provide assistance.and detailed information on the City's land use requirements and
standards. For further information on this project, see the instruction sheet entitled "Submittal
Requirements for Preliminary Project Review."
PURPOSE: A variance is a means by which citizens may be granted relief from the strict application of
the provisions of zoning ordinances or other land use regulations. The process is intended to review
situations where uniforM zoning requirements would unduly burden one property more than the other
properties in the vicinity.
APPLICATION MATERIALS:
1. Land Use Permit Master Application: Please provide the original plus nine (9) copies (10 total)
of the COMPLETED Master Application form. Applications must have notarized signatures of ALL
current property owners listed on the Title Report. The legal description of the property must be
listed on the application form. If the legal description references any other recorded documents
(i.e. easements, public use dedications, restrictive covenants) five (5) copies of the referenced
recorded document must also be provided.
2. Mailing Labels: Please submit two (2) sets of self-adhesive mailing labels including the name,
mailing address, and King County Assessor's account numbers for all property owners within
three hundred feet (300') of the boundaries of the subject site. DO NOT provide envelopes,

metered postage or stamps. The Development Services Division will provide these items,
although postage is paid by the applicant.
3. List of Surrounding Property Owners: Please submit two (2) copies of a signed and notarized
City of Renton Development Services Division "List of Surrounding Property Owners" form listing
all current property owners and their mailing addresses and King County Assessor's account
numbers within three hundred feet (300') of the boundaries of the subject site as obtained from a
Title Company or the King County Assessor's Office. The list shall include a notarized statement
attesting that the ownership information provided is current and accurate. Current shall mean
obtained within the past thirty (30) days unless otherwise approved by the Development Services
Division.
4. Fees: The application must be accompanied by the required application fee (see Fee Schedule)
and first class postage rate per mailing label. Please DO NOT provide metered postage or
stamps. Please call (425) 430-7294 to verify the exact amount required. We cannot accept
checks for over the total fee amount.
Preapplication Meeting Summary (if any): If the application was reviewed at a "preap plication
meeting" and a written summary was provided to you, please provide five (5) copies of the
summary.
Project Narrative: Please provide ten (10) copies of a clear and concise description and
summary of the proposed project, including the following:
• Project name, size and location of site;
• Zoning designation of the site and adjacent properties;
• Current use of the site and any existing improvements;
• Special site features (i.e. wetlands, water bodies, steep slopes);
• Statement addressing soil type and drainage conditions;
• Proposed use of the property and scope of the proposed development (i.e. height, square
footage, lot coverage, parking, access, etc.);
• Proposed off -site improvements (i.e. installation of sidewalks, fire hydrants, sewer main,
etc.);
• Total estimated construction cost and estimated fair market value of the proposed project;
• Estimated quantities and type of materials involved if any fill or excavation is proposed;
• Number, type and size of trees to be removed;
• Explanation of any land to be dedicated to the City; and,
• Any proposed job shacks, sales trailers, and/or model homes.
7. Neighborhood Detail Map: Please provide ten (10) copies of a map drawn at a scale of one
inch equals one hundred feet (1" = 100') or one inch equals two hundred feet (1"= 200') (or other
scale approved by the Development Services Division Director). This map shall show the location
of the subject site relative to the property boundaries of the surrounding parcels within
approximately one thousand feet (1,000'), or approximately two thousand five hundred feet
(2,500') for properties over five (5) acres, and identifying the subject site with a darker perimeter
line than that of surrounding properties.
This map will be used to identify the site location on public notices and to review compatibility with
surrounding land uses. The map shall also show: the property's lot lines, existing land uses,
building outlines, boundaries of the City of Renton (if applicable), north arrow (oriented to the top
of the plan sheet), graphic scale used for the map, and City of Renton (not King County) street
names for all streets shown.
Variance Submittal Requirements
Kroll Map Company (206-448-6277) produces maps that may serve this purpose or you may use
the King County Assessor's maps as a base for the Neighborhood Detail Map. Additional
information (i.e. land uses and building outlines for adjacent sites) will need to be added by the
applicant.
8. Site Plan: Please provide ten (10) copies of a fully dimensioned plan sheet drawn at a scale of
one inch equals twenty feet (1" = 20') (or other scale approved by the Development Services
Division Director). We prefer that the site plan be drawn on ONE sheet of paper unless the size of
the site requires that several plan sheets be used. If you are using more than a single plan sheet,
please indicate connecting points on each sheet.
The Site Plan should show the following:
• Name of proposed project;
• Date, scale, and north arrow (oriented to the top of the paper/plan sheet);
Drawing of the subject property with all property lines dimensioned and names of adjacent
streets;
• Widths of all adjacent streets and alleys;
• Location of all existing public improvements including, but not limited to, curbs, gutters,
sidewalks, median islands, street trees, fire hydrants, utility poles, etc., along the full
property frontage;
Location and dimensions of existing and proposed structures, parking and loading areas,
driveways, existing on -site trees, existing or proposed fencing or retaining walls, free-
standing signs, easements, refuse and recycling areas, free-standing lighting fixtures,
utility junction boxes, public utility transformers, storage areas, job shacks/sales
trailers/model homes, buffer areas, open spaces, and landscaped areas;

of a twenty four inch by thirty six inch (24" x 36") fully dimensioned architectural elevation plan
drawn at a scale of one-fourth inch equals one foot (1/4" = 1') or one -eighth inch equals one foot
(1/8" = V) (or other size or scale approved by the Development Services Division). The plans
must clearly indicate the information required by the "Permits" section of the currently adopted
Uniform Building Code and RCW 19.27 (State Building Code Act, Statewide amendments),
including, but not limited to the following:
Identify building elevations by street name (if applicable) and orientation i.e. Burnett Ave.
(west) elevations;
• Existing and proposed ground elevations;
• Existing average grade level underneath proposed structure;
• Height of existing and proposed structures showing finished roof top elevations based
upon site elevations for proposed structures and any existing/abutting structures;
• Building materials and colors including roof,.walls, any wireless communication facilities,
and enclosures;
• Fence or retaining wall materials, colors, and architectural design;
Architectural design of on -site lighting fixtures; and,
• Cross section of roof showing location and height of roof -top equipment (include air
conditioners, compressors, etc.) and proposed screening.
10. Floor Plans: Please provide five (5) copies of a basic line drawing plan of the general building
layout showing walls, exits and designated uses indicating the proposed locations of kitchens,
baths and floor drains, with sufficient detail for City staff to determine if an oil/water separator or
grease interceptor is required and to determine sizing of side sewer. Floor plans are not required
for speculative construction projects. If you do not provide floor plans, your project narrative must
state that the project is a "speculative" project.
11. Utilities Plan, Generalized (sewer, water, stormwater, transportation improvements):
Please provide five (5) copies of a plan drawn on twenty two inch by thirty four inch (22" x 34")
plan sheets using a graphic scale of one inch equals forty feet (1" = 40') (or other size or scale
approved by the Development Services Division Plan Review Supervisor) clearly showing all
existing (to remain) and proposed public or private improvements to be dedicated or sold to the
public including, but not limited to, curbs, gutters, sidewalks, median islands, street trees, fire
hydrants, utility poles, refuse areas, free-standing lighting fixtures, utility junction boxes, public
utility transformers, etc., along the full property frontage. The finished floor elevations for each
floor of proposed and existing (to remain) structures shall be shown.
12. Geotechnical Report (except when waived by Plan Review Section): Please provide five (5)
copies of a study prepared and stamped by a licensed professional engineer including soils and
slope stability analysis, boring and test pit logs, and recommendations on slope setbacks,
foundation design, retaining wall design, material selection, and all other pertinent elements.

13. Fill Source Statement: (Required only for projects located within an Aquifer Protection Area):
Unless exempt by RMC 4-8-120f, if the project will involve stockpiling or grading of imported fill at
the project site in excess or 50 cubic yards in APA Zone 1 or 100 cubic yards in APA Zone 2,
please provide five (5) copies of a -"source statement" certified by a professional engineer licensed
in the State of Washington. A source statement, as defined in RMC 4-8-120D19, shall be required
for each source location from which imported fill will be obtained. If the project is located within an
Aquifer Protection Area but no fill is planned for the site, please state this in the "Project
Narrative". However, if you do not know the source of fill at this stage, you will be required to
provide this information at the time of building or construction permit application.
14. Flood Plain Map (if applicable): Please provide twelve (12) copies.
15. Wetlands Delineation Map and Wetlands Classification Study: (Required if ANY wetlands
are located on the subject property or within 100' feet of the subject property.) Please provide
twelve (12) copies of the map and five (5) copies of the study. The study shall include an analysis
of the type and extent of wetlands prepared by a wetland specialist based upon a field
investigation using the procedures found in the 1987 Federal Interagency Committee for Wetland
Delineation Federal Manual for Identifying and Delineating Jurisdictional Wetlands or later
adopted identification and delineation methodology.
17. Colored Display Maps: (Folded to 8 1/2" by 11") DO NOT MOUNT ON FOAM -CORE OR
OTHER BACKING. Please provide one (1) full size plan sheet (24" x 36" or other size approved)
of each of the following maps colored with a wide tip marker in order to clearly define the site's

Variance Submittal Requirements
18. Justification for the Variance Request: Please provide ten (10) copies. The burden of proof as
to the appropriateness of the application lies with the applicant. The applicant must submit a
written statement addressing and justifying the issues to be considered by the Hearing
Examine0 and of Adjustment. In order to approve a variance request, the Examiner/Board must
find that ALL the following conditions exist:
a. That the applicant suffers undue hardshi�a he�anance is necessary because of
special circumstances applicable to subject property Including size, shape, topography,
and location or surroundings of the subject property; and the strict application of the
Building & Zoning Code is found to deprive subject property owner of rights and privileges
enjoyed by other property owners in the vicinity and under identical classification;
b. That the granting of the variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone in which subject
property is situated;
C. That approval shall not constitute a grant of special privilege inconsistent with the
limitation upon uses of other properties in the vicinity and zone in which the subject
property is situated; and,
d. That the approval, as determined by the Hearing Examiner or Board of Adjustment, is a
minimum variance that will accomplish the desired purpose.
19. Photographs of the property (Optional): Photographs may be submitted to illustrate the
subject under discussion and are suggested as exhibits with the application.
REVIEW PROCESS FOR VARIANCE REQUESTS: Once the complete Variance application
package has been accepted for initial review, the Development Services Division will post three (3) notices
of the pending application at or near the subject site and mail notices to property owners within 300 feet of
the project site. The proposed plan will be routed to other City departments, jurisdictions or agencies who
may have an interest in the application. The reviewers have two (2) weeks to return their comments at
which time the project will be scheduled for review by the Board of Adjustment.
Notice of the Board of Adjustment Meeting will be published at least ten (10) days prior to the hearing, the
site will be posted again, and parties of record will receive notices via mail. Development Services Division
staff will issue a report to the Board at least seven (7) days prior to the hearing. This report will be mailed
to the contact person named on the Master Application and will also be available for review by the public.
The Board of Adjustment typically issues a determination at the hearing. Notice of the decision to
approve, conditionally approve, or deny variance will be mailed to the applicant and all parties of record.
APPEAL PROCESS FOR BOARD OF ADJUSTMENT DECISIONS: Any person, including
the applicant, aggrieved by the granting or denial of a Variance may appeal the decision to the King
County Superior Court within fourteen (14) days of the date of the decision.

Variance Submittal Requirements
GENERAL: In the City of Renton, a Building Permit must be obtained to build buildings and structures.
A Construction Permit must be obtained to install utility lines, transportation improvements and work in
City right of ways. Building and Construction Permits are separate permits.
Applicants may apply for building and construction permits concurrently with their requests for a Variance.
However, the applicant should be aware that conditions of the Variance may create a need for revisions to
these other permit applications.
If no appeals or reconsideration requests are filed within fourteen (14) days of the Board of Adjustments
decision to approve the Site Plan, the applicant will be eligible to obtain building and construction permits.
A construction permit for the installation of on and off -site utilities will be issued upon the City of Renton
Public Works' review and approval of civil engineering drawings and receipt of all applicable development
and permit fees. The applicant will also be eligible to receive a building permit upon City of Renton
Building Department approval of building plans and receipt of all applicable fees.
DEFERRAL OF IMPROVEMENTS: If a developer wishes to defer certain on or off -site improvements
(i.e. landscaping, curbs, sidewalks) written application with full and complete engineering drawings shall
be submitted to the Board of Public Works. The applicant shall state the reasons why such delay is
necessary. If approval is granted, security in the form of an irrevocable letter of credit, set -aside fund,
assignment of funds, certified check of other type of security acceptable to the City, shall be furnished to
the City of Renton in an amount equal to a minimum of 150 percent (150%) of the estimated cost of the
required improvements.

COMPLETE APPLICATION REQUIRED: The City will not accept an application that does not
have all of the required items. In order to accept your application, each of the following must be submitted
at the same time. If you have received a prior, written waiver of a submittal item(s) during a preapplication
meeting, please provide this form in lieu of any submittal item not provided.
APPLICATION TIMES: All applicants are encouraged to bring in one copy of the application
package for informal review by staff prior to formal application and fee payment in order to ensure the
application is complete. This should be done prior to making the requested number of copies.
Applications will be accepted at the 6th floor counter of the Renton Municipal Building, 1055 South Grady
Way, between 8:00 A.M. and 4:00 P.M. Monday through Friday. No appointment is necessary. Please
allow for 20 to 30 minutes for application screening. Due to the screening time required, applications

EARLY CONSULTATION: Prior to submitting an application, the applicant should informally
discuss the proposed development with the Development Services Division. The Development Services
Division will provide assistance and detailed information on the City's land use requirements and
standards. For further information on this project, see the instruction sheet entitled "Submittal
Requirements for Preliminary Project Review."
PURPOSE: The purpose of Environmental Review is to evaluate the environmental impacts of a
proposal and to identify methods to reduce the impacts. During this review process, environmental values
are considered as well as technical and economic considerations.

approximately one thousand feet (1,000'), or approximately two thousand five hundred feet
(2,500') for properties over five (5) acres, and identifying the subject site with a darker perimeter
line than that of surrounding properties.

surrounding land uses. The map shall also show: the property's lot lines, existing land uses,
building outlines, boundaries of the City of Renton (if applicable), north arrow (oriented to the top

Kroll Map Company (206-448-6277) produces maps that may serve this purpose or you may use

Project Environmental Review
ENVIRONMENTAL REVIEW PROCESS:
Once the complete Environmental Review application package has been accepted, the Development
Services Division will post three (3) notices of the pending application at or near the subject site and mail
notices to property owners within 300 feet of the project site. We will also route the proposed plan to other
City departments, jurisdictions or agencies who may have an interest in the application for review and
comments and schedule the project for review by the City official(s) responsible for administering the State
Environmental Protection Act (SEPA). The reviewers have two (2) weeks to return any comments. The
application will then be presented to the City's SEPA Responsible Official(s).
Approximately three (3) weeks after the application is submitted to the City, the SEPA Responsible
Official(s) will review the project to determine whether the proposed project will result in significant
negative environmental impacts. The Official(s) will consider such issues as environmental health
hazards, wetlands, groundwater, energy, and natural resources and will then issue a Threshold
Environmental Determination.
The SEPA Responsible Official(s) will either:
Make a threshold determination that the project will have no negative environmental impacts
(issue a Determination of Non -Significance);
Make a threshold determination that the project, if modified, would have no significant negative
environmental impacts (issue a Mitigated Determination of Non -Significance); or,
Make a threshold determination that the project will have significant negative environmental
impacts and require that the applicant have an Environmental Impact Statement (EIS) prepared
(issue a Determination of Significance). See the Development Services Division's SEPA
information package for more information.
APPEAL PROCESS FOR THRESHOLD ENVIRONMENTAL DETERMINATION:
Once the ERC has issued its Threshold Environmental Determination, any interested party aggrieved by
the determination may request that the ERC reconsider its decision (or, an interested party may skip the
optional reconsideration process, and directly appeal the determination). If, after reconsideration, the
applicant or other interested party is still not satisfied with the decision of the ERC, an appeal may be filed
with the City of Renton Hearing Examiner (provided the fourteen (14) day appeal period timeframe has not
expired).
BUILDING AND CONSTRUCTION PERMIT ISSUANCE AND INSTALLATION OF
IMPROVEMENTS: if no appeals or reconsideration requests are filed within fourteen (14) days of the
issuance of a DNS or MDNS, the applicant is eligible to receive building and/or construction permits.
Building and Construction Permits are separate permits. In the City of Renton, a Building Permit must be
obtained to build buildings and structures, and a Construction Permit must be obtained to build utility lines,
transportation improvements and work in City right-of-ways. A construction permit for the installation of on
and off -site utilities may be issued upon the City of Renton Public Works' review and approval of civil
engineering drawings and receipt of all applicable development and permit fees. A building permit may be
issued for any buildings or structures, provided the plans comply with all applicable code requirements
and all required fees have been paid.
DEFERRAL OF IMPROVEMENTS: If a developer wishes to defer certain on -site or of -site
improvements (i.e. landscaping, curbs, and sidewalks) written application with full and complete
engineering drawings must be submitted to the Board of Public Works. The application should explain
the reasons why such delay is necessary. If approval is granted, security in the form of an irrevocable
letter of credit, set -aside fund, assignment of funds, certified check of other type of security acceptable to
the City, shall be furnished to the City of Renton in an amount equal to a minimum of 150 percent (150%)
of the estimated cost of the required improvements. Deferral of improvements is covered in greater detail
in Renton Municipal Code, Section 4-9-060.

of an existing facility shall be permitted
within five thousand feet (5,000') of an ex-
isting bulk storage facility if their com-
bined emission for any of the listed sub-
stances exceeds two (2) times the permit-
ted annual emission of the substance for
a single facility. The emissions of applica-
ble existing facilities shall be reduced as
per subsection D131 of this Section.
I. Special Emission Standards for
Existing Facilities: All existing bulk stor-
age facilities on the effective date of this
Section (9-18-1975) and emitting more
than the maximum permitted emission of
any listed substance shall be assumed
as having the maximum permitted emis-
sion for the purpose of calculating the lo-
cational density of facilities as specified
in subsection D13k of this Section. For
the purpose of this standard, existing
bulk storage facilities shall include those
facilities for which substantial construc-
tion, other than site preparation, is in
progress and as determined by the Ad-
ministrative Official.
m. Compliance Later Required for
Existing Facilities: All existing facilities
qualifying under subsection D131 of this
Section shall comply with the emission
standards set forth in the emission and
density schedule in this subsection D13
within three (3) years of the effective date
of this Section. A one time extension of
up to two (2) years may be granted by the
Administrative Official upon the showing
of good cause why compliance cannot be
achieved within the specified time period.
n. Efficiency Rating — Minimum:
Emission control shall be required of
those specific substances for which a re-
port is required as per subsection D13h of
this Section. Sources and/or points of
emissions within the lot lines shall be suit-
ably controlled to result in a reduction or
recovery of emissions with an overall ef-
ficiency for the facility of ninety percent
(90%) or greater when compared to the
uncontrolled facility and when the equip-
ment and technology are readily avail-
able. Sources and points of emission
shall include the carrier vehicle and trans-
fer mechanism when actively engaged in
loading or unloading operations. Control
shall include, but is not limited to, vapor
recovery systems for volatile liquids and
hoods or fully enclosed buildings with ex-
haust fans and filters or their equivalent
for transfer operations generating air-
borne particulates. Such emission control
shall be required even though the emis-
sions of the bulk storage facility are below
the maximum permitted levels. (Ord.

4-4-120 STORAGE LOTS -
OUTSIDE:
A. SCREENING REQUIRED:
Outside storage lots shall be effectively screened
by a combination of landscaping and fencing.
1. Landscaping: A minimum of ten feet
(10') landscaped strip is required between
the property lines along public rights -of -way
and the fence. The landscaping shall be of
size and variety so as to provide an eighty
percent (80%) opaque screen.
2. Fencing: The entire perimeter must be
fenced by a minimum of an eight foot (8') high
sight obscuring fence. Gates may be left un-
screened for security purposes.
B. SURFACING:
Storage areas may be surfaced with crushed rock
or similar material subject to the approval of the
Development Services Division to minimize dust,
control surface drainage and provide suitable ac-
cess. (Ord. 3653, 8-23-1982)
4-4-130 TREE CUTTING AND LAND
CLEARING REGULATIONS:
A. PURPOSE:
This Section provides regulations for the clearing
of land and the protection and preservation of
trees and associated significant vegetation for the
following purposes:
1. To preserve and enhance the City's
physical and aesthetic character by minimiz-
ing indiscriminate removal or destruction of
trees and ground cover;
2. To implement and further the goals and
policies of the City's Comprehensive Plan for
the environment, open space, wildlife habitat,
vegetation, resources, surface drainage, wa-
tersheds, and economics, and promote build-
ing and site planning practices that are con-
sistent with the City's natural topographical
and vegetational features while at the same
time recognizing that certain factors such as
condition (e.g., disease, danger of falling,
etc.), proximity to existing and proposed
structures and improvements, interference
with utility services, protection of scenic
views, and the realization of a reasonable en-
joyment of property may require the removal
of certain trees and ground cover;
3. To ensure prompt development, restora-
tion and replanting, and effective erosion con-
trol of property during and after land clearing;
4. To promote land development practices
that result in a minimal adverse disturbance to
existing vegetation and soils within the City;
5. To minimize surface water and ground-
water runoff and diversion, and aid in the sta-
bilization of soil, and to minimize erosion and
sedimentation, and minimize the need for ad-
ditional storm drainage facilities caused by
the destabilization of soils;
6. To retain clusters of trees for the abate-
ment of noise and wind protection;
7. To recognize that trees and ground cover
reduce air pollution by producing pure oxy-
gen from carbon dioxide;
8. To preserve and enhance wildlife and
habitat including streams, riparian corridors,
wetlands and groves of trees.
B. APPLICABILITY:
The regulations of this Section apply to any devel-
oped, partially developed or undeveloped prop-
erty where land development or routine vegeta-
tion management activities are undertaken.
C. EXEMPTIONS:
The following activities are exempt from routine
vegetation management permit requirements,
and may be authorized without an associated
land development permit; however, the activities
must be conducted in accordance with stated re-
quirements:
1. Emergency Situations: Removal of
trees and/or ground cover by the City and/or
public or private utility in emergency situa-
tions involving immediate danger to life or

property, substantial fire hazards, or interrup-
tion of services provided by a utility.
2. Dead, Dangerous, or Diseased Trees:
Removal of dead, terminally diseased, dam-
aged, or dangerous ground cover or trees
which have been certified as such by a for-
ester, registered landscape architect, or cer-
tified arborist, selection of which to be
approved by the City based on the type of in-
formation required, or the City prior to their re-
moval.
3. Maintenance Activities/Essential Tree
Removal — Public or Private Utilities,
Roads and Public Parks: Maintenance ac-
tivities including routine vegetation manage-
ment and essential tree removal for public
and private utilities, road rights -of -way and
easements, and parks.
4. Installation of SEPA Exempt Public or
Private Utilities: Installation of distribution
lines by public and private utilities provided
that such activities are categorically exempt
from the provisions of the State Environmen-
tal Policy Act and RMC 4-9-070, Environmen-
tal Review Procedures.
5. Existing and Ongoing Agricultural Ac-
tivities: Clearing associated with existing
and ongoing agricultural activities as defined
in chapter 4-11 RMC, Definitions.
6. Commercial Nurseries or Tree Farms:
Clearing or cutting of only those trees which
are planted and growing on the premises of a
licensed retailer or wholesaler.
7. Public Road Expansion: Expansion of
public roads.
8. Site Investigative Work: Site investiga-
tive work necessary for land use application
submittals such as surveys, soil logs, perco-
lation tests, and other related activities in-
cluding the use of mechanical equipment to
perform site investigative work provided the
work is conducted in accordance with the fol-
lowing requirements.
a. Investigative work should not disturb
any more than five percent (5%) of any
protected sensitive area described in
subsection D2 of this Section, Restric-
tions for Critical Areas, on the subject
property. In every case impacts shall be
minimized and disturbed areas restored.
b. In every location where site investi-
gative work is conducted, disturbed ar-
eas shall be minimized, and immediately
restored.
c. A notice shall be posted on the site
by the property owner or owner's agent
indicating that site investigative work is
being conducted, and that the work must
minimize disturbance to the critical areas
identified in subsection D2 of this Sec-
tion, Restrictions for Critical Areas.
d. No site investigative work shall com-
mence without first notifying the Director
or designee in advance.
9. Allowable Minor Tree Cutting Activi-
ties: Tree cutting and associated use of me-
chanical equipment is permitted as follows,
except as provided in subsection D2 of this
Section, Restrictions for Critical Areas:
a. On a developed lot or on a partially
developed lot less than one-half (1/2) of
an acre any number of trees may be re-
moved;
b. On a partially developed lot greater
than one-half (1 /2) of an acre or on an un-
developed lot provided that:
i. No more than three (3) trees are
removed in any twelve (12) month
period from a property under thirty
five thousand (35,000) square feet in
size; and
ii. No more than six (6) trees are re-
moved in any twelve (12) month pe-
riod from a property over thirty five
thousand (35,000) square feet in
size.

In conducting minor tree cutting ac-
tivities, rights -of -way shall not be ob-
structed.
10. Landscaping or Gardening Permit-
ted: Land clearing in conformance with the
provisions of subsection C9 of this Section,
Allowable Tree Cutting Activities, and sub-
section D2, Restrictions for Critical Areas, is
permitted on a developed lot for purposes of
landscaping or gardening. Land clearing in
conformance with the provisions of subsec-
tion C9, Allowable Minor Tree Cutting Activi-
ties, and subsection D2, Restrictions for
Critical Areas, is permitted on a partially de-
veloped or undeveloped lot for purposes of
landscaping or gardening provided that no
mechanical equipment is used.
11. Operational Mining/Quarrying: Land
clearing and tree cutting associated with pre-
viously approved, operational mining and
quarrying activities.
12. Modification of Existing Utilities and
Streets (not otherwise exempted by RMC
4-3-05007) by Ten Percent (10%) or Less:
Overbuilding (enlargement beyond existing
project needs) or replacement and/or rehabil-
itation of existing streets, provided the work
does not increase the footprint of the struc-
ture, line or street by more than ten percent
(10%) within the critical area and/or buffer ar-
eas. (Ord. 4851, 8-27-2000)
D. PROHIBITED ACTIVITIES:
1. Prohibited Activities: There shall be no
tree cutting or land clearing on any site for the
sake of preparing that site for future develop-
ment unless a land development permit for
the site has been approved by the City.
2. Restrictions for Critical Areas — Gen-
eral: No tree cutting, or land clearing, or
groundcover management is permitted:
a. On portions of property with identi-
fied and protected critical habitats;
b. On protected slopes except as al-
lowed in this Section or in the Critical Ar-
eas Regulation, RMC 4-3-050; or
c. Areas classified as very high land-
slide hazards, except as allowed in this
Section or in the Critical Areas Regula-
tions, RMC 4-3-050.
Buffer requirements shall be consistent with
the critical area regulations. Tree cutting or
land clearing shall be consistent with estab-
lished native growth protection area require-
ments of RMC 4-3-05OG.
3. Restrictions for Critical Areas — Rou-
tine Vegetation Management Permits: In
addition to the prohibitions of subsection D2
of this Section, no tree cutting, land clearing
or groundcover management, except for en-
hancement purposes or otherwise permitted
by this Section, shall be allowed per a routine
vegetation management permit in the follow-
ing cases:
a. In wetlands and their buffers; and
b. Riparian corridors including a mini-
mum buffer area of twenty five feet (25')
from the ordinary high water mark of the
creek or stream and in the two hundred
foot (200') State shoreline area.
4. Restrictions for Critical Areas — Land
Development Permits and Building Per-
mits: In addition to the prohibitions of sub-
section D2 of this Section, no tree cutting,
land clearing or groundcover management,
except for enhancement purposes or other-
wise permitted by this Section, shall be al-
lowed per a land development or building
permit in the following cases:
a. In a wetland; and
b. Within a minimum of twenty five feet
(25') of the ordinary high water mark of
creeks, streams, lakes and other shore-
line areas or within fifteen feet (15') of the
top of the bank of same, nor should any
mechanical equipment operate in such
areas except for the development of pub-
lic parks and trail systems and enhance-
ment activities.
E. AUTHORITY AND INTERPRETATION:
The City's Development Services Division Direc-
tor, or his duly authorized representative, is
hereby authorized and directed to interpret and
enforce all the provisions of this Section.
