RE: UNPROCESSED APPLICATIONS
The attached applications are more than one year. old. This department
has reviewed the dismissal process with the City Attorney who indicates
that following notice to the applicants, that the Examiner should act
to dismiss the applications.
Pursuant to the Attorneys recammendation; on June 10, 1980 each
applicant was notified by certified mail that the application was
inactive, and would be recam ended for dismissal unless comments to
the contrary were received by June 24th. With the exception of the
application for rezone by Chris Palzer (R-832-75) no canments have
been received. Mr. Palzer has not responded tong letter of June 18th
which indicated that he had not provided sufficient information to
reactivate his file.
Therefore,, it is recommended that the following applications be dismissed

Dear Mr. Smith:
,Upon receiving your letter dated July 14 , 1977 , in which you sup-
plied the information we requested in our meeting on July 7, 1977 ,
we met with our client and discussed the various matters reviewed
in our meeting.
As you pointed out in our July 7 meeting, the first step to be
taken is to proceed with the petitions to vacate the public ways
bordering the west and south boundaries of Tri-State' s property.
We are presently discussing the petitions for vacation with ad-
joining property owners . In addition, there appears to be some
,confusion as to the application that is presently on file with
the City. I have been advised that the petition is not complete
because the necessary fee was not paid. On the other hand, our
client advises they have a cancelled check for the amount of the
fee. To promptly resolve this question, would you please request
the appropriate department to advise me of the deficiencies in
Tri-State' s petition for vacation.
We shall continue to proceed as rapidly as possible to complete
the petitions for vacating the public ways . As soon as the
vacation has been accomplished, Tri-State will submit its plan in
conformance with all of the requirements that we have previously
discussed in our meetings , conversations , and letters.
I discussed your letter dated July 29 , 1977 with our client per-
taining to the storage of materials adjacent to the subject property.
The storage of these materials is temporary and is necessitated by
the fact that the plans submitted by Tri-State for developing. the •

property have not met approval of your department. I will

We appreciate your August 10 , 1977 , response to our recent
communication regarding the status of the proposed Tri -State devel -
opment. You mentioned --a- question regarding the necessary fees•
for street vacation . You should check with Arlene Haight of
our Public Works Department regarding any questions relating
to such fees . Our records indicate that Mr. Agostino has paid
$247 . 00 in fees for the Special Permit , Site Plan Approval ,
and Environmental Checklist review processes . Receipt No . 115
was issued on March -18 , 1977 , for these fees . However , these
do not in any way pertain to any fees related to the street
vacation process .
The storage of materials north of the . present M-P zoned site
is not related to acceptance of the plans submitted as this
area is not included in said plans and is presently zoned
"G" Residential , which is not the appropriate zoning for such
• use . This area must be rezoned to 1i-P and incorporated into
the overall site development plans , or the materials removed .

on May 24 , 1977 . Upon review, we find that the proposed

Dear Mr. Sparrow:
At our March 2, 1977 meeting, we discussed the various
Manufacturing Park District and Bulk Storage Ordinance
requirements to be incorporated in your site plans and
development along East Valley Road. These include a
minimum 60 foot setback for fencing and bulk storage
along all public rights-of-way, and a minimum 20 foot
setback along all other property lines . A minimum
20 feet of landscaping suitable for screening and
buffering purposes is required on all sides . Any addi-
tional setback area may be utilized for parking purposes .
The parking requirement for uncovered storage area is
1 space per 2,000 square feet of area. The requirement
for warehouse area is 1 space per 1,500 square feet of
area.
We also discussed the possibility of vacation of certain
adjacent rights-of-way. You should consult further with
the Public Works Department regarding such possibilities .
Once you have made the necessary revision to your plans ,
this department will further process your Site Approval
and Special Permit Applications . You have continued to
operate the subject storage yard without the necessary
permits and approvals, and contrary to established City
ordinance requirements . It is hoped that this situation
can be rectified without the necessity of referring it to
our City Attorney for legal action. If you have any questions
please do not hesitate to contact this department.
