Pvfis- d,( / efv 4 t( pkv ?..s opik n T I w PLANNING DEPARTMENT PRELIMINARY REPORT TO HEARING EXAMINER PUBLIC HEARING OF APRIL 12 , 1977 PAGE THREE RE : KIP RAY JARDINE SPECIAL PERMIT APPLICATION Le ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended (RCW 43 . 216 ) , a Declaration of Non-significance has been issued for the subject proposal ( see. attached ) . This is based on provision of various developmental controls to mitigate potential impacts . ►M. ADDITIONAL INFORMATION : A vicinity map and site map are attached . City of Renton Traffic Engineering Division 5 . City of Renton Fire Department The above departments approved the applications . 0. PLANNING DEPARTMENT ANALYSIS : 1 . The site is presently zoned B- 1 business district . The pro- posed use is considered similar to a lumber yard which is allowed in the B- 1 zone by special permit , after public hear- ing thereon , and acceptance of the design and an examination of the location with a finding that such proposed use is in compliance with all provisions , regulations , and standards and will not be unduly detrimental to adjacent properties and enjoyment thereof . 2 . Minimum standards are also stipulated in the Zoning Ordinance . These include the requirement for an eight foot screening fence around the facility and a minimum 100 foot setback from any residential district. The applicant proposes a view obscuring fence , together with a 25 foot landscape buffer , in lieu of the 100 foot setback requirement. The applicant also proposes to utilize an earth-tone color and make a four foot cut in the elevation of the site , which will further reduce visual impact of the proposed structure and use . 'The Plan- ning Department has also received letters from the owners of the single family residences directly south of the subject site , which express acceptance of the project as proposed . These letters are attached to the staff report . It is the conclusion of the Planning Department that , if developed properly with the proposed setbacks and sufficient landscaping areas , together with certain amendments , the proposed project will not be detrimental to adjacent residential and commercial uses . 3 . Changes and amendments in the plans which are needed to reduce potential impacts and conform to ordinance requirements include : a . The eight foot screening fence is required around the entire site . b . Additional landscaping will be necessary along the public right-of-way in the proposed parking areas and along the westerly fence line . The southerly landscape area should also 'be continued to the proposed gate at the southwest corner of the site . PLANNING DEPARTMENT PRELIMINARY REPORT TO HEARING EXAMINER PUBLIC HEARING OF APRIL 12 , 1977 ' PAGE FOUR RE : KIP RAY JARDINE SPECIAL PERMIT APPLICATION 4 . The applicant had initially indicated that the proposed use would be temporary . However , the proposed improvements indi - cate a more permanent facility. It may be necessary to establish a time period for the special permit ,\ thereby allowing an opportunity for further review of the operation and extension of the permit . A reasonable time period would be three years . P. PLANNING DEPARTMENT RECOMMENDATION: Recommend approval of the special permit request with the setbacks and following conditions : 1 . Said approval shall be for a three year period from the date of the Examiner ' s decision . The permit may be extended for three years and for successive three-year intervals there- after upon review and determination by the Examiner that the operation is in compliance with all conditions of approval and applicable City ordinances and is not detrimental to adjacent properties . 2 . Final Planning Department approval of detailed landscape/ screening plans , including , but not limited to : a . HISTORY/BACKGROUND: The site has been zoned B-1 since the original zoning map was pre- pared in the early . 1950 ' s . The site has been utilized for single family residential purposes for many years . There is an existing single family residence located on the site , which will also be used for office purposes related to the subject proposal . E. PHYSICAL BACKGROUND: 1 . Topography : The site is relatively level . However , the site gently slopes from the southeast corner towards Sunset Blvd . N . E . creating a difference in elevation of approximately three or four feet. 2 . Soils : Ragnar (RdC ) , well drained , gently sloping , utilized for timber and urban development . Wildlife : The existing vegetation on the site may provide, some habitat for birds and small mammals native to the area .. 5 . Water : Surface water and streams are not apparent on the site . 6 . Land Use : A single family residence exists on the subject site . Single family residences are located immediately south and east of the property , and an apartment building is situated south and west of the site . Various commercial uses are located to the west along Sunset Blvd . N . E . F. NEIGHBORHOOD CHARACTERISTICS : The area consists of a combination of small businesses , apartment buildings , and single family residences . G . PUBLIC SERVICES : 1 , Water and Sewer : An 8" water main , an 8" sanitary sewer main , and an 18" storm sewer main exist along Sunset Blvd . N . E . Water and sewer service is available upon payment of fees and a $ , O1 per square foot for water and a $ . O1 per square foot for sewer connection charges . 2 . Fire Protection : Fire Department review comments included the requirement that a fire hydrant be located within 165 feet with no portion of the building being over 300 feet from the hydrant . A new hydrant leading from the main shall be on an 8 inch line . Fire flow requirement is 1750 gallons per minute . The subject building and business shall meet all the requirements of the Uniform Fire Code Article 21 covering lumber yards . If material to be stocked in the building is over 15 feet in height , the building shall be sprinkled . A new hydrant , to be more cen- trally located , is required as indicated on the plans . 3 . Transit : Metro Route No . 107 operates along Sunset Blvd . N . E . approximately one-fourth mile south of the subject site . 4 . Schools : The site is located within the Renton School District. 5 , Parks : Not applicable . H . Any outdoor storage shall be contained entirely within the • screening fenced area of the site and shall not exceed a maximum height that is so stipulated by the height of an existing adjacent screening fence. 5. Suitable ingress/egress and circulation control shall be provided per the Parking and Loading Ordinance along Sunset Blvd. N.E. , including but not limited to proper driveway widths and locations, landscaping, and curbing. 6. Recommendations as stipulated by the Public Works Department , Traffic Engineering Division, and Fire Department providing the screening fence is extended around the entire storage area of the property. This screening fence may extend to a height of 12 feet upon option of the property owner and, as a clarification, subject to the overnight parking of no more than three trucks or four vehicles that may be described as heavy equipment., 7. Ericksen, Planning Director Pursuant to Ordinance No. 3071 , Section 4-3015, request for reconsideration or notice of appeal must be filed in writing on or before May 6, 1977. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedures, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days of the date of the Examiner' s written decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. SP-037-77 Page Three The Examiner inquired about public access to the proposed circular driveway leading to the sales office. Mr. Jardine indicated that one- way traffic flow would be required and the driveway would be restricted from public access. The Examiner asked the applicant to estimate a maximum number of vehicles which would be parked on the site at one time. Mr. Jardine indicated his reluctance to impose a limit because of possible future expansion. The Examiner indicated that because storage of heavy equipment is prohibited by the city, a maximum number must be established, and asked Mr. Jardine if, as an example, no more than ten vehicles would be a reasonable figure. Mr. Jardine responded that though the number would most likely be excessive, he accepted that figure. The Examiner asked for further comments . Since there were none, the hearing on Item #SP-037-77 was closed by the Examiner at 9 :00 p.m. • FINDINGS, CONCLUSIONS & RECOMMENDATIONS : Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS : 1. The intent of the application is to request a special permit to locate a retail sales business in a B-1 zone which has the characteristics of a lumber yard. The proposed use is to consist of sales and storage of construction and roofing supplies. 2 . It is the opinion of the Planning Department that the proposed use can be considered acceptable in a B-1 zone by the issuance of a ' special permit. 3. The existing zoning of the subject property is B-1. Section 4-711 , as amended, states that lumber yards are allowed by special permit • with the finding that the use will not be unduly detrimental to adjacent surrounding properties and enjoyment thereof , provided that when established they shall be surrounded by an eight foot solid. wall or sight-obscuring fence herein known as a structure and the yard regulations of this district shall be observed and provided further that no such lumber yard shall be maintained closer than 100 feet to the sideline of the residential districts. Therefore, an approval of this request would be conditioned on the acceptance of this use and the granting of a variance from the required setback by the Board of Adjustment. 4 . A single family residence exists on the subject site which will be converted to an office use and will be an extension of the commercial use intended for the property. Single family residences are located immediately south and east of the property and an apartment building is situated southwest of the site. The property primarily fronts Sunset Boulevard N.E. with uses located to the west of Sunset Boulevard that consist of a variety of commercial enterprises. Adequate utility lines exist on Sunset Boulevard N.E. 5. Pursuant to the City of Renton' s Environmental Ordinance, Gordon • Y. Ericksen, responsible official, has issued a Declaration of Non-Significance for the subject proposal. This is based on provisions of various developmental controls to mitigate potential impact. 6. The applicant, Mr. Kip Jardine, stated that he has received the . . staff report, concurs with the staff recommendations with the exception of Items #P-1, P-5, and P-6 . 7. The applicant stated that there is an occasional need to park delivery trucks on an overnight basis primarily during the weekends when qualified personnel are unavailable to unload material. Upon inquiry by the Examiner, the applicant could not state the maximum number of vehicles which would be parked at one given time. • • SP-037-77 Page Four 8. It is of concern to the Hearing Examiner that the storage of a large number of commercial trucks could be construed to consist of a storage area for heavy equipment, which is prohibited in a commercial zone and is limited to industrial areas. • 9. The Planning Department report accurately sets forth the issues, findings of fact, applicable' policies and provisions and departmental recommendationsi in this matter, and this report itself, being uncontested, is hereby attached as Exhibit #1 and incorporated in this report by reference as is set forth in full herein. CONCLUSIONS : • • 1. It appears that the intended use and .storage of construction materials is similar to a lumber yard, which is allowed by special permit in , a B-1 zone. 2. The B-1 Ordinance specifiesithat :a .minimfum setback of 100 feet • must be maintained from residential districts. At this time, the ' Hearing Examiner does not have the jurisdictional authority to grant an exception from this setback. This authority is currently designated to. the Board Of 'Adjustment. This is an example of the need to combine rezones, special permits and variances under one authority to save applicants and staff needless steps. Therefore, approval of this application is subject to submittal of a variance request to the Board of Adjustment to modify the setback from the required 100 feet .to a proposed 25 foot setback. 3. The proposed use as illustrated. on Exhibit #3 appears to be compatible with the surrounding " area subject to . the provision of ample screening and landscaping to buffer the adjacent residential areas. 4. In viewing the site, the storage of miscellaneous materials such as pallets of roofing material seem to be significantly higher than an intended 8 foot screening fence. The height of the material that was viewed by the Hearing Examiner appeared to be in excess of 20 feet. This .material was very apparent when viewed from adjacent residential properties and is not considered ' compatible with these uses. . Therefore, the storage of material in the storage areas should not exceed the height of the proposed screening fence. 5. This use should not be considered as a type of facility that requires the storage of a: large number of trucks normally considered • by ordinance as heavy equipment storage on a regular basis. RECOMMENDATION: Recommend approval of the special 'permit request with the following conditions: 1. Final Planning Department approval of detailed landscape/screening plans , including, but not limited to: . a. Provision of a twelve, foot,. sight obscuring wall or fence • around the entire proposed operation. b. Additional landscaping as noted in red on the plans along Sunset Blvd. N.E. , within, 'the proposed parking .area, and along the westerly fence line. c. Continuation of southerly; landscaping to the proposed gate at the southwest corner oi...the site. M : April 25 , 1977 OFFICE OF THE 'LAND'.USE HEARING EXAMINER CITY OF RENTON REPORT AND RECOMMENDATION. APPLICANT: Kip Ray Jardine FILE NO. SP-037-77 LOCATION: Property located at 1068 Sunset Blvd. N.E. SUMMARY OF REQUEST: Applicant requests special permit for location of a retail sales business similar to a lumber yard within a B-1 zone. Proposed use would consist of sales and storage of construction and roofing supplies. SUMMARY OF Planning Department: Recommend approval with RECOMMENDATION: setbacks and conditions. Hearing Examiner : Recommend 'approval with a conditions. PLANNING DEPARTMENT The Planning Department staff report was received REPORT: by the Examiner on April 5, 1977 . PUBLIC HEARING: After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding areas, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on April 12 , 1977 , at 8 :20 p.m. in the 4th floor conference room of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2 : General Plat Plat with Site Configuration. Exhibit #3 : Detailed Site Plan with ' Landscaping, Parking and Screening. Exhibit . #4A: Elevation Drawings Exhibit #4B: Foundation Plan In response to the Examiner' s inquiry regarding the zoning of the area, Mr. Smith reported that the site had been zoned B-1 for a number of years. The Examiner asked Mr. Smith to read city departmental recommendations on the application into the record. Mr. Smith read responses from Utilities/Public Works Department, Engineering Design Division, Traffic Engineering, and Fire Department into the record. He also reported that an environmental checklist has been submitted. The Examiner asked Mr. Smith if he were aware of other departmental recommendations when the staff report was finalized and if modifications on the report would be required. Mr. Smith responded that he was not in receipt of the comments at that time and revisions would be made in regard to • SP-037-77 Page Two drainage and fire department recommendations. The Examiner asked Mr. Smith to define ingress and egress for the subject property on the site map. Mr. Smith reported that edges of the pavement and the entrance to the parking area would be clearly defined including incorporation of landscaped islands at the ends of the stalls. In response to the Examiner' s inquiry regarding . ownership of the adjacent property, Mr. Smith reported that a commercial building adjacent to the site is under separate ownership. The Examiner asked Mr. Smith if he had additional information to enter at that time. Mr. Smith indicated that comments of the Engineering Division regarding traffic and circulation in relation to Sunset Boulevard would be incorporated into the report. The Examiner asked Mr. Jardine if he concurred in- the staff report. Responding was: Kip Ray Jardine 1068 Sunset Blvd. N.E. Renton, WA 98055 Mr. Jardine indicated his concurrence with the exception of Item #P. 1. of Exhibit #1, which recommends approval of a permit for a three year period and successive three year periods thereafter. Mr. Smith responded that he had reviewed the proposal with respect to the relationship to the surrounding area which is in a transitional state and felt periodic review should be stipulated. Mr. Jardine noted that the business was being established on a permanent rather than temporary basis with considerable expense involved in landscaping. The Examiner indicated that the nature of a special permit allows uses that are not normally allowed in a certain zone to make the subject use compatible with the surrounding properties. Mr. Jardine inquired about the possibility of elimination of review of requirements if conditions continued to be met., The Examiner stated that conditions could not be more restrictive at a later date than were imposed on the original request. Mr. Jardine inquired about Item #P. 5. of Exhibit #1 regarding the storage of large trucks or trailers on the property, and reported that large delivery trucks were parked on the property overnight and on weekends on occasions. He expressed the desire to eliminate the restriction on this item because of the lack of rail service to the site. Mr. Smith responded that vehicles which were utilized as part of the business operation were not subject to the restriction, but restrictions would be imposed on storage of other vehicles. The Examiner reported that violations of the Parking and Loading Ordinance would be reported to the city. !, Mr. Jardine questioned Item #P. 6. which imposes a height limit on outdoor stored material, noted that most material is processed in four foot increments , and requested the limit be increased to 12 feet. Mr. Smith reported that the Bulk Storage Ordinance allows a maximum of 25% over the existing height of the eight foot fence, setting the restriction at ten feet. The Examiner asked for further testimony in favor of the application. There was no response. The Examiner asked for testimony in opposition to the application. There was no response. The Examiner indicated his concern regarding height of stored material with relationship to visual impact from the street and inquired about • a site obscuring screening fence. Land Use : A single family residence exists on the subject site . Single family residences are located immediately south and east of the property , and an apartment building is situated south and west of the site . Various commercial uses are located to the west along Sunset Blvd . N . E . F, NEIGHBORHOOD CHARACTERISTICS : The area consists of a combination of small businesses , apartment buildings , and single family residences . G. PUBLIC SERVICES : 1 . Water and Sewer : An 8" water main , an 8" sanitary sewer main , and an 18" storm sewer main exist along Sunset Blvd . N . E . Water and sewer service is available upon payment of fees and a $ , 01 per square foot for water and a $ . O1 per square foot ' for sewer connection charges . 2 . Fire Protection : Fire Department review comments included the requirement that a fire hydrant be located within 165 feet with no portion of the building being over 300 feet from the hydrant . A new hydrant leading from the main shall be on an 8 inch line . Fire flow requirement is .1750 gallons per minute . Topography : , The site is relatively level . However , the site gently slopes from the southeast corner towards Sunset Blvd . N . E . creating a difference in elevation of approximately three or four feet. 2 . Soils : Ragnar (RdC) , well drained , gently sloping , utilized for timber and •'urb'an development . The applicant had initially indicated that the proposed use would be temporary . However , the proposed improvements indi - cate a more permanent facility . It may be necessary to establish a time period for the- special permit , thereby allowing an opportunity for further review of the operation and extension of the permit . A reasonable time period would be three years . P, PLANNING DEPARTMENT RECOMMENDATION : Recommend approval of the special permit request with the setbacks and following conditions : 1 . Said approval shall be for a three year period from the date of the Examiner ' s decision . The permit may be extended for three years and for successive three-year intervals there- , after upon review and determination by the Examiner that the operation is in compliance with all conditions of approval and applicable City ordinances and is not detrimental to adjacent properties . 2 . Final Planning Department approval of detailed landscape/ screening plans , including , but not limited to : a . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended (RCW 43 . 216) , a Declaration of Non-significance has been issued for the subject proposal (see attached ) . This is based on provision of various developmental controls to mitigate potential impacts . M. ADDITIONAL INFORMATION : A vicinity map and site map are attached . N. AGENCIES/DEPARTMENTS CONTACTED: 1 . City of Renton Engineering Division 2 . City of Renton Utilities Division 3 . City of Renton Building Division 4. City of Renton Traffic Engineering Division 5. City of Renton Fire Department The above departments approved the applications. 0. PLANNING DEPARTMENT ANALYSIS: 1 . The site is presently zoned B-1 business district. The pro- posed use is considered similar to a lumber yard which is allowed in the B- 1 zone by special permit , after public hear- ing thereon , and acceptance of the design and an examination of the location with a finding that such proposed use is in compliance with all provisions , regulations , and standards and will not be unduly detrimental to adjacent properties and enjoyment thereof . 2 . Minimum standards are also stipulated in the Zoning Ordinance . These include the requirement for an eight foot screening fence around the facility and a minimum 100 foot setback from any residential district . The applicant proposes a view obscuring fence , together with a 25 foot landscape buffer , in lieu of the 100 foot setback requirement. The applicant also proposes to utilize an earth-tone color and make a four foot cut in the elevation of the site , which will further reduce visual impact of the proposed structure and use . The . Plan- ning Department has also received letters from the owners of the single family residences directly south of the subject site, which express acceptance of the project as proposed . These letters are attached to the staff report. It is the conclusion of the Planning Department that, if developed properly with the proposed setbacks and sufficient landscaping - areas , together with certain amendments , the proposed project will not be detrimental to adjacent residential and commercial uses . 3 . Changes and amendments in the plans which are needed to reduce potential impacts and conform to ordinance requirements include : a . The eight foot screening fence is required around the entire site . b. Additional landscaping will be necessary along the public right-of-way in the proposed parking areas and along the westerly fence line .
