No. R-464-68; rezone from GS-1 to R-2 and R-3; property located on 106th Ave. S.E. between Puget Dr. and S. 155th St. (continued from Novem- ber 13, 1968) The Planning Director stated that originally this application was submitted for two parcels of land owned by Lennis Hutchens and Winifred Engeland. The Planning Commission indicated it would prefer to consider the area on a comprehensive rather than a piecemeal basis, and requested the applicants to try to bring the whole area south to Puget Drive in on one application. The original applicants complied with this request, and the appli- cation was amended to include the Johnson, Gronvold and Syrstad properties. Public hearing was held on the total property and the Commission granted rezoning to R-2 and R-3 contingent upon restrictive covenants being executed providing for a fifty-foot unbuildable buffer strip along the east property line. The original applicants, Mr. Hutchens and Mrs. Engeland, have signed the covenants prepared in accordance with the wishes of the Plan- ning Commission; the other three applicants have indicated they would not sign the covenants. The Planning Director pointed out the location of the Hutchens- Engeland properties on the zoning map. Renton Planning Commission Meeting November 27, 1968 Minutes Page 2 The Planning Director stated it was the prerogative of the Plan- ning Commission to determine whether they wished to consider the entire parcel or cut the application back to the original two properties. It was determined that none of the parties concerned in the addi- tional three parcels of land who did not sign the covenants were present in the audience. Sterling stated the reason the Commission requested Mr. Hutchens to bring the other property owners in with him on the rezone applica- tion was the feeling among Commission members that the total parcel could be more advantageously developed as one piece rather than each property separately. Sterling stated further that now the Commission is considering the rezone from a piecemeal standpoint and he did not feel this area could be developed desirably on this basis. Denzer stated the property owners are entitled to the best use of their properties; that Mr. Hutchens and Mrs. Engeland complied with Commission requests to the best of their abilities and are entitled to action by the Commission on their portion of the ap- plication. Discussion followed concerning the status of the application--with specific reference to the three properties owned by persons who did not wish to comply with the restrictive covenants the Commis- sion felt was necessary for the protection of the single family area, Rolling Hills, to the east of subject property. Mr. Hutchens of 15614 106th Avenue S.E., one of the applicants, stated that a meeting was held with the other property owners represented in the amended application, and they stated they did not wish to go along with the fifty-foot buffer strip requested by the Commission and that they did not want to have anything more to do with the application. The Planning Director stated there was no action by the other applicants indicating withdrawal from the application, either by phone or letter. After further discussion concerning status of the application, the Chairman stated the Commission could determine a higher zoning for the Hutchens-Engeland properties and deny any higher zoning for the three parcels apparently withdrawn. Ross stated that in his opinion the fifty-foot buffer strip re- quired in the approval granted by the Commission on September 25, 1968, was too restrictive. Comments from the audience were invited. Mr. George Poff, 3285 Court B, Rolling Hills, stated he wished to reiterate his objections as stated at previous meetings plus the additional throught that rezone of just two properties could border on spot zoning. As there were no other comments, it was moved by Denzer, seconded by Racanello, that the hearing be closed. Motion carried unanimously. Two of the appli- cants, Mr. Hutchens and Mrs. Engeland, have signed covenants prepared in accordance with the wishes of the Planning Commission. Renton Planning Commission Meeting November 13, 1968 Minutes Page 2 On the motion, Stredicke stated that in his opinion the motion was out of order because the original action on the application was made for the entire parcel. Persons present at the Septem- ber 25, 1968 hearing were under the impression the whole parcel was being rezoned. If the Commission wishes to rezone only a portion at this time, another public hearing should be duly advertised and held. Teegarden stated there was a question in his mind regarding the legality of Racanello's motion considering the fact that the ap- plication before the Commission was made by five property owners, and a rezone covering only two of the properties would, in his mind, present an entirely different situation from the one existing when the rezone was granted on September 25, 1968. Sterling and Mola stated they felt the Commission had an obliga- tion to people in the area to inform them of any action by the Commission differing from the action taken at the public hearing meeting of September 25, 1968, which was attended by many persons living in the area and having a definite interest in any rezone granted. Re: restrictive covenants The Planning Director stated this matter has been referred back to the Planning Commission for review due to problems encountered by the applicants with reference to the preparation and execution of the restrictive covenants. One of the applicants, Mr. Lennis Hutchens, has indicated that with the exception of himself and Mrs. Winifred Engeland, the other three applicants concerned in the application do not wish to comply with covenants covering the 50 foot buffer strip on the easterly boundary of subject property. In addition, Mr. Hutchens has submitted restrictive covenants prepared by his attorney which are not acceptable to the department or the Com- mission. The covenants prepared in accordance with the stated wishes of the Commission contain portions that are not acceptable to Mr. Hutchens. Mr. Hutchens is requesting that if the wording of the covenants can be made mutually acceptable, such revised covenants apply only to his and Mrs. Engeland's properties. The Planning Director stated that in his opinion this presents a completely different situation than existed when the rezone was granted. Mr. Hutchens and Mrs. Engeland originally applied for rezone on their two parcels and were advised by the Commission that rather than rezone on a piecemeal basis, they would prefer that the applicants bring adjacent properties in on the rezone request. This was accomplished, but at this point negotiations have broken down and the original situation exists. If the cov- enants apply only to the Hutchens and Engeland properties, parcels to the south would remain single family residential and it is possible that further covenants should be required to protect those properties. Discussion followed among Commission members on the problems exist- ing in the rezone, types of restrictive covenants that would be best for the property in question, possible impact of multiple development on adjacent single family areas, etc. There was also considerable discussion on the best procedure for the Commission to follow, as the hearing had been closed and Commission decision made at the public hearing meeting of September 25, 1968. The Chairman stated it would probably be necessary for the Commission to act to rescind its previous action and reopen the hearing on the matter. ACTION: MOVED BY STREDICKE, SECONDED BY TEEGARDEN, THAT AS THE RESTRICTIVE COVENANTS FILED BY LENNIS HUTCHENS AND WINIFRED ENGELAND DO NOT SATISFACTORILY MEET THE CONDITIONS AS SET BY THE CITY OF RENTON PLANNING COMMISSION, THEY BE REJECTED. Comments from the audience were invited. Mr. Lennis Hutchens, 15614 106th Ave. S.E., one of the applicants, stated he objected to the wording in the restrictive covenants prepared at the request of the Planning Commission under the heading "Landscaping", as he felt he would be required to land- Renton Planning Commission Meeting October 23, 1968 Minutes Page 4 scape and maintain the 50 foot buffer strip. The Planning Director stated the purpose of this section of the covenants was to ensure replacement of any natural landscaping removed from the buffer strip so as to avoid any possibility of the strip being paved over and used aS a parking area, which possibility was not the intent of the Planning Commission. FURTHER ACTION: MOVED BY RACANELLO, SECONDED BY DENZER, THAT MR. STREDICKE'S MOTION BE AMENDED TO READ THAT THIS MATTER BE TABLED FOR TWO WEEKS. Sterling stated that the applicants should not be mislead into be- lieving that this matter would be completely settled by their’ sign- ing the covenants as prepared by the Planning Department; that if only two of the five applicants are willing to sign the covenants, a different situation exists, new action may be required of the Commission and new covenants may have to be drawn. At this point Chairman Garrison left the meeting briefly and Vice Chairman Stredicke conducted the hearing. Further discussion followed concerning the subject property and present as well as possible future covenants. PENDING MOTION TO TABLE THE MATTER FOR TWO WEEKS CARRIED UNANIMOUSLY. Mr. Hutchens inquired as to the status of his application at this point. The Chairman stated the covenants as submitted by the ap- plicant are apparently not acceptable and something else will have to be worked out. If the applicant comes back in two weeks with covenants as prepared by the city staff and signed by only two parties, then it will be up to the Commission to decide what to do. The matter could come back to public hearing. Mola stated as only two parcels of land out of the original five are now involved, addition covenants may be added on to those al- ready prepared at the request of the Planning Commission. The Chairman advised the applicant to review the proposed covenants with his attorney. Chairman Garrison rejoined the meeting. 3. (continued from July 24, 1968) The Chairman described the rezone application and stated a petition had been received in opposition to the rezone bearing 134 signatures of residents in the Rolling Hills area adjacent to the subject prop- erty. The Planning Director pointed out the location of the property on the zoning map. Comments from the audience were invited. Mr. Mike Roberts, representing the applicants, spoke on behalf of the proposed rezone. Mr. Lennis Hutchens and Mrs. Winifred Engeland, two of the applicants, also spoke on behalf of the proposed rezone. Upon inquiry by the Commission, Mr. Hutchens declined to revise his application to R-2 for the whole parcel, stating such zoning would deny him full reasonable use of the property. Mr. Stanley Stone, representing the residents of Rolling Hills, spoke in opposition to the proposed rezone. Mr. Stone suggested that in order to protect the single family residences of Rolling Hills, the property should be developed as a planned unit develop- ment or under R-2 zoning with apartments by special permit which would permit control by the Planning Commission. Mr. Gardner Colman, 3293 Court A Discussion was held among the applicants, opponents and the Plan- ning Commission regarding the proposed development, various. alter- natives to the zoning requested, possible densities: of development, densities of development of adjacent multi-family residential uses to the west of subject property, etc. Moved by Denzer, seconded by Sterling, that. the hearing be closed. Several members of the Commission opposed this motion stating that the problem had not been resolved and they felt it was a mistake to close the hearing. (continued from June 26, 1968) The Chairman described the amended application and stated the Original application had requested R-4 zoning for two parcels of land. This application has been amended to include several additional parcels and the zoning requested has been changed from R-4 to R-2 on the easterly 175 feet and R-3 on the westerly 450 feet. The total area now under consideration is approximately 12.34 acres, The Planning Director stated that if multiple zoning is granted on the subject property it was highly probable that an additional ten acres directly north would come in for rezone. He discussed the potential number of multipie dwelling units that could be constructed on the subject property as well as the additional ten acres to the north and recommended that the Commission con- sider the area on a comprehensive basis as well as the impact on the single family residential area known as Rolling Hills to the east of subject property. The staff recommendation for the prop- erty under discussion is R-2 zoning. Sterling stated he concurred with the staff recommendation, Stredicke stated it has been Commission policy to grant multiple zoning adjacent single family on a graduated basis (R-3 down to R-2 adjacent single family) whenever possible, and he felt subject property could be handled on this basis; that the only question being where to draw the line for R-3 and commencement of R-2., Racanello pointed out that a high rise apartment is proposed for construction within 1000 feet of subject property. Comments from the audience were invited, Mr. George Poff, 3285 Court B, Rolling Hills, stated he was spokesman for the residents of Rolling Hills and presented a petition in opposition to the rezone signed by 56 persons living in Rolling Hills. Mr. Poff stated that he had become aware of the rezone application and the hearing just a few days ago and that he was certain many more residents would sign petitions against the proposed rezone were there more time to collect such signatures. Mr. Poff stated the residents of Rolling Hills were concerned about their area of single family homes, for which they had paid high prices, becoming an island surrounded by apartments, The following persons, also residents. of Rolling Hills, spoke in opposition to the proposed rezone, citing the same basic reasons as Mr. Poff: Walter Smith, 1711 Rolling Hills Pl. Mr. Manio Phillips, the applicant, stated he was present to answer any questions the Com» mission might have. The Planning Director discussed briefly the history of the applica- tion and stated while the department was in sympathy with the applicant's plight with reference to delay, the ordinance provides no relief to the normal rezone procedures. He also pointed out that the Council had asked for a recommendation from the Planning Commission on this application for their May 27th meeting. How- ever, the ordinance requires a 10-day waiting period before sub- mittal of Planning Commission recommendations to the City Council to allow time for appeals. As it appears unlikely that any appeal will be filed in this case, it was felt the Commission could make its recommendation to the City Council for their May 27, 1968 meeting. Renton Planning Commission Meeting May 8, 1968 Minutes Page 3 The Commission generally felt, after discussion of this matter, that it was unwise policy to disrupt the normal procedures of rezone applications for the convenience of one applicant since the delay was the result of his failure to submit the application by the dead- line date for the April Planning Commission public hearing. Action by the Council would, at best, save the applicant only two weeks in time. Forgaard noted that should SR-1 be granted, that the applicant would lack 500 square feet of having another building site on the property, and he believed the applicant's plot plan submitted with his rezone application did not indicate the true location of the proposed house but that the house would be set well over, possibly to accommodate another building site which might be acquired by a variance request. Commissioners were interested in this point and felt it would be well to check this out on the field trip. ACTION: Moved by Ross, seconded by Racanello, that the Planning Commission follow the normal procedure on this rezone application of Manio Phillips. Mola stated he felt the Planning Commission could come under unfavorable criticism by allowing normal procedures to be by- passed; that some people had indicated to him they believed the Planning Commission would be showing favoritism toward this ap- plicant. The pending motion carried unanimously.
