The Planning Director stated that the applicant had executed the restrictive covenants in accordance with the wishes of the Planning Commis- sion. The restrictive covenants establish that there will be no building or structure closer than 20 feet to any property line; the first ten feet adjacent to the south and east property lines shall be landscaped; and the outside storage of materials shall be permitted within the storage area of the property provided such storage area is screened from all adjacent property lines by a wall or view obscuring fence not less than six feet nor more than ten feet in height. As there were no additional comments, it was moved by Stredicke, seconded by Denzer, that the hearing be closed. Motion carried unanimously. The Planning Director stated the original request by Pacific Northwest Bell located the proposed sign four feet from the right of way line. In accordance with the wishes of the Planning Commission, the applicant revised the location of the sign to approximately 16 feet from the property line. The question of sight distance in terms of location of the sign at the old location and the moving of the sign to the proposed new location was discussed with the applicant's representative, and the staff felt the new location would result in better traffic circulation. Stredicke asked why the sign wasn't moved back the entire 20 feet requested by the Commission, Mr. Eaton of the Benaroya Company and Mr. Bob Laney of Pacific Northwest Bell were present. Mr. Eaton explained that moving the sign back any further would re- sult in its being too close to the driveway. A drawing of the sign and its revised location was displayed. Stredicke stated he felt the new location was a distinct improve- ment over the original location. The Planning Director pointed out the location of the proposed plat on the zoning map and read a letter received from the Seattle-King County Department of Public Health which stated in part that in their opinion any lot less than 9600 square feet should not be allowed to install a drainfield for sewage disposal because of past experience with septic tank failures on small lots. It was their recommendation that property development be delayed until sewers are available as septic tanks and drainfields are only a temporary means of disposing of sewage. Three of the six lots in the proposed plat are less than 9600 square feet in size. Considerable discussion followed among Planning Commissioners, Mr. Houk of the Engineering Department and members of the audience concerning the sewage disposal problem in the Kennydale area, local improvement districts, etc. ACTION: STERLING STATED IN LIEU OF CLOSING THIS HEARING, HE WOULD MOVE TO CONTINUE THE MATTER FOR 30 DAYS TO ALLOW TIME TO REVIEW WITH THE - DEVELOPERS THE POSSIBILITY OF ENLARGING LOT SIZES IN LINE WITH THE RECOMMENDATION FROM THE SEATTLE-KING COUNTY HEALTH DEPARTMENT; DENZER SECONDED. Stredicke stated he felt the Planning Commission should ask for a statement of policy from the City Council regarding the possibility of the City's making sewers available in the area. He did not feel changing the lot sizes would solve the sewage disposal problem. Ross stated that due to the demand for housing in the area and the present high cost of land, that if developers are denied the right to build, they would simply go elsewhere in the county to build, thereby stagnating development in Renton. Renton Planning Commission Meeting May 8, 1968 Minutes Page 3 The Commission generally felt, after discussion of this matter, that it was unwise policy to disrupt the normal procedures of rezone applications for the convenience of one applicant since the delay was the result of his failure to submit the application by the dead- line date for the April Planning Commission public hearing. Action by the Council would, at best, save the applicant only two weeks in time. Forgaard noted that should SR-1 be granted, that the applicant would lack 500 square feet of having another building site on the property, and he believed the applicant's plot plan submitted with his rezone application did not indicate the true location of the proposed house but that the house would be set well over, possibly to accommodate another building site which might be acquired by a variance request. Commissioners were interested in this point and felt it would be well to check this out on the field trip. ACTION: Moved by Ross, seconded by Racanello, that the Planning Commission follow the normal procedure on this rezone application of Manio Phillips. Mola stated he felt the Planning Commission could come under unfavorable criticism by allowing normal procedures to be by- passed; that some people had indicated to him they believed the Planning Commission would be showing favoritism toward this ap- plicant. The pending motion carried unanimously. The Chairman stated he would suggest that the Commission communi- cate with the City Council indicating that it was the unanimous feeling of the Planning Commission that due to the circumstances the usual procedures should not be by-passed; that the Planning Department has published and posted this application for hearing on May 22, 1968; that other publications and postings for a hear- ing on May 20, 1968 would tend to confuse interested persons; not to mention the possible legal aspects of this case.
