Discussion followed concerning the Puget Sound Power and Light right-of-way bisecting the subject property. Forgaard stated he believed the right-of-way is still in existence and has not been vacated. Audience comments were invited. Mr. Mike Lotto, 7812 Sunnycrest Road, Seattle, one of the appli- cants, stated the right-of-way is in his ownership; that Puget Power had requested a change in the location of the right-of-way at the time the freeway was put in. The Planning Director stated the legal description submitted with the rezone application lesses out that portion of the property shown as the right-of-way and does not show it as an easement to the power company. ACTION: MOVED BY TEEGARDEN, SECONDED BY MOLA, THAT THE REZONE APPLICATION OF O'NEIL AND LOTTO BE CONTINUED TO THE PUBLIC HEARING MEETING OF JANUARY 22, 1968. Mr. Lotto stated he would like to have the matter acted upon as soon as possible as delay would work a hardship on his building schedule. Ross stated he felt the Commission could act on the matter. The ownership of the right-of-way would have no bearing on the rezone itself; that could be worked out when the building permit was applied for. Mola stated he seconded the motion to continue because it appeared to him there is a legal problem in the description of the land involved. Forgaard stated he believed the application could be acted on by the Planning Commission as submitted; that no building could be located under the power lines so zoning was not a problem in the right-of-way area. PENDING MOTION TO CONTINUE THE HEARING LOST. Moved by Denzer, seconded by Racanello, that the hearing be closed. The Chairman stated the Planning Director, in study session, had brought up the question of landscaping as required in nearby developments. Renton Planning Commission Meeting November 27, 1968 Minutes Page 5 Teegarden stated he believed it was the thinking of the Commission to require landscaping and asked the attitude of the property owner as to whether or not he would be willing to provide screening and landscaping by covenants. The Planning Director outlined some of the landscaping, screening and setback requirements obtained from the Richards and Ostlund properties nearby. Mr. Lotto stated he would be agreeable to furnishing landscaping and would like the opportunity of working with the Planning De- partment in this respect in order to prepare the proper covenants. Pending motion to close the hearing carried unanimously. The Planning Director pointed out the location of the property on the zoning map, indicating it was a continuation of Earlington Industrial Park No. 1 previously approved. Pacific Coast R.R. Company, the applicant, submitted a letter con- cerning the variance request which was read by the Chairman. The letter stated that construction of sidewalks as prescribed by City regulations would serve no public purpose as provision will be made for on-site parking and all employees and any other parties using or visiting the proposed facilities will be traveling by motor vehicle. Further, construction of sidewalks would leave a strip between the sidewalks and the edge of the paved portion of the street which would not lend itself to landscaping. Side- walks would therefore become a detriment to proper landscaping, care and maintenance of the platted area. In addition, there is no way for the applicant or the City to predict or plan the precise location of industrial buildings on the lots. Thus, to require sidewalks in the initial development would result in portions of them ultimately being destroyed in order to pro- vide driveway accesses and other uses of the property. The Chairman read a letter from the City Engineer which stated that the Engineering Department had examined the preliminary plat of Earlington Industrial Park No. 2 and recommended approval subject to final approval of all street and utility plans. Discussion followed concerning the number of extensions allowed by Ordinance. The hearing on the final plat application of Victoria Park No. 7 was continued by the Planning Commission for six months to allow time to resolve the problem of access. It was determined that the Commission could, at its discretion, continue the hearing further. This matter will be reviewed at the next study session and decision made at the public hearing meeting of November 27, 1968. (b) URCH SUBDIVISION; Appl. (continued from October 23, 1968) Mr, Houk of the Engineering Department stated the plat improvement bond has not as yet been posted covering this plat.
