C. Project Description / Background:
The applicant has requested approval of an administrative variance from the required
setback for a garage accessed frorn a street along a side yard. The subject site is
located at 1727 Nile Avenue NE (Parcel No, 032305-9035, Exhibit 2),
The site is Lot 8 of the Windstone Division II development (Exhibit 3), Windstone Div
II (formerly called Stoneridge Div II) was approved as a short subdivision (LUA04-
124) February 8, 2005, The density of the approved plat is 2,84 dwelling units per
acre,
Although Windstone Div. II is in the Residential 4 (R-4) zone, it is vested by virtue of
an annexation agreement to Residential 5 (R-5) development standards (Exhibit 4),
Therefore, the minimum lot size allowed is 7,200 sf. Lot 8 is 16,660 sf, but in spite of
this size, the configuration of the lot has created difficulty in siting a standard-floor
plan structure.
The irregular lot shape is due to the location of a fork or tributary of Greene's Creek
that forms the west boundary of Lot 8. Greene's Creek itself is located at the east
part of the subdivision. Greene's Creek was determined to be a seasonal stream at
this location. Buffer averaging of the stream setback was allowed to accommodate
the private street accessing Lot 9, but was not requested for structure siting.

The development standards require a side yard along a street of 15 feet for the
primary structure and 20 feet for an attached garage accessed from the side street.
The setback is measured from the property line to the building.
The primary building would meet the setback requirement, but the garage would be
situated between the primary structure and the side street. Approximately % of the
garage fa<;:ade would be 20 feet and closer to the side street (Exhibit 5). Therefore,
the applicant is proposing a 5-foot setback between the street and the northeast
comer of the garage. The proposed structure would meet all other applicable
development standards.
The side street is a 20-foot wide private access easement across Lot 8 that
intersects with Nile Avenue NE. It serves Lots 8 and 9 of Windstone II only.
Analysis of the garage footprint in relation to the stream setback indicates that if
buffer averaging was utilized, the garage could be placed farther away from the side
street, thereby meeting the minimum setback requirement. Alternate 'A' (Exhibit 6)
would have the garage situated so that the north corner is 20 feet from the edge of
the access street. It would be accessed from northeast to southwest. Alternate '8'
(Exhibit '7') would also have the north corner of the garage located 20 feet from the
edge of the access street, but would be accessed from northwest to southeast. 80th
alternatives would place the garage within the 35 foot buffer from the seasonal
stream, but outside of the 25 foot buffer area.
It would be the applicant's option to request a reduction in the stream buffer and use
buffer averaging.
FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter, the City now makes and enters the
following:
D. Findings
1) Request: The applicant has requested approval of an administrative
variance from the required 20~foot side yard along a street setback for a
garage accessed from the street. A 5-foot sideyard along a street setback is
proposed for the northeast corner of the garage. All other portions of the
primary structure and attached accessory structure would comply with the
required setbacks and all other development standards would be met.
2) Administrative Variance: The applicant's administrative variance submittal
materials comply with the requirements necessary to process a variance. The
project file, the applicant's site plan, and other project drawings are entered as
Exhibits 1 through 7.

3) Existing Land Use: Land uses surrounding the subject site include: North:
single-family residential (R-4 zone); South: single-family residential (R-4
zone); East single-family residential (unincorporated King County); and West:
single-family residential (R-4 zone).
4) Zoning: The site is located in the Residential - 4 (R-4) zone. It is vested to
the Residential 5 development standards however. The development
standards for the R-5 zone require a 15 foot side yard setback along a street
for the primary structure and a 20-foot setback for an attached garage.
5) Topography: On Lot 8, the site slopes in a southwesterly direction toward the
Greene's Creek tributary.
6) Lot and Building: The area of Lot 8 is 16,660 square feet. The proposed
single-family residence and garage are situated outside of the stream buffer
area (Native Growth Protection Easement).
7) Variance Request: In addition to the requested variance, the applicant has
proposed two alternatives that would result in a reduction of the stream buffer
through buffer averaging and relocation of the garage into the 35 foot buffer to
a point no closer than 25 feet from the seasonal stream. This would require a
modification of the approved subdivision. These alternatives, however, are not
preferred, due to the increased potential for negative impacts on the stream
from reduced buffering.
CONSISTENCY WITH VARIANCE CRITERIA
Section 4-9-2508.5.a. Lists 4 criteria that the Responsible Official is asked to
consider, along with aI/ other relevant information, in making a decision on an
Administrative Variance application. These include the fol/owing:
The Responsible Official shall have authority to grant an administrative variance
upon making a determination, in writing, that the conditions specified below have
been found to exist:
1) That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property,
including size, shape, topography, location or surroundings of the
subject property, and the strict application of the Zoning Code is found
to deprive subject property owner of rights and privileges enjoyed by
other property owners in the vicinity and under identical zone
classification:
Due to the irregular shape of Lot 8 and the proximity of Greene's Creek, an
attached garage cannot be positioned on the lot without either being within the
sideyard setback area or within 25 feet (reduced buffer area) of a Class 4
stream. An attached garage is a requirement of a "marketable" product.

Therefore, denial of the variance request would result in a request to reduce
the stream buffer through averaging.
Staff agrees that an attached garage is necessary to preserve the value of the
property and that a variance, as requested, would have less impact on the
stream than buffer averaging. which is the alternative course of action.
2) That the granting of the variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in the
vicinity and zone in which subject property is situated:
The granting of the variance would have less impact on the environment and
other properties nearby than reducing the buffer, which is the next alternative
available. The granting of the variance would not be materially detrimental to
the public welfare or injurious to surrounding properties or improvements.
3) That approval shall not constitute a grant of special privilege
inconsistent with the limitation upon uses of other properties in the
vicinity and zone in which the subject property is situated:
The approval of the variance request would not be a grant of special privilege
as the variance would allow for an attached garage, which is an accessory
stnucture enjoyed by most homeowners in the vicinity.
4) That the approval as determined by the Reviewing Official is a minimum
variance that will accomplish the desired purpose:
The applicant contends that the request is the minimum variance needed in
order to construct the attached garage. Staff has reviewed the request and
concurs that the proposed variance is the minimum necessary to accomplish
the desired purpose of siting the proposed garage.
E. Conclusions
1) The subject site is located at 1727 Nile Ave NE, within a Residential - 4
dwelling units per acre (R-4) zoning designation.
2) The applicable development standards require a minimum 20-foot side yard
along a street setback for the attached garage from the property boundary.
The applicant is proposing to reduce this setback to 5 feet.
3) The analysis of the proposal according to variance criteria is found in the body
of the Staff Report.
4) Staff's analysis concludes that the applicant's proposal is justified based on
the four applicable criteria needed to grant a variance.

The administrative land use decision will become final if the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV. Section 4-8-11.B. which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must
be made in writing on or before 5:00 PM on June 28. 2007. Any appeal must be accompanied by a $75.00
fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications
may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals
to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing
through the Hearing Examiner. All communications are public record and this permits all interested parties to
know the contents of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation of the appeal by the Court.

RE: Request for a Variance for the front yard setback for the existing home located on Lot 8 of
Windstone Division II. (LUA 04-124-FP LND 10-0450)
Dear Jennifer,
On behalf of KBS Development Corporation, and per our recent conversation(s); this letter shall
serve as a formal request for a variance at the Windstone Division II Short Plat. The variance we
are requesting is listed below:
Reduction of the front yard setback for Lot 8 of Winds tone Division II down to 5'.
The justification(s) for the variance request are as follows:
I. Lot 8 has an irregular shape, and is surrounded by a stream/wetland buffer on the West,
and Nile Ave. NE on the East. (which requires a 15' setback)
2. Granting the variance will not be detrimental to the public welfare or injurious to the
property or improvements in the vicinity and zone in which the subject property is
located. Approving this variance would, in fact, allow the new home to be built on the
lot, to build to a similar spec level as those in Windstone Division I.
3. The approval will not constitute a grant of special privilege inconsistent with the
limitation upon uses of other properties ill the vicinity and zone in which the subject
property is located.
4. The lot is +-105' wide at the front (N. side), but within 70', narrows down to 60' wide.
With a IS' setback from Nile Ave. NE on the East, and a wetland buffer on the West,
(which the home will need to be +-10' away from), the building envelope would be
reduced t035' wide. Such a narrow home would greatly impact the quality and value of
the new home built on the lot. If approved, the requested variance is the minimum
variance that will accomplish the desired purpose.
