Bellamonte in the Highlands lot line Adjustment

The City of Renton has finished reviewing your proposed lot line adjustment and is now
ready to approve and send the final version for recording. Please make the attached
changes and submit three sets of original signed mylars and a check for $15.81 made out
to Champion Couriers to my attention at the sixth floor counter of City Hall.
Please verify that the mylars have been signed by all owners of record and have been
notarized with an ink stamp (not embossed). The ink stamp must be legible so that King
County will promptly record the lot line adjustment.
This decision to approve the proposed lot line adjustment is subject to a fourteen (14) day
appeal period from the date of this letter. Any appeals of the administrative decision must
be filed with the City of Renton Hearing Examiner by 5:00 pm, June 11, 2009.
Appeals must be filed in writing together with the required $75.00 application fee with:
Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057. Appeals to
the Examiner are governed by City of Renton Municipal Code Section 4-8-110. Additional
information regarding the appeal process may be obtained from the Renton City Clerk's
Office, (425) 430-6510.

Bob Mac Onie and I have reviewed the above referenced lot line adjustment submittal and have
the following additional comments:
Comments for the Applicant:
Change the title of the City of Renton official who will be signing the lot line adjustment
mylars to: City of Renton Planning Director of the Department of Community and
Economic Development.
The Stewart Title Second Commitment title report, Order No. 955587, dated April 17,
2009, notes a number of encumbrances that may need to be noted on the lot line adjustment
submittal. These encumbrances are listed under "SCHEDULE B" as "SPECIAL
EXCEPTIONS". Said encumbrances are Item Nos. 12-15 and 23-24. Review and add as
needed.
Because the subject property falls within Zone 2 of the City of Renton Aquifer Protection
Area, the Aquifer Protection Notice needs to be noted on the drawing. See the attachment.

CONDITIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquired actual knowledge of any defect, lien, encumbrance, adverse claim or

those shown in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the
Company shall be relieved from liability for any Joss or damage resulting from any act of reliance hereon to

disclose such knowledge to the Company, or if the Company otherwise acquires actual knowledge of any
such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may amend
Schedule B of this Commitment accordingly, but such amendment shall not relieve the Company from liability
previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such
parties included under the definition of Insured in the form of policy or policies committed for and only for
actual loss incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof,
or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate or interest or
mortgage thereon covered by this Commitment. In no event shall such liability exceed the amount stated in
Schedule A for the policy or policies committed for and such liability is subject to the insuring provisions and
Conditions and Stipulations and the Exclusions from Coverage of the form of policy or policies committed for
in favor of the proposed Insured which are hereby incorporated by reference and are made a part of this
Commitment except as expressly modified herein.
4. This Commitment is a contract to issue one or more title insurance policies and is not an abstract of title or a
report of the condition of title. Any action or actions or rights of action that the proposed Insured may have or

Bob Mac Onie and I have reviewed the above referenced lot line adjustment submittal and have
the follo\ving comments:
Comments for the Applicant:
None.
Information needed for final lot line adjustment approval includes the following:
Note the City of Renton land use action number and land record number, LUA-07-080-LLA and
LND-30-0331, respectively, on the drawings in the spaces already provided.
Ties to the City of Renton Survey Control Network are incomplete. Note the bearing and
distance between City of Renton Mon #1503 and Mon# 1227. The geometry will be checked by
the city when the ties are provided.
The legal descriptions for Parcel Bare incorrect and incomplete (both of them). Review and
revise as needed.
The required City of Renton signature, for lot line adjustment approval, is the City of Renton
Administrator of Public Works (note the change in title).
Separate the City of Renton approval block from the King County approval block. Separate via a
horizontal line between the two blocks, or place each approval block in individual boxes, or etc.

to the BeUamonte in the Highlands Lot Line Adjustment (LUA07-080, LLA). Based on
correspondence and communication to date it appears the objective of the lot line adjustment is to
create a circumstance to allow a small remnant of land; the area between the west property line
and the western edge of stream buffer on Parcel #5182100020; to be adjoined to the abutting
property to the west.
I recommend that you submit your Lot Line Adjustment accordingly; depicting parcel numbers
#5182100012, 5182100014 and 5182100011 combined with your adjacent remnant property to
the east on Parcel #5182100020.
This letter serves as confirmation that the City would approve such a proposal. I hope this letter

Dear Mr. Watts,
We have completed the construction work for the plat and are prepared to submit
corrections to the Final Plat submission. The mitigated Wetland Area is also
complete and awaiting the Performance Monitoring Report by Shannon & Wilson
based on their inspection of the Wetland Buffer last week.
While waiting for the City of Renton's review of the Wetlands and construction site
corrections letter, we would like to request a rearrangement of the lot lines. The
requested changes are as follows;
1. Enlarge Lot 1 to about 55,000 SQ. FT. by extending the lot line to the
West property line thus including the north 180 feet of the wetlands and
mitigated buffer.
2. Enlarge Lot 2 to include the East Half of the remaining Wetland and
Buffer as an easement on the lot as well as the Storm Detention Pond.
3. Tract A WOULD BE REDUCED IN SIZE to include the West Half of the
remaining Wetlands and Buffer (please see attached Exhibit 1 & 2).
The proposed changes should be considered minor in nature since the Open Space
Area would remain the same, the number of lots and tracts are not increased or
decreased and all access points are unchanged.
However the proposed changes will help facilitate the recording the approved
Bellamonte in the Highlands Lot Line Adjustment, File No. LUA07-080, LLA. Once
the Rabera-Balko Short Plat is recorded, we plan to continue with final approval
and recording the LLA. By making the proposed changes to our lot lines prior to

recording, considerable engineering time as well as City of Renton staff review time
to complete the Bellamonte LLA. Tract A, by remaining a SEPARATE PARCEL,
could be deeded to the Bcllamonte parcel, subject to Renton approval, without
requirement of a boundary line adjustment.
The maintenance and monitoring of the Wetlands and Mitigated Buffers would
remain under the Rabera-Balko Homeowners Association. However, if the City of
Renton considers this request a possible delay in recording the Plat, we are
prepared to record as currently APPROVED. If there are any questions, please

The City of Renton has finished reviewing your proposed lot line adjustment and is now
ready to approve and send the final version for recording. Please submit two sets of
original signed mylars and a.check for $17.97, made out to Velocity Express, to my
attention at the sixth floor counter o[City Hall.
Please verify that the mylars have been signed by all owners of record and have been
notarized with an ink stamp (not embossed), The ink stamp must be legible so that
King County will promptly record the lot line adjustment.
This decision to approve the proposed lot.line adjustment is subjectto a fourteen (14) day
appeal period from the date of this letter. Any appeals of the administrative decision
must be filed with the City of Renton Hearing Examiner by 5:00 pm, November 12, 2007.
Appeals must be filed in writing together with the required $75.00 application fee with:
Hearing Examiner, City of Renton, I 055 South Grady Way, Renton, WA 98055.
Appeals to the Examiner are governed by City of Renton Municipal Code Section 4-8-

PROJECT NARRATIVE
The proposed plat of Bellamonte in the Highlands is located on the east side of Union Ave. NE,
south of the intersection of NE 4th street in the City of Renton. We propose to subdivide three
(3) tax parcels into 26 single family residences. This is proposed to be a Mixed Use
Condo/Retail town home project, with associated infrastructure in accordance with the City of
Renton code. The first Pre-application meeting, reference # PRE 04-013, was held on
September 02, 2004. The second Pre-application meeting, reference # PRE 06-085, was held
on July 27, 2006.
Currently the site is developed with single-family detached dwellings with accessory structure.
This proposal will call for removal of these existing structures. Topography on the properties
slopes down gently to the east. There are no wetlands, streams, or wildlife networks present on
the site. A forested area is located east of the subject parcels. The proposed 26 single-family
attached homes will also include infrastructure, with right of way, a detention/water quality vault
facility, and park, using City of Renton's subdivision processes. The project will access from
Union Ave. NE, served by a sub access street. City of Renton's Development Standards: RMC 4-
2-120A, "Development Standards for Commercial Zoning Designations" applies to new
development on this site. The project is subject to the requirements of Downtown Urban Design
Overlay District B, and compliance will be reviewed at the site plan and preliminary plat stage of
the permitting process.
The Permits that are required for this project are: SA, PP, and LLA and the zoning on this
project is CA (Commercial Arterial) NE 4th St. Corridor District. This narrative is in regards to the
LLA (Lot Line Adjustment) that will be necessary for this project. The additional property that is
being incorporated into this project is with the Langley 4th Ave. Associates. It is being added for
drainage purposes for our proposed Detention Vault.
The proposed estimated project cost is $8 million.

COMMITMENT FOR TITLE INSURANCE
ISSUED BY
STEWART TITLE GUARANTY COMPANY, A Texas Corporation, herein called the Company,
for a valuable consideration. hereby commits to issue its policy or policies of title insurance, as
identified in Schedule A, in favor of the proposed Insured named in Schedule A, as owner or
mortgagee of the estate or interest covered hereby in the land described or referred to 1n Schedule
A, upon payment of the premiums and charges therefore; all subject to the provisions of
Schedules A and B and to the Conditions and Stipulations hereof.
This Commitment shall be effective only when the identity of the proposed Insured and the
amount of the policy or policies committed for have been inserted in Schedule A hereof by the
Company, either at the time of the issuance of this Commitment or by subsequent endorsement.

1. The term mortgage. when used herein, shall include deed of trust, trust deed. or other
secunty instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien,
encumorance, adverse claim or other matter affecting the 8state or intersst or mortgage
thereon cov8r8d by this Commitment other than those shown in Schedule B hereof, and
shall fail to disclose such knowledge to the Company in writing, the Company shall be
relieved from liabllity for any loss or damage resulting from any act of reliance hereon to
the extent the Company is prejudiced by failure to so disclose such knowledge. If the
proposed Insured shall disclose such knowledge to the Company, or if the Company
otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim
or other matter, the Company at Its option may amend Schedule B of this Commitment
accordingly, but such amendment shall not relieve the Company from liability previously
incurred pursuant to paragraph 3 of these Conditions and Stipulations
3. Uabilrty of the Company under this Commitment shall be only to the named proposed
Insured and such parties included under the definition of Insured in the form of policy er
policies committed for any only for actual loss incurred in reliance hereon in undertaking in
good faith (a) to comply wrth the requirements hereof, or (b) lo eliminate exceptions shown

CONDITIONS AND STIPULATIONS
1 The term mortgage, when used herein, shall include deed of trust. trust deed. or other
security instrument.
2 If the proposed Insured has or acquires actual knowledge of any defect, lien,
encumbrance. adverse claim or other matter affecting the estate or interest or mortgage
thereon covered by this Commitment other than those shown in Schedule B hereof, and
shall fail to disclose such knowledge to the Company in writing, the Company shall be
relieved from liability for any loss or damage resulting from any act of reliance hereon to
the extent the Company is prejudiced by failure to so disclose such knowledge. If the
proposed Insured shall disclose such knowledge to the Company, or if the Company
otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim
or other matter. the Company at its option may amend Schedule B of this Commitment
accordingly, but such amendment shall not relieve the Company from liability previously
incurred pursuant to paragraph 3 of these Condrtions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed
Insured and such parties included under the definition of Insured in the form of policy or
policie5 committed for any only for actual loss incurred in reliance hereon in undertaking in
good faith (a) to comply with the requirements hereof, or (bJ to eliminate exceptions shown
in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon
covered by thi5 Commitment. In no event shall such liability exceed the amount stated in
Schedule A for the policy or policies committed for and such liability is subject to the
insuring provisions. the Conditions and Stipulations, and the Exclusions from Coverage of
the form of policy or policies committed for in favor of the proposed Insured which are
hereby incorporated by reference and are made a part of this Commitment except as
expressly modified herein.
4. Any action or action5 or rights of action that the proposed Insured may have or may bnng
