Dear Parties of Record:
This letter is written on behalf of the Environmental Review Committee (ERC) and is to inform
you that they have completed their review of the environmental impacts of the above-
referenced project. The Committee, on June 1, 2009, decided that your project will be issued a
Determination of Non-Significance.
The City of Renton ERC has determined that it does not have a probable significant adverse
impact on the environment. An Environmental Impact Statement (EIS) is not required under
RCW 43.21C.030(2)(c). This decision was made by the ERC under the authority of Section 4-6-6,
Renton Municipal Code, after review of a completed environmental checklist and other
information, on file with the lead agency. This information is available to the public on request.
Appeals of the environmental determination must be filed in writing on or before 5:00 p.m.
on June 19, 2009. Appeals must be filed in writing together with the required $75.00
application fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98057. Appeals to the Examiner are governed by City of Renton Municipal Code Section 4-8-

STAFF Staff Recommends that the Environmental Review Committee issue a Determination
RECOMMENDATION: of Non-Significance (DNS).
PART ONE: PROJECT DESCRIPTION/ BACKGROUND
1. D-02: Indoor Recreation Use
Description: This item proposes to amend the Zoning Use Table, RMC 4-2-060J, to permit new
Indoor Recreational Uses in the Industrial Light (IL), Commercial Neighborhood (CN), Center
Downtown (CD), Commercial Office (CO), Commercial/Office/Residential (COR), and the Urban
Center North I & 2 (UC-NI & UC-N2) zoning designations, subject to some restrictions. The
proposed restrictions include:
i. In the IL zone, only permitted in Employment Area Valley (EA V);
ii. In the CN zone, limited to a maximum gross floor area of 3,000 square feet;
iii. In the CD zone, must be located within a mixed-use structure;
iv. In the CO zone, limited to health clubs/fitness centers/sports clubs, which shall be developed as
part of larger office structures. Such uses shall not stand alone and shall not occupy more than
twenty five percent (25%) of any one floor of a building whose primary use is ofiice:
v. In the COR zone, only in conjunction with offices, residences, hotels, and convention centers, or
research and development facilities, and should be architecturally and functionally integrated
into the development;
vi. In the UC-NI zone, freestanding structures not permitted unless architecturally and timctionally
integrated into an overall shopping center or mixed use development.
vii. In the UC-N2 zone, must be located within a mixed-use structure.
2. D-04: Commercial Setbacks
Description: This item proposes to add procedures to Title IV that so that the Planning Division can
require, or an applicant can request, Site Plan Review in order to reduce setbacks where code allows
setbacks to be reduced through site plan review. This would only occur for small scale commercial

uses that would have been otherwise exempt from Site Plan Review and that cunently cannot use Site
Plan Review to reduce setbacks.
a. Location: Citywide.
3. D-08: Stream Re-class
Description: This item proposes to upgrade from Class 3 to Class 2 portions of Honey Creek and
Maplewood Creek. This is based on infom1ation provided by the Washington Department of Fish &
Wildlife (WDFW) and the Mucklcshoot Tribe that indicates the presence of fish some reaches of the
streams. Additionally, it is proposed that process for reclassification of streams to higher level be
clarified in Title JV. The process will require administrative acceptance/determination, followed by
legislative amendment.
4. D-11: Live-Work Units
Description: This item proposes to allow Live Work Units in the CN, R-14, and CA zones. The
following would be required: nonresidential space to be built to commercial code, street presence and
pedestrian orientation, one parking space for the residential space with parking for commercial based
on type, and an internal connection between commercial and residential spaces. The following
limitations would be place on live work units: the maximum commercial space is 1,000 square feet,
retail sales, on-site services, and eat/drink establishments would be the only commercial uses allowed.
Finally, live work would only be allowed in the R-14 zone along arterials (Primary, Minor, Collector)
and in the CA zone when at least 150 feet from an arterial.
5. D-12 Animals Modifications
Description: This item proposes to amend the amount of additional lot size required to keep an
additional Household Pet to match the additional lot size required for the keeping of additional

approved site/floor plan, and a statement of regarding the limitations of ADU's in Title IV. One off

of single-family residences. The proposal for three lots would arrive at a density of 3.98 dwelling
units per net acre (du/ac). There is an existing house which is proposed for removal. The project site
is located within the Residential -4 (R-4) dwelling units per acre zoning designation, however the
applicant is proposing a "small lot cluster" development. The proposed lots would range in net size
from 5,000 square feet in area to 8,698 square feet. Access would be provided via a new 18-foot
wide private alley extending from 148th Ave SE. The applicant has requested a street modification in
order for the alley to be used as primary access for proposed lot A and to reduce the width of the
alley to 18 feet. A total of 2,298 square feet Category 3 wetlands are present in the western portion
of the site and are associated with a Class 5 stream.

Review of a 2.14-acre site located at 19029 120th Avenue SE. This application is vested to King
County Development Standards and is located within King County's R-6 zoning designation. The
applicant proposed to subdivide the lot into 9 lots for single-family residential development and one
Tract for draina_ge and recreation. lots 1-8 range in size from 5,696 to 5,800 square feet. Lot 9 is
proposed as a future development tract and is 28,370 square feet. All buildings on site are to be
removed. Access to the lots would be via SE 191st Street. The site was graded prior to application
submittal; as such, 42 replacement trees are required at 3-inch caliper. The applicant has proposed
to install a drainage vault in Tract A, in addition to street frontage improvements along 120th
Avenue SE and 191st Street.
HCC Expansion & Remodel (Timmons}

location: 3031 NE 101h Street. The applicant is requesting Hearing Examiner Site Plan Review and
Environmental (SEPA) Review for the phased construction of additions to and the interior remodel of the
existing Highlands Community Church facility. The 19,000 square feet of additions include office space, a new
lobby and a 2-story education wing. The additions would create the opportunity to remodel the existing
facility and increase the size of the sanctuary. The proposal also includes an expansion of the surface parking
lot in the amount of 168,000 square feet. As part of the parking lot expansion the applicant is also proposing
associated landscaping and pedestrian pathways. The site is approximately 7.68 acres and is located within
the Center Village (CV) and Residential-8 du/ac zoning designations and is also located within Urban Design
District D. Access to the site would continue to be provided via existing curb cuts along Kirkland Ave NE, NE
9th and NE 10th Street. One additional entry to the new parking area is proposed on the southwest corner of

Description: This item proposes to amend the Zoning Use Table, RMC 4-2-060J, to permit new Indoor
Recreational Uses in the Industrial Light (IL), Commercial Neighborhood (CN), Center Downtown
(CD), Commercial Office (CO), Commercial/Office/Residential (COR), and the Urban Center North I
& 2 (UC-NI & UC-N2) zoning designations, subject to some restrictions. The proposed restrictions
include:
i. In the IL zone, only permitted in Employment Area Valley (EAV);
ii. In the CN zone, limited to a maximum gross floor area of 3,000 square feet;
iii. In the CD zone, must be located within a mixed-use structure;
iv. In the CO zone, limited to health clubs/fitness centers/sports clubs, which shall be developed as
part of larger office structures. Such uses shall not stand alone and shall not occupy more than
twenty five percent (25%) of any one floor of a building whose primary use is office;
v. In the COR zone, only in conjunction with offices, residences, hotels, and convention centers, or
research and development facilities, and should be architecturally and functionally integrated
into the development;
vi. In the UC-N 1 zone, freestanding structures not permitted unless architecturally and functionally
integrated into an overall shopping center or mixed use development.
vii. In the UC-N2 zone, must be located within a mixed-use structure.

Description: This item proposes to add procedures to Title IV that so that the Planning Division can
require, or an applicant can request, Site Plan Review in order to reduce setbacks where code allows
setbacks to be reduced through site plan review. This would only occur for small scale commercial
uses that would have been otherwise exempt from Site Plan Review and that currently cannot use Site
Plan Review to reduce setbacks.

3. D-08: Stream Re-class
Description: This item proposes to upgrade from Class 3 to Class 2 portions of Honey Creek and
Maplewood Creek. This is based on information provided by the Washington Department of Fish &
Wildlife (WDFW) and the Muckleshoot Tribe that indicates the presence of fish some reaches of the
streams. Additionally, it is proposed that process for reclassification of streams to higher level be
clarified in Title IV. The process will require administrative acceptance/determination, followed by
legislative amendment.
4. D-11: Live-Work Units
Description: This item proposes to allow Live Work Units in the CN, R-14, and CA zones. The
following would be required: nonresidential space to be built to commercial code, street presence and
pedestrian orientation, one parking space for the residential space with parking for commercial based
on type, and an internal connection between commercial and residential spaces. The following
limitations would be place on live work units: the maximum commercial space is 1,000 square feet,
retail sales, on-site services, and eat/drink establishments would be the only commercial uses allowed.
Finally, live work would only be allowed in the R-14 zone along arterials (Primary, Minor, Collector)
and in the CA zone when at least 150 feet from an arterial.
5. D-12 Animals Modifications
Description: This item proposes to amend the amount of additional lot size required to keep an
additional Household Pet to match the additional lot size required for the keeping of additional
medium lot domestic animals (from 10,000 square feet to 7,500 square feet). Also, to discontinue the

addition to the parking for primary dwelling will be required. Other building standards (side setbacks, height, etc.) will be

OPTIONAL DETERMINATION OF NON~SIGNIFICANCE (DNS): As the Lead Agency, the City of Renton has determined
that significant environmental impacts are unlikely to result from the proposed Comprehensive Plan amendments and
zoning changes. Therefore, as permitted under the RCW 43.21C.110, the City of Renton is using the Optional DNS
process to give notice that a DNS is likely to be issued. Comment periods for the project and the proposed DNS are
integrated into a single comment period. There will be no comment period following the issuance of the Threshold
Determination of Non-Significance (DNS). A 14-day appeal period will follow the issuance of the DNS

PURPOSE OF CHECKLIST:
The State Environmental Policy Act (SEPA), Chapter 43.21 C RCW, requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions. An Environmental Impact
Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be
done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your
proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most
precise information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases,
you should be able to answer the questions from your own observations or project plans without the need
to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write
"do not know'' or "does not apply". Complete answers to the questions now may avoid unnecessary
delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these questions if you can. If you have problems, the governmental agencies can
assist you.

time or on different parcels of land. Attach any additional information that will help describe your proposal

This non-project action includes the following nine docket items:
1. D-02: Indoor Recreation Use -This item proposes to amend the Zoning Use Table, RMC
4-2-060J, to permit new Indoor Recreational Uses in the Industrial Light (IL), Commercial
Neighborhood (CN), Center Downtown (CD), Commercial Office (CO),

Commercial/Office/Residential (COR), and the Urban Center North 1 & 2 (UC-N1 & UC-
N2) zoning designations, subject to some restrictions. The proposed restrictions include:
a. In the IL zone, only permitted in Employment Area Valley (EAV);
b. In the CN zone, limited to a maximum gross floor area of 3,000 square feet;
c. In the CD zone, must be located within a mixed-use structure;
d. In the CO zone, limited to health clubs/fitness centers/sports clubs, which shall be
developed as part of larger office structures. Such uses shall not stand alone and
shall not occupy more than twenty five percent (25%) of any one floor of a
building whose primary use is office;
e. In the COR zone, only in conjunction with offices, residences, hotels, and
convention centers, or research and development facilities, and should be
architecturally and functionally integrated into the development;
f. In the UC-N1 zone, freestanding structures not permitted unless architecturally
and functionally integrated into an overall shopping center or mixed use
development.
g. In the UC-N2 zone, must be located within a mixed-use structure.
2. D-04: Commercial Setbacks -This item proposes to add procedures to Title IV that so
that the Planning Division can require, or an applicant can request, Site Plan Review in
order to reduce front setbacks. This would only occur for small scale commercial uses
that would have been otherwise exempt from Site Plan Review.
3. D-08: Stream Re-class -This item proposes to upgrade from Class 3 to Class 2 portions
of Honey Creek and Maplewood Creek. This is based on information provided by the
Washington Department of Fish & Wildlife (WDFW) and the Muckleshoot Tribe that
indicates the presence of fish some reaches of the streams. Additionally, it is proposed
that process for reclassification of streams to higher level be clarified in Title IV. The
process will require administrative acceptance/determination, followed by legislative
amendment.
4. D-11: Live-Work Units-This item proposes to allow Live Work Units in the CN, R-14, and
CA zones. The following would be required: nonresidential space to be built to
commercial code, street presence and pedestrian orientation, one parking space for the
residential space with parking for commercial based on type, and an internal connection
between commercial and residential spaces. The following limitations would be place on
live work units: the maximum commercial space is 1,000 square feet, retail sales, on-site
services, and eat/drink establishments would be the only commercial uses allowed.
Finally, live work would only be allowed in the R-14 zone along arterials (Primary, Minor,
Collector) and in the CA zone when at least 150 feet from an arterial.
5. D-12 Animals Modifications -This item proposes to amend the amount of additional lot
size required to keep an additional Household Pet to match the additional lot size required
for the keeping of additional medium lot domestic animals (from 10,000 square feet to
7,500 square feet). Also, to discontinue the requirement of an Additional Animals Permit
for people who have the dictated additional lot size. For example, a person with one acre
of lot size would be allowed to keep four medium lot domestic animals and up to three
household pets without obtaining an Additional Animals Permit. Finally, to remove ducks
and geese from medium lot domestic animals definition and place in small lot domestic
animals definition.
6. D-14 Temporary Uses -This item proposes to create a two tier structure for temporary
use permits. The criteria used to determine the tier level include: the length and duration
of the activity, the hours of operation, consistency with underlying zone, the impact on
surrounding zones. Additionally, the number of auto sale events would be limited to one
seven day period per quarter per site. Temporary use permits would be valid for one
year. The fee for Tier I would be $75 and for Tier II $150.
7. D-21 Down Lighting -This item proposes to add a definition of downlighting to Title IV.
Also, to amend design district standards to require the use of downlighting as applicable.
Alternative lighting may be allowed when reviewed and approved administratively.
8. D-23 Accessory Dwelling Units -This item proposes to allow as an Administrative
Conditional use detached Accessory Dwelling Units (ADU's) in RC, R-1, R-4, R-8, R-10, &
R-14 zones. ADU's would only be allowed in association with single-family dwellings. No

more than 50 ADU's would be permitted per year. Either the primary home or the ADU
would be required to be owner occupied and the owner will sign an affidavit regarding this.
Each ADU will be evaluated to ensure consistency with the architectural character of
primary dwelling. ADU's will not be counted towards density. A notice on the property title
will be required to be filed; it will include: the legal description of the property, a copy of
the approved site/floor plan, and a statement of regarding the limitations of ADU's in Title
IV. One off street parking space per ADU in addition to the parking for primary dwelling
will be required. Other building standards (side setbacks, height, etc.) will be the same as
primary dwelling except for rear yards which will be determined through Administrative
review.
9. D-24 Bulk Standards and Definitions -This item proposes to revise the definition of
building height, so that it reflects International Building Code standard. Also, to add
definitions of Existing Grade and Grade Plane. Finally, to revise the definition of Net
Density to so that trails are removed from the calculation and so that some man-made
slopes may be removed when approved by the Administration.
12. Location of the proposal. Give sufficient information for a person to understand the precise
location of your proposed project, including a street address, if any, and section, township, and
range if known. If a proposal would occur over a range of area, provide the range or boundaries
of the site(s). Provide a legal description, site plan, vicinity map, and topographic map, if
reasonably available. While you should submit any plans required by the agency, you are not
required to duplicate maps or detailed plans submitted with any permit applications related to this
checklist.

for those with lesser income levels. Item 0-11 would allow live-work units, which the City
does not currently explicitly allow, however the zones in which it is proposed to be allowed
already allow mixed-use. Live-work may provide residential units on a limited basis, but it
is not expected to be substantial. It is unknown what income level the housing would be
intended for.

D. SUPPLEMENTAL SHEETS FOR NONPROJECT ACTIONS
(These sheets should only be used for actions involving decisions on policies, plans and

Because these questions are very general, it may be helpful to read them in conjunction with the
list of the elements of the environment.
When answering these questions, be aware of the extent the proposal, or the types of activities
likely to result from the proposal, would affect the item at a greater intensity or at a faster rate than

It is unlikely that the proposal would have any affect on the above environmental issues. Item D-
23 proposes to allow additional development, the development will only occur on parcels that have
already been built on. It is expected that although there may be slight increases in discharge to
water, typical to what is expected with residential land use, it would be less than a typical single
family home due to size limitations (800 square feet) and much less than typical Greenfield
development. In fact, item D-23 may lead to less overall (Citywide) discharge to water, etc. than
if anticipated population growth is accommodated in Greenfield development. Additionally, all
ADU's would be required to comply with all building and development regulations with increases
to discharge, etc. being mitigated at the time of proposal.
Proposed measures to avoid or reduce such increases are:

2009 DOCKET -GROUP 1
PROJECT NARRATIVE AND PROPOSAL SUMMARY
Docket Group 1 includes nine docket items which are:
1. D-02: Indoor Recreation Use
a. Description: This item proposes to amend the Zoning Use Table, RMC 4-2-0601, to
permit new Indoor Recreational Uses in the Industrial Light (IL), Commercial
Neighborhood (CN), Center Downtown (CD), Commercial Office (CO),
Commercial/Office/Residential (COR), and the Urban Center North 1 & 2 (UC-NI &
UC-N2) zoning designations, subject to some restrictions. The proposed restrictions
include:
i. In the IL zone, only permitted in Employment Area Valley (EAV);
ii. In the CN zone, limited to a maximum gross floor area of 3,000 square feet;
iii. In the CD zone, must be located within a mixed-use structure;
iv. In the CO zone, limited to health clubs/fitness centers/sports clubs, which shall
be developed as part of larger office structures. Such uses shall not stand alone
and shall not occupy more than twenty five percent (25%) of any one floor of a
building whose primary use is office;
v. In the COR zone, only in conjunction with offices, residences, hotels, and
convention centers, or research and development facilities, and should be
architecturally and functionally integrated into the development;
vi. In the UC-N 1 zone, freestanding structures not permitted unless architecturally
and functionally integrated into an overall shopping center or mixed use
development.
vii. In the UC-N2 zone, must be located within a mixed-use structure.
b. Location: Citywide in the Industrial Light (IL), Commercial Neighborhood (CN),
Center Downtown (CD), Commercial Office (CO), Commercial/Office/Residential
(COR), and the Urban Center North I & 2 (UC-Nl & UC-N2) zones.
2. D-04: Commercial Setbacks
a. Description: This item proposes to add procedures to Title IV that so that the Planning
Division can require, or an applicant can request, Site Plan Review in order to reduce
front setbacks. This would only occur for small scale commercial uses that would have
been otherwise exempt from Site Plan Review.
b. Location: Citywide.
3. D-08: Stream Re-class
a. Description: This item proposes to upgrade from Class 3 to Class 2 portions of Honey
Creek and Maplewood Creek. This is based on information provided by the
Washington Department of Fish & Wildlife (WDFW) and the Muckleshoot Tribe that
indicates the presence of fish some reaches of the streams. Additionally, it is proposed
that process for reclassification of streams to higher level be clarified in Title IV. The
process will require administrative acceptance/determination, followed by legislative
amendment.
b. Location: The portions of Honey Creek and Maplewood Creek that have been
identified by the Washington Department of Fish & Wildlife (WDFW) and the
Muckleshoot Tribe.
4. D-11: Live-Work Units
a. Description: This item proposes to allow Live Work Units in the CN, R-14, and CA
zones. The following would be required: nonresidential space to be built to commercial
code, street presence and pedestrian orientation, one parking space for the residential
space with parking for commercial based on type, and an internal connection between
commercial and residential spaces. The following limitations would be place on live
work units: the maximum commercial space is 1,000 square feet, retail sales, on-site
services, and eat/drink establishments would be the only commercial uses allowed.
Finally, live work would only be allowed in the R-14 zone along arterials (Primary,
Minor, Collector) and in the CA zone when at least 150 feet from an arterial.
b. Location: Citywide in the Commercial Neighborhood (CN), Commercial Arterial
(CA) and, Residential Fourteen Dwelling Units per Acre (R-14) zones.
5. D-12 Animals Modifications
a. Description: This item proposes to amend the amount of additional lot size required to
keep an additional Household Pet to match the additional lot size required for the
keeping of additional medium lot domestic animals ( from 10,000 square feet to 7,500
square feet). Also, to discontinue the requirement of an Additional Animals Permit for
people who have the dictated additional lot size. For example, a person with one acre
of lot size would be allowed to keep four medium lot domestic animals and up to three
household pets without obtaining an Additional Animals Permit. Finally, to remove
ducks and geese from medium lot domestic animals definition and place in small lot
domestic animals definition.
b. Location: Citywide.
6. D-14 Temporary Uses
a. Description: This item proposes to create a two tier structure for temporary use permits.
The criteria used to determine the tier level include: the length and duration of the
activity, the hours of operation, consistency with underlying zone, the impact on
surrounding zones. Additionally, the number of auto sale events would be limited to
one seven day period per quarter per site. Temporary use permits would be valid for
one year. The fee for Tier I would be $75 and for Tier II $150.
b. Location: Citywide.
7. D-21 Down Lighting
a. Description: This item proposes to add a definition of downlighting to Title IV. Also,
to amend design district standards to require the use of downlighting as applicable.
Alternative lighting may be allowed when reviewed and approved administratively.

8. D-23 Accessory Dwelling Units
a. Description: This item proposes to allow as an Administrative Conditional use
detached Accessory Dwelling Units (ADU's) in RC, R-1, R-4, R-8, R-10, & R-14
zones. ADU's would only be allowed in association with single-family dwellings. No
more than 50 ADU's would be permitted per year. Either the primary home or the
ADU would be required to be owner occupied and the owner will sign an affidavit
regarding this. Each ADU will be evaluated to ensure consistency with the
architectural character of primary dwelling. ADU's will not be counted towards
density. A notice on the property title will be required to be filed; it will include: the
legal description of the property, a copy of the approved site/floor plan, and a statement
of regarding the limitations of ADU's in Title IV. One off street parking space per
ADU in addition to the parking for primary dwelling will be required. Other building
standards (side setbacks, height, etc.) will be the same as primary dwelling except for
rear yards which will be determined through Administrative review.
b. Location: Citywide in the Resource Conservation (RC), Residential One Dwelling Unit
per Acre (R-1), Residential Four Dwelling Unit per Acre (R-4), Residential Eight
Dwelling Units per Acre (R-8), Residential Ten Dwelling Units per Acre (R-10), and
Residential Fourteen Dwelling Units per Acre (R-14) zones.
9. D-24 Bulk Standards and Definitions
a. Description: This item proposes to revise the definition of building height, so that it
reflects International Building Code standard. Also, to add definitions of Existing
Grade and Grade Plane. Finally, to revise the definition of Net Density to so that trails
are removed from the calculation and so that some man-made slopes may be removed
when approved by the Administration.
