SUMMARY OF ACTION: Development Services Recommendation: Approve with conditions DEVELOPMENT SERVICES REPORT: The Development Services Report was received by the Examiner on February 17, 1998. PUBLIC HEARING: After reviewing the Development Services Report,examining available information on file with the application,field checking the property and surrounding area;the Examiner conducted a public hearing on the subject as follows: MINUTES The following minutes are a summary of the February 24, 1998 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,February 24, 1998, at 9:00 a.m. in the Council Chambers on the second floor of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit No. 1: Yellow file containing the original Exhibit No.2: Vicinity map application,proof of posting,proof of publication and other documentation pertinent to this request. Exhibit No.3: Blown-up map of project site Exhibit No.4: Blown-up map of crew shelters, buildings 5-08 and 5-109 Exhibit No. 5: Area of Apron A with 5 of 6 crew Exhibit No.6: Building elevation drawing shelter buildings The Boeing Company Boeing Apron A Crew Shelters File No.: LUA-97-193,CU-H March 9, 1998 Page 2 The hearing opened with a presentation of the staff report by MARK PYWELL,Project Manager,Development Services, City of Renton, 200 Mill Avenue South,Renton,Washington 98055. The applicant requests conditional use permit for the Apron A crew shelters in the southeast section of Renton Municipal Airport to re- authorize the six existing crew shelters and add a seventh crew support building. The applicant is asking for a 10 year permit. The project is located on the publicly owned property of Renton Municipal Airport,zoned P-1. The P-1 zoning requires a conditional use permit for most of the airport-related activities on the airport. In 1990 Boeing obtained a conditional use permit for the location of the crew support shelters on Apron A and those will remain as part of this permit. On January 20, 1998,the Environmental Review Committee(ERC)reviewed this project and issued a Determination of Non-Significance. During the comment and appeal period the City did not receive any comments from citizens in regards to the project or the activities occurring on apron A. The Comprehensive Plan(CP)designation of this area is Employment Area-Industrial and this proposal is consistent with that. The construction and completion of the aircraft in this area prior to their flight is a heavy industrial use. Applicant is requesting continued use of the crew shelters and the support building which support that activity. The crew support shelters are used by the crews for their storage of tools and a place out of the weather to keep blueprints and other materials. Staff does not believe that this project will lead to an over-concentration of the use. The only new addition at this time is the crew support building, again to provide an area for the existing crews that are working on the aircraft in this area a place to be out of the weather,have lunch,read blueprints. It will not increase the number of employees or the number of aircraft being worked on in this area and will not cause a need for any additional paving of the area. Apron A is the section of the airport that the City looks at as a long-term area for the use of Boeing and the construction of their aircraft. These buildings are all within the height limits.required by the airport and are lower than the adjacent airport hangars. The use of the shelters is very compatible with the use of building aircraft in this area and also the use of the airport in support of the aircraft. Parking at various times has been an issue on the airport and Boeing recently has taken several steps to work with the airport supervisor to correct these problems. This permit will not generate any new traffic. Apron A is used for the run-up of engines at various times. In the past this issue has been studied in a lot of detail, and at this time adequate measures have been taken as far as dampening the noise and ensuring that it occurs at hours that are more appropriate for the higher noise levels of this industrial area. Staff would recommend approval of the conditional use permit with the ten year time period that the applicant has requested. Paul B. Crane, Senior Environmental Planner,The Boeing Company,P.O.Box 3707,MS 63-01, Seattle, Washington 98124,responded to the Examiner's concerns regarding noise levels due to engine run-ups. He stated that this was the object of study in a 1989-1990 expansion EIS, of which stations were provided on the West Hill as well as neighborhoods to the east. Agreements were arrived at in the mitigation documents as a result of that EIS between the City of Renton and Boeing allowing Boeing to do run-ups during specific hours for specific lengths of time. To date they have not received any complaints through the City of Renton as to running up of engines on Aprons A or D. He further stated that to his knowledge applicant does not use hush- houses at any of its locations. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:25 a.m. FINDINGS,CONCLUSIONS &DECISION Having reviewed the record in this matter,the Examiner now makes and enters the following: FINDINGS: 1. The applicant,The Boeing Company,filed a request for approval of a Conditional Use Permit to allow six crew shelters and a support building at the Renton Municipal Airport. 2. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 3. The Environmental Review Committee(ERC),the City's responsible official, issued a Declaration of Non-Significance(DNS)for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is at the Renton Municipal Airport. It is located along the east side of the main runway south of North 6th Street(if extended)and immediately adjacent to the west end of the South Boeing Bridge. Portions of the site are within 200 feet of the Cedar River. The proposal is similar to one recently reviewed by the City(File No. LUA 97-143,CU-H). 6. The airport is currently zoned P-1 (Public/Quasi-Public uses). While the City is working to eliminate the P-1 zoning and replacing it with other appropriate zoning,the airport has not been rezoned yet. The proposed use at the airport requires a Conditional Use permit. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of employment generating industrial uses,but does not mandate such development without consideration of other policies of the Plan. 8. The site where the proposal is located is more specifically referred to as Apron A. 9. The applicant seeks to re-permit the existing six(6)crew shelters that have been used since 1990. They were approved under an earlier conditional use permit which was limited to five(5)years. This limitation was imposed to make sure that the buildings were properly maintained and to provide the City with an opportunity to review the use. The permit has expired and the applicant has been operating under an interim temporary permit. 10. The applicant also seeks approval of a new crew support building. The new building will be approximately 24 feet wide by approximately 56 feet long. The building will have a slightly peaked roof and will be approximately 14 feet tall at the peak. Like the other crew buildings, it will be a utilitarian structure. 11. While some of the existing crew buildings may be within 200 feet of the Cedar River,the new building is located more than 200 feet from the river and is therefore not subject to the Shoreline Management Program. The applicant now seeks a permit that would extend the use for an additional ten(10)years. 14. These facilities permit crews working on airplanes to store tools, eat lunch,review plans and attend meetings closer to the airplanes they are working on. 15. A review of the situation near these facilities has shown that landscaping is not appropriate. 16. As with the other site across the airport to the west,there have been some vehicle conflicts in this area. 17. The buildings meet the required setback and height limitation of the airport zone and Federal Aviation Administration(FAA)regulations. 18. Engine "run-ups," an engine testing regime, occur at and around these buildings. 19. The applicant noted that a settlement agreement a number of years ago set certain limits on engine testing. The applicant was not aware of any particular complaints. CONCLUSIONS: 1. The applicant for a Conditional Use Permit must demonstrate that the use is in the public interest,will not impair the health, safety or welfare of the general public, and is in compliance with the criteria found in Section 4-31-36(C)which provides in part that: a. The proposal generally conforms with the Comprehensive Plan; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The.proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking,unless otherwise permitted,will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. Landscaping shall be sufficient to buffer the use from rights-of-way and neighboring property where appropriate; and i. Adequate public services are available to serve the proposal. 2. As the permit's name suggests, Conditional Uses are permits that may be appropriately conditioned. The ERC determination on environmental impacts does not displace this review nor the possible implementation of appropriate conditions. While the requested conditional use appears justified,the site is the locus of engine testing and the greatest noise produced by this very large manufacturing process. 4. While it would appear that nothing substantial has really changed, circumstances sometimes change. So while releasing sooty smoke and discharging polluted water were once part of many manufacturing processes and nothing about those operations changed, circumstances indicated it was time to change processes that polluted the air and polluted the water. 5. The buildings themselves don't have much impact. They remain purely utilitarian in form and function, but they facilitate the engine testing that occurs as part of the final step in manufacturing airplanes. No one doubts that the applicant is an important contributor to the local, state and national economy. There are many manufacturing processes and industries that add substantially to our robust economy, but that does not mean they are allowed to take advantage of the air or water that surrounds their respective operations. They have been required to modify processes and well-accepted behaviors in deference to changing mores and standards. 6. There is little doubt that if any other integral aspect of the applicant's manufacturing process needed updating to make it more modern or efficient,the applicant would undertake those modifications. There is no question that engine run-ups or testing are one of those integral processes. In this case rather than occur somewhere inside on the manufacturing floor,these integral processes are taking place in the public's air space. There is no question that the sonic impacts of these processes are heard in the surrounding community. As noted,the Apron A operations are one more stage in the production of the finished product. It happens that the applicant has found it reasonable to complete this stage in the open environment. Would they expect the same tolerance if they moved the riveting, or machine stamping or other aspects of fabrication outdoors? The designation of"industrial"neighborhood and zoning does not provide any magic or immunity for impermissible uses, or impacts. 7. It may be time to nudge the testing and servicing of jet engines into the 21st century by nudging them into a hush house. Is it appropriate for the environmental costs of producing modern jet planes to be passed on to the general public and particularly the residents living around the Renton Airport? Using some of the arguments against modernization of the testing and servicing are not unlike those heard to control air pollution and water pollution. The general public was considered more capable of bearing the costs and distributing them. That may no longer be appropriate. 8. Clearly,there cannot be much question that some residents are disturbed in the quiet enjoyment of their homes and yards. Clearly,there are those who accept these impositions of someone else's manufacturing process. They may work at the plant and think these are acceptable. They may not work at the plant and find them acceptable. Then there are those who may find them very intrusive, irritating and annoying. 9. Methods of confining the sounds produced by revving engines is possible and it may be time to at least study whether to employ those methods as we approach the 21 st Century. At least,on the property subject to this application,the City should not be foreclosed from imposing conditions which could reduce or alter the nature or duration of the sounds that are produced by the applicant's operation. This site is owned by the City and it should maintain the ability to limit what does occur on this site. There may be no need to examine whether the applicant is subject or rather should be subject to some limitations on its own property,but the subject site is City property. The prerogatives are different. Conditions and circumstances change. Clearly that is why the permit was subject to a five year limitation. Also while the ERC may not have found the proposal significant in the overall environmental impacts,this does not mean the project does not have impacts. It seems reasonable to reserve to the City the right to always examine the noise consequences of the operation and retain the power to limit it if it does become a problem. The City is attempting to change the downtown environment and the mix of residential uses. This change could invite more scrutiny of the applicant's noise generation. If not now,there may come a time when additional acoustic measures are necessary. 11. The proposed use continues to be related to the functioning of the airport,although if final stages of manufacturing were to occur elsewhere there would be more room for general aviation activities. That appears to be also highlighted by the Airport Manager's comments regarding parking at the site. Relocation of such activities could free up valuable and limited aviation space. 12. The buildings, other than their plain exteriors, should not have an adverse impact on adjacent property or the general public welfare. 13. There should be no adverse impact in the areas of light or glare. As indicated, engine run-ups will occur at these locations and they do create substantial noise impacts as discussed. The buildings are sized and designed so as not to interfere with aviation safety. 14. Public service support has not changed and is adequate in the areas of water and sewer. Fire protection is provided by both the applicant and the City. 15. In conclusion,the proposed ten year conditional use permit is appropriate given appropriate conditions. DECISION: The Conditional Use Permit is approved for a period not to exceed a total of ten years, and subject to the following conditions: 1. The City shall reserve the right to always examine the noise consequences of the operation and retain the power to limit it if it is a problem or becomes one during the permit period. The City may impose whatever reasonable conditions are necessary to eliminate the problem including requiring studies funded by the applicant and remedies including altering the time, location,manner and nature of engine testing and including the construction of noise attenuating buildings or structures. 2. The City shall reserve the right to terminate the permit at any time if the applicant fails to properly maintain the buildings in a clean,well-maintained exterior appearance. 3. The City shall reserve the right to limit or restrict the parking and circulation of vehicles at the subject site if such parking hampers the general operation of the airport. DEPARTMENT ANALYSIS: 1. PROJECT DESCRIPTION/BACKGROUND In 1990 the Boeing Company obtained a conditional use permit (CU-120-90) to locate six Crew Shelters on Apron A of the Renton Municipal Airport. This permit was given a termination date that has now expired. The Boeing Company is requesting a new permit in order to continue the use of the six crew shelters and the addition of one crew support building on Apron A. The Crew Shelters and Crew Support Building are used to provide a location for Boeing's employees to read blue prints and store tools while working on the adjacent aircraft. If the conditional use permit is approved there will be no change in the location of the crew shelters. All of the existing buildings are located over 200 feet from the Cedar River. The new crew support building will be located in a manner so that it is over 200 feet from the Cedar River. Therefore, no shoreline permits are required. ENVIRONMENTAL REVIEW Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 as amended), on January 20, 1998, the Environmental Review Committee issued a Determination of Non-Significance. 3 COMPLIANCE WITH ERC MITIGATION MEASURES N/A 4. STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials to identify and address site plan issues from the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. CONSISTENCY WITH CONDITIONAL USE CRITERIA Section 4-31-36 lists 11 criteria that the Hearing Examiner is asked to consider, along with all other relevant information, in making a decision on a Conditional Use application. These include the following: (5A) CONSISTENCY WITH THE COMP. PLAN, ZONING CODE& OTHER ORDINANCES: The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City of Renton. (1) COMPREHENSIVE PLAN LAND USE ELEMENT The existing crew shelters and support building are consistent with the Comprehensive Plan designation of Employment Area - Industrial. Policy LU-195: The primary use in the Employment Area - Industrial designation should be industrial. The shelters and support building are accessory uses to the primary use of the construction of airplanes by the Boeing Company. The Boeing Company uses aprons B & C as staging areas for the final steps in the construction of aircraft. The shelters and support building provide the work crews with an area out of the weather to store tools and blueprints used in their work. Policy LU-197: Industrial uses with a synergistic relationship should be encouraged to locate in close proximity to one another. The industrial use of the airport's apron for the construction of aircraft is an industrial use. The completion of construction of the aircraft must occur on or adjacent to an airport out of which the completed plane can be flown. Policy T-49: Use existing airport land primarily for direct aviation related uses. The construction of aircraft can be considered a direct aviation related use. The crew shelters and support building are necessary for the completion of this work. The manufacturing of aircraft is listed as a conditional use. As the shelters and support buildings are part of the Boeing Companies manufacturing of aircraft the conditional use permit is required to retain these structures on the municipal airport. (58) COMMUNITY NEED: There shall be a community need for the proposed use at the proposed location. In the determination of community need, the Hearing Examiner shall consider the following factors, among all other relevant information: (a) The proposed location shall not result in either the detrimental over concentration of a particular use within the City or within the immediate area of the proposed use. The planned development will the not increase the number of employees or expand the use of the project site. It will provide support facilities for the existing employees in the performance of their work. (2) That the proposed location is suited for the proposed use. The proposed site has been found to be suitable for the final assembly and the testing of aircraft. The proposed sheds are located so as to not interfere with the ongoing use of the airport or with adjacent land use. The proposed buildings are located behind the Building Restriction Line for the airport. (5C) EFFECT ON ADJACENT PROPERTIES: The proposed use at the proposed location shall not result in substantial or undue adverse effects on adjacent property The following site requirements shall be required: (1) Lot Coverage: Lot coverage shall conform to the requirements of zone in which the proposed use is to be located. There are no lot coverage requirements in the Public Use zone (P-1). In this case where the use is the outdoor testing of aircraft, the only buildings will be the crew support buildings and sheds applied for under this permit. (2) Yards: Yards shall conform to the requirements of the zone in which the proposed use is to be located. Additions to the structure shall not be allowed in any required yard. In this case the "yards" are provided by the landscape buffer area that the airport provides on around,the perimeter of the airport along the street frontages. No further landscape buffering has been required. (3) Height: Building and structure heights shall conform to the requirements of the zone in which the proposed use is to be located. Spires, belltowers, public utility antennas or similar structure may exceed the height requirement upon approval of a variance. Building heights should be related to surrounding used in order to allow optimal sunlight and ventilation, and minimal obstruction of views from adjacent structures. Building heights within the airport are restricted to ensure that they do not interfere with the use of the airport runways and taxiways. This project has been reviewed by the Airport Supervisor who has found the height of the proposed buildings to be acceptable within the areas that they are located. (Ord 3599, 1-11-82) The proposed units are compatible in use with the existing airport facilities. The buildings are generally aesthetically compatible with other buildings located within the airport area. Based upon concerns about the advisability of permitting modular structures in this area on a permanent basis staff recommended as part of the last conditional use permit that the life of these units be limited to two years with the possibility of the applicant being granted three one- year extensions for a total of five years. The old permit has now expired. At no time in the past did City staff have a problem with the maintenance program that Boeing has established for these units. The structures'are still in good shape and are not considered to be a problem. The applicant is now requesting that a ten year permit be granted for these structures. City staff is supportive of this request. If at some time in the future City staff felt that the structures required replacement, there are adequate provisions in the Code to enforce the maintenance of the structures or to revoke the conditional use permit if the structures are not adequately maintained. (5E) PARKING: Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five percent(75%) of the lot coverage requirement of the zone, in which the proposed use is located, if all parking is provided underground or within the structure. (Ord.3903, 4-22-85) Parking on the airport aprons and the use of vehicles in this area is a continuing area of conflict between vehicles and aircraft using the taxiways. Although not directly tied to the current permit, the vehicle traffic would exist whether or not the shelters are in place, the applicant needs to be aware of the City's concern and expectations for the safe movement of vehicles. This can be more directly addressed when the leases for the aprons are next under review for renewal. It should be noted that recently Boeing has taken several steps to ensure that employee parking does not cause problems at the airport. Although the parking problem has not been fully resolved according to the Airport Supervisor, it is felt that be working directly with one another that the problems will be fully resolved and the Airport Supervisor has not requested any conditions of approval be established through this permit. No additional parking is requested or granted through this conditional use permit. (5F) TRAFFIC: Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in the surrounding area. These buildings will not generate additional employees or additional traffic. The Transportation Systems Section has indicated that the proposed development should not impact existing traffic circulation. The Airport Supervisor has noted that there is a concern over the movement of vehicles on the aprons and taxiways. These concerns are not directly tied to the current permit but the applicant needs to ensure that their staff follow due diligence in the movement of vehicles and equipment in this area. HEXRPT.DOC • City of Renton PB/PW Department - Preliminary Report to the Hearing Examiner BOEING APRON A CREW SHELTERS LUA-97-193,CU-H PUBLIC HEARING DATE: February 24, 1998 Page 7 of 8 (5G) NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. Although the testing of aircraft can produce high levels of noise, this is not the issue be addressed by this permit. The shelters themselves have not in the past nor is it anticipated that they will produce noise or glare in the future. (5H) LANDSCAPING: Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use. No landscaping is required or appropriate on this area of the airport. In this area landscaping material or debris could easily be drawn into the engines of the aircraft so the aprons need to be kept clean of this type of material. (51) ACCESSORY USES: Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers, convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and shall be subject to the provisions of the use district in which they are located. All structures located on the airport property are subject to height restrictions that are based upon the distance from the main runway. The intent of the height restriction is to ensure that the structures located on the airport do not interfere with the movement or landing of aircraft. The shelters have been located on Aprons A for several years. The Airport Supervisor has not noted any problems with the location of these structures. The Boeing Company works closely with the Airport Supervisor to ensure that their activities do not interfere with the operations of the airport or violate their leases. (5J) CONVERSION: No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the provisions of this Chapter. N/A (5K) PUBLIC IMPROVEMENTS: The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements, facilities, utilities, and services. Approval of a conditional use permit may be conditional upon the provision and/or guarantee by the applicant of necessary public improvements, facilities, utilities, and/or services. No new public improvements are required at this time. The major impact is the parking of employee vehicles within the airport. Boeing does not have sufficient parking spaces to provide for change of shift parking. This results in employees parking at locations other than Boeing parking areas. Boeing employees are parking along East Perimeter Roadway and other tenants'leased areas. Boeing Management has spoken to their respective employees concerning illegal parking on both City and Boeing owned and leased property. Management and Boeing Security are continuing to monitor and directly address this situation. 2. The Boeing Company and the City of Renton have posted, or are in the process of posting, their respective properties with No Parking signs, where appropriate. 3. Boeing flight line Parking will be shifted to Boeing Parking Lot 8 (see attached map). In support of this shift, a Boeing automatic turnstile pass gate is being considered for installation, to facilitate the need of Boeing employees to have direct access to and from the flight line and parking lot 8. Currently, there is a locked gate that may be used by employees. Boeing is implementing a registered carpool program at the Renton Plant. The Boeing Company supports this carpool program by allowing emergency ride home services and reserved parking, among other incentives, to entice employees to use this commuter option. The proposed carpool lot is adjacent to lot 8 (lot 7) (see attached map). BOE/NG 5. Boeing is reviewing our parking options to maximize parking, on Boeing property, without jeopardizing existing agreements with the Renton Airport Manager. All options considered will preserve the health, safety and welfare of our employees. The Airport Manager will be advised of the outcome of our review. Please be aware that The Boeing Company has parking space for every employee. We are continually improving our parking management and maximizing parking assets. Pywell, AICP • Project Description In 1990 the Boeing Company obtained a conditional use permit (CU-120-90)to locate six Crew Shelters on Apron A of the Renton Municipal Airport. This permit was given a termination date that has now expired. The Boeing Company is requesting a new permit in order to continue the use of the six crew shelters and the addition of one crew support building on Apron A. The Crew Shelters and Crew Support Building are used to provide a location for Boeing's employees to read blue prints and store tools while working on the adjacent aircraft. If the conditional use permit is approved there will be no change in the location of the crew shelters. All of the existing buildings are located over 200 feet from the Cedar River. The new crew support building will be located in a manner so that it is over 200 feet from the Cedar River. Therefore, no shoreline permits are required. Earth/Land Use Impacts: The area where the crew shelters and support building are located is a paved portion of the Renton Municipal Airport. Utilities were addressed at the time the structures were originally located on this site. No new . utilities or foundation supports are required at this time for the crew support shelters. Minor construction may be required to provide utilities to the crew support building. The potential for soil erosion will be minor and shall be mitigated by the requirement for the installation and maintenance of temporary erosion control measures. These structures are located on a portion of the apron where the height of the structures does not interfere with the use of the runway. If, for any reason, Boeing determines that one of the structures needs to be relocated,the applicant will need to ensure that the structure does not intrude into the setback area of the airport or intrude into the 200 foot setback from the Cedar River. • The Airport Manager has noted that there is an existing parking problem due to the ongoing Boeing work on AprOn A. Although this is not an environmental impact,it will need to be addressed through the conditional use permit process. Staff will work with the Airport Manager and Boeing to develop a condition of approval that will address this issue. Mitigation Measures: No mitigation is required at this time. Nexus: N/A 2. Air Impacts: Air impacts normally associated with the construction phase of the project include dust and exhaust from construction equipment. As there will be only minor construction associated with this permit, there will be no significant adverse impacts associated with this project. Any minor impacts will be mitigated by the temporary erosion control measures required by City ordinance. Adverse air impacts could also be associated with the mechanical equipment used on-site and with the vehicles used by the workers to access these sites. Exhaust from these sources are already regulated by state and federal agencies. No site specific mitigation is required. Mitigation Measures: None required. Nexus: N/A 3. Noise Impacts: When these structures were first proposed City staff was concerned that the noise generated by the planes on the runway and apron.could impact the workers using the structures. At that time Boeing tested the structures and it was found that the buildings reduced the interior noise to acceptable levels. PROJECT JUSTIFICATION FOR A CONDITIONAL USE PERMIT The project consists of an application for a Conditional Use Permit for 6 existing crew shelters and 1 new support building on Apron A (Please see Project Narrative). These shelters were previously approved under a Conditional Use Permit. The Conditional Use Permit has expired and the shelters and building are remaining under a Temporary Permit pending the outcome of this application. The following is the Conditional Use Permit justification for these buildings to remain. A. Comprehensive Plan. The City of Renton Comprehensive Plan designation policies for the airport is Employment Area - Industrial. The zoning is P-1- Public Zone. The existing shelters are compatible with the general purpose, goals, objectives and standards of the Comprehensive Plan (Policy - EA-1.1 to EA-1.8, EA-2.3, ). The airport designation as a Public Zone does not match the Comprehensive Plan designation policies for the airport. The proposed existing buildings are not in conflict with any public use of the airport. The existing buildings are compatible with, and support the existing uses operating of the airport. B. Community Need. The community needs are continued jobs and continued revenue from Boeing operations in the City of Renton. The existing location of the existing buildings will not result in the detrimental over-concentration of a particular use within the immediate area of the existing/continued proposed use. The buildings are aviation related crew shelters used to support Boeing Commercial Jet Aircraft at the City of Renton Municipal Airport. C. Effect on Adjacent Properties. The adjacent property surrounding the existing buildings is a municipal airport. The existing buildings and the activity they support will not result in `_- substantial or undue adverse effects on this adjacent property. Property adjacent to the airport are commercial, industrial and residential. These existing crew shelter buildings support work on aircraft that are towed to, and operational in their respective Apron positions. These aircraft positions on Apron A are used for engine run ups or and other activity that produces noise. The engine run up timing does not result in substantial or undue adverse effects on the property adjacent to the Renton Municipal Airport property. PROJECT NARRATIVE Apron A Crew Shelters and Support Building The Boeing Company currently has 6 existing crew shelters and 1 proposed support building located on Apron A. These shelters were previously approved under a Conditional Use Permit issued by the City of Renton in 1990. The Conditional Use Permit has expired. The proposed Land Use Action is an application for a Conditional Use Permit that will allow the construction of a new support building and the existing buildings to remain at Apron A. The crew shelters are used in the pre flight preparation of Commercial Jet Aircraft. The "crew" that works on the preparation of each jet liner requires a place, out of the weather, to review plans, meet and store small tool boxes. The location of these crew shelters, on Apron A, covers the length of the South East side of the Renton Municipal Airport ( see attached plans). The crew support building at Apron B is approximately 1,440 s.f. , measures 60' X 24' and is 10'- 6" high. Parking is provided adjacent to the Apron. The crew shelters are located at Apron A and are 12' X 30' and are 11' - 7 1/a" high. In the eight years the crew shelters have been active they have been regularly painted and maintained. They have not been materially detrimental to the public health, safety or welfare, nor injurious to property or improvements in the vicinity in which they were located. The existing approved parking adjacent to the crew building is adequate and is not an impact upon non Boeing, general aviation activities.
