Mike,
1 spoke with Mr Bret Bowden today regarding his past drainage complaints. Mr. Bowden owns the property at 13814 160th
Ave SE , phone 425-821-3400, just south of your proposed development on the east side of 160th Ave SE. He said the
ditch on the west side of 160th overtopped and flowed across 160th, overtopping his driveway and flooding his yard area.
The county has apparently cleaned both ditches(west and east side) and according to Mr. Bowden the problem has not re-
occurred. His last complaint was filed 12/1312001.
Please note that there is a new owner for the property at 14028 160th Ave SE-- Dana Belshaw phone office 425-821-3400
ext 158 or 425-8204904. 1 received a copy of an E-mail from Ms Belshaw regarding the past flooding, attached for your
info..
Please let me know what downstream mitigation you and Mr. McCarthy recommend after you have a chance to review
these latest complaints.

Dear Mr. Romano:
The purpose of this letter is to provide written notice that the Land Use Services Division
has requested additional information and/or studies to complete the review of the above -
referenced project. This information is necessary to continue processing the application.
Recently, copies of several downstream drainage claims and complaints were released to
us and were forwarded to you by fax and mail. I understand that Bruce Whittaker has
discussed with you by phone these complaints and his concerns.
Please review this new information with the project engineer. After
reviewing the complaints, submit an addendum to the Level III Downstream
Analysis, which provides analysis of the complaints (6 copies). The analysis
shall include proposed mitigation for the downstream problems per Core
Requirement 2 of the King County Surface Water Design Manual. If any
mitigation is proposed on private property, a letter of intent is required from
the property owner.
When submitting the requested information, include copies of the letters requesting
information and retain copies for your records. Provide a cover letter, which lists how
each item, was addressed. Any clarification or explanation of the submittal can also be
included in the cover letter. Please submit the information to:

feel extenuating circumstances exist, which may justify an extension of this date, you
may submit such request, in writing, for consideration .by this Department. Failure to
meet the deadline shall be cause for the Department to cancel or deny the application.

Description of Details:
Because of negligence regarding a King County maintained ditch in front of my
home, flooding following a recent snowstorm caused 10-12" of water to flood into
my basement. This is a problem that has occurred before and has caused the
loss of my washer and dater. In spite of numerous calls to King County, nothing
has been done. In November of 1996, after I called in a complaint, a King
County employee cameo to assess the situation. He said that the County would
fix the problem in 2-3 weeks. Nothing was done. On December 27, 1586, my
basement was flooded again. The standing water ruined my hot water tank.

Description of Details:
Because of negligence -regarding a King County maintained ditch in front of my
home, flooding following a recent snowstorm caused 10-12" of water to flood into
my basement. This is a problem that has occurred before and has caused the
loss of my washer and dryer. In spite of numerous calls to King County, nothing
has been done. In November of 1996, after I called in a complaint, a King
County employee came to assess.the situation. He said that the County would
fix the problem in 2-3 weeks. Nothing was done. On December 27, 1996, my
basement was flooded again_ The standing water ruined my hot water tank_
Property Damage.
My hot water tank has been ruined.

RE: Claim: 31249/Claimant: Chad L. Meyers /Amount: $6,402.61
Thank you for your February 12, 2002 email requesting comments and a recommendation
concerning the above -referenced claim filed against King County. The claimant alleges
County responsibility for flooding damage to the garage and lower level of a residence located
at 14028 160th Avenue Southeast, which occurred on November 14, 2001 and again on
December 13, 2001 between 8:00 AM and 5:00 PM.
My staff has reviewed this claim and provides the following findings:
Incident Confirmation: A query of the Citizen Action Request database produced CAR 01-
005097, received from the claimant on November 30, 2001 at 2:55 PM, which stated "ditch
plugged from last rain, had water in basement." CAR 01-005343 and 01-5405, which were
received on December 13th and 14th also confirmed the incident.
Damage Confirmation: Roads staff did not confirm damage to the Meyers' residence. Used
sandbags were, however, located on the north edge of the property, which would indicate a
flooding problem.
Recommendation: Staff recommends this claim be denied. Roads staff believes there is no
liability on the part of King County.
Second Party Liability: Please note Brenden Marshall, Jr. (former owner), filed a claim for
flooding damage (Claim 21860), which occurred on December 31, 1996. Staff investigation
confirmed the installation of an 18 -inch enclosed drainage system extending across the entire
frontage of the property. A check with DDES could not locate any valid right of way use
permits authorizing installation of this pipe. Staff believes this pipe is undersized (and
probably was at time of installation) and cannot handle flows from event storms. Roads staff
further recommend Mr. Meyers check his purchase paper work to determine if the `known'
flooding problem was disclosed.
Remedial Action: County engineering staff have reviewed the site, have assigned tracking
number (4-1032) to this project and are currently designing an upgraded system to correct the
problem created by the improper pipe installation.

11114/01 — Arrived home at approximately 5.30 pm to find that the lover level of the house had
flooded that day. Most of the water had soaked into the carpet and pad by the time that 1 got
home. By that time, the ditclx was also lo%Ntr but I suspected that it had overflowed. There were
signs of water and debris running down the driveway frorn the ditch so I called King County to
report the problem.
11129101 —1 called King Country Roads Division, again. They stated that someone would be out
on Monday, December 3`1 to investigate the problem.
12/5/01 - ],arrived Dome at approximately bpm, I had a message on my answering machine from
Manny Espinosa with King County Roads. He stated that he was in my neighborhood and would
be out to my property in approximately f2 Dour. He did not state the time that he called and my
answering machine doesn't track it so I do not know what time of the day he called. This was
the only message that I received from hien. I do not know if he was out to my house or not.
12/13101 -- My wife arrived home at approximately 3" pm to find that the ditch had been
overflowing and the water running into the house again through the garage. She called me and I
called the King County Road Division at 3:34 pm. Mike Hudson arrived at 5:30 pm. Ile stated
that the drainage tile probably needed to be upgraded to Dandle a larger capacity of water flow.
.fie instructed me to call 1-800-KCroads. My wife also called 911 and the Renton Fire
Department was, dispatched. Bill Kullburg and his crew from King County Fire District 425
assisted in draining all of the -,Mater from our home that day.
12/14/01 I called 1-800-KCRoads and talked to slob Napier. All of the other employces were
out at lunch. I told him that (his was the second time that this had happened and we needed
someone out to our home to see the damage as soon as possible. He said that someone would be
contacting us and would come cant and seethe damage before we repaired anything. He said that
this person would be out later that same day or Monday, December 17`r`.
12/14/01 - I called and talked to Lori Kronan at 1:45 pm. She had called my wife earlier and
stated that they had a "vac truck" out to our property on the morning of December I I th but she
didn't know if they had found anything that would have caused the problem.
1.2/18/01— Called at 9:00 am and left a message for the roads department to see if they had been
out yet and it they hadn't, it was imperative that theta come out ASAP because we were having
new carpet installed and didn't want this to happen a third time.
12118/01-- 1 called 1-800-KCRoads at 3 pmTalked to a woman at first, then I was transferred
to Lori. Kronans voicemail. I left her a message to call me. Lori Kronan called me back that
same day and stated that there vvouldn't be anyone from their department looking at our
damages. She said someone would be out to checkout the drain that same afternoon.

12127/81 —1 called again at 11:50 am. I asked for Lori but she was out in the field. The person
that I talked to looked up my file and said that nothing was reported as being done yet. She
would leave a message ror Lori.
12/28/01 — 10:34 am — Deceived call from Lori Kronan. She said she had been out at our
property and looked down. our drain and didn't see any blockage. She saw a slight bow in the
pipe near the telephone pole area. but nothing that should restrict flaw. She's not sure if the
victor cleaned out sticks or deliria, but when they vactored it, they found nothing that was of
large proportion to cause blockage. She said she had filed the paperwork to have the ditch dug
and cleaned.
1/25/02 — Called Lori Kronan at 7 a.m. informing her that the ditch was ere sting again and it
needed to be looked at immediately. Sometime that morning after loam, someone was out to my
property, but by that time, the water in the ditch had decreased. They left a load of sandbags in a
pile in my driveway. She stated that she had filed the request to have the ditch cleaned but was
not sure when this would happen.
CURRENT SITUATION -
As of today's date, the ditch has not been dug out and there are still
times during heavy rain where the water is at a level higher than
expected.

SUBJECT: Gragg Quick Fix, 97-0206, Q -fix #8K1788
The Gragg Quick Fix was completed by Clean Service Company on September 20, 1997. The project
involved installing —60 feet of 24 inch diameter N-12 pipe in the ditch on his north property line. The pipe
should prevent some of the seepage into his drain field. The pipe was sized based on calculations
performed by Alan Meyers. He used some conservative estimates for land use in the basin analysis and
disregarded any attenuation by the wetland upstream of the ditch. His analysis is enclosed.
The cleaning of the ditch on his east property line common with the unimproved KC ROW was determined
to be unfeasible as a Quick fix due to the amount of work required to clear the channel in the downstream
direction. I suggested to Mr. Gragg that he continue to monitor the situation.
A TCE/HH was completed for the project and is enclosed with the file.

one or more of the Assureds; (2) which result in no loss to the Assured; -r (a) which 6o not result in the invalidity or potential invalidity of any judicial or non -judicial

GUARANTEE CONDITIONS AND STIPULATIONS
1. Definition of Terms.
The folbvring terms when used in the Guarantee mean,
(a) the "Assured": the party or parties named as the Assured in this Guarantee, or
on a supplemental writing executed by the Company.
(b) "land": the land described or referred to In Schedule (A) (C) or in Part 2, and
Improvements affixed thereto which by law constitute real property. The term "land"
does not include any property beyond the lines of the area described or referred to in
Schedule (A) (C) or in Part 2, nor any right, title, Interest, esdte or easement in
abutting streets, roads, avenues, alkyl, lanes, ways or waterways.
(L) "mortgage"; mortgage, deed of trust, trust deed, or other secu*,,' instrument.
(d) "public records" : records established under state statutes at Date of
Guarantee for the purpose of imparting constructive notice of matters mrtating to real
property to purchasers for value and without knowledge,
(e) "date% the effective date.
2. Notice of Claim to be Given by Assured Claimant
An Assured shall notify the Company promptly in writing in case krowleoge shal;
come to an Assured hereunder of any claim of title or Interest which is adverse to they
title to the estate or interest, as stated herein, and which might cause lass or damage
for which the Company may be liable by virtue of this Guarantee. If prompt notice
shall not be given to the Company, then all liability of the Company <_hall terrnimate
with regard to the matter or matters for which prompt notice Is requw*d, provided,
ho, )ever, that failure to notify the Company shall in no case prejudice the rights of
any Assured under this Guarantee unless the Company shall be prejudiced by the
failure and then only to the extent of the prejudice.
3. No Duty to Defend or Prosecute,
The Company shall have no duty to defend or prosecute any action or proceeding to
which the Assured is a party, notwithstanding the nature of any allecatior in such
action or proceeding.
4" Company`s Option to Defend or Prosecute Actions; Duty.'of Assured
Claimant to Cooperate.
Fven thwigh the Company has no duty to defend or prosecute as set forth in
Paragraph 3 above:
(a) The Company shall have the right, at its sok option and cost, to insl `ute and
prosecute any action or proceeding, interpose a defense, as limited in (b),.. r to do
any other act which in its opinion may be necessary or desirable to establish: 'he title
to the estate or interest as stated herein, or to establish the lien rightt' of the•.
Assured, or to prevent or reduce 1095 or damage to the Assured. The '-ompany may
tame any appropriate action under the temrs of this Guarantee, whether or not it shall
be liable hereunder, and shall not thereby concede liability or waive any provision of
B the Guarantee. If the Company shall exercise its rights under this pamciraph it shall
do so diligently.
0) If the Company elects to exercise its options as stated in Paragraph 4(a) the
Company shall have the right to select counsel of its choice (subject to the i fight of
such Assured to object for reasonable cause) to represent the Assured and'shall not
be liable for and will not pay the fees of any other counsel, nor will the Company pay
any fees, costs or expenses incurred by an Assured in the defense of those causes of
action which allege matters not covered by this Guarantee.
(c) Whenever the Camps my shalt have brought an action or interposed a defense
as permitted by the provisions of this Guarantee, the Company may pursue any
litigation to final determination by a court of competent jurisdiction and expressly
reserves the right, in its sole discretion, to appeal from an adverse judgment or order.
(d) In all cases where this Guarantee permits the Company to prosecute or
provide for the defense of any action or proceeding, an Assured shall secure to the
Company the right to so prosecute or provide for the defense of any action or
proceeding, and all appeals therein, and permit the Company to use, at its option, the
name of such Assured for this purpose. Whenever requested by the Company, an
Assured, at the Company's expense, shall give the Company all reasonable aid in any
action or proceeding, securing evidence, obtaining witnesses, prosecuting or
defending the action or lawful act which in the opinion of the Company may be
necessary or desirable to establish the title to the estate or interest as stated herein,
or leo establish the lien rights of the Assured. If the Company is prejudiced by the
failure of the Assured to furnish the required cooperation, the Company's obligations
to the Assured under the Guarantee shall terminate.
S. Proof of Loss or Damage.
In addition to and after the notices required under Section 2 of these Conditions and
Stipulations have been provided to the Company, a proof of loss or damage signed
and sworn to by the Assured shall be furnished to the Company within ninety (90)
days after the Assured shall ascertain the facts giving rise to the loss or damage. The
proof of hiss or damage shall describe the matters covered by this Guarantee which
constitt+te the bask of loss or damage and shall state, to the extent possible, the
basis of calculating the amount of the loss or damage. If the Company is prejudiced
by the failure of the Assured to provide the required proof of loss or damage, the
Company's ablgation to such Assured under the Guarantee shall terminate. In
addition, the Assured may reasonably be required to submit to examination under
oath by any authorized representative of the Company and shall produce for
examination, inspection and copying, at such reasonable times and places as may be
designated by any authorized representative of the Company, all records, books,
iedgers, cheeky, correspondence and memoranda, whether bearing a date before or
after Date of Guarantee, which reasonably pertain to the loss or damage. Further, if
requested by any authorized representative of the Company, the Assured shall grant
its permission, in writing, for any authorized representative of the Company to
examine, inspect and copy all records, books, ledgers, checks, correspondence and
mcmore+nda in the custody or control of a third party, which reasonably pertain to the
Loss or Damage. All information designated as confidential by the Assured provided
to the Company, pursuant to this Section shall not be disclosed to others unless, in
the reasonable judgment of the Company, it is necessary in the administration of the
claim. Failure of the Assured to submit for examinatbn under oath, produce other
reaDonabfy, requested information or grant permission to secure reasonably necessary
information from third parties as required in the above paragraph, unless prohibited
by law or governmental regulation, shall terminate any liability of the Company under
this Gua rantee to the Assured for that claim.

6. Options to Pay or Otherwise Settle Claims: Termination of LJabllli".
In case of a claim under this Guarantee, the Company shall have. the Followinc:
aciditioral options:
(a) To Pay or Tender Payment of the Amount of Liability or td: Purchase the
Indebtedness.
The Company shall have the option to pay or settle or compromise for 6r in the name
of the Assured any claim which could result in loss to the Assured within the coverage
of this Guarantee, or to pay the full amount of this Guarantee or, if this Guarantee is
issued for the benefit of a holder of a mortgage or a lienholder, the Company shall
have the option to purchase the indebtedness secured by said mortgage or :.aid lien
for the amount owing thereon, together with any costs, masonable attorneys' fees and
expenses incurred by the Assured clalmant which were authorized by the Company up
to the time of purchase.
Such purchase, payment a tender of payment of the full amount of 'rhe Guarantee
shall terminate all liability of the Company hereunder. In the event after notice of
claim has been given to the Company by the Assured the Company offers to purchase
said indebtedness, the owner of such indebtedness shall transfer and assign said
indebtedness, together with any collateral security, to the Company upon payment of
the purchase price.
Upon the exercise by the Company of the option provided for in Pamgra!-h (a) the
Company's obligation to the Assured under this Guarantee for the caimr '. loss --
damage, other than to make the payment required in that paragraph, shall -irnir!atn
in.luding any obligation to continue the defense or prosecution of ary €iti +doe; fes
�,vhirh the Company has exercised its options under Paragraph 4, and the C,jarantes
shall be surrendered to the Company for cancellation.
(b) To Pay or Otherwise Settle With Parties Other Than the Assured or With the
Assured Claimant.
'To pay or otherwise settle with other parties for or in the name of an A iiuree claimant
any claim Assured against under this Guarantee, together with any costs, atbmeys'
fees and expenses incurred by the Assured claimant which were audiotizec' by the
Company up to the time of payment and which the Company s obligated to pay.
Upon the exercise by the Company of the option provided for in Parzpraph (b) the
Company's obligation to the Assured under this Guarantee for the claimed loss or
damage, other than to make the payrient required in that paragraph, shall terminate,

7. Determination and Extent of Liability.

R. Limitation of Liability.
(a) If the Company establishes the title, or removes the alleged defect, lien or
encumbrance, or cares any other matter Assured against by this G'uarartee in a
seasonably diligent manner by any method, including litigation and the completion of
any appeals therefrom, it shall have fully performed its obligations with aspect to that
matter and shall not be liable for any loss or damage caused thereby.
(b) In the event of any Iltiga6on by the Company or with the Company& consent,
the Company shall have no liability for loss or damage until there ham been a final
dTtermiration by a court of competent jurisdiction, and disposition of r7! appeals
therefrom, adverse to the title, as stated herein.

(c) The Company shall not be liable for loss or damage to any Assured for liability
w:luntarily assumed by the Assured in settling any claim or suit without the
prior written consent of the Company.
9. Reduction of Liability or Term tnation of Liability.
All payments under this Guarantee, except payments made for costs, attorneys' fees
and expenses pursuant to Paragraph 4 shall reduce the amount of liability pro tanto,
10. Payment of Moss.
(a) No payment shall be made without producing this Guarantee for endorsement
of the payment unless the Guarantee has been lost or destroyed, in which case proof
of loss or destruction shag be furnished to the satisfaction of the Company.
(b) When liability and the extent of loss or damage has been defrnitialy fixed in
accordance with these Conditions and Stipulations, the loss or damage shall be
payable within thirty (30) days thereafter,
11. Subrogation Upon Paymentor Settlement
Whenever that Company shag have settled and paid a claim under this Guarantee, all
right of subrogation shall vest in the Company unaffected by any act of the Assured
c:4lment.

tt•e Assured would have had against any person or property in respect to the claim had
tf.=s Guarantee not been issued, If requested by the Company, the Assured shall
transfer to the Company all rights and remedies against any person or property

Company to sue, compromise or settle in the name of the Assured and to use the
name of the Assured in any transaction or litigation involving these rights or remedies.
If a payment on account of a claim does not fully cover the loss of the Assured the
Company shall be subrogated to all rights and remedies of the Assured after the
Assured shall have recovered Its Principe;, interest, and costs of collection,
12. Arbitration,
Unless prohibited by applicable law, either the Company or the Assured may demand
arbitration pursuant to the Title Insurance Arbitration Rules of the American Arbitration
Association. Arbttrable matters may include, but are not limited tn, any controversy or
claim between the Company and the Assured arising out of or relating to this
Guarantee, arty service of the Company in connection with its issuance or the breach
of a Guarantee pmvislon or other obligation. All arbitrable matters when the Amount
of Liability is $1,000,000 or less shag be arbitrated at the option of either the Company
or the Assured. All arbitrabfr, matters when the amount of liability is in excess of
$1,000,000 shalt be arbitrated only when agreed to by both the Company and the
A -sur d, The Rules in effect at Date of Guarantee shall be binding upon the parties,

Company is the entire Guarantee and contract between the Assured and the
Company. In interpreting any provision of this Guarantee, this Guarantee shall be
construed as it whole.
(b) Any claim of loss or damage, whether or not based on negligence, or any action
asserting such claim, shall be restricted to this Guarantee.
(c) No amendment of or endorsement to this Guarantee can be made except by a
writing endorsed hereon or attached hereto signed by either the President, a Vice
President, the Secretary, an Assistant Secretary, or validating officer or authorized
signatory of the Company.
14. Notices, Where Sent.

shall have no liability to you because of this amendment.
3. EXISTING DEFECTS
If any defects, liens or encumbrances existing at Commitment Date are not shown in Schedule B, we may
amend Schedule B to show them. If we do amend Schedule B to show these defects, liens or
encumbrances, we shall be liable to you according to Paragraph 4 below unless you Knew of this
information and did not tell us about it in writing.
4. LIMITATION OF OUR LIABILITY
Our only obligation is to issue to you the Policy referred to in this Commitment, when you have met its
Requirements. If we have any liability to you for any loss you incur because of an error in this
Commitment, our liability will be limited to your actual loss caused by your relying on this Commitment
when you acted in good faith to:

Purpose:
The easement granted herein is for the purpose of a public pedestrian pathway over,

SBI Developing, LLC and/or Assigns shall maintain the pedestrian pathway located on

that the surface located in the easement area is damaged, the party responsible for the
(':image shall repair the surface to the previously existing condition. However; SBI
Developing, LLC and/or Assigns shall bear the sole responsibility of said maintenance
witil such time that the Dickinson plat develops and assumes the maintenance
responsibilities.
Miscellaneous:
The pedestrian pathway surface within the easement shall be used in a manner consistent
with a pedestrian walkway. No parking shall be allowed on the driveway surface and at
no time shall the easement be blocked. The easement shall not be used for vehicular
access to any commercial or multi -family development.
This Easement and Maintenance Agreement (the "Agreement) shall be construed in
accordance with the laws of the State of Washington.
This Agreement shall inure to the benefit of and shall be binding upon the respective
successors and assigns of the undersigned. This Agreement and the benefits and
obligations provided hereunder shall be deemed to be a covenant running with the land
and shall bind all subsequent Owners.
This Easement shall become effective on the date of this instrument and shall terminate
on the date a permanent right -o f -way area is dedicated to the public and any permanent

EXHIBIT A, attached hereto, and depicted on the drawing attached hereto as EXIIIBIT B ("the
Pedestrian Walkway Easement") which are within and a part of the proposed Liberty Grove
Contiguous Plat (KC# L -0331W located in unincorporated King County, Washington,
hereby conveys, quit claims, and dedicates unto Grantee, and agrees to provide and maintain,
AN EASEMENT for a public pedestrian non -motorized -vehicle trail, for the benefit and use
of the members of the general public, over, under, in, upon, and across the Easement Area,
for purposes of public pedestrian non -motorized -vehicle ingress, egress, and use as a public
pedestrian, non -motorized -vehicle trail, in satisfaction of certain King County development
permit requirements set forth in Conditions of Approval for the preliminary plats of Liberty
Grove, Liberty Grove Contiguous, Evendell, and Nichols Place, SUBJECT TO AND
RESERVING UNTO GRANTOR the following:
I. Grantor reserves the right to relocate any of the Walkway Easement Areas to
other property owned by Grantor or King County; provided, however, that any such relocation
must be approved in advance and in writing by the King County Department of
Development and Environmental Services ("DDES"), or any successor agency.
2. Grantor reserves the right to temporarily close any of the Trail Easement Areas
to public ingress, egress, or use from time to time, in order to enable Grantor to undertake
maintenance, repair, reconstruction, or improvement work on such Walkway Easement Area.
3_ This easement shall automatically extinguish upon the recordation of the
Liberty Grove Contiguous plat or at such time another approved public walkway is
constructed. At such time, Grantor, will have completed the sidewalk improvements within
said easement and dedicated the improvements to the public as right-of-way.
4. Grantor agrees that Grantor shall be responsible for the maintenance of all
walkways constructed on and in the Emement Area.
The dedication, easement, and agreements contained herein shall run with the land
(subject to the terms hereof) and shall be binding upon Grantor's successors and assigns.
The exhibits attached hereto are incorporated herein by this reference as if fully set forth.
By recordation of this dedication, easement, and agreement, to the maximum extent
allowed by law, this agreement shall encumber the Easement Area as an easement and
dedication to the general public for public walkway uses set forth herein.
Grantor agrees that time is of the essence, and King County shall have non-exclusive
standing to enforce the provisions of this dedication, casement, and agreement.
