SP-031-81 LOCATION: South side of S.W. 16th Street on the Longacres racing facility site. SUMMARY OF REQUEST: The applicant seeks a special permit to excavate 10,000 cubic yards and to grade a second area with 20,000 cubic yards to allow development of a training track for race horses and construction of a pathway within an existing barn area for access from the barns and to the training track. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on May 6, 1981 . PUBLIC HEARING: After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on May 12 , 1981 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department preliminary report. Steve Munson, Planning Department , presented the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: King County Assessor's Map with staff comments Mr. Munson corrected the word "cases" in line 2 of Section L.3 to "uses." The Examiner requested testimony by the applicant. Responding was : John Koloski GeoEngineers, Inc. P.O. Box 6325 Bellevue, WA 98007 Mr. Koloski referenced a letter contained in Exhibit #1 from his firm to the city, dated March 23, 1981 , which describes the proposal in detail . He clarified that the bulk of the fill material will be obtained, transported and remain on site. The Examiner requested testimony in support of the application. Responding was: Lt. Don Persson Renton Police Department Representing both the Police and Fire Departments, Lt. Persson advised support of the proposal because it will eliminate an existing manure pile on the site which has caused extreme fire hazards during summer months. The Examiner requested testimony in opposition to the application. There was no response. He then invited final comments from the Planning Department staff. Roger Blaylock, Associate Planner, advised that specific impact of the proposal upon the flood fringe was evaluated very carefully, and a determination had been made that the material that would be removed from the railroad berm would be greater in volume than material placed in the flood fringe itself, resulting in very little impact. The Examiner requested final comments . Since there were none, the hearing regarding File No. SP-031-81 was closed by the Examiner at 9:15 a.m. SP-031-81 Page Two FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS : 1 . The request is for approval of a special permit to fill , grade and excavate areas on the Longacres Race Track site with approximately 30,000 cubic yards of material . 2. The application file containing the application, SEPA documentation, the Planning Department report , and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The subject property is located on the south side of S.W. 16th Street. The areas are all within the Longacres complex. Material will be shifted between areas on the northwest side of the complex and areas on the east and southwest sides of the complex. 8. Little, if any, of the material used for the fill operation will be obtained off site. Trucking of the material will also be confined to the boundaries of the site. 9. An existing manure pile located on the site will be removed to allow the grade and fill . The pile has been the source of fires during the dry summer months, and the Police and Fire Departments have concurred in its removal . 10. The removal of material from one location and placement in another nearby location will not disturb the flood potential of the subject site. 11 . The subject property is zoned B-1 (Business/Commercial ) , while surrounding zoning is generally G (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) . 12. The Comprehensive Plan designates the area in which the subject property is located as suitable for the development of recreational and greenbelt uses. 13. The proposed reuse of the property is for the construction of a training track and pathway for access to the barn area of the race track. CONCLUSIONS: 1 . The proposed fill and grade appears to serve the public use and interest as well as permitting the applicant to make reasonable use of the subject property. 2. The Comprehensive Plan designates the area for recreational and greenbelt uses. The proposed grading will permit expanded training facilities of an existing recreational use associated with Longacres Race Track. 3. At the same time, the land is zoned B-1 which permits the operation of commercial pursuits. The grade and fill will permit the applicant to further employ the subject site for commercial and business purposes. 4. The public welfare will be benefitted by the removal of the fire source and will be safeguarded as the relocation of the fill material will not interfere with the flood fringe potential of the subject site. The fill material will not alter the flood storage potential of the site as the fill material will come from other areas on the site, and the basic displacement should not be changed by the operations. 5. Since most of the fill will be generated on site, there should not be any major interference by trucks with traffic in the area. In the event trucks do frequent the area, the Police Department should have the ability to restrict the hours of operation and the routes used. DECISION: SP-03. .:', Page Three The proposed fill , grade and excavation is approved subject to the Police Department approval of routes and times for truck trips if such trips are necessitated by the proposal . This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. Copies of this ordinance are available for inspection in the Finance Department, first floor of City Hall , or same may be purchased at cost in said department. It was rezoned from "G" to B-1 by Ordinance No. 1884 of May 2, 1961 . D. PHYSICAL 13ACYG'ODTh D: 1 . Topography: The subject properties are essentially level. 2. Soils : Puyallup fine sandy loam (Py) . Permeability is moderately rapid. Runoff is slow and the erosion hazard is slight. Stream overflow is a slight to severe hazard, depending on the amount of flood protection provided. This soil is used for row crops and pasture and for urban development. Urban land (Ur) is soil that has been modified by disturbance of the natural layers with additions of fill material several feet thick to accommodate large industrial and housing installations. The erosion hazard is slight to .moderate. 3. Vegetation: Some scrub brush and weeds are the only significant vegetation on the site. 4. Wildlife: The existing vegetation does not provide any significant area suitable for wildlife habitat. 5. Water: No surface water was observed on the subject site (April 24 , 1981 ) . 6. ,Land Use: The .subject sites include an abandoned railroad spur embankment and manure stockpile. To the north is the Longacres Racing Track while to the east the properties are undeveloped. To the south and west are undeveloped sites and restaurant uses respectively. ENVIRONMENTAL ASSESSMENT/THRESHOLD DE N""TIO1H1I: Pursuant to the City of Renton ' s Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, the Environmental Review Committee issued a declaration of non-significance for the subject proposal on April 20, 1981 . Although the subject proposal is not entirely consistent with the Comprehensive Plan designations of Recreation and Greenbelt, the nature of the existing use (horse racing track) can be considered appropriate for the applicant 's proposed excavation and filling operation. 2. The applicant plans to remove an existing manure stockpile on the site and dispose of it off site. Fill consisting of 11 , 000 cubic yards from the existing abandoned railroad spur embankment located at the northwest corner of the north parking lot will be excavated and placed as compacted material in the track area. Culverts will be constructed and an additional 10, 000 cubic yards of granular fill imported for track surfacing and construction of an access road through the existing barn area to the °training track. The subject proposal clearly involves commercial and retail cases for_ profit. However, the grading plans demonstrate that the amount of material to be excavated and filled will not significantly alter the on-site flood storage capacity of the property. Therefore, the intensified use of the • site is not likely to result in any adverse impacts. 4 . Fire hydrants will have to be relocated to meet present water utility specifications as per Fire _ Department comment. 5. Utility plan approval and systems development fees must be arranged through the Utilities Engineering Division of the Public Works Department. 6. The Engineering Division has reviewed the subject proposal. See comment. M. Clemens Gentlemen: Application for Special Permit for Excavation and Grading Longacres Racetrack Renton, Washington Submitted with this letter are the application form and various other required documents regarding a proposal at the Longacres Racetrack. The pro- posal includes removal of part of an abandoned rail spur embankment and construction of a training track for race horses. Racing at Longacres was exclusively a summer activity from the initial opening of the track in 1933 until in the mid 1970s. There were far fewer participants at that time, including spectators as well as people directly involved with the racing industry. During the last several years there has been a substantial increase in the popularity and participation in racing. At the present time the racetrack barn area opens for training in February and racing extends from early May through late September. The extention of train- ing and racing dates into the early spring and late fall necessarily incorpor- ate increased periods of inclement weather. During this period, up to 1400 horses are stabled in the existing barns and on any given day most of these horses are taken to the track for training or racing. For many years disposal of bedding straw and manure was accomplished by stockpiling and composting this material on a parcel of Broadacres' land immediately east of the existing barn area. Presently (and in the future) , this waste material is hauled offsite (to Oregon) . The 11-plus acre site formerly used for manure storage is ideally located for construction of the badly needed training track. The regrading proposed with this application will primarily involve three activities which include: 1. Excavation and offsite disposal of most of the remaining manure stockpile. 2. Construction of a pathway within the existing barn area to provide safe access from the barns to the trainingtra•ck. The training track surface will be very near the existing site grades as is shown on the enclosed plans. This will require excavation of some existing materials (manure and soil) and replacement with a properly compacted granular soil base for the track. The granular materials will consist mostly of soil excavated from the abandoned rail spur which is located within the Longacres property and is owned by Broadacres, Inc. Screened sand will be imported for the running surface. The access path will also be constructed of soil excavated from the railroad berm. Excess soil material from the railroad berm will be stored in an existing soil stockpile located at the south edge of the south parking lot and will be used as necessary in future maintenance activities on the Longacres grounds: The rail berm to be excavated is adjacent to the existing north parking area. The present north parking area is a maintained grass lot bordered by hedges and flowering trees. The rail spur will be regraded and finished to an appearance very similar to the existing parking area and will be used for addi- tional parking.
