EE98578 CASE# 24-7305 OFC LNaoy L isI©�ON 07/13/24 02:01 F cu NARRATIVE On 7/13/2024 at 0207 hours, I was dispatched to a motor vehicle collision at Edmonds Ave NE and NE 12 St. Pre-Collision Unit 1's driver stated that he was traveling North on Edmonds Ave NE approaching the intersection of NE 12th St, where there is a 4-way stop. Unit 1's driver stated that he came to a stop at this intersection. Unit 2's driver stated that he was traveling East on NE 12th St approaching Edmonds Ave NE which is a 4-way stop. Unit 2's driver stated that he came to a complete stop while a vehicle that was in front of Unit 1 proceeded through the intersection. Unit 2's driver stated that he then proceeded through the intersection. Collision Unit 1 proceeded through the intersection and stated that Unit 2 was traveling somewhat fast. Unit 1's driver stated that he proceeded into the intersection and saw Unit 2, but was unable to maneuver and avoid a collision where the front passenger side of Unit 1 made contact with the rear passenger side of Unit 2, causing substantial damage to the axle of Unit 2. Unit 2's driver stated that he proceeded through the intersection after the first vehicle went Northbound. Unit 2's driver stated that Unit 1 proceeded through the intersection shortly after and the front passenger side of Unit 1 made contact with the rear passenger side of Unit 2. Unit 2's driver stated that the driver of Unit 1 smelled of alcohol. Upon completing HGN, it was determined that although Unit 1's driver had drank earlier in the day, at around 1800 hours, he did not present with enough clues to establish probable cause for DUI. Unit 1's driver does not have a valid drivers license and provided me with a Mexico drivers license. Unit 2's driver also does not have insurance. Injuries Neither driver complained of injuries. Vehicle dispositions Unit 2 was towed from the scene and Unit 1 was able to be driver and parked nearby. Proximate Cause If Unit 1 had yielded to the right of way of Unit 2, this collision would not have happened. Final disposition Driver 1 exhibited signs of having drank alcohol or intoxicating liquors. I was able to smell alcohol on his breath when I was speaking with him and he presented with 1 clue during HGN. Driver 1 stated that he does not have a valid drivers license or insurance. Driver 1 provided me with a Mexico drivers license. Driver 1 did violate RCW 46.61.5249 because he operated a motor vehicle in a manner that is both negligent and endangers or is likely to endanger any person or property, and exhibits the effects of having consumed liquor or cannabis or any drug or exhibits the effects of having inhaled or ingested any chemical, whether or not a legal substance, for its intoxicating or hallucinatory effects. Driver 1 did violate RCW 46.30.020 because No person may operate a motor vehicle subject to registration under chapter 46.16A RCW in this state. Driver 1 did violate RCW 46.20.015 because he drove any motor vehicle upon a highway in this state without a valid driver's license issued to Washington residents under this chapter in his or her possession Driver 1 did violate RCW 46.61.180.1 because he failed to yield to the right of way of Unit 2. 1 certify (declare) under penalty of perjury under the laws of the State of Washington that the foregoing is true and correct.
