The City of Renton has approved the above referenced lot line adjustment and has
forwarded the final mylars to King County for recording.
Please note the recording of the lot line adjustment map alone does not transfer
ownership of property. If necessary, prepare and record a deed transferring ownership
of the portion of land depicted in the lot line adjustment map. We recommend that the
legal description for this document be prepared by a surveyor. It is the applicant's
responsibility to ensure this document is properly prepared and recorded with the
County.

Dear Mr. Young:
The City of Renton has finished reviewing your proposed lot line adjustment and is now ready
to approve and send the final version for recording subject to the comments contained in the
attached memorandum from Property Services. The comments should be incorporated into
the mylars submitted. Please submit two sets of original signed mylars and a check for $15.81
made out to Champion Couriers to my attention at the sixth floor counter of Citv Hall.
Please verify that the mylars have been signed by all owners of record and have been notarized
with an ink stamp (not embossed). The ink stamp must be legible so that King County will
promptly record the lot line adjustment.
This decision to approve the proposed lot line adjustment is subject to a fourteen (14) day
appeal period from the date of this letter. Any appeals of the administrative decision must be
filed with the City of Renton Hearing Examiner by 5:00 pm, June 24, 2010.
Appeals must be filed in writing together with the required fee with: Hearing Examiner, City of
Renton, 1055 South. Grady Way, Renton, WA 98057. Appeals to the Examiner are governed by
City of Renton Municipal Code Section 4-8-110. Additional information regarding the appeal
process may be obtained from the Renton City Clerk's Office, (425) 430-6510.

and have the following comments:
Comments for the Applicant:
A comment made in our April 15, 2010 review memo was not fully communicated
to the applicant/surveyor: "Provide distances along the centerline of Wells Ave N,
between the centerline perpendiculars of the southern -most corner of Lot 99-A
and the PC of the centerline curve to the north". This second centerline
perpendicular is located easterly of Lot 104-A. See the attachment.
Use the new lot names (99-A, 100-A, etc.) on Sheet 1 of 2 in the address block and
in the before and after area square footages block. See the attachment.
Please note that the "LND" number (shown on both drawing sheets) is incorrect.
The correct number is LND-30-0356.
See the attachment for circled items that need to be corrected on Sheet 1 of 2
("RESTRICTIONS" block).

Include under the "NOTES" block or modify an existing note to the effect that ties
to the City's Survey Control Network are pursuant to the plat of Barbee Mill.

All vested owner(s) of the subject lot line adjustment properties need to sign the final
lot line adjustment submittal.
The "DECLARATION" block should be titled "OWNER'S DECLARATION".
Correct the spelling for the word COORDINATE (noted in the "REFERENCE MONUMENT"
block on Sheet 2 of 2).
The City of Renton Planning Director, Department of Community and Economic
Development is the city official who signs this lot line adjustment submittal. Remove
the reference to "Planning/Building/Public Works Department Administrator" in the City
of Renton "APPROVAL" block.
It is suggested that the names of the adjusted lots be modified to reflect a changed lot
configuration - perhaps LOT 99-A, LOT 100-A, etc.?
Because there is an existing Native Growth Protection Easement over those portions of
Tract "A" and Tract "B" that are to become part of Lots 99-102 and 104-106 (via the lot
line adjustment), there is no need to record a separate easement document, unless the
terms and conditions of said document are different from what was in place for the
underlying plat of Barbee Mill, recorded in Volume 246 of Plats, Pages 25-29, records of
King County, Washington.
Note that if there are easements, restrictive covenants or agreements to others (City of
Renton, etc.) as part of this lot line adjustment, they can be recorded concurrently with
the lot line adjustment. The lot line adjustment submittal and the associated
document(s) are to be given to the Project Manager as a package. Reference the
associated document(s) on the lot line adjustment submittal, and provide spaces for the
recording numbers thereof.
Fee Review Comments:
Lots within or affected by the lot line adjustment are subject to the city's special
charges, if any.

All vested owner(s) of the subject lot line adjustment properties need to sign the final
lot line adjustment submittal.
The "DECLARATION" block should be titled "OWNER'S DECLARATION".
Correct the spelling for the word COORDINATE (noted in the "REFERENCE MONUMENT"
block on Sheet 2 of 2).
The City of Renton Planning Director, Department of Community and Economic
Development is the city official who signs this lot line adjustment submittal. Remove
the reference to "Planning/Building/Public Works Department Administrator" in the City
of Renton "APPROVAL" block.
It is suggested that the names of the adjusted lots be modified to reflect a changed lot
configuration - perhaps LOT 99-A, LOT 100-A, etc.?
Because there is an existing Native Growth Protection Easement over those portions of
Tract "A" and Tract "B" that are to become part of Lots 99-102 and 104-106 (via the lot
line adjustment), there is no need to record a separate easement document, unless the
terms and conditions of said document are different from what was in place for the
underlying plat of Barbee Mill, recorded in Volume 246 of Plats, Pages 25-29, records of
King County, Washington.
Note that if there are easements, restrictive covenants or agreements to others (City of
Renton, etc.) as part of this lot line adjustment, they can be recorded concurrently with
the lot line adjustment. The lot line adjustment submittal and the associated
document(s) are to be given to the Project Manager as a package. Reference the
associated document(s) on the lot line adjustment submittal, and provide spaces for the
recording numbers thereof.

Dear Project Reviewer-,
Conner Homes developed the plat of Barbee Mill in the City of Renton which was
recorded in 2008_ During the course of construction, the developer determined that a lot
line adjustment was necessary between the above lots and Tract A as shown on the plat
to accommodate the construction of the homes on lots 99-102 and 104 -106 -
Lots 99-102 and 104-106 whose addresses are 4015, 4021, 4027, 4033, 4059, 4065
and 4071, Wells Ave. N. respectively, Renton Washington are currently vacant lots
awaiting the construction of homes subsequent to the approval and recording of the lot
line adjustment. Additionally, Conner Homes proposes to record a Native Growth
Protection Easement (NGPE) over the entire area taken from Tract A and made a part of
the above named lots. No additional code modifications are required or requested at
this time.

This Native Growth Protection Easement is executed by Conner Homes at Barbee Mill, LLC,
Grantor, a Washington limited liability company, ("Grantor"), for the benefit of Grantor and
Grantor's heirs, successors and assigns.
RECITALS
A. Grantor is the developer of the Plat of Barbee Mill in the City of Renton.
B. Grantor is the current owner of Tract _ in the Plat of Barbee Mill. Tract _ was
created as a buffer to protect May Creek and is designated as a Native Growth
Protection Area subject to certain conditions and terms set forth on the Final Plat of
Barbee Mill. Tract —will be transferred to the Barbee Mill Community Organization
following completion of development of the Plat of Barbee Mill and will, thereafter be
maintained by the Community Organization in accordance with the terms and
conditions of its designation as a Native Growth Protection Area.
C. During the course of construction of the Plat of Barbee Mill, Grantor determined that a
minor adjustment in the rear yard boundary of Lot , Plat of Barbee Mill, was
necessary in order to accommodate the construction of a home on Lot �. This

adjustment requires a boundary line adjustment approval from the City of Renton,
which has been granted, subject to a requirement that the area that was a portion of
Tract _ and will become a part of Lot shall be remain a Native Growth Protection
Area subject to the terms and conditions applicable to such areas in accordance with
the final Plat of Barbee Mill.
GRANT OF EASEMENT
In consideration of the mutual benefits and responsibilities set forth herein, Grantor hereby
imposes a perpetual Native Growth Protection Easement on the following described
property:

Containing a total area of Sq. Ft., more or less.

2. The Area subject to Native Growth Protection Easement hereunder has been created to
allow establishment and protection of more extensive and complex communities of
indigenous vegetation along May Creek. Grantee has supplemented the existing vegetation
within Tract _ and the Easement Area in accordance with a Landscaping plan approved by
the City of Renton.
3, Grantee and Grantee's successor, the Barbee Mill Community Organization, shall have the
right and responsibility to maintain and protect the vegetation within the Easement Area in
accordance with the terms and conditions of the final Plat of Barbee Mill.
4. Grantor, and Grantors successors and assigns shall not engage in any alteration, construction,
development or other activity in the Easement Area which alters or disturbs the Easement
Area without prior written approval of the City of Renton and Grantee and/or Grantee's
successor in interest.
5. This Easement shall remain in effect perpetually unless a written termination agreement is
approved by the City of Renton and either Grantee or Grantee's successor in interest.
6. This Easement shall be a covenant running with the land and shall be binding on the heirs,
successors and assigns of the parties. The terms and conditions of this Easement may be
enforced by Grantor, Grantee, the City of Renton, and their respective heirs, successors
and assigns.
7. This Agreement shall be governed by and interpreted in accordance with Washington law.
Any litigation arising out of or in connection with this Agreement shall be conducted in
King County, Washington.
