ED65533 CASE# 23-5476 OF COLLISION 05/15/23 10:39 OF CbLLI510N NARRATIVE 23-5476 On 05/15/2023 at approximately 1043 hours, I was dispatched to a non-injury and non-blocking vehicle collision with a possible Driver Under the Influence (DUI) at the intersection of Union Ave NE and NE 4th Street, within the City Limits of Renton, County of King, State of Washington. Upon arrival, other Officers had arrived on scene before me and suggested that the collision was non- DUI related. I conducted a voluntary Preliminary Breath Test (PBT) on one of the involved drivers that was suspected of DUI by the initial responding Officers. The driver agreed to voluntary conduct the test which returned as a .000 reading on the PBT. No other indicators were notated from me or the other responding Officers. The driver being suspected of DUI informed Officers that he had Parkinson's disease which is why there was an initial report/suspect of DUI. While on scene, Officers confirmed there were no complaints of injury from either of the involved parties at the time of report. While on scene, Officer D. Lamothe was able to collect each involved party's information and independent summary of their involvement. The driver of Unit#1 said he was the sole occupant of his vehicle and was traveling northbound in about the 300 block of Union Ave NE in lane 2 of 2 and stopped at the intersection of NE 4th ST. The driver of Unit#1 stated that he was intending to continue north at the intersection upon the traffic control legend changing from red to green. The driver of Unit#1 stated that upon the traffic legend changing to green, he proceed across the intersection. Upon reaching just beyond the intersection, both Unit#1 and Unit#2 collided causing moderate damage to passenger side doors of Unit#1. The driver of Unit#2 said she was the sole occupant of her vehicle and was also traveling northbound in about the 300 block of Union Ave NE in lane 1 of 2. The driver of Unit#2 stated she was intending to continue north when Unit#1 disregarded the traffic control device and proceeded to go straight from a left-turn only lane. When the driver of Unit#2 reached just beyond and north of the intersection at NE 4th ST and Union Ave NE, both vehicles subsequently collided with Unit#1 causing moderate damage to the front drivers side door and fender of Unit#2. 1 reviewed the intersection and determined that lane 2 of 2 for northbound Union Ave NE at NE 4th Street, and the lane in which Unit#1 was traveling in, was left-turn lane only. And that lane 1 of 2 for northbound Union Ave NE at NE 4th Street, and the lane which Unit#2 was traveling in, was a straight or right-turn only lane. Based on the above statements, I determined that the Driver of Unit#1 (Smith) was the predominant factor for the cause of collision as Smith violated RCW 46.61.050(1) which states that the driver of any vehicle, shall follow the instructions of any official traffic control device applicable thereto, and as specified in this chapter, placed in accordance with the provisions of this chapter, unless otherwise directed by a traffic or police officer, subject to the exception granted the driver of an authorized emergency vehicle in this chapter. Smith did not obey the traffic control device set forth indicating that he was to turn left from his lane of travel and not proceed straight, causing a collision. The driver of Unit#1 did not have proof of insurance and was therefore issued a citation for Operating a Motor Vehicle without Insurance. I issued Smith a verbal warning for failing to obey a traffic control device. Both Unit#1 and Unit#2 were able to be driven away without further incident.
