SUBJECT: Request for Minor Modification to an Approved Site Plan, and Parking
Modification Request for Zanatta Townhomes; File LUA06-168, SA -A
Dear Mr. Pool,
I have reviewed your request for a modification to the approved site plan for the Zanatta
Townhomes (File No. LUA06-168, SA -A, ECF) and an associated parking modification. You
propose to be allowed to remove the two on-site dumpster areas and instead utilize individual
recycle and garbage collection containers in each residential unit. The areas where the
dumpsters were to be located would be converted to a total of two additional surface parking
stalls and lawn. You also propose to install five surface parking stalls on the south portion of the
site in an area that was originally proposed to be landscaped: The modifications are analyzed by
comparing the approved site plan with the proposed site plan modifications. Our response is
outlined as follows.
SUMMARIZATION OF THE REQUESTED SITE PLAN MODIFICATION:
1. Remove the dumpsters on the northeast and south central portions of the site and convert
one area to two su ace parking stalls; install gross in the other area where the dum ster is
proposed for removal
2. Convert a landscaped gross area on the south portion of the site to five additional surface
parkingstalls.
Renton Municipal Code, Section 4-9-2001, allows minor adjustments to an approved site plan,
provided:
1. The adjustment does not involve more than a ten percent (105146) increase in area or scale
of the development in the approved site plan; or
2. The adjustment does not have a significantly greater impact on the environmental find .
facilities than the approved plan; or
3. The adjustment does not change the boundaries of the originally approved plan.

ANALYSIS OF SITE PLAN MODIFICATION:
1. Remove the dumpsters on the northeast and south central portions of the site and convert one
area to two surface parking stalls, install grass in the other area where the dumpster is proposed
for removal.
The proposal to remove the trash and recyclables dumpsters and instead utilize individual
containers within the units and to convert these areas to provide for two additional parking
stalls does not involve more than a 10% increase in area of scale of the approved site plan. The
area is to be paved and the elimination of the dumpsters would not increase the area or scale of
the project. The proposal would not impact the environmental of the proposal, and would
provide for additional guest parking. Trash and recycling would be provided for in the individual
dwelling unit garages. The proposal would not change the boundaries of the originally approved
site plan. Linda Knight, Solid Waste Coordinator for the City has provided comments regarding
this proposal. The elimination of the dumpsters and conversion to individual containers is
acceptable provided that: .
• Waste Management is able to actually service individual containers.
• There must be adequate storage area onsite to be able to park a car and stare the
collection carts in the garage.
• Billing must go to one central party responsible for payment — most cases it is a property
owner, or homeowner association — the City does not individually bill multifamily
condominiums.
• Management of the service level for the project is the responsibility of the property
owner/HDA. individual tenants are not authorized to change their service level. If
individual tenants wish to change their service level, they must do so through their
property owner/HOA.
• Service is for multifamily cart service. Service includes weekly garbage cart & recycling
cart collection.
• YardfFood Waste Service is available for an extra fee per cart.
• The rate charged is the multifamily cart rate, currently $26.00/month/cart for the 35
gallon cart collected weekly.
Staff recommends approval of the suggested revision to eliminate the trash & recycle areas and
convert these areas to parking and landscaping subject to conditions as noted above.
2. Convert a landscaped grass -area on the south portion of the site to five additional surface
parking stalls.
The proposal to convert a landscaped area to five additional surface parking stalls on the south
side of Building 7 is not supported. This would result in surface parking being located in the
front yard setback area. RMC 4-2-110A only allows surface parking in the side and rear yard
areas for RM -F zoned properties. On-site landscaping would be reduced; and the proposal
would not provide sufficient back -out or maneuvering area for vehicles. For these reasons, staff
recommends that the conversion of the area south of Building 7 to parking be denied.

SUMMARY & ANALYSIS OF PARKING MODIFICATION:
The proposal would increase the amount of parking on site by seven parking stalls, two in an
area previously proposed for a dumpster, and five surface stalls on the south side of Building 7.
At the time of original approval of the site plan, the required parking for the project was 54
stalls. This was provided in individual units. A parking modification was granted to exceed this
number by nine stalls. The current proposal would add seven more surface parking stalls.
Criteria used to evaluate the proposed modification are as follows:
A. Will meet the objectives and safety, function, appearance, environmental protection and
maintainability intended by the Code requirements, based upon sound engineering
judgment; and
B. Will not be injurious to other property(s) in the vicinity, and
C. Conform to the intent and purpose of the Code, and
D. Can be shown to be justified and required for the use and situation intended, and,
E. Will not create adverse impacts to other property (ies) in the vicinity.
1. Add two surface parking stalls in an area originally ro osed for a dum sten.
The proposed parking modification to add two stalls is appropriate as additional surface parking
stalls would be provided. This would help alleviate concerns when for guests needing parking.
The proposal would potentially result in a beneficial impact to adjoining properties by
diminishing the number of vehicles that would park off-site. The revision conforms to the intent
and purpose of the Code. Even though the project meets Code requirements for provision of
parking spaces; the majority of the parking is within garage units. The proposal appears to be
justified, and would not create adverse impacts to other properties in the vicinity. The provision
of additional parking would likely diminish parking demand off site that could have adversely
affected other properties. In addition, the modification would likely have been approved during
the initial consideration of the application. A parking modification was previously approved as
part of the project in order to provide additional nine additional surface parking stalls.
2. Add five surface parkinq stalls on the south side of Building 7.
The proposed parking modification to add five surface parking stalls on the south side of
Building 7 and is not appropriate in this location. The parking would not meet the minimum
standards for vehicle back-up and two-way circulation. In addition, landscaping area would be
eliminated; and provisions of the development regulations that specify where parking can be
located would be violated (RMC4-2-100A).
DECISION —Site Plan Modification:
The site plan modification has been evaluated in relation to the approved site plan. Based on
this analysis, we have determined that Item 1 for both the Minor Adjustment is approved
subject to the following conditions:

1. The applicant shall provide landscaping for the created parking stalls as shown
on the submitted site plan. The landscaping shall be installed prior to
Certificate of Occupancy for the first building on the site.
2. Waste Management must agree to service the individual trash/recycle
containers.
3. There must be adequate storage area onsite to be able to park a car and store
the collection carts in the garage.
4. Billing for trash collection must go to one central party responsible for
payment (property owner, or homeowners association); the City of Renton
will not individually bill multifamily condominiums or apartments.

DECISION – Parking Modification:
Based on the analysis of the requested parking modification, we have determined that Item 1
for the addition of two parking stalls is approved, and Item 2 for the addition of five parking
stalls is denied.
These administrative land use decision will become final if not appealed in writing to the
Hearing Examiner on or before 5:00 p.m. on July 14, 2010. Appeals to the Examiner are
governed by City of Renton Municipal Code Section 4-8-110. Additional information regarding
the appeal process may be obtained from the Renton City Clerks' Office, (425) 430-6510.
Appeals must be filed in writing, together with the $250 appeal fee to: Hearing Examiner, City
of Renton, 1055 South Grady Way, Renton, WA 98057.

PROJECT DESCRIPTION & ANALYSIS: Applicant proposes to install a 6 -foot high, black
powder -coated ornamental iron fence, along portions of the perimeter of the Zanatta
Townhomes property. A Special Fence Permit is requested in order to exceed the permitted
fence height of 48 inches (48") in the front and side yards along a street.
The fence would be an ornamental steel residential fence (Universal Style, 2 Rail) with 1" x 1"
rails and 5/18" pickets. The 6 -foot high fence is proposed along NE 10th Street, Sunset Blvd NE,
and NE 10th Place, where the project fronts on public streets. Approximately 500 linear feet of
fence would be installed. The fence would be set back approximately 5 feet from Sunset Blvd
NE, approximately 3 feet from NE 10th Place, and approximately 2 feet from NE 10th Street.
Ornamental landscaping is proposed in a 5 -foot wide planting bed in front of the fence on
Sunset Blvd NE, and the fence would be locate within the landscaped beds such that plants are
being installed on both sides of the fence on NE 10th Place and NE 10th Street. The spacing of
the black ornamental iron pickets would allow for visibility through the fence, while creating an
enclosed area, and separating the property from the street.
The proposed fence location on Sunset Blvd NE is appropriate provided that the fence is set at
the edge of the lawn area and a minimum of 5 feet from the edge of the sidewalk. Staff
recommends this as a condition of approval. However, the fence location along NE 10th Place

and NE 10th Street should be located such that the majority of the landscaping is in the public
realm in front of the fence. Therefore, staff recommends that the fence along N E 10th Place be
located a minimum of 2 feet north of the edge of the paved drive/garage aprons. In addition,
staff recommends that the fence bordering NE 10th Street be located at the edge of the lawn
and a minimum of 5 feet from the back of the sidewalk.
The fence is proposed to traverse the corner where the property abuts the intersection of NE
Sunset and NE 10th Place. RMC 4-4-040.1) limits the height of fences to 48 inches in the front
yard and the side yard along a street, except for the "clear vision area" which limits fence
height to 42 inches. The fence would not be allowed to exceed 42 inches within the clear vision
area (NE Sunset Blvd and NE 10th Place) therefore, staff recommends that the fence in this area
either be reduced so as not to exceed 42 inches in height, or the fence be relocated out of the
clear vision area. A Special Fence Permit has been requested by the applicant in order to
exceed the permitted fence height of 48 inches in the front and side yards along a street.

1. The 6 -foot high black ornamental fence shall be installed at the edge of the existing lawn
area and a minimum of 5 feet back from the edge of the sidewalk, for that portion of the fence
located along Sunset Blvd NE (except as noted below for the portion of the fence located within

2. The 6 -foot high black ornamental fence shall be located such that the majority of the
ornamental landscaping is located within the public realm in front of, or north of, the fence.
The fence shall be installed a minimum of 2 feet to the north of the paved driveway/apron for
that portion of the fence located along NE 10th Place (except as noted below for the portion of
the fence located within the "clear vision area").
3. The 6 -foot high black ornamental fence along NE 10th Street shall be located such that it is
located north of and a minimum of 5 feet from the back of the sidewalk.
4. The 6 -foot high ornamental fence shall either be reduced in height to no taller than 42
inches in the clear vision area (corner or Sunset Blvd NE and NE 10th Place), OR, shall be
installed behind and outside of the "clear vision area".
5. This approval is only given for a black steel fence as described within the application and is
not transferable to another type of fence (i.e., solid wood) unless allowed via written approval
by the City's Planning Director.
6. Landscaping shall be installed as proposed in the Site Plan, within 30 days of the fence being
installed. Please contact the project manager to schedule an inspection of the landscaping and
fence.

Re: Special Fence Permit and Parking on Site Approval

The purpose of this letter is to obtain a special fence permit , additional parking stalls,
and removal of the community dumpsters on my property at 1020 Sunset Blvd NE.
Fence- I would like to install a 6' high fence, which abuts the public road
around my property. See Site Plan. The fence is a sight permeable ornamental
iron that will be located on my property. It will not impede any sight distance
concerning vehicle turning. I have attached a design from the manufacturer
Master Halco or like. Landscaping will be on both sides of the fence. The
purpose of the fence is to add a better sense of security within the
development, without making it a fortress.
2. Parking- I have spoken with you on adding additional parking, see site plan
believe there is too little additional parking on site and the neighbors also
would appreciate less street parking.
3. 1 have gotten approval from Waste Management to have each unit serviced by
individual recycle and garbage containers. Each unit has a large two car
garage and will be required to keep the containers within their garage at all
time unless it is garbage pick up day. One dumpster area will be grassed and
part of the landscaping ad the other will be a new parking spot. .
