SHINPOCH July 26, 1982 MAYOR Letter to File Subject: Mobil Oil Corporation SP-099-81 The referenced Special Permit was reviewed by the Hearing Examiner and a decision rendered January 29, 1982, with the stipulation that restrictive covenants be filed for the maintenance of current storm water capacity of the site. Because of Mobil Oil's internal structure and policies, they could not, and would not, write such covenants and bur- den their entire holdings at the site. Therefore, because of the need for this proposed improvement and the benefits to the City and Fire Department, we negotiated possible acceptable alternatives. Their submittal of June 7th, 1982, was reviewed by the Public Works and Policy Development Directors and the Hear- ing Examiner, as well as our review with the Fire Department and found to be acceptable. Mobil Oil was so notified and the submittal filed with our department. Their plans are presently under review fox issuance of a permit to do the proposed work covered by the Special Per- mit. Mobil considers the fire access road and fire main to be an essential portion of our overall program to upgrade the fire protection at the Renton Terminal. To obtain the required permits, Mobil agrees that: 1) Mobil will maintain the existing storm water storage capability within the dyked area of the Renton Terminal until such time as the P-1 channel is constructed and the flood problem in the area is alleviated. 2) Mobil has no foreseeable intention of moving from the Renton Terminal property and/or selling it to others. The facility provides Mobil with the most economical means of supplying petroleum products to the Seattle market area and as such, it is considered to be an essential part of Mobil's distribu- tion system. SP-099-81 Dear Mr. Nelson: In accordance with your request of May 18, 1982, additional information re ating to subject permit is submitted, that will expand on my previous letter of February 23, 1982 and Mr. G. W. Frisby's correspondence of April 13, 1982. The letter of February 23, 1982 stated that: This storm storage capability of site has been reviewed. The proposed fill will displace approximately 579,000 gallons assuming a flood stage elevation of 12' and no credit for the water containment in the fill. The retainage within the dikes to balance this displacement can be accomplished by storing for a short time period approximately 1.5 feet of water over the entire area not occupied by tanks. Attachments 1L nd 2 show the calculations for the retainage within the dikes necessary to balance the storm water displaced by the proposed fire roadway fill. This is determined to be 1.3 ft. Also, included for your information are copies of Mobil drawings RW 82-01 sheet 1 and sheets 1, 2 and 3 of Drawing RW 81-02 which show details of the proposed fire road with water line and hydrants as well as the two fopt high interior dikes within the tank farm. These interior dikes will allow us to isolate any tank spills if they should ever occur and pr vide further controlled storage of storm water. As previously stated, all storm water from the tank farm is retained until 'it is manually drained through gravity head oil water separator after extreme periods of flooding are over. S. permit No WA-000194-5 regulates the discharge of water from the diked area through the separator at a rate that will not exceed 160 gallons per mit. This discharge is controlled by a valve left closed while unattended. We abide by this regulation for obvious reasons. We are now in the process of evaluating competitive bids for upgrading the fire protection at our Renton Terminal and are anxious to resolve the problems related to SP-099 84 so that contracts can be awarded and colfistruction started promptly. This will allow installation of fire access road and 10" fire line with hydrants that will tie into the construction of 27th street by the City of Renton. Items 2, 3, and 4 of the conditions outlined by office of the Land use Hearing Examiner will cause us no concern. We do not see the necessity to execute a Declaration of Restrictive Covenants on our property to maintain the current storm water of the site. The physical capabilities to store this water is being comprehended in our drawings being developed at this time. We understand that evaluation of the flood plain issue is contained within the authority of the Renton Building Department and the City recognizes that Mobil con provide on-site storm water detention to meet the requirements. In the presentation at the public hearing on January 19, 1982, I brought out the fact that dikes exist around our tank farm which allow us to store some storm water. This storm water is retained until it slowly drains through a separator when the valves are manually operated and after the extreme periods of flooding are over. This storm storage capability of our site has been reviewed and the above conclusions are correct. The proposed fill will displace approximately 579,000 gallons assuming a flood stage elevation of 12' and no credit for the water containment in the fill. The retainage within the dikes to balance this displacement can be accomplished by storing for a short time period approximately \.1.5 feet of water over the entire area not occupied by tanks.. The area is `graded so that this amount of emergency storm water will not reach the tank bases. Page 2 City of Renton Municipal Buidling Renton, Washington We feel that upgrading our fire protection capabilities to new standards is of equal benefit to Mobil and the City of Renton. This will be done at no cost to the City. The 670 feet of 10" fire line from the existing 16" main to the new main to be installed by the City on 27th St. will also provide a loop that will be beneficial in providing water service to adjacent properties as well as additional fire protection capabilities to the area. We also feel that consideration should be given to the fact that the Mobil Terminal is an existing facility developed under older regulations and we are now trying to upgrade our safety standards to meet the new regulations. BUILDING & ZONING The Building and Zoning Department report was received by the DEPARTMENT REPORT: Examiner on January 13, 1982. PUBLIC HEARING: After reviewing the Building & Zoning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The healing was opened on January 19, 1982 at 10:50 a .m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger .Blaylock, Zoning Administrator, presented the staff report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Building & Zoning Department report and other pertinent documents Exhibit #2: Site Plan showing original fill area • Exhibit #3: Site Plan showing revised fill area Mr. Blaylock advised that Exhibit #2 had been revised following determination by the Environmental Review Committee that the applicant 's intent could be met by reducing the amount of proposed fill material . Responding to the Examiner's inquiry regarding whether the app icant could maintain on site storm water storage potential , Mr. Blaylock indicated that in analyzing the issues of fire protection versus the flood plain, the impacts are seen as insignificant. Although the city desires to comply with both provisions, particularly fire protection, the flood plain issue cannot be ignored because other land fill projects in the valley have been halted. He indicated the belief of the ERC that evaluation of the flood plain issue is contained within the authority of the Building Official during review of the annual license. He further stated that while the applicant can provide on site storm water detention, the timing of required utility installations and access will depend upon completion of LID 314 which will include construction of S.W. 27th Street and installation of loop water systems around the tank farm. The Examiner requested testimony by the applicant. Responding was: Kenneth M. Roberts Senior Field Engineer Mobil Oil Corporation 1711 13th Avenue S.W. Seattle, WA 98134 Mr. Roberts described the proposed project to upgrade and protect self-insured property with the most modern fire prevention and fighting equipment available to meet newer, more stringe6t fire safety standards. One-half million dollars has been appropriated to accomplish the necessary improvements, which include installation of an automatic foam system on the loading rack and upgrading the existing foam system on the tanks. He discussed installation of water lines and fire hydrants for provision of cooling water in the event of a tank fire, and he noted that sufficient space exists for fire trucks and fire fighters to operate from a platform. Referencing discussion regarding on site storm water retention, Mr. Roberts noted that dikes from five to six feet in height exist on site; and all of the storm water which falls in those areas is retained until it drains through a separator and then to lower areas. All water is drained onto the subject property, he advised, and water is not drained from the tank farm during periods of flooding. SP-099-81 Page Two Responding to the Examiner's inquiry regarding proposed road surface material , Mr. Roberts stated that the road will be graveled, and to protect the public safety, a locked gate will be installed across either end of the road for fire protection purposes. He also indicated that water lines will be constructed at the applicant's expense to serve not only the subject property but other properties in the city to aid the Fire Department and also provide fire protection for future development located west of the site. • Responding to the Examiner's request for testimony in support of the application was: Jim Matthew Battalion Chief/Fire Marshal Renton Fire Department Mr. Matthew indicated that upon initial development of the Mobil Oil facility in 1965, the area in which the subject site is located was remote and sparsely developed, and provided with a single, limited access from the East Valley Highway. The facility contains one million gallons of gasoline at the current time, and as a result of major development in the area with accompanying increased traffic and population, the operation presents a distinct hazard to public safety. Therefore, in recognizing that danger, the applicant is upgrading the facility to improve fire protection capabilities. Although a problem exists with the flood plain, it is the opinion of city staff that it can be mitigated within the next year, and the proposed automated fire protection, modification in floating roofs, and new access roadway and hydrants will be of great benefit to the public welfare of the city. The Examiner requested further comments in support or opposition to th,e application. There was no response. Mr. Blaylock clarified that by recommending approval of the - request, staff is addressing an existing problem and not encouraging future development, noting that a proposal for expansion of the tank farm would be opposed. However, proposed modernization and improvement to fire fighting systems is beneficial . The Examiner stated his concern regarding loss of flood potential either by new development or development of an access road, and noted that imposition of restrictive covenants which may be dissolved if the P-1 Channel is constructed, may not be unreasonably burdensome to the applicant . The Examiner requested final comments. Since there were none, the hearing regarding File No. SP-099-81 was closed by the Examiner at 11 : 15 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The applicant, Mobil Oil Corporation, filed a request for a special permit to allow the filling and grading of property for the construction of a secondary access road for a tank farm facility. 2. The application file containing the application, SEPA documentation, the Building and Zoning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , RCW 43.21C, as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC) , responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. Utilities are available, in close proximity, and will be upgraded as part of an LID for the area as well as specific improvements on site. 7. The subject site is located in the vicinity of 2423 Lind Avenue S.W. The subject site consists of two generally level plateaus. The upper plateau, at elevation 18-19 feet, is the site of the gasoline tank farm; the lower plateau is about 8-9 feet and is undeveloped. 8. The subject site is zoned H-1 (Heavy Industry) . The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park uses and greenbelt. 10. The applicant proposes updating the fire prevention and protection system at their tank farm and installing a second road to provide emergency access to the more remote area of the site. LID 314 will. provide access to the proposed emergency road. In order to construct the road, approximately 10,500 cubic yards of fill material will have to be imported to the site. 11 . The applicant has applied for the fill permit pursuant to Sections 4-2303(2) and 4-722(B) which allow the Examiner to issue a special permit to allow fill and grade. 12. The road will be approximately 640 feet in length and 20 feet in width and will be surfaced with gravel . 13. The subject property is surrounded by dikes which serve to retain any spills on site, and would prevent spills from entering Springbrook Creek and to keep flood waters off the site. 14. The Fire Department indicated that the additional fire protection is necessary at this time. When the installation was first constructed, the valley was considered a remote location with little or no development or traffic. The area has grown and continues to grow with related increases in traffic and the potential for increased hazard to the facility. 15. North of the subject site is the Olympic, Pipeline. Other property in the immediate area remains undeveloped. Springbrook Creek and the proposed P-1. Channel are ' located just westerly of the site. 16. _ Other projects proposed for areas of the valley which may have changed the water holding capacity of their respective properties have been required to covenant to construct in such manner as to retain the current holding capacity (File No. R-069-81 , Caraccioli ; File No. R-079-81 , MacGregor) . 17. The subject site is located within an area of increased traffic and industrialization and the Police Department has recommended that the hours and route for hauling be limited to weekdays between the, hours of 6:00 a.m. and 2:30 p.m. so that hauling does not interfere with traffic in the valley. Also recommended was a cash bond to allow city crews to clear debris from haul routes if not accomplished in a complete and timely manner by the applicant. The restriction to weekdays was recommended because city crews are not generally available to monitor the site or streets on weekends. CONCLUSIONS: 1 . The proposal to grade and fill the subject site in order to construct an emergency fire access lane appears to serve the public use and interest, but the applicant should also preserve the current capacity of the site to retain storm water as is required for other development in the valley. 2. While the merits of the proposal cannot be questioned, that is, modernizing the fire prevention and protection system of the gasoline tank farm, the applicant should not be allowed to increase the flood potential by even a small amount. The issue is not solely the potential of harm to the subject property, which is the reason the city initiated the hold harmless agreement. Each additional development in the valley decreases the holding capacity of the underlying soil either by covering permeable soils with impermeable surfaces or the construction of facilities which are capable of displacing water onto other properties in the flood plain. The subject proposal is of the latter type. The proposed grade, fill and road will displace water from the subject site and such displacement should be accounted for by the, construction of an equal capacity holding system. 3. While the flood control system is proposed for the valley until it is constructed, potentially damaging floods may still occur and any increase in flood waters, no matter how small , is unwarranted. Therefore, the applicant should execute covenants similar to those executed by others requiring on site holding capacity equal to the capacity to be lost to development,' such covenants to dissolve upon completion of flood protection measures in the valley. It would be inconsistent to require retention by only some property owners'and not all similarly situated. 4. Because of growing traffic in the valley, recommendations to limit the hours from 6:00 a.m. to 2:30 p.m.. during weekdays for the hauling of fill material are appropriate.
