NOWTHEREFORE,theAPPLICANTherebyagreesandbindstselfanditstegalrepresentatives,successors,andassignsasfollows:ITheAPPLICANTguaranteesthatconstruction,maintenanceandrestorationofroadway,site,drainage,retention/detention,water,andsanitarysewerfacititieswilloccurinfuticompliancewiththeapprovedconstructionplansandprofiles,includinganyapprovedamendmentsthereto,andinfullconformancewithapplicableC1TYordinances,standardsandspecifications,tothesatisfactionoftheCITY.2.Ifthesubdivision,shortsubdivision,orsiteplanisnotrecorded,orthebuildingdoesnotreceiveanycertificateofoccupancyorfinalbuildingpermit,theAPPLICANTagreestorestoretherightofwaytoitsoriginalconditionorbetterANDstabilizethesiteorcomplywiththeconditionsofanypermitorapproval,including,butnotlimitedto,correctiveworknecessarytoprovidedrainageconsistentwithapprovedplansandconditions,andtoprotectthepublichealth,safety,andwelfare,includingeffectsonwaterquality.3TheCITYmustapprove(inwriting)anyproposedchangesfromtheapprovedplanspriortotheAPPLICANTbeginningsuchwork.4Priortobeginningconstruction,apreconstructionmeetingshallbeheldwiththeCITY,theAPPLICANTandtheAPPLICANT’Scontractor(s)5TheAPPLICANTshallberesponsibleforthecostofanycorrectiveworkonoroffthesiteorwithintherightofwaytotheextentthatsuchcorrectivemeasuresareassociatedwithworkperformedand/ornotcompleted.6.TheAPPLICANTshallpayanyfeesrequiredinconjunctionwiththeprojectpursuanttotheCityofRentonFeeSchedule.7.IftheAPPLICANTfailstoproceedwithduediligenceandingoodfaithintheworkprovidedherein,theAPPLICANTshallremoveallorpartofconstructedfacilitiesandrestorealldisturbedareasofthesitetoitsoriginalorbetterconditionattheAPPLICANT’Ssoleexpense.TheAPPLICANTshallnotstop,delayorabandontheprojectwithoutfirstrectifyinganydamage,stabilizingandrestoringtherightofwayand/orsitebygrading,hydroseeding,and/orlandscapingasmayberequiredbytheCITY.8TheAPPLICANTshallfurnishtotheCITYasetoffinalcorrectedplans”(photoMylarquality)ofallrequiredpublicandprivatefacilitieswhenapplicable.PublicAgencyAgreementforPerformancePage2of5
