Applicant is proposing to construct a nine foot (9') retaining
wall at an existing single-family residence located within 200
feet of the shoreline of Lake Washington. The wall would
support a one-vehicle concrete-paved parking pad. The wall
and parking area are within the side setback area for the
residence. An administrative variance to allow this reduction
of the setback area was previously approved by the
Development Services Division of the
Planning/Building/Public Works Department of the City of
Renton. Lake Washington is designated as an Urban
Shoreline Environment at this location.

This letter is to inform you that the appeal period has ended for both the Environmental Review
Committee's (ERC) Determination of Non-Significance -Mitigated and Administrative
Variance approval for the above-referenced project.
No appeals were filed on the ERC determination and the Administrative Variance approval,
therefore, the decisions are final and application for the appropriately required permits may
proceed. The applicant must comply with all ERC Mitigation Measures.
Also, please see the enclosed Certificate of Exemption fro~ Shoreline Substantial Development

Subject: Request for Parking Modification for Residential Parking Space

Dear Mr. Dye:
This letter is sent to advise you that the Development Services Division Director has
reviewed and denied a parking code modification for your residence. This letter will
supercede the letter sent on August 20, 2007.
Due to filling, for the creation of an additional parking space, within 200 feet of a
shoreline of statewide significance and within a critical area (protected slope) the land
use permits below are required before the modification request can be considered. I have
enclosed the Director's denial with this letter. Below are the city permits, licenses and
approvals needed for your proposal. There may be other State and Federal Permits
needed for your proposed project please contact the appropriate agencies:
Permits, Licenses and Approvals Required: You will need to obtain the following
City approvals ( applications attached) prior to performing work at the site.

The afplication should be submitted to the Building Department at the front counter on
the 61 floor of City Hall between 8:00 AM and 5:00 PM.

Project Narrative:
Purpose: To construct a parking pad/ driveway on the property line, and to build a retaining wall
around 9 feet high in order to avoid parking along the small lane and obstructing street traffic.
Background: Ripley Lane is a small one way lane serving houses on Lake Washington between the
Railroad tracks and the water. Most properties are quite small (4-5000 sq. feet lots), and as a result
parking cars is a problem and space is limited. I wish to construct a retaining wall around 9 feet high in
order to build a driveway/parking pad on top of it. My neighbor already has his garage near the
property line as it was built so+ years ago and this area of my property adjacent to the neighbour's
garage is currently useless. From the street side, there is an existing 8 Y, foot retaining wall and then
landscaping in front of it, and at the end of the 20 foot long parking pad, it would be about 9 Y, foot high
thus the gradient over 20 horizontal feet is about 1 vertical foot. My mother requires wheelchair access
to the house entrance, and the current parking area is too small to reasonably accommodate wheelchair
access to the front door. I remodeled the kitchen and entrance to the house (interior) in 2005 to make
it wheelchair accessible, and now the parking area in front of the entrance is not large enough for
reasonable wheelchair access thus I propose this parking pad to make it accessible for my mother and
father who currently reside at my house.

Setback Variance Justification:
Suffers undue hardship ... :
Ripley Lane is a one way, small lane with limited parking anywhere. Most homes on the lane have
already made site improvements to their property and added additional parking areas, including
building retaining walls and adding fill. The sizes of properties are small (my property is 3990 sq. ft), and
my neighbour's properties are similar size. The topography of the area which is a near vertical drop
from the street to the property requires me to build 2 retaining walls and fill in a space before it is
possible to create a parking space. This space is needed because my parents live in the house, and my
mother is handicapped and requires wheelchair access to/from the car and house. If there were
cheaper and more reasonable solutions for parking I would surely pursue them, but due to Burlington
Northern Railroad refusals to lease land to adjacent landowners and their prohibition of moving any dirt
on their land to create parking forces the adjacent homes to solve their own parking problems which is
what I am trying to do with the creation of this parking pad. Most of my neighbours have sufficient
parking, including many who have built on the property line. Unfortunately the previous owners of my
house did not have the foresight to have built better parking for the house as other neighbours on this
lane have done 20 years ago. I just wish to have what my neighbours already have.
Granting of variance not materially detrimental to the public, etc:
As most of my neighbours already enjoy parking similar to my proposal, there is no detrimental effect to
the neighbourhood. Rather the contrary, if each neighbor can better take care of their own parking
needs, then it will decrease potential conflicts within the neighbourhood.

As stated above, most of my neighbours already enjoy better parking facilities than my property. They
just did it 20 years or more ago, or without a permit. I should not be penalized for following the
regulations/ laws.

No reasonable use of the property left if requested variance is not granted ... :
This area of my property is currently wasted space. It is already 70% filled with old concrete and dirt.
Building a proper retaining wall, and using proper fill material as noted in the Geo Tech report (which
shall be fo))pwed and recommendations adhered to) would be a significant improvement to the
property and neighbourhood.
Variance granted is the minimum amount necessary ... :
This is the simplest and most effective solution to my parking woes that I can think of. Without a
variance, my mother cannot reasonably access the car and house as the current parking space is too
small for reasonable wheelchair access.

I have gone above and beyond by spending nearly $7000 to date on the geotech and engineering
reports for a project that has a value of around $10,000. The engineers, both structural and geological,
have written their reports and considered my project a feasible and reasonable solution for my parking
problems. I hope the city and county concur.

Drainage Control Plan
The recommendations in the Geo Tech report shall be followed and implemented. Such
recommendations include provision of a drain at the footing elevation that consists of PVC pipe
surrounded by washed pea gravel. The perforations in the pipe shall be set down at the bottom of the
footing and the drains shall be constructed with sufficient gradient to allow gravity discharge away from
the wall. Final drainage shall be tied in to the existing gutter drain system which prevents the water
from going in to Lake Washington. See geotech report for more details.

Construction Mitigation Description:
Use of small trucks and equipment are required in this area due to limited space to move, and as a result
this project will be more labour intensive and therefore less obtrusive to neighbours. Small trucks and
equipment will be kept clear of the street, and the work will be done during normal working hours thus
most of my neighbours will have already left for work and problems should be minimized. Please see
also the Geo Tech. Report for further details and recommendations which shall be followed.

The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions. An Environmental Impact
Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be
.done} and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:

I. PROJECT AND SITE CONDITIONS
This report presents the results of Associated Earth Sciences, Inc. 's (AESI's) subsurface
exploration and geotechnical engineering study for the proposed Dye residence project located
at 7029 Ripley Lane North in Renton, Washington (Figure 1). The proposed building location
and approximate locations of the explorations accomplished for this study are presented on the
"Site Sketch," Figure 2.
If any changes in the nature, design, or location of the structure are planned, the conclusions
and recommendations in this report should be reviewed and modified, or verified.
1.1 Purpose and Scope
The purpose of this study was to provide subsurface data and design recommendations for
construction of a driveway widening that would involve construction of an approximately
15-foot-high, cast-in-place, concrete retaining wall to the south of the Dye's present driveway.
This study included a review of available geologic literature, drilling exploration borings, and
performing geologic studies to assess the type, thickness, distribution, and physical properties
of the subsurface sediments and ground water conditions. Geotechnical engineering studies
were also conducted to recommend the types of suitable foundation support, depth to suitable
foundation, allowable foundation soil bearing pressures, anticipated foundation settlements,
retaining wall lateral pressures, structural fill placement and compaction, drainage
considerations, and erosion mitigation recommendations. This report summarizes our current
fieldwork and offers development recommendations based on our present understanding of
the project.
1.2 Authorization
Written authorization to proceed with this study was granted by Mr. Bob Dye. Our study was
accomplished in general accordance with our proposal dated January 18, 2007. This report has
been prepared for the exclusive use of Mr. Bob Dye and his agents for specific application to
this project. Within the limitations of scope, schedule, and budget, our services have been
performed in accordance with generally accepted geotechnical engineering and engineering
geology practices in effect in this area at the time our report was prepared. No other warranty,
express or implied, is made. Our observations, findings, and opinions are a means to identify

2.1 Project Description

Project and Site Conditions
This report was completed with an understanding of the project based on our discussions with
Mr. Clemons Rossell, the project structural engineer, and Mr. Bob Dye, the property owner.
Present plans call for construction of an approximately 15-foot-high, cast-in-place, concrete
retaining wall to the south of the present driveway to allow filling of that area to street grade to
create additional drive and parking area at the southeast corner of the lot. The existing
terraced, concrete rubble planter will be removed.
2.2 Site Description
The property was located at 7029 Ripley Lane North, just west of the Burlington Northern's
railroad on the west side of Ripley Lane North, adjacent to Lake Washington. The
approximately 3,900 square-foot parcel was constructed level with Ripley Lane North on the
east side, then slopes down to Lake Washington on the west. Total elevation change across the
property was on the order of 15 feet. Vegetation consisted of landscape bushes, trees, and
grass. The subject site appears to straddle the boundary between the city of Renton and
unincorporated King County, with most of the site lying within King County. The property is
not classified by either King County or the City of Renton as a Geologic Hazard Area.
3.0 SUBSURFACE EXPLORATION
Our field study included drilling two exploration borings and a geologic reconnaissance to gain
information about the site. The various types of sediments, as well as the depths where
characteristics of the sediments changed, are indicated on the exploration logs presented in the
Appendix. The depths indicated on the logs where conditions changed may represent
gradational variations between sediment types. Our explorations were approximately located
in the field by measuring from known site features. We did not have a topographic survey at
the time of our fieldwork.
The conclusions and recommendations presented in this report are based on the exploration
borings and geologic reconnaissance completed for this study. The number, locations, and
depths of the explorations were completed within site and budgetary constraints. Because of
the nature of exploratory work below ground, extrapolation of subsurface conditions between
field explorations is necessary. Differing subsurface conditions may sometimes be present due
to the random nature of deposition and the alteration of topography by past grading and/ or
filling. The nature and extent of any variations between the field explorations may not become

fully evident until construction. If variations are observed at that time, it may be necessary to
re-evaluate specific recommendations in this report and make appropriate changes.
3. 1 Exploration Borings
During drilling, samples were obtained at generally 2. 5-or 5-foot-depth intervals. Due to
limited site access, an Acker/skid-mounted, limited-access drill rig was used to explore the
site. This drilling equipment uses a 2 %-inch, inside-diameter, hollow-stem auger. The
borings were continuously observed and logged by a geologist from our firm. The exploration
logs presented in the Appendix are based on the field logs, drilling action, and visual
classification of the samples secured.
Disturbed, but representative samples were obtained from our borings by using the Standard
Penetration Test (SPT) procedure in accordance with American Society for Testing and
Materials (ASTM):D 1586. This test and sampling method consists of driving a standard
2-inch, outside-diameter, split-barrel sampler a distance of 18 inches into the soil with a
140-pound hammer free-falling a distance of 30 inches. The number of blows for each 6-inch
interval is recorded, and the number of blows required to drive the sampler the final 12 inches
is known as the Standard Penetration Resistance ("N") or blow count. If a total of 50 is
recorded within one 6-inch interval, the blow count is recorded as the number of blows for the
corresponding number of inches of penetration. The blow count provides a measure of the
relative density of granular soils or the relative consistency of cohesive soils; these values are
plotted on the attached boring logs.
The samples obtained from the split-barrel sampler were classified in the field and
representative portions placed in watertight containers. The samples were then transported to
our laboratory for further visual classification and laboratory testing. Testing was limited to
visual-manual classification of the collected samples in general accordance with ASTM
standard practices.
4.0 SUBSURFACE CONDITIONS
Subsurface conditions at the project site were inferred from the subsurface explorations
accomplished for this study, visual reconnaissance of the site, and review of applicable
geologic literature. As shown on the exploration logs, the explorations generally encountered
fill materials overlying native dense to very dense, silty sand. Minor amounts of clay were
also encountered in some locations. The following section presents more detailed subsurface
information organized from the shaUowest (youngest) to the deepest (oldest) sediment types.

Fill soils (not naturally placed) were encountered in boring EB-I. The fill thickness was
approximately 6.5 feet and typically consisted of loose, moist, brown to gray, silty sand with
few fine to coarse gravel and trace to few organics. The fill was placed behind a terraced,
concrete rubble planter that extended from street level down to the level of the backyard. Fill
should also be expected elsewhere on the site, particularly adjacent to existing buildings,
buried utilities, and driveway/landscape areas. These materials appear to vary in both quality
and depth across the site. Since the quality, thickness, and compaction of the fill materials are
low or variable, the fill is considered unsuitable for structural support. However, this material
could be used behind the new retaining wall as structural fill if it is moisture-conditioned and
any deleterious material is removed.
Pre-Fraser Undifferentiated
Natural soils beneath the fill materials, and at the surface where fill materials were absent,
generally consisted of dense to very dense, moist, brown to gray, fine-coarse sand with few silt
(typically interbedded and mildy oxidized) and trace gravels. With depth, these materials
typically became denser. This material has been overridden by past glacial incursions into the
Puget Sound basin, resulting in a soil with high compressive strength and relatively low
permeability. This soil is suitable for the support of the retaining wall foundations.
4.2 Geologic Literature
We reviewed the Geologic Map of Su,jicia/ Deposits in the Seattle 1:100,000 Quadrangle,
Washington, by James C. Yount, James P. Minard, and Glen R. Dembroff (1993). This
publication shows the site area is mantled by early-late Pleistocene-age undifferentiated nonglacial
sediments with undifferentiated glacial sediments. Geologic mapping at the published scale only
shows regional trends in sediment type. Therefore, the boundaries between units and
sediment/rock type in any given area are sometimes mapped approximately. The geologic units
and sediment/rock type in any given area are sometimes mapped approximately. The mapped
geologic units are in general conformance with our findings at the site.
4.3 Hydrology
Ground water seepage was encountered in exploration EB-2 at the time of our field study in
February 2007. The depth of seepage was observed at about 7 feet below existing site grade
and probably indicated the water table associated with Lake Washington. Fluctuations in the
level of the ground water may occur due to variations in the amount of rainfall, time of the
year, lake levels, and changes in site development.

Our exploration indicates that, from a geotechnical standpoint, the parcel is suitable for the
proposed development provided the recommendations contained herein are properly followed.
The bearing stratum is relatively shallow, and spread footing foundations may be utilized.
Consequently, foundations bearing on the dense natural soils or structural fill are capable of
providing suitable building support.
6.0 SITE PREPARATION
6. 1 Demolition
Landscape features presently on the site that are under building areas or not part of future plans
should be removed and disposed of off-site. Any buried utilities should be removed or
relocated if they are under building areas. The resulting depressions should be backfilled with
structural fill, as discussed under the "Structural Fill" section.
6.2 Clearing and Stripping
Site preparation of the planned retammg wall should include removal of all trees, brush,
debris, and any other deleterious material. Additionally, the upper organic topsoil should be
removed· and the remaining roots grubbed. Areas where loose surficial soils exist due to
grubbing operations should be considered as fill to the depth of disturbance and treated as
subsequently recommended for structural fill placement.
Loose surficial soil and topsoil should be stripped down to the underlying dense sand. Since
the density of the soil is variable, random soft pockets may exist, and the depth and extent of
stripping can best be determined in the field by the geotechnical engineer or their
representative.
6.3 Temporary Cut Slopes
In our opinion, stable construction slopes should be the responsibility of the contractor and
should be determined during construction, based on the local conditions encountered at that
time. For planning purposes, we anticipate that temporary, unsupported cut slopes in the
native unsaturated sand can be made at a maximum slope of lH:lV (Horizontal:Vertical).

Where ground water seepage is present, shallower slopes or shoring may be required. As is
typical with earthwork operations, some sloughing and raveling may occur, and cut slopes may
have to be adjusted in the field. In addition, WISHA/OSHA regulations should be followed
at all times.
6. 4 Site Disturbance
The site soils contain some fine-grained material that makes them somewhat moisture-sensitive
and subject to disturbance when wet. The contractor must use care during site preparation and
excavation operations so that the underlying soils are not softened. If disturbance occurs, the
softened soils should be removed and the area brought to grade with structural fill.
6.5 Permanent Cut Slopes
Permanent, unsupported cut slopes comprised of structural fill should not exceed a gradient of
2H: IV. All permanent slopes should be revegetated or otherwise protected from erosion as
soon as possible after they are constructed.
7.0 STRUCTURAL FILL
Structural fill will be necessary behind the retaining wall for support of the proposed driveway.
All references to structural fill in this report refer to subgrade. preparation, fill type, and
placement and compaction of materials, as discussed in this section. If a percentage of
compaction is specified under another section of this report, the value given in that section
should be used.
7 .1 Subgrade Compaction
After overexcavation/stripping has been performed, the upper 12 inches of exposed ground
should be recompacted to a firm, unyielding condition, as determined by the geotechnical
engineer or their representative. If the subgrade contains too much moisture, suitable
recompaction may be difficult or impossible to obtain and should probably not be attempted.
In lieu of recompaction, the area to receive fill should be blanketed with washed rock or quarry
spalls to act as a capillary break between the new fill and the wet subgrade. Where the
exposed ground remains soft and further overexcavation is impractical, placement of an
engineering stabilization fabric may be necessary to prevent contamination of the free-draining
layer by silt migration from below. After the recompacted, exposed ground is tested and
approved, or a free-draining rock course is laid, structural fill may be placed to attain
desired grades.

Structural fill is defined as non-organic soil, acceptable to the geotechnical engineer, placed in
maximum 8-inch loose lifts, with each lift being compacted to at least 95 percent of the
modified Proctor maximum dry density using ASTM:D 1557 as the standard. Roadway and
utility trench backfill should be placed and compacted in accordance with applicable municipal
codes and standards. The top of the compacted fill should extend horizontally a minimum
distance of 3 feet beyond the perimeter footings or pavement edges before sloping down at an
angle no steeper than 2H: 1 V. Fill slopes should either be overbuilt and trimmed back to final
grade or surface-compacted to the specified density.
7 .3 Moisture-Sensitive Fill
Soils in which the amount of fine-grained material (smaller than the No. 200 sieve) is greater
than approximately 5 percent (measured on the minus No. 4 sieve size) should be considered
moisture-sensitive. Use of moisture-sensitive soil in structural fills should be limited to
favorable dry weather conditions. The shallow on-site soils generally contained some silt and
are considered moisture-sensitive. In addition, construction equipment traversing the site when
the soils are wet can cause considerable disturbance. If fill is placed during wet weather or if
proper compaction cannot be obtained, a select import material consisting of a clean, free-
draining gravel and/or sand should be used. Free-draining fill consists of non-organic soil with
the amount of fine-grained material limited to 5 percent by weight when measured on the
minus No. 4 sieve fraction.
7.4 Structural Fill Testing
The contractor should note that any proposed fill soils must be evaluated by AESI prior to their
use in fills. This would require that we have a sample of the material at least 72 hours in
advance to perform a Proctor test and determine its field compaction standard. A
representative from our firm should observe the stripped subgrade and be present during
placement of structural fill to document the work and perform a representative number of in-
place density tests. In this way, the adequacy of the earthwork may be evaluated as filling
progresses and problem areas may be corrected at that time. It is important to understand that
taking random compaction tests on a part-time basis will not assure uniformity or acceptable
performance of a fill. As such, we are available to aid the owner in developing a suitable
monitoring and testing frequency.

Spread footings may be used for structure support when founded either directly on the medium
dense natural sediments, or on structural fill placed over these materials, as described under
the "Site Preparation" and "Structural Fill" sections of this report. For footings founded
either directly upon the medium dense natural sediments, or on structural fill as described
above, we recommend that an allowable bearing pressure of 3,500 pounds per square foot (psf)
be used for design purposes, including both dead and live loads. An increase of one-third may
be used for short-term wind or seismic loading.
8. 2 Footing Depths
The footing for the proposed wall should be buried a minimum of 18 inches into the
surrounding soil for frost protection. All footings must penetrate to the prescribed stratum,
and no footings should be founded in or above loose, organic, or existing fill soils.
8.3 Footings Adjacent to Cuts
The area bound by lines extending downward at lH: 1 V from any footing must not intersect
another footing or intersect a filled area that has not been compacted to at least 95 percent of
ASTM:D 1557. In addition, a l.5H:1V line extending down from any footing must not
daylight because sloughing or raveling may eventually undermine the footing. Thus footings
should not be placed near the edges of steps or cuts in the bearing soils.
8.4 Footing Settlement
Anticipated settlement of footings, founded as described above, should be on the order of 1
inch or less. However, disturbed soil not removed from footing excavations prior to footing
placement could result in increased settlements.
8. 5 Footing Sub grade Bearing Verification
All footing areas should be observed by AES! prior to placing concrete to verify that the
exposed soils can support the design foundation bearing capacity and that construction
conforms to the recommendations in this report. Foundation bearing verification may also be
required by the governing municipality.

of this report.
9.0 LATERAL WALL PRESSURES
All backfill behind the wall or around foundations should be placed following our
recommendations for structural fill and as described in this section of the report. Horizontally
backfilled walls, which are free to yield laterally at least 0.1 percent of their height, may be
designed using an equivalent fluid equal to 35 pounds per cubic foot (pcf). Fully restrained,
horizontally backfilled, rigid walls that cannot yield should be designed for an equivalent fluid
of 50 pcf. A surcharge equivalent to 2 feet of soil should be added to the wall height in
determining lateral design forces to account for cars parking behind the wall.
9 .1 Wall Backfill
The lateral pressures presented above are based on the conditions of a uniform backfill
consisting of granular fill within 3 feet of the wall compacted to 90 to 95 percent of ASTM:D
1557. A higher degree of compaction within 3 feet of the wall is not recommended, as this
will increase the pressure acting on the wall. A lower compaction may result in fill settlement.
Thus, the compaction is critical and must be tested by our firm during placement. Surcharges
from adjacent footings, heavy construction equipment, or sloping ground must be added to the
above values. Footing drains should be provided for the retaining wall, as discussed under the
"Drainage Considerations" section of this report.
9.2 Wall Drainage
It is imperative that proper drainage be provided so that hydrostatic pressures do not develop
against the wall. This would involve installation of a minimum, I-foot-wide, blanket drain for
the full wall height to within 1 foot of final grade using imported washed gravel against the
wall. If drainage mat is used, it should be installed according to the manufacturer's
specifications.
9.3 Passive Resistance and Friction Factor
Lateral loads can be resisted by friction between the foundation and the natural dense
sediments or supporting structural fill soils, or by passive earth pressure acting on the buried
portions of the foundations. The foundations must be backfilled with compacted structural fill

10.0 DRAINAGE CONSIDERATIONS
The near-surface soils appear to contain some silt, and water may tend to perch atop this
stratum. Additionally, traffic across these soils when they are damp or wet will result in
disturbance of the otherwise firm stratum. Therefore, prior to site work and construction, the
contractor should be prepared to provide drainage and sub grade protection, as necessary.
10 .1 Wall/Foundation Drains
All retaining walls should be provided with a drain at the footing elevation. Drains should
consist of rigid, perforated, polyvinyl chloride (PVC) pipe surrounded by washed pea gravel.
The level of the perforations in the pipe should be set down at the bottom of the footing, and
the drains should be constructed with sufficient gradient to allow gravity discharge away from
the wall. All retaining walls should be lined with a minimum, 12-inch-thick, washed gravel
blanket provided to within 1 foot of finish grade, and which ties into the footing drain. Roof
and surface runoff should not discharge into the footing drain system, but should be handled by
a separate, rigid, tightline drain. If drainage mat is used, it should be installed in accordance
with the manufacturer's specifications.
The driveway grades adjacent to the house should be sloped downward away from the structure
to achieve surface drainage. Final exterior grades should promote free and positive drainage
away from the structure at all times. A minimum driveway gradient of I percent should be
provided unless provisions are included for collection and disposal of surface water adjacent to
the structure.
11.0 PROJECT DESIGN AND CONSTRUCTION MONITORING
We are available to provide additional geotechnical consultation as the project design develops
and possibly changes from that upon which this report is based. We recommend that AESI
perform a geotechnical plan review prior to completion of the final design. In this way, our
earthwork and foundation recommendations may be properly interpreted and implemented in
the design.

1. This endorsement shall be effective only if at Date of Policy there is located on the land described in the policy a
one-to-four family residential structure, in which the insured owner resides or intends to reside. For the purpose
of this endorsement the term "residential structure" is defined as the principal dwelling structure located on the
land together with all improvements thereon related to residential use of the property except plantings of any
nature, perimeter fences and perimeter walls, and the term "insured owne(' is defined as any insured named in
Schedule A and, subject to any rights or defenses the Company may have had under the policy and all
endorsements, such insured owne(s heirs, distributees, devisees, survivors, personal representatives or next of
kin.
2. The Company hereby insures the insured owner of the estate or interest described in Schedule A against loss or
damage which the insured owner shall sustain by reason of:
a. the existence at Date of Policy of any statutory lien for labor or materials attaching to the estate or interest
referred to in Schedule A arising out of any work of improvement on the land, in progress or completed
at Date Of Policy, except those liens arising out of a work of improvement for which the insured owner
has agreed to be responsible.
b. the removal of the residential structure or the interference with the use thereof for ordinary residential
purposes as the result of a final court order or judgment, based upon the existence at Date of Policy of:
(1) any encroachment of said residential structure or any part thereof onto adjoining lands, or onto any
easement shown as an exception in Schedule B of said Policy, or onto any unrecorded subsurface
easement;
(2) any violation on the land of enforceable covenants, conditions or restrictions, provided that this
coverage shall not refer to or include the terms, covenants and conditions contained in any lease, sul>-
lease, or contract of sale referred to in the policy;
(3) any violation of applicable zoning ordinances to the extent that such ordinances regulate (a) area,
width or depth of the land as a building site for the residential structure; (b) floor space area of the
residential structure; (c) set back of the residential structure from the property lines of the land; or (d)
height of the residential structure.
c. damage to the residential structure resulting from the exercise of any right to use the surface of the land for
the extraction or development of minerals excepted from the description of the land or shown as a
reservation in Schedule B.
For the purposes of this endorsement, the words "covenants", "conditions" or "restrictions" shall not be deemed to refer to
or include any covenants, conditions or restrictions relating to environmental protection, except to the extent that a notice
of a violation or alleged violation affecting the land has been recorded in the public records at Date of Policy and is not
excepted in Schedule B.
This endorsement is made a part of the policy and is subject to all of the terms and provisions thereof and of any prior
endorsement thereto. Except to the extent expressly stated, it neither modifies any of the terms and provisions of the
policy and any prior endorsements, nor does it extend the effective date of the policy and any prior endorsements, nor
does it increase the face amount thereof.

To be attached and become a part of Policy No. SV3958326/5207013682
The undersigned insuring Company hereby insures that notwithstanding anything therein contained to the contrary, the
attached policy shall be supplemented and amended as follows:
The amount of insurance provided by the Owners Policy of Title Insurance to which this endorsement is attached, as
stated in Schedule A thereof, is subject to cumulative annual upward adjustments in the manner and to the extent
hereinafter specified.
"Adjustment Date" is defined, for purposes of this endorsement, to be 12:01 a.m. on the first January 1 which occurs
more than six months after the Date of Policy of the title insurance policy to which this endorsement is attached, as
shown in Schedule A thereof, and 12:01 a.m. on each January 1 thereafter; provided, however, there shall be no more
than ten adjustments dates on which the amount of insurance provided by such title insurance policy shall be eligible for
upward adjustment.
An upward adjustment will be made on each of the Adjustment Dates, as defined above, by increasing the maximum
amount of insurance provided by said Policy (as said Amount may have been increased theretofore under the terms of
this Endorsement) by the same percentage, if any, by which the United States Department of Commerce Composite
Construction Cost Index (base period 1967) for the month of September immediately preceding exceeds the highest
Index number for the month of September in any previous year which is subsequent to Date of Policy; provided,
however, that the maximum amount of insurance in force shall never exceed 150% of the amount of insurance stated in
Schedule A of said Policy, less the amount of any claim paid under said Policy which, under the terms of the Conditions
and Stipulations, reduces the amount of insurance in force. There shall be no annual adjustment in the amount of
insurance for years in which there is no increase in said Construction Cost Index.
In the settlement of any claim made against the insurer on the title insurance policy to which this endorsement is
attached, the amount of insurance provided by such policy shall be deemed to be the amount which is in force as of the
date on which the claimant first learns of the assertion or possible assertion of such claim or as of the date of receipt by
the Company of the first notice of such claim, whichever shall first occur.
PROVIDED HOWEVER, this endorsement shall be effective only if one of the following conditions exists at Date of
Policy:
(a) The land described in this policy is a parcel on which there is only a one-to-four family residential
structure, including all improvements on the land related to residential use, in which the Insured Owner
resides or intends to reside; or
(b) The land consists of a residential condominium unit, together with the common elements appurtenant
thereto and related to residential use thereof, in which the Insured Owner resides or intends to reside.
This endorsement is made a part of the policy and is subject to the Schedules, Conditions and Stipulations therein,
except as modified by the provisions hereof. Nothing herein contained shall be construed as extending the effective date
of said policy unless otherwise expressly stated.
NOTE: In the event of future reissuance of the aforesaid Owners Policy of Title Insurance, the reissued rate shall be
predicated only on the original amount of insurance and not the adjustment amount.

Hi Pat
I've attached a copy of your Owner's Policy that we insured in 2003.
Since the date of this Policy, our Company has insured a refinance of the
Deed of Trust showing on said Policy. This Deed of Trust is in favor of
Loan City, recorded April 8, 2004. (I'm not allowed to send you that
Policy)
There are no changes in title since the date of this Owner's Polley other
than the refinance.
