anticipated that marijuana producers and processors will be required to be located in a structure
and be permitted in the Industrial Heavy (IH) zone. Marijuana retailers are anticipated to be
permitted in the Commercial Arterial (CA), Center Village (CV), Center Downtown (CD),
Commercial -office -Residential (COR), Urban Center North 1 (UC -N1), and Urban Center North 2

The City of Renton Environmental Review Committee has determined that it does not have a probable significant
adverse impact on the environment, An Environmental Impact Statement (EIS) is not required under RCW
43.21C.030(2)(c). This Determination of Non -Significance is issued under WAC 197-11-340. Because other agencies of
jurisdiction may be involved, the lead agency will not act on this proposal for fourteen (14) days.
Appeals of the environmental determination must be filed in writing on or before 5:00 p.m. on March 21, 2014.

PART ONE: PROJECT DESCRIPTION/ BACKGROUND
In November 2013, Council adopted a moratorium on accepting applications for medical and/or recreational
marijuana business licenses or permits. Since then, staff in conjunction with the Planning Commission has been
engaged in a work program that has helped the City to: develop an understanding of Liquor Control Board rules and
implications of those rules, study potential impacts of the new land uses, evaluate and consider how other
jurisdictions are regulating, and determine how Renton wishes to regulate recreational marijuana businesses. The
process has also allowed the City to adequately provide public participation.
Summary of proposed and considered recreational marijuana changes:
• Permit marijuana producers and processors outright in the Industrial Heavy zone.
o Marijuana processors will be extracting marijuana and that requires the use of solvents and gases
and for producers there is typically an odor that may extend beyond the site. This makes a producer
and processor businesses most similar to an industrial or manufacturing use.
o industrial Heavy is defined as processing using raw materials that have externalities, such as odor
and noise that pose a hazard to public health and safety.
• Require marijuana producers to be indoors.
o Given the incentivized pairing of marijuana producers and processors, with no requirement to pay
25% tax for sales between the two if both licenses are held by one person/entity, it is appropriate to
require marijuana producers to be indoors.
• Consider marijuana retailers to be a similar use to taverns and allow in the same zones taverns are allowed
in.
o Taverns are very comparable to the way in which marijuana retailers will function. Both taverns and
marijuana retailers must hold a license issued by the State. Additionally, people under the age of 21
are not allowed to enter either type of business.
o Not adopt the footnote associated with taverns in the Commercial Arterial (CA) zone for marijuana
retail. The footnote currently does not allow the use within the Northeast Sunset, Northeast Fourth
(4th), and South Puget Drive Commercial Corridor Comprehensive Plan land use designation.
• Additional regulations under consideration by Planning Commission:
o Require marijuana businesses to be located 500 to 1,000 feet away from chemical dependency
centers.
■ Some Commissioners have strong concerns about the potential negative impact marijuana
retailers, especially if located in close proximity to treatment facilities, may have on
members of the public who have drug dependencies.
o Require marijuana businesses to be located 500 to 1,000 feet away from the RC, R-1, R-4, R-8, R-10,
and R-14 zones.
■ An alternative to this is to not allow marijuana retailers to be located on any parcel that
abuts a property zoned RC, R-1, R-4, R-8, or R-10.
■ Many Commissioners wish to protect single family residential neighborhoods from potential
negative impacts of marijuana retailers. While many of the negative impacts are only
anticipated at this point in time, without direct knowledge and experience of what the
negative impacts are, Commissioners wish to mitigate potential impacts by not allowing
marijuana retailers to locate in close proximity to neighborhoods. Some concerns expressed
include: children living next door to a marijuana retailer, frequent and high traffic volumes
in parking areas located near neighborhoods, and noise of customers congregating in and
around store parking areas.

In compliance with RCW 43.21C.240, the following environmental (SEPA) review addresses only those
project impacts that are not adequately addressed under existing development standards and
environmental regulations.
A. Environmental Threshold Recommendation
Based on analysis of probable impacts from the proposal, staff recommends that the Responsible
Officials:
Issue a DNS with a 14 -day Appeal Period.
B. Mitigation Measures
None.
C. Exhibits

D. Environmental Impacts
There are no environmental impacts that are anticipated to occur in conjunction with the proposal.
E. Comments of Reviewing Departments
The proposal will be circulated to City Department Division Reviewers and appropriate agencies. All
substantive comments will be provided to the Responsible Officials for their consideration and possible
recommendation that the comments be incorporated as "Advisory Notes to Applicant."
Environmental Determination Appeal Process: Comments and Appeals of the environmental
determination must be filed in writing on or before 5:00 PM, March 21, 2014.
Renton Municipal Code Section 4-8-110.6 governs appeals to the Hearing Examiner. Appeals must be filed
in writing at the City Clerk's office along with the required fee. Additional information regarding the
appeal process may be obtained from the City Clerk's Office, Renton City Hall - 7th Floor, 1055 S. Grady
Way, Renton WA 98057.

PURPOSE OF CHECKLIST:
The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental
agencies to consider the environmental impacts of a proposal before making decisions. An
Environmental Impact Statement (EIS) must be prepared for all proposals with probable
significant adverse impacts on the quality of the environment. The purpose of this checklist is
to provide information to help you and the agency identify impacts from your proposal (and to
reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide
whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of

Regulations regarding recreational marijuana are being considered. It is anticipated
that marijuana producers and processors will be required to be located in a structure
and be permitted in the Industrial Heavy (1H) zone. Marijuana retailers are anticipated
to be permitted in the Commercial Arterial (CA), Center Village (CV), Center Downtown
(CD), Commercial -Office -Residential (COR), Urban Center North 1 (UC -N1), and Urban
Center North 2 (UC -N2) zones. Consideration is being given to requiring a buffer
between marijuana retailers and single family residential zones and/or chemical
dependency centers.

marijuana retailers.

be required to comply with all city development regulations. However, land uses
located in the industrial Heavy zone are anticipated to have some off-site

3. WATER

amount of shoreline along both Lake Washington and the Cedar River. There are
also wetlands located in many locations throughout the city. All land use

likelihood that this proposal of zoning and establishing regulations for recreational
marijuana businesses will deplete energy or natural resources. The actual uses of
marijuana production and processing, in particular, have been identified as possible uses
that are use a lot of water and energy. The Liquor Control Board's SFPA checklist dated
March 2012 listed anticipated statewide emissions from electricity use for the production
of recreational marijuana. It is assumed that Renton should anticipate a proportionate
share of those emissions depending on how many marijuana producers are located
within the city.
Proposed measures to protect or conserve energy and natural resources are:

4. How would the proposal be likely to use or affect environmentally sensitive areas or
areas designated (or eligible or under study) for governmental protection; such as parks,
wilderness, wild and scenic rivers, threatened or endangered species habitat, historic or
cultural sites, wetlands, flood plains, or prime farmlands? There is no likelihood that this

will affect environmentally sensitive areas. The zones being considered to allow
marijuana businesses are zones that allow for high intensity use and have low likelihood
of being located in close proximity to environmentally sensitive areas. if a marijuana
business were to be proposed to be located in close proximity to environmentally
sensitive area, that would be considered and mitigated for as part of such a proposal.

5. How would the proposal be likely to affect land and shoreline use, including whether it
would allow or encourage land or shoreline uses incompatible with existing plans?
There is no likelihood that this proposal of zoning and establishing regulations for
recreational marijuana businesses will affect land and shoreline use.
Proposed measures to avoid or reduce shoreline and land use impacts are:

6. How would the proposal be likely to increase demands on transportation or public
services and utilities? There is no likelihood that this proposal of zoning and establishing
regulations for recreational marijuana businesses will increase demands on
transportation or public services and utilities. Actual marijuana businesses may cause
an increase in demand on public services, police response in particular. The LCB SFPA
review states that "due to the high monetary value placed upon marijuana" there may
be incidents such as robberies and theft that will impact local low enforcement with
increased calls for service.
Proposed measures to reduce or respond to such demand(s) are: LCB rules work
to create a highly regulated industry with strict requirements for security protocols and
protection. These measures are anticipated to work towards mitigating the number of
calls for service.
7. Identify, if possible, whether the proposal may conflict with local, state, or federal laws
or requirements for the protection of the environment. No conflicts have been
identified.
