APPLICABLE SECTIONS OF THE RENTON MUNICIPAL CODE: 1. Chapter 7 Noise Level Regulations a. Section 8-7-8: Variances and Appeals ' D. FINDINGS OF FACT {FOF): 1. The Planning Division of the City of Renton accepted the above master application for review on April 21, 2016 and determined the application complete on April 21, 2016. The Administrator of Community and Economic Development Department will waive the public comment period of 14 days for this specific variance request. 2. The project site is located at 616 W Perimeter Road 3. The project site is currently developed with asphalt (roadway prism) in the City's right-of-way. 4. Access to the site would be provided via road access and may require a lane closure. 5. The applicant is proposing to begin construction on April 18, 2016 and end on May 3, 2016. 6. Per RMC 8-7-8, the applicant notified the residences living within a 300 ft. radius of water line alignment on April 18, 2016. Any complaints within the Renton city limits shall be summarized and reported to the City's project manager, Vicki Grover, VGrover@rentonwa.gov within 2 days of the complaint. Staff recommends the applicant comply with this requirement as a condition of approval. Variance Analysis: The decision maker, in passing upon an application for a variance, shall consider all technical evaluations, all relevant factors and standards specified in other sections of this Chapter, and in addition thereto shall consider the following, none of which is mandatory for the granting of the variance: Compliance Variance Criteria and Analysis a. That the applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to the applicant's property or project, and that the strict application of this Chapter will deprive the subject property owner or applicant of rights and privileges enjoyed by others. ,/ Sta(( Comment: Boeing is requesting this variance to work at night in order to reduce the duration of construction activities at the site. The project location and the haul routes available from this site result in substantial impacts to traffic on the heavily travelled Rainer Avenue, Airport Way and Logan Avenue N. The project will also adversely affect traffic araund the Airport on W Perimeter Road for the duration of the construction. That the granting of the variance will not be materially detrimental to the public health, welfare or safety, or unduly injurious to the property or improvements in the vicinity of the location for which this variance is sought. Staff Comment: The contractor will schedule work activities to greatly reduce or eliminate activities that generate excessive noise levels such as jack hammering and pile driving activities at night. Boeing and the contractor are heavily invested in this area and it surrounding community. Both having been in the area and conducted work in the area for many years, they both take their commitments of being good stewards of the area very seriously and will actively work to reduce noise impacts from the site whenever possible and will quickly address any noise complaints received from the surrounding residents. c. That the approval is a minimum variance that will accomplish the desired purpose. Staff Comment: Staff believes thot the request is the minimum needed to accomplish the installation of the water line. Boeing and the Airport are allowing the contractor a very short construction schedule for this project and both are committed to finishing all construction activities in as short of duration as possible. d. That the variance contains such conditions deemed to be necessary to limit the impact of the variance on the residence or property owners impacted by the variance. The variance approval may be subject to conditions including, but not limited to, the following: a. Implementation of a noise monitoring program; b. Maximum noise levels; c. limitation on types of equipment and use of particular equipment; d. limitation on back-up beepers for equipment; e. Required use of noise shields or barriers; f. Restrictions to specific times and days; g. Specific requirements for documentation of compliance with the noise variance conditions; h. Specific requirements for notification to nearby residents; i. Required cash security to pay for inspection services to verify compliance; j. Required access to the project by the City to verify compliance with the noise variance conditions; k. Specific program to allow for temporary hotel vouchers to effected residents; I. Requirements for written verification that all workers understand the noise variance conditions for the project; and m. Stott Comment: Staff believes that the request is the minimum needed to accomplish the installation of the water main. e. The importance of the services provided by the facility creating the noise and the other impacts caused to the public safety, health and welfare balanced against the harm to be ,/ suffered by residents or property owners receiving the increased noise permitted under this variance. Stat[ Comment: Staff believes that the request will reduce the duration of the construction activity noise the residents are subjected to for this project. f. The availability of practicable alternative locations or methods for the proposed use which ,/ will generate the noise. Sta[[ Comment: Staff believes that there are not any practicable alternate locations far this project. g. The extent by which the prescribed noise limitations will be exceeded by the variance and the extent and duration of the variance. ,/ Staff Comment: Staff believes that the request is the minimum needed to accomplish installation of the water main. I f. CONCLUSIONS 1. The subject site is located along W Perimeter Road on the Renton Airport property and the water installation will be within the roadway prism. 2. The requested variance meets the seven criteria to be considered in making a decision on a variance request as specified in RMC 8-7-8 if all conditions of approval are met. The analysis of the proposal according to variance criteria is found in the body of the Staff Report. II F. DECISION: The Apron C 737 ClMAX Stalls Noise Variance Noise Variance, File No. LUA16-000300, as depicted in Exhibit 1, is approved and is subject to the following conditions: 1. The project owner is Boeing Commercial Airplanes, Seattle District, and the project location is the City of Renton -Renton Municipal Airport. Boeing has leased property from Renton Airport, namely properties 760, 770 and 820, and Boeing will make required infrastructure improvements to support the increased production rates required for the Boeing MAX Cl Program (737 production) . The site is located midfield on the west side of Runway 15/33, between the taxiway and the west perimeter road. The area is largely flat impervious pavement used for aircraft parking. There are tie- downs for general aviation parking, as well as hard stands for larger aircraft. The site is fenced from public access with public parking along the west perimeter road. Since the property is located on the airfield, planning use is largely designated in the Airport Master Plan. The Master Plan is dated 1997 and is currently being updated. The new master plan will be reviewed and approved by various local, regional, state and federal agencies to permit long range programming. The proposed upgrades to the parking area are in concurrence with the designations of the current and future master plans. The area has concrete and asphalt pavement, and associated parking, fencing and airport security features. Aircraft tie downs are available to secure the GA aircraft at their parking positions. Adjacent buildings are used for aircraft support, manufacturing, engine repair and other aviation support functions such as training and maintenance. Soil Type and Drainage Conditions Soil conditions for the site indicate several feet of fill, probably a compact mixture of sand and gravel (pitrun fill). The fill is underlain by alluvial soils 5 to 15 feet thick of fine to medium sand below fill. The material varies from soft to medium dense to a depth of 40 feet. Groundwater depths are expected to be 3-5 feet below predeveloped ground surface, and will fluctuate with the season and precipitation. Footing subgrades will be designed and prepared in accordance with the geotechnical report recommendations. If loose or unstable soils are encountered during construction the subgrade will be over-excavated as required by the geotechnical engineers. Footings will be extended at least 1su below the adjacent finished grade to provide freeze protection. Stormwater upgrades will use City of Renton or Boeing details as applicable. The storm system will capture pavement flows and route the runoff to oil water separator(s) and storm filter vaults as required to meet discharge criteria. Stormwater discharge Infrastructure will be provided at both the north and south leased parcels. The south parcel will require a lift station that will discharge to a box culvert located in the west perimeter road. The fuel will be directed to a 10,000 gallon fuel containment vaults. The flow will be directed to the vault using an emergency button accessible at the apron. Proposed Use of the Property and Scope of the Proposed Development The site will be upgraded with infrastructure improvements to support the parking of seven (7) Boeing 737 aircraft. Improvements include pavement repair and replacement, aircraft parking support infrastructure including water, fire protection, electrical and storm water drainage improvements; and office and support structures including (11) modular type buildings for office type functions, and (7) tool rooms. Office square footage (combined total) is nominally 8500 SF at the south parcel and 720 SF at the north parcel. The existing building 5-427 will be upgraded with tenant improvements . Access Access to the site will be via three driveways along West Perimeter Road. Proposed Off-site improvements Offsite improvements are limited to a new sidewalk on the west side of the perimeter road; the sidewalk will connect the two leased parcels, allowing north-south pedestrian access along the west side of the perimeter road. Building plumbing will tie into existing sanitary sewer. Water will tie in to existing water service mains, no offsite upgrades ar! required to water sewer infrastructure. A sanitary sewer lift station will be required on-site to provide required lift to the gravity flow connect location. Total Estimated construction Cost Estimated construction cost is approximately $18 million. Proposed Modifications The project is requesting a variance to the City of Renton standard work hours for this project to allow for the contractor to perform construction activities at night. The contractor is requesting the ability to perfonn construction activities during a second shift which would be performed between 10 pm and 7 am Monday through~-This variance requests the ability to work up to 2 consecutive nights throughout the duration of the scheduled construction activities. Distance in feet from Wetlands or Streams (if within 100 feet from stream/wetland) The project is not located within 100 feet of a stream or wetland. Variance Request Justification Detailed below is the justification requirements provided by the City of Renton along with our explanation as to why this project should receive a variance and the measures that the project will take to mitigate any adverse effects that may be encountered by the adjacent property owners. • The applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, and location or surroundings of the subject property, and the strict application of the Zoning Code ls found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification; o Boeing is requesting this variance to work at night in order to reduce the duration of construction activities at the site. The project location and the haul routes available from this site will result in substantial impacts to traffic on the heavily traveled Rainier Ave, Airport Way and Logan Ave rJ. The project will also adversely affect traffic around the Airport on Perimeter Rd for th'e duration of construction. The only tool that the ~ • • contractor has to reduce the duration of these activities and impacts to the surrounding business and commuter traffic is to work at night there by allowing the contractor to greatly reduce the duration of construction activities The contractor on this project willprovide a safe and efficient movement of people, goods, and services through and around the project, while minimizing negative impacts to residents, commuters, and businesses. Working at night is the best way to minimize negative effects as a result of construction which will only exacerbate the existing traffic conditions mentioned above. • The granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated; o The project is located within the Renton Municipal Airport property zoned IM Industrial -Medium. The area directly surrounding the project consists of general aviation airport use and both W Perimeter RD and Rainier Ave N. The airport being zoned IM and not containing residential ar aµa, t111es:1t ,e,.,,ilewcs ;;cold not be negatively impacted by ~-The closest residences to the project site are approximately 250 feet away, sound levels decrease as the distance from the source increases. ~B noise level 1 produced by a dump truck measured at 30' away (the approximate middle of W Perimeter Rd) would be reduced to adB measured at the closest residence to the construction site. This represents an 18 dB drop in any construction noise generated from the project site prior to reaching the closest adjacent residence. For reference 70 dB represents a busy roadway or vacuum cleaner, 60 dB represents a typical conversation or dishwasher. The cont,ractor will schedule work activities to greatly reduce or eliminate activities that generate excessive noise levels such ~s jack hamm~ri~_g.or pile driving activities at night. Boeing and the contractor are both heavily invested in this area and its surround community both having been in the area and done work in the area for many years they both take their commitments to being good stewards of the area very seriously and will actively work to reduce wherever possible noise impacts from the site and will quickly address any noise complaints received from surrounding residents. • The approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated; and o Within the construction industry night work is considered a standard industry practice to reduce the duration and impact of construction activities. The City of Renton has in the past approved the same requests for other airport projects and it is our understanding that they have also approved similar requests for surrounding roadway projects as well as individual commercial and residential construction projects. 1 '? All rights r•seM!d • City of Renton Noise Variance Project Narrative Apron C Cl Project Project Name. Size. and Location • The project is the 737 Max Flightline Utilities -Apron C Cl Project. The project owner is Boeing Commercial Airplanes, Seattle District, and the project location is the City of Renton -Renton Municipal / Airport. Boeing has leased property from Renton Airport, namely properties 760, 770 and 820, and Boeing will make required infrastructure improvements to support the increased production rates required for the Boeing MAX Cl Program (737 production). The site is located midfield on the west side of Runway 15/33, between the taxiway and the west perimeter road. The area is largely flat impervious pavement used for aircraft parking. There are tie- downs for general aviation parking, as well as hard stands for larger aircraft. The site is fenced from public access with public parking along the west perimeter road. Since the property is located on the airfield, planning use is largely designated in the Airport Master Plan. The Master Plan is dated 1997 and is currently being updated. The new master plan will be reviewed and approved by various local, regional, state and federal agencies to permit long range programming. The proposed upgrades to the parking area are in concurrence with the designations of the current and future master plans. Construction activities associated with this project are scheduled to start April 18, 2016 to May 3, 2016. Zoning Designation of Site and Adjacent Properties The zoning designation for the property per the Renton Zoning Code is Medium Industrial (IM), with Comprehensive Plan Designation as Urban Center-North 2 (UC-N2). Current Use of Site and Existing Improvements The current use of the site is for general aviation parking. The area has concrete and asphalt pavement, and associated parking, fencing and airport security features. Aircraft tie downs are available to secure the GA aircraft at their parking positions. Adjacent buildings are used for aircraft support, manufacturing, engine repair and other aviation support functions such as training and maintenance. The site has existing infrastructure improvements including sewer, water, electrical and storm available for tie-in. Figure (1) -Existing Site Aerial -Renton Airport West of R/W 15/33 Special Site Features (Wetlands, Water Bodies, Steep Slopes) None known . Soll Type and Drainage Conditions Soil conditions for the site indicate several feet of fill, probably a compact mixture of sand and gravel (pitrun fill). The fill ls underlain by alluvial soils 5 to 15 feet thick of fine to medium sand below fill. The material varies from soft to medium dense to a depth of 40 feet. Groundwater depths are expected to be 3-5 feet below predeveloped ground surface, and will fluctuate with the season and precipitation . Footing subgrades will be de signed and prepared in accordance with the geotechnicai report recommendations. If loose or un stable soils are encountered during construction the subgrade will be over-excavated as required by the geotechnical engineers. Footings will be extended at least 18" below the adjacent finished grade to provide freeze protection . Stormwater upgrades will u se City of Renton or Boeing details as applicable. The storm system will capture pavement flows and route the runoff to oil water separator(s) and storm filter vaults as required to meet discharge criteria. Stormwater discharge infrastructure will be provided at both the north and south leased parcels . The south parcel will require a lift station that will discharge to a box culvert located in the west perimeter road. A drainage report is included with this application and contains additional required details related to the storm water conveyance system . • • In addition to stormwater features, the apron aircraft parking positions that will park fueled aircraft will have trench grates to collect a fuel spill should it occur. The fuel will be directed to a 10,000 gallon fuel containment vaults. The flow will be directed to the vault using an emergency button accessible at the apron. Proposed Use of the Property and Scope of the Proposed Development The site will be upgraded with infrastructure improvements to support the parking of seven (7) Boeing 737 aircraft. Improvements include pavement repair and replacement, aircraft parking support infrastructure including water, fire protection, electrical and storm water drainage improvements; and office and support structures including (11) modular type buildings for office type functions, and (7) tool rooms. Office square footage (combined total) is nominally 8500 SF at the south parcel and 720 SF at the north parcel. The existing building 5-427 will be upgraded with tenant improvements. Access to the site will be via three driveways along West Perimeter Road. Proposed Off-site Improvements Offsite improvements are limited to a new sidewalk on the west side of the perimeter road; the sidewalk will connect the two leased parcels, allowing north-south pedestrian access along the west side of the perimeter road. Building plumbing will tie into existing sanitary sewer. Water will tie in to existing water service mains, no offsite upgrades are required to water sewer infrastructure. A sanitary sewer lift station will be required on-site to provide required lift to the gravity flow connect location. Total Estimated Construction Cost Estimated construction cost is approximately $18 million. Estimated Quantities of FIii and Excavation Excavation • Utilities= 5,000 CY • New Pavement (including pavement removal)= 7,000 CY Fill • Utility Backfill= 5,000 CY • Aggregate Base = 6,000 CY • Asphalt Pavement= 2,500 Tons • Concrete Pavement= 1,900 CY Trees to be removed A few trees may be required to be removed during the installation of the sidewalk along the west side of the perimeter road. Proposed Job Shacks, Sales Trailers, and Model Homes A job shack may be provided on site during construction. Proposed Modifications • The project is requesting a variance to the City of Renton standard work hours for this project to allow for the contractor to perform construction activities at night. The contractor is requesting the ability to perform construction activities during a second shift which would be performed between 10 pm and 7 ' am Monday through Friday and Saturday upon City of Renton approval. This variance requests the ability to work up to 2 consecutive nights throughout the duration of the scheduled construction activities. April 18, 2016 -May 3, 2016. Distance in feet from Wetlands or Streams Hf within 100 feet from stream/wetland) The project is not located within 100 feet of a stream or wetland. Variance Request Justification Detailed below is the justification requirements provided by the City of Renton along with our explanation as to why this project should receive a variance and the measures that the project will take to mitigate any adverse effects that may be encountered by the adjacent property owners. • The applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, and location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification; o Boeing is requesting this variance to work at night in order to reduce the duration of construction activities at the site. The project location and the haul routes available from this site will result in substantial impacts to traffic on the heavily traveled Rainier Ave, Airport Way and Logan Ave N. The project will also adversely affect traffic around Item# 1 2 3 4 5 • • the Airport on Perimeter Rd for the duration of construction. The only tool that the contractor has to reduce the duration of these activities and impacts to the surrounding business and commuter traffic is to work at night there by allowing the contractor to greatly reduce the duration of construction activities The contractor on this project will provide a safe and efficient movement of people, goods, and services through and around the project, while minimizing negative impacts to residents, commuters, and businesses. Working at night is the best way to minimize negative effects as a result of construction which will only exacerbate the existing traffic conditions mentioned above. • The granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated; o The contractor will schedule work activities to greatly reduce or eliminate activities that generate excessive noise levels such as jack hammering or pile driving activities at night. Boeing and the contractor are both heavily invested in this area and its surrounding community. Both having been in the area and done work in the area for many years they both take their commitments to being good stewards of the area very seriously and will actively work to reduce noise impacts from the site wherever possible and will quickly address any noise complaints received from surrounding residents. Please see the table below that outlines some equipment with potential to produce excessive noise and the mitigation measure that will be taken if excessive noise is reported. The City of Renton has in the past approved the same requests for other airport projects and it is our understanding that they have also approved similar requests for surrounding roadway projects as well as individual commercial and residential construction projects. • The approval is the minimum variance that will accomplish the desired purpose. o Boeing is allowing the contractor a very short construction schedule for this project the contractor and Boeing are committed to finishing all construction activities in as short of a duration as possible. The number of working days requested by this variance represents the minimum needed to complete the work elements required. While night work is an industry standard practice it is costly for Boeing and the contractor to that end the contractor will continue to evaluate the need for night work as the construction of this project progresses, if possible the number of nights work will be reduced when possible. We are formally requesting the ability to perform construction activities for this project outside of the normal hours of work allowed by the City of Renton for 2 nights or less based on the justification provided within this variance request. Any issues/complaints that arise during this time will be reported to the City of Renton along with the action taken to remedy the situation.
