This letter is to inform you that the appeal period ended September 12, 2013 for the
. above referenced Additional Animals Permit approval. No appeals were filed, therefore,
this decision is final.
The applicant shall adhere to the following conditions of approval for the duration of the
approved Additional Animals Permit:
• Condition #1: the applicant shall maintain the raised bed planters next to the sou.th
property line fence as, well as the interior fence located 15 feet northerly of the
south. property line fence.
• Condition #2: This additional animals permit shall .remain valid for o.ne year and
shall expire on August 29, 2014 unless nuisance complaints about the additionaJ
animals have been received and investigated prior to that date: should such
nuisance complaints prove to. be justified, this additional animals· permit may be
revoked as permitted by RMC 4-9-lOOJ.1. If no.valid nuisance complaints have been.
received prior to the expiration date of this permit, the applicant may apply for

Dear Ms. Brenner:
This correspondence is in response to your letter dated July 25, 2013 requesting
reconsideration of the denial of your Additional Animals Permit application which was
issued on July 5, 2013.
That denial was based on. objections from neighboring property owners who live in the
house abutting your property to the south. In your request for reconsideration,you
have provided evidence in the form of photographs a.nd a verbal description which
· shows that a good faith effort is beingmade to keep your dogs a reasonable. distance
away from the fence which separates you from your neighbors.to the south. This
separation inclu.des raised bed planters located near the south property line fence with ·
an interior fence 15 feet to the north of the existing side yard fence. This interi.or fence
is designed to keep your dogs away from the raised bed planters and your neighbors'·
property. Additionally, the abutting neighbors to the south of your property submitted
a letter on August 22, 2013 which states that the excessive barking experienced
previously has improved.·
Because ofthe information described above, your request for reconsideration is granted
and LUA13°000308, Brenner Coppock Additional Animals Permit, is approved with·
conditions. This approval is reflected in the enclose.d Additional.Animals Permit. Please
note that the approved additional animals permit expires cm August 29, 2014.
Appeals of this reconsideration decision must be filed in writing on or before 5:00 p.m.

Dear Ms. Brenner:
The City of Renton Planning Division approved the above referenced permit on August 29,
2013, subject to the following conditions:
1. The applicant shall maintain the raised bed planters next to the south property line
fence as well as the interior fence located 15 feet northerly of the south
property line fence.
2. This additional animals permit shall remain valid for one year and shaU expire on
August 29, 2014 unless nuisance complaints about the additional animals have
been received and investigated prior to.that date; should such nuisance
complaints prove to be justified, this additional animals permit may be revoked
as permitted by RMC 4-9-lOOJ.1. If no valid nuisance complaints have been
received prior to the expiration date of this permit, the applicant may apply for
another additional animals permit to continue to keep the additional animals at
the subject premises.
This approval was valid for one (1) year. Our records indicate that the additional animals
permit will expire on August 29, 2014. Based on city record, no nuisance complaints have
been received since issuance of the additional animals permit, approved on August 29,
2013. This letter is to inform you that you will need to apply for another additional animals
permit to continue to keep the additional animals at the subject premises.

The applicant is requesting the approval of an Additional Animals
Permit to permit the keeping of five dogs where three household pets
are allowed (RMC 4-4-0lOG.1). The dogs include: one German
Shepherd mix, one Dachshund, one Cocker Spaniel, one Chihuahua, and
one Chihuahua/Terrier mix. The dogs would be kept in the existing
1,200 square house, the 3,500 square foot back yard, and the 240
square foot covered porch at the rear of the house on a 7,754 square
foot parcel. The property is a corner lot in the Residential -8 dwelling
units per acre (R-8) zone.
A denial of the additional animals permit request was issued on July 5,
2013; the denial was based on a letter from abutting property owners
to the south describing excessive barking at the fence separating the
two properties. The applicant, subsequently, requested
reconsideration of the denial. In order to substantiate the
reconsideration request, the applicant provided evidence that a good
faith effort is being made to keep the dogs a reasonable distance away
from the existing common property line fence which separates the two
properties. Such effort includes the installation of raised bed planters
located next to the common property line fence with an interior fence
15 feet to the north of the existing fence. The interior fence is
designed to keep the applicant's dogs away from the common property
line fence and out of the raised bed planters.
On August 22, 2013, the abutting neighbors to the south submitted a

letter which states that the excessive barking at the subject site has
improved due to the efforts of the applicant. Those neighbors
suggested conditions of approval including specifying a period of
permit validity.
DECISION CRITERIA:
The Planning Division Director shall review requests for Additional Animals Permits for compatiblity of
the proposal with the surounding neighborhood. In order to determine that the site and facility will be
adequate and to ensure the humane and appropriate care of the animals, the Planning Division
Director may require that the property be inspected by an Animal Control Officer. Factors to be
considered in determining compatiblity and adequacy are:
NO 1. Will the keeping of additional animals have an adverse effect on abutting or adjacent
properties or cause a detriment to the community?
Comments: A letter in opposition from the abutting property owners to the south to
issuing an additional animals permit was received; based on that letter the permit was
denied on July 5, 2013. Those neighbors stated that excessive barking was emanating
from the subject property.
Subsequently, the applicant requested reconsideration of the denial. Information was
submitted which indicates the applicant's efforts at limiting their dogs access to the
fence on the common property line with the abutting neighbors to the south. Such
efforts include raised bed planters adjacent to the side yard fence with an interior yard
fence 15 feet northerly of the common property line which is intended to keep dogs
away from the property line fence and out ofthe raised bed planters.
In their letter of August 22, 2013, the abutting neighbors to the south of the subject
property acknowledge that excessive dog barking has improved as a result of measures
taken by the applicant.
NO 2. Is there a past history of animal control complaints regarding animals kept by the
applicant?
Comments: City of Renton Animal Control has indicated that there is no past history of
any complaints. However, there was a warning issued for no dog license on March 14,
2013.
YES 3. Do adequate and appropriate facility and rear yard specifications/dimensions exist that
ensure the health and safety of the animals?
Comments: City of Renton Animal Control has indicated that adequate ventilation, food
storage, and waste management are present at the subject site after conducting an
inspection on May 13, 2013.
YES 4. Are the animals' sizes, types, and characteristics of breed compatible with the adequacy
of the site and facilities?
YES 5. Is the animal waste product managed in a safe, clean and odor-free manner?

Comments: City of Renton Animal Control has indicated that adequate ventilation, food
storage, and waste management are present at the subject site after conducting an
inspection on May 13, 2013.
YES 6. Is the request for additional animals compatible with the zoning classification of the
premises on which the keeping of additional animals is to occur?
N/A 7. Keeping of Additional Large Lot Animals Requirements: If the application is for keeping
of additional large lot animals does the applicant provide a copy of the adopted farm
management plan based on the King County Conservation District's Farm Conservation
and Practice Standards?
N/A 8. Keeping of Additional Large Lot Animals Requirements: Is there adequate pasturage to
support a greater number of animals?

all foster animals which states that the animals are foster animals from a sponsoring

Comments: An existing 6-foot high fence surrounds the rear yard area and is locatd on
the property line.
As part of a reconsideration request, the applicant has submitted information which
indicates that raised bed planters have been installed next to the common property line
fence and that an additional interior yard fence has been installed 15 feet northerly of
the south property line. This interior yard fence keeps the applicant's dogs away from
the common property line fence and out of the raised bed planters.
In their letter dated August 22, 2013, the abutting neighbors to the south have
acknowledged that the raised bed planters and interior yard fence installed by the
applicant have improved the excessive barking of the applicant's dogs.
N/A 12. Is the subject lot larger than one (1) gross acre in size? If so, are dog-runs, open run
areas and permanent/temporary kennel structures surrounded by a fence of adequate
height, may be located closer than ten (10) feet from any property line and if the
dog-run, open run areas and kennel structure is no closer than one hundred (100) feet t<
any dwelling unit and the location is approved by the Planning Division.
YES 13. Are all animals kept in such a manner so as not to create any objectionable noise, odor,
annoyance, or become a public nuisance?

Comments: City of Renton Animal Control has indicated that adequate ventilation, food
storage, and waste management are present at the subject site after conducting an
inspection on May 13, 2013.
CONCLUSION: Staff recommends that the Brenner Coppock Additional Animals Permit,
LUA13-000308, AAP, be approved with conditions. Su.ch conditions
shall include the maintenance of the raised bed planters and interior
yard fence, described earlier in this document, on the subject premises;
and that the permit shall be valid for a period of one year.
DECISION:
*CONDITIONS OF APPROVAL:
The Brenner Coppock Additional Animals Permit, LUA13-000308 is
approved with conditions*.
1. The applicant shall maintain the raised bed planters next to the south property line fence as well
as the interior fence located 15 feet northerly of the south property line fence.
2. This additional animals permit shall remain valid for one year and shall expire on August 29, 2014

September 12, 2013, together with the required fee with: Hearing Examiner, City of Renton, 1055
South Grady Way, Renton, WA 98057. Appeals to the Examiner are governed by RMC 4-8-110 and
more information regarding the appeal process may be obtained from the Renton City Clerk's Office,
Reconsideration: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not
readily discoverable prior to the original decision is found or if he finds there was misrepresentation
of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to
amend the original decision, there will be no further extension of the appeal 'period. Any person
wishing to take further action must file a formal appeal within the 14-day appeal time frame.

Dear Mr. Wasser,
It is our understanding that the above permit has come up for "Reconsideration" and is
again being examined for approval. In May, we wrote a letter opposing the approval of
this Additional Animals Permit and received notification that the permit had been
denied. This was the last we heard of this application until today, when we were
informed of the Reconsideration through informal channels. As a party of record, we
should have been officially notified that the application was going through
Reconsideration and given the chance to respond to the Reconsideration request. We
believe this is procedural defect and that notice of the Reconsideration request should
be provided to all parties of record before a decision is made.
After reading Ms. Brenner's letter for reconsideration we have the following response.
The information characterizing our behavior in our home is mostly accurate. We allow
our children to play along our street and in our backyard. Many neighbors, including our
family, enjoy walking on the sidewalk that abuts their yard. We rely on our backyard to
house our dog much of the time when we are not home. These are normal things that
people do, normal things that we have done, during the eight years that we have lived
at this property. We have the right to do these things and to enjoy our property. The
problem here should not be framed as what people do to provoke their animals, but
whether or not animals so easily provoked should be allowed to be kept in greater
numbers than allowed by code. We should not have our lives examined because we are
not creating a nuisance, nor do we need to ask for any type of special permission in
order to allow our lifestyle.
We do not expect to never hear noise from our neighbors, nor do we expect that they
will never hear noise from us. We do not expect that their animals will never bark. Our
dog does sometimes whine, scratch, and bark. However, as we stated before, the entire
time we have lived there, the occupants of that house have had dogs. The neighbors
behind us have dogs. Never have we encountered the persistence of the problem of
dogs barking across the fence, nor have we encountered the neighbors who were so
reluctant to do anything about it. This problem has been uniquely created by the
neighbors applying for this permit.

It unfortunate that we had to write a letter to the City, in response to this permit, for
our neighbors to do anything in about the problem with their animals. This concerns us
in light of a potential Reconsideration. In the last month, the problem of their dogs
making noise has eased considerably. We could hear that they were constructing
something in their yard and did not know it was a fence. It is likely that their garden
fence and their increased attention to curbing their animals have improved the problem
significantly. As a result, we have been able to enjoy our back yard more often and the
situation has been much improved. However, if approved, this Additional Animals
permit would be in place for as long as these neighbors live at this property. This
blanket approval removes the incentive or any guarantee that the situation will
continue to remain improved.
As a result, we would ask that if you are inclined to approve the Additional Animals
Permit upon reconsideration that you consider the following conditions:
• Approve the permit on a temporary basis, with a re-examination at some point
in the future, perhaps the one-year mark. Provide notice to parties of record
that the permit is coming up for renewal so they are able to comment on how
extension of the permit may affect their interests.
• Require the existing garden fence, or other similar barrier, to prevent their
animals from pacing the fence, as we believe this is the major cause of
interaction between their animals and ours. (We also have installed a temporary
fence on our side of the fence line, which keeps our dog and children about one
to two feet from the fence itself).
We would like to find a way to live peacefully next to our neighbors. We would like to
find a way for them to keep their pets that they care so much about. The above
conditions would help us to discover whether or not this can be done while still
preserving our ability to enjoy our property. Thank you for your time and consideration.

Dear Mr. Wasser:
This correspondence is in regards to the above referenced permit application, specifically
asking for reconsideration of the decision made July 5, 2013, denying the permit. Our family
has lived in this community since 1963 and have never had a complaint lodged against us or
our animals.
We were quite surprised by the letter from the Conkling's in response to this application.
When my natural curiosity would lead me to wonder who had made the original complaint I
would always comment that it couldn't be them who complained because their dog, Gomez, is
as bad as any of ours when it comes to barking at the fence. I am often "greeted" by Gomez
when using the gate to the backyard or taking my garbage/recycling out (these are both in-
between us and the Conkling's.) Gomez is often the instigator of the barking that goes on
between our dogs at the fence. Every Sunday, we have to listen to Gomez when he is left out
after the family leaves for a good portion of the day. He is not napping in his favorite sunny
spot, he is whining or barking at their slider or our fence. We would never have ignored them
coming to the door or avoided talking to them about the dogs; we could not have imagined the
effect the dogs occasionally barking at each other was having on them (as described in the
letter.) We saw them continue to use their backyard, often camping, hanging clothes on the
line, gardening or the kids playing. Just the other morning I threw their bat back over the
fence. When there is noise across the fence and we are using our backyard too, the dogs may
bark initially, but are quick to redirect with the command, "leave it." I use this same command
on Gomez when he is barking at me at the gate using my normal speaking voice, never
screaming. What we have noticed is the kids play out front to ride their bikes and scooters,
frequently using the sidewalk that is in front of our house and on the north side of the property,
this makes the dogs bark, but again just redirecting them ends it. I would never allow
occasional barking to keep me from enjoying the beautiful backyard we have and I still find it
hard to believe the Conkley's felt so strongly they lost the joy of using their backyard and yet
couldn't find an opportunity to talk to us directly. The Renton Animal Control inspector
reports we are responsible pet owners, having our dog licensed and following proper
procedures for food and waste storage and disposal and we keep our dogs up to date on
vaccinations and pest control. In any case, the Conkley's agree the dogs are well cared for, and
said we do stop the barking, the actual time barking is short in duration, and the dogs are never
just barking endlessly.
This is the history: My elderly father and I moved into the rental house in January 2012; we
had four dogs between us. It was cold at this time of year, but there was occasional barking at
the fence between one or more of our four dogs and the Conkley's dog. My father passed away
unexpectedly in March of that year leaving me in a position of having to move or find a
roommate. My brother who lived just down 126th moved in with me at that point and he has a
German shepherd. The landlord is fine with the number of dogs we have and apparently it was
acceptable to the city as all dogs were registered at this address. The fact that the Conkling's
didn't realize we had four dogs when we moved in could perhaps be due to it being winter time,
however, it was at this time their eight year old talked to me and relayed back his eight year old
interpretation of my response to his request we introduce the dogs. Since then, I've knocked
on the Conkley's door to inform them of a situation that had occurred between our houses
(unrelated to the dogs) and have occasionally had the opportunity to say hello in the driveways
and at no point did they request we converse about the dogs.
The German shepherd does like to bark at passing trucks, and the terrier/Chihuahua mix likes
to bark at squirrels (she sits on the deck,) but that is on the north side of the yard boarding
167'1' and for a short duration; the German shepherd rarely barks at the Conkling's fence. The
original four dogs have experienced a lot of transition over the past two years between moving
around and/or losing their masters. I've only seen improvement with time as they adjust to
their new surroundings and getting to know each other, with new and unique personalities
emerging.
As the Conkley's mentioned, there was a beagle (my daughters) that was here some of the time
because of a situation she was in. We recognized that their beagle and "our" beagle would
never be best buddies and were extra diligent in making sure the dogs were not barking at the
fence. That family beagle has not spent time here for some time and I'm sure that has been
noted by the Conkley's as a big improvement. It's really pretty even among the original four
dogs of ours who responds to the perceived threat at the fence that is innocent little Gomez.
The dachshund and Gomez seem to have a special interest in each other with one or both of the
Chihuahua's most likely standing back yelping a bit. The cocker spaniel, fortunately, only
occasionally gets in on it as she is the one harder to redirect. And again, the German shepherd
rarely barks at the fence and is never outside when we are not home.
As I said, we continue to work on curbing the barking and always respond quickly to stopping
it. In addition, we built raised garden beds on the south side of the backyard and are fencing
15' feet from the existing fence to keep the dogs out of the garden area (and away from the
fence between us and the Conkley's.) I've enclosed a photo of the new fence, which shows the
Conkley's house in the background.
We would hope through reconsideration to be given the chance to continue working to curb the
barking and see what improvement comes from having the new garden fence keeping the dogs
away from the south end of the backyard.

Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on Monday, July 29,
2013, together with the required fee with: Hearing Examiner, City of Renton, 1055 South Grady Way,
Renton, WA 98057. Appeals to the Examiner are governed by RMC 4-8-110 and more information
regarding the appeal process may be obtained from the Renton City Clerk's Office, 425-430-6510.
Reconsideration: Within 14 days ofthe decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not
readily discoverable prior to the original decision is found or if he finds there was misrepresentation
of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to
amend the original decision, there will be no further extension of the appeal period. Any person
wishing to take further action must file a formal appeal within the 14-day appeal time frame.
Expiration: An Additional Animals Permit shall be valid as long as the keeping of animals has not
been discontinued for more than one year, the operator is in compliance with the City requirements

Dear Mr. Wasser:
Thank you for the opportunity to comment on the Brenner Coppock Additional Animals
Pennit application. We live at 16710 126th Ave SE and are the next door neighbors to
this property. We share a side fence where our back yards abut. They should not be
allowed to keep additional animals on this lot.
We have lived at our address for more than seven years, and during that time the property
requesting the permit has been a rental. In the time that we have lived there, there have
almost always been one or two dogs who resided there. We have also had one or two
dogs during the time we have lived at this location. Prior to the current occupants of the
house moving in in 2012, there was never any issue between dogs or people between our
property and the one next door.
In early 2012 the house was rented to a very old man and a woman who appeared to be
his caregiver. They may have kept pets, but it was not noticeable to us next door. At
some point the man passed away, and at least one other person moved in, which is when
we began to notice that they had a lot of dogs on their property. This was a little over a
year ago in spring 2012.
They have all of the dogs listed on the additional animals permit, plus they regularly keep
a beagle or beagle-mix dog on the property, which can be there up to half the time, and
has been in their care for at least a short time since the date of the application for the
pennit. Our issue with these dogs is that whenever we use our backyard they will bark at
us. It doesn't matter if we are gardening, having a barbeque, our kids are playing, or our
dog is napping in his favorite sunny spot. .. at least one of their dogs will be barking.
Typically it is the German Shepard or one of the Chihuahua dogs, and definitely the
Beagle when it is there. The occupants of the house will usually call their dogs inside
after they spend several minutes at our fence barking.
Like the property in question, we have a large, fenced back yard. It is one of the nicest
features of our property and one of the reasons why we chose to buy this house. Our big,
fenced backyard is supposed to be a safe place for our three children to play, a nice space
for our dog to run, a place to grow a small garden, and a space to entertain guests during
nice weather. Until 2012, we regularly enjoyed those features of our property. In the last
year, our kids no longer want to play in the backyard because of the dogs barking on the
other side of the fence. We are reluctant to invite friends over, eat outside in nice
weather, or spend time gardening because of the dogs barking on the other side of the
fence. Our neighbors' pets should not be determining how we are able to enjoy our
property.
For whatever reason, the occupants of the house avoid contact with us. We have tried
knocking on their door to talk to them when it is clear they are home, but they do not
answer the door. With past residents of the house, we made a point of introducing
ourselves to each other and our dogs, which ended any barking between the properties
that occurred when new people and dogs moved in there. Our eight year old son did
manage to talk to one of the occupants last summer, when he was out riding his bike. He
asked if we could meet their dogs, to see if they would stop barking at us. The woman
replied, "No, we have too many dogs for you to meet."
We hoped that this would be a problem that would be solved with time, and we have tried
to be patient, but we ultimately talked with Donna Locher in Code Compliance to ask
about what we could do. While the dogs next door do seem well cared for, and there
probably is adequate space for them, it doesn't make sense that they would be allowed an
Additional Animals Permit when they cannot curb their animals barking. Our property is
impacted, as is our enjoyment of our home. Our property is uniquely impacted because
of the two abutting properties to their backyard, ours is the only one with useable outdoor
yard space. We have lived here for several years, with different neighbors and different
dogs at the same property, and never had a problem before.
Please consider the on-going consequences of approving this Additional Animals Permit
on our family and deny it. Please include us as an interested parties, so we may be
notified when decisions are made on this application.

Dear Mr. Wasser:
Thank you for the opportunity to comment on the Brenner Coppock Additional Animals
Permit application. We live at 16710 126 1h Ave SE and are the next door neighbors to
this property. We share a side fence where our back yards abut. They should not be
allowed to keep additional animals on this lot.
We have lived at our address for more than seven years, and during that time the property
requesting the permit has been a rental. In the time that we have lived there, there have
almost always been one or two dogs who resided there. We have also had one or two
dogs during the time we have lived at this location. Prior to the current occupants of the
house moving in in 2012, there was never any issue between dogs or people between our
property and the one next door.
In early 2012 the house was rented to a very old man and a woman who appeared to be
his caregiver. They may have kept pets, but it was not noticeable to us next door. At
some point the man passed away, and at least one other person moved in, which is when
we began to notice that they had a lot of dogs on their property. This was a little over a
year ago in spring 2012.
They have all of the dogs listed on the additional animals permit, plus they regularly keep
a beagle or beagle-mix dog on the property, which can be there up to half the time, and
has been in their care for at least a short time since the date of the application for the
permit. Our issue with these dogs is that whenever we use our backyard they will bark at
us. It doesn't matter if we are gardening, having a barbeque, our kids are playing, or our
dog is napping in his favorite sunny spot. .. at least one of their dogs will be barking.
Typically it is the German Shepard or one of the Chihuahua dogs, and definitely the
Beagle when it is there. The occupants of the house will usually call their dogs inside
after they spend several minutes at our fence barking.
Like the property in question, we have a large, fenced back yard. It is one of the nicest
features of our property and one of the reasons why we chose to buy this house. Our big,
fenced backyard is supposed to be a safe place for our three children to play, a nice space
for our dog to run, a place to grow a small garden, and a space to entertain guests during
nice weather. Until 2012, we regularly enjoyed those features of our property. In the last
year, our kids no longer want to play in the backyard because of the dogs barking on the
other side of the fence. We are reluctant to invite friends over, eat outside in nice
weather, or spend time gardening because of the dogs barking on the other side of the

fence. Our neighbors' pets should not be determining how we are able to enjoy our
property.
For whatever reason, the occupants of the house avoid contact with us. We have tried
knocking on their door to talk to them when it is clear they are home, but they do not
answer the door. With past residents of the house, we made a point of introducing
ourselves to each other and our dogs, which ended any barking between the properties
that occurred when new people and dogs moved in there. Our eight year old son did
manage to talk to one of the occupants last summer, when he was out riding his bike. He
asked if we could meet their dogs, to see if they would stop barking at us. The woman
replied, "No, we have too many dogs for you to meet."
We hoped that this would be a problem that would be solved with time, and we have tried
to be patient, but we ultimately talked with Donna Locher in Code Compliance to ask
about what we could do. While the dogs next door do seem well cared for, and there
probably is adequate space for them, it doesn't make sense that they would be allowed an
Additional Animals Permit when they carmot curb their animals barking. Our property is
impacted, as is our enjoyment of our home. Our property is uniquely impacted because
of the two abutting properties to their backyard, ours is the only one with useable outdoor
yard space. We have lived here for several years, with different neighbors and different
dogs at the same property, and never had a problem before.
Please consider the on-going consequences of approving this Additional Animals Permit
on our family and deny it. Please include us as an interested parties, so we may be
notified when decisions are made on this application.
