Project Description: Renton Public Works staff is working with the Victoria Hills HOA, the storm
water facility owners, to transfer responsibility for long-term maintenance of the facility per the
City's policy to assume maintenance for storm water flow control facilities in single family
residential plats.
The proposed work is for long term routine maintenance required to restore and preserve the flow
control and water quality function of the existing storm water detention facility, and to reduce risk
of storm water overflows into the Victoria Hills Community.
Three significant utilities structures are located adjacent to and down slope of the Victoria Hills
storm water facility's north berm. They include the Seattle Public Utilities 60 inch diameter water
main, the Olympic Pipeline Co. 16 inch oil and gas pipeline, and the City of Seattle power
transmission line. Several existing trees that overhang the detention pond and access road would
be removed. An existing Class 4 stream, Rolling Hills Creek, is located within the tract that includes
the storm water detention oond.

EXEMPTION JUSTIFICATION: RMC4-3-050.5.e. Roads, Parks, Public and Private Utilities: v. Vegetation
Management/Essential Tree Removal for Public or Private Utilities, Roads, and Public Parks : Maintenance
activities, including routine vegetation management and essential tree removal, and removal of non -native
invasive vegetation or weeds listed by the King County Noxious Weed Board or other government agency, for
public and private utilities, road rights-of-way and easements, and parks.
RMC4-3-050.5.g. Maintenance and Construction Existing Uses and Facilities: ii.
Maintenance and Repair -Any Existing Public or Private Use: Normal and routine maintenance and repair of
any existing public or private uses and facilities where no alteration of the critical area and required buffer or
additional fill materials will be placed. The use of heavy construction equipment shall be limited to utilities
and public agencies that require this type of equipment for normal and routine maintenance and repair of
existing utility or public structures and rights-of-way. In every case, critical area and required buffer impacts
shall be minimized and disturbed areas shall be restored during and immediately after the use of construction
equipment.
FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-0SOC.5:
1. The activity is not prohibited by this or any other chapter of the RMC or state or federal law or regulation.
2. The activity will be conducted using best management practices as specified by industry standards or
appiicable Federal agencies or scientific principles .if submitted plans are followed and the conditions of
approval of this exemption are met.
3. Impacts will be minimized and disturbed areas will be immediately restored, if submitted plans are followed
and the conditions of approval of this exemption are met.
4. Where wetland or buffer disturbance occurs during construction or other activities in accordance with this
exemption, the site will be revegetated with native vegetation as required as a condition of approval for this
exemption.
DECISION: An exemption from the Critical Areas Regulations is hereby Approved with
Conditions*.
CONDITIONS: Trees shall be retained as large woody debris in the stream /buffer corridor,
where feasible.

The above land use decision will become final if the decision is not appealed within the 14-day appeal
period (RCW 43.21.C.075(3); WAC 197-11-680).
APPEALS: An appeal of this administrative land use decision must be filed in writing together with the
required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98057, on or before 5:00 p.m., on May 27, 2014. RMC 4-8-110 governs appeals to the Hearing Examiner and
additional information regarding the appeal process may be obtained from the Renton City Clerk's Office,
(425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not readily
discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After
review of the reconsideration request, if the approval body finds sufficient evidence to amend the original
decision, there will be no further extension of the appeal period. Any person wishing to take further action
must file a formal appeal within the 14-day appeal time frame.
EXPIRATION: Five (5) years from the date of decision (date signed).

Narrative of Required Maintenance Work Description
Facility Location:
Victoria Hills Plat, within Tract 'C' (see Exhibit A, Vicinity Map)
Facility Background:
The Victoria Hills stormwater detention pond facility (FaclD #145407) was constructed in 1988 as
part of the Victoria Hills PUD. Phase I of the PUD built the Victoria Hills residentiai single family
homes, and Phase II built a condominium complex (now the Montclair Heights Apartments).
The stormwater facility was modified during Phase II construction to meet permit requirements
to include stormwater runoff from Phase II. This included connecting the two Phase II drainage
outfalls to the detention pond, increasing the pond storage capacity, and modifying the flow
control FROP-Torifices. See attached Exhibit B, Phase I and Phase II Plan Sheets for Victoria
Hills Starin Drain Detention Pond.
The City does not own the detention pond facility. Renton Public Works staff is working with
the Victoria Hills HOA, the stormwater facility owners, to transfer responsibility for long-term
maintenance of the facility per the City's policy to assume maintenance for stormwater flow
control facilities in single family residential plats. As an interim documented permission see
attachment, Permission to Access and Maintain Stormwater Facility {#145407} within Victoria
Hills Plat.
Rolling Hills Creek, a class 4 stream, outfalls into south end of the detention pond facility and
continues in a channel downstream the detention pond outlet.
Three significant utilities structures are located adjacent to and down slope of the Victoria Hills
stormwater facility's north berm. They are: Seattle Public Utilities 60" diameter water main,
Olympic Pipeline Co. 16" oil and gas pipeline, City of Seattle power transmission line.
Facility Maintenance Requirements:
The proposed work is for long-term routine maintenance required to restore and preserve the
' flow control and water quality function of the existing stormwater detention facility, and to
reduce risk of stormwater overflows into the Victoria Hills Community. This stormw_ater facility
was designed and constructed in accordance with the_PUD permit requirements. Proper
maintenance and operation of this stormwater detention facility is needed to prevent flooding
and property damage (including the utilities described above, as well as down slope residential
properties), protect public safety, protect environmental resources, and to bring the facility to

maintenance standards per the City adopted 2009 King County Surface Water Design Manual,
Appendix A.
Facility Maintenance Activities:
Primary maintenance tasks include removing accumulated sediment from within the detention
pond, maintenance and repair of the pond inlet pipe and outlet pipes, control structure and
perimeter fence, and facility vegetation maintenance. See attached Exhibit C, Facility
Maintenance Site Plan. Note: see section below, Minimizing Adverse Impacts ta the Aquatic
Environment.
Long-term routine stormwater facility maintenance activities will include:
Restore and maintain road surface of existing access road (top of north berm)
-includes removal of 6 trees (>6" dia.)
-may include small quantity of fill
Restore and maintain bank slope of north berm
-includes removal of 7 trees (>6" dia.)
Remove accumulated sediment from north end of detention pond bottom (see Exhibit-A).
-up to 300 cubic yards accumulated sediment (within 3,900 ft.2 area)
-includes removal of brush & small trees growing within the sediment(< 6" dia.)
-an excavator will remove accumulated sediment. The removed sediment material will be
trucked off site. When sediment excavation is complete all wheel tracks and ruts will be
healed, grass seed will be spread and straw placed over the grass seed.
Maintain & repair pond inlet/outlet pipes, catch basins & control structure
Vegetation maintenance
-control invasive plants and maintain grass ground cover
Replace & maintain perimeter fence
-remove existing 6' high wooden fence and replace with 6' vinyl coated chain link fence
-may include tree removal, however all effort will be given to minimize impacts to trees by
locating the replaced fencing to avoid tree removal
Maintenance Activity Timeline:
The maintenance activities timeline would be subject to a required WDFW Hydraulic Project
Approval provisions.
Immediate Maintenance:
This work will focus on restoring the facility functionality. It is anticipated to occur during
Spring through Fall 2014, beginning as soon as conditions are dry enough.· It will focus on
restoring the maintenance road surface, restoring the bank slope of north berm, and
removing accumulated sediment. These maintenance activities are estimated to take 4
weeks total.

The fence replacement will be scheduled per the Public Works Stormwater Facility Fencing
Project budget and prioritization.
Long-term Routine Maintenance:
The most frequent occurring routine work will be vegetation maintenance activities that will
be completed within 1 day, and will be performed at a minimum 3-4 times per year. All other
maintenance activities listed in the above section will be performed as nee.ded (anticipated to
occur on an infrequent basis). It is unknown how quickly sediment will again accumulate to a
level requiring removal.. A best estimate is that removal of accumulated sediment will need
to be done every 3-5 years.
Minimizing Adverse Impacts to the Aquatic Environm_ent:
Rolling Hills Creek, a class 4 stream, outfalls into the south end of the detention pond facility
and continues in a channel downstream the detention pond outlet. Wheri the maintenance
work is performed, stream flow from this creek will be diverted around the work area within
the detention pond, through a temporary pipe to the existing rock channel below the detention
pond outlet pipe outfall.
The Regional Road Maintenance Endangered Species Act Program Guidelines will be used to
select and implement appropriate Best Management Practices to minimize the disruption to
the natural environment. Work will also comply with other regulations protecting water ·
quality, endangered species, shorelines, and sensitive areas:

Permission to Access and Maintain
Stormwater Facility (#145407) within Victoria Hills Plat
The Homeowners Association (HOA) for Victoria Hills Plat grants the City of Rent~n
access permission to Stormwater Facility #145407 within the Victoria Hills Plat to perform
· maintenance on the stormwater facility.
The City shall have the right without prior institution of any suit of proceeding at law, at
such times as may be necessary, to enter upon said property for the purpose of
performing maintenance work, as determined by the City to be needed, on Stormwater
Facility #145407 within the Victoria Hills Plat without incurring any legal obligation or
damage to the property. In the event thai there is disturbance or damage, the property
will be restored to the same condition as il was before lhe property was entered upon
by the City. This access permission shall extend until the stormwater facility transfer to
the City has been completed.
This permission is granted with the understanding that the HOA for Victoria Hills Plat
intends to formally transfer future maintenance responsible to the City per the
conditions of the City's policy to assume maintenance responsibility for stormwater flow
control and water quality facilities with ·single family plats with public streets.

PURPOSE: To allow certain activities to intrude into a critical area or required buffer subject to the City
providing a Jetter of exemption of any listed conditions or requirements.
FREE CONSULTATION MEETING: Prior to submitting an application, the applicant should informally
discuss the proposed development with the Planning Division. The Planning Division will provide
assistance and detailed information on the City's requirements and standards. Applicants may also take
this opportunity to request the waiver of the City's typical application submittal requirements, which
may not be applicable to the specific proposal. For further information on this meeting, see the
instruction sheet entitled "Submittal Requirements: Pre-Application."
COMPLETE APPLICATION REQUIRED: In order to accept your application, each of the numbered items
must be submitted at the same time. If you have received a prior written waiver of a submittal item(s)
during a pre-application meeting, please provide the waiver form in lieu of any submittal item not
provided. All plans and attachments must be folded to a size not exceeding 8Yi by 11 inches.
APPLICATION SCREENING: Applicants are encouraged to bring in one copy of the
application package, for informal review by staff, prior to making the requested number
of copies, colored drawings, or photo reductions. Please allow approximately 45
minutes for application screening.
APPLICATION SUBMITIAL HOURS: Applications should be submitted to Planning Division staff at the
6th floor counter of Renton City Hall, 1055 South Grady Way, between 8:00 a.m. and 4:00 p.m. Monday
through Friday. Please call your assigned project manager to schedule an appointment or call (425) 430-
7200 to reach the Planning Division. Due to the screening time required. applications delivered by

Victoria Hills Stormwater Detention Pond Facility
Required Maintenance Work Description
Facility Location:
Victoria Hills Plat, within Tract 'C' (see Exhibit A, Vicinity Map)
Facility Background:
The Victoria Hills stormwater detention pond facility was constructed in 1988 as part of the
· Victoria Hills PUD. Phase I of the PUD built the Victoria Hills residential single family homes,
and Phase II built a condominium complex (now the Montclair Heights Apartments). The
stormwater facility was modified during Phase II construction to meet permit requirements to
include stormwater runoff from Phase II. This included connecting the two Phase II drainage
outfalls to the detention pond, increasing the pond storage capacity, and modifying the flow
control FROP-T orifices. See attached Exhibit 8, Phase I and Phase II Plan Sheets for Victoria
Hills Storm Drain Detention Pond.
The City does not own the detention pond facility. Renton Public Works staff is working with
the Victoria Hills HOA, the stormwater facility owners, to transfer responsibility for long-term
maintenance of the facility per the City's policy to assume maintenance for stormwater flow
control facilities in single family residential plats.
Rolling Hills Creek, a class 4 stream, outfalls into south end of the detention pond facility and
continues in a channel downstream the detention pond outlet.
Three significant utilities structures are located adjacent to and down slope of the Victoria Hills
stormwater facility's north berm. They are: Seattle Public Utilities 60" diameter water main,
Olympic Pipeline Co. 16" oil and gas pipeline, City of Seattle power transmission line.
Facility Maintenance Requirements:
The proposed work is for long-term routine maintenance required to restore and preserve the
flow control and water quality function of the existing storm water detention facility, and to
reduce risk of stormwater overflows into the Victoria Hills Community. This stormwater facility
was designed and constructed in accordance with the PUD permit requirements. Proper
maintenance and operation of this storm water detention facility is needed to prevent flooding
and property damage (including the utilities described above, as well as down slop_e residential
properties), protect public safety, protect environmental resources, and to bring the facility to
maintenance standards per the City adopted 2009 King County Surface Water Design Manual,
Appendix A.

Facility Maintenance:
Primary maintenance tasks include removing accumulated sediment from within the detention
pond, maintenance and repair ofthe pond inlet pipe and outlet pipes, control structure and
perimeter fence, and facility vegetation maintenance. See attached Exhibit C, Facility
Maintenance Site Plan.
Long-term routine stormwater facility maintenance activities would include:
Restore and maintain road surface of existing access road (top of north berm)
-includes removal of 6 trees (>6" dia.)
-may include small quantity of fill
Restore and maintain bank slope of north berm
-includes removal of 7 trees (>6" dia.)
Remove accumulated sediment from north end of detention pond bottom
-up to 300 cubic yards accumulated sediment (within 3,900 ft. 2 area)
-includes removal of brush & small trees(< 6" dia.)
Maintain & repair pond inlet/outlet pipes, catch basins & control structure
Vegetation maintenance
-control invasive plants and maintain grass ground cover
Replacement & repair perimeter fence
-may include tree removal, however all effort will be given to minimize impacts to trees by
locating the replaced fencing to avoid tree removal
Minimizing Adverse Impacts to the Aquatic Environment:
Rolling Hills Creek, .a class 4 stream, outfalls into the south end of the detention pond facility
and continues in a channel downstream the detention pond outlet. When the maintenance
work is performed, stream flow from this creek will be diverted around the work area within
the detention pond, through a temporary pipe to the existing rock channel below the detention
pond outlet pipe outfall.
The Regional Road Maintenance Endangered Species Act Program Guidelines will be used to
select and implement appropriate Best Management Practices to minimize the disruption to
the natural environment. Work will also comply with other regulations protecting water
quality, endangered species, shorelines, and sensitive areas.
Specific Regional Road Maintenance Guidelines that will be referred to include Maintenance
Category# 4 Open Drainage Systems. Outcome Categories:
• Keep water from work area. BMP 2.49-2.107.-2.97
• Reduce potential for soil erosion, BMP 2.73-2.97-2.120
• Habitat protection/maintenance. BMP. 2.73
