ERe Report -Maertins.dacx City of Renton Department of Communi MAERTINS ANNEXATION PREZONE Report of September 16, 2013 Economic Development PART ONE: PROJECT DESCRIPTION / BACKGROUND ,nmental Review Committee Report WA13-001l30, ECF Page 2 of 3 The applicants for the proposed Maertins Annexation have requested that the City prezone the subject site in advance of annexation, pursuant to RCW 3sA.14.330, so zoning will be in place at the time the subject site comes into the City. The site is located at the northeastern portion of the City. It is bordered to the south parcel lines located near Southeast Renton Issaquah Road, by Northeast 16th Street to the north, and parcel lines to the east and west. Annexation is considered exempt from SEPA. However, the prezoning ofthe subject area does require SEPA review. The City is proposing to prezone the area with Residential Four Dwelling Units per Net Acre (R-4). The zoning corresponds with the designation in Renton's Comprehensive Plan, Residential Low Density (RLD) designation. The proposed prezone is considered a non-project action under SEPA. Currently, one single family house exists in this area. At full build out it is estimated there will be 13 additional homes. Since this prezone is a non-project proposal, development of additional housing units will be subject to additional project specific review at the time of development. The existing King County Comprehensive Plan designation of the area is Urban Residential Medium 4-12 dwelling units per gross acre, with R-4 zoning. There are three zones that implement Renton's Residential Low Density designation: Resource Conservation (1 dwelling unit per net 10 acres), R-l (1 dwelling unit per net acre), and R-4 (4 dwelling units per net acre). The Renton proposed R-4 zoning most closely approximates the County's zoning when comparing King County and Renton zoning and is consistent with the Comprehensive Plan designation. The City's Comprehensive Plan policies (LU 151 and LU-ls3) call for land within the RLD designation to be zoned R-4 where there are not significant environmental constraints. Land that has significant environmental constraints is identified as land where: • a significant percentage of the gross area is critical areas, • developable areas are separated by pervasive critical areas, • sensitive areas are located where if developed development would be non-contiguous, or • variances or modifications would be required to develop at the allowed density on the land remaining after application of the required buffers. None of these conditions apply to the area being considered in this zoning recommendation, therefore the area is most appropriately zoned R-4. I PART TWO: ENVIRONMENTAL REVIEW In compliance with RCW 43.21C.240, the following environmental (SEPA) review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. A. Environmental Threshold Recommendation Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials: Issue a DNS with a 14-day Appeal Period. Environmental Impacts fnvin ntal Review Committee Report LUA13-001230, ECF Page 3 of 3 There are no environmental impacts that are anticipated to occur in conjunction with the proposal. E, Comments of Reviewing Departments The proposal will be circulated to City Department Division Reviewers and appropriate agencies. All substantive comments will be provided to the Responsible Officials for their consideration and possible recommendation that the comments be incorporated as "Advisory Notes to Applicant." Environmental Determination Appeal Process: Appeals of the environmental determination must be filed in writing on or before 5:00 PM, October 4, 2013. An Environmental Impact Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required. INSTRUCTIONS FOR APPLICANTS: This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should be able to answer the questions from your own observations or project plans without the need to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write "do not know" or "does not apply". Complete answers to the questions now may avoid unnecessary delays later. Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations. Answer these questions if you can. If you have problems, the governmental agencies can assist you. The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of time or on different parcels of land. Attach any additional information that will help describe your proposal or its environmental effects. The agency to which you submit this checklist may ask you to explain your answers or provide additional information reasonably related to determining if there may be significant adverse impact. USE OF CHECKLIST FOR NONPROJECT PROPOSALS: Complete this checklist for non-project proposals, even though questions may be answered "does not apply." IN ADDITION, complete the SUPPLEMENTAL SHEET FOR NON PROJECT ACTIONS (part D). For non'project actions (actions involving decisions on policies, plans and programs), the references in the checklist to the words "project." "applicant," and "property or site" should be read as "proposal," "proposer," and "affected geographic area," respectively. You do not need to fill out these sheets for project actions.) Because these questions are very general, it may be helpful to read them in conjunction with the list of the elements of the environment. When answering these questions, be aware of the extent the proposal, or the types of activities likely to result from the proposal, would affect the item at a greater intensity or at a faster rate than if the proposal were not implemented. Respond briefly and in general terms. 1. How would the proposal be likely to increase discharge to water; emissions to air; production, storage, or release of toxic or hazardous substances; or production of noise? It is unlikely that the proposal would have any affect on the above environmental issues. Additional residential development is likely to occur on this site with or without the proposal. Under the proposed Renton zoning full development of the site would result comparable residential units as is possible under the current King County zoning. Proposed measures to avoid or reduce such increases are: If new development occurs, it will be required to comply with the City's development regulations, such as the Citiy's Surface Water Design Manual (2009 King County Surface Water Design Manual and City amendments RMC 4-6-030. 2. How would the proposal be likely to affect plants, animals, fish, or marine life? There would be no affect on plants, animals, fish, or marine life as a direct consequence of this non-project zoning proposal. There may be some displacement of existing vegetation to clear undeveloped lots for future development, which is likely to occur under the both the present conditions and the proposal. Proposed measures to protect or conserve plants, animals, fish, or marine life are: None at this non-project level. Development of additional dwelling units must comply with City of Renton regulations and with Renton's Critical Areas Ordinance. Any measures needed in this regard will be implemented at the project level review. 3. How would the proposal be likely to deplete energy or natural resources? The proposed non-project action will not deplete energy or natural resources. Future project level development may impact energy or natural resources slightly but will not deplete them. Proposed measures to protect or conserve energy and natural resources are: None are proposed at this non-project action stage. 4. How would the proposal be likely to use or affect environmentally sensitive areas or areas designated (or eligible or under study) for governmental protection; such as parks, wilderness, wild and scenic rivers, threatened or endangered species habitat, historic or cultural sites, wetlands, flood plains, or prime farmlands? This proposal to designate the area with City of Renton zoning does not use or effect environmentally sensitive areas. If development occurs in the future, it will be required to comply with City of Renton critical areas regulations and development stondards that are designed to protect environmentally sensitive areas. Proposed measures to protect such resources or to avoid or reduce impacts are: City regulations and requirements will work to avoid and/or reduce impacts. 5. How would the proposal be likely to affect land and shoreline use, including whether it would allow or encourage land or shoreline uses incompatible with existing plans? 12 The proposed zoning of this area will increase compatibility with the surrounding uses since it would require future development to comply with City of Renton development regulations. Proposed measures to avoid or reduce shoreline and land use impacts are: None. 6. How would the proposal be likely to increase demands on transportation or public services and utilities? Development in this area is likely to occur with or without this pre-zoning. Additional demands of transportation that may be creoted by new development will be evaluated at the time of a project proposal. Proposed measures to reduce or respond to such demand(s) are: None. 7. Identify, if possible, whether the proposal may conflict with local, state, or federal laws or requirements for the protection of the environment. The proposal will not conflict with local, state, or federal laws or requirements for pratection of the environment. SIGNATURE I, the undersigned, state that to the best of my knowledge the above information is true and complete.
